Walsh wll be pleased to learn that he wll shortly return to the slands and engage n the practce of law. Not long ago ths paper chroncled the fact that Mr. Walsh had been elected presdent of the senor law class, 895, of the Unversty of Mchgan, at Ann Arbor, where he went some tme ago to complete a law course. Mr. Walsh graduated wth the hghest honors,.f&t" TV ' D &. M. WALSH, ESQ. Recently graduated from Unversty of JJfch'pan wth hgh honors, and who wll ehortly return to the slands and eneagd n the practce of law. and was selected as presdent of the senor class solely on deserved mert, whch speaks hghly for hs legal ablty. Hs address to that class, delvered on June 24th, was a masterty effort and called forth unversal prase from hs classmates, many of whom wll no doubt watch wth nterest the future of ther respected presdent. A bref sketch of Mr. Walsh's lfe and work n the slands shows what can be accomplshed by perseverance, whch trat has been a potent factor n rasng hm to the hgh standard attaned The subect of the above sketch came to the slands, together wth a valued frend and partner, n S78. Shortly after arrvng he secured employment as a luua at Naalehu plantaton, Hawa. Answerng the call of frendshp and duty, he returned to Honolulu and admnstered to the wants of hs frend durng an llness whch proved fatal. Securng the poston of deputysberf T at Makawao, Maul, he ds charged the dutes of that poston, durng two years ncumbency, n such a manner as to mert the goodwll of all wth whom he came n contact. Among those who carefully watched the career of the young man was Hon. H. P Baldwn, who was quck to realze the sterlng qualtes of the man. Paa plantaton was placed un der hs management, whch he conducted so successfully that later he was ntrusted wth the Baldwn nterest n that and Hamakuapoko plan taton. Although the dutes of plantaton lfe were extremely arduous, yet Mr. wasn rouna tme to study law, and n 882 was admtted to practce n the lower courts. Trng of plantaton lfe, Mr. Walsh traveled exten svely n Amerca and Europe, afterward returnng to the slands, opened up and acqured some nterest n Makawel plantaton and became ts frst manager. Later he dsposed of hs nterest n Makawel and went to Amerca, afterwards concludng to complete hs legal educaton by a course at Ann Arbor, Mch., where, as mentoned above, he craduated wth the hghest honors. Mr. Valsh wll be a valued addton to the legal fraternty of the slands. Concert at Emma Square. The Hawaan band, under the leadershp of Actng Bandmaster H. On the back of the note there are the followng ndorsements: "Pay to order of Dr. St. D. G. Walters, H. P. Hngns. Pay to order of J.. Coney, St. D. Ganlas Walters." The case was tred before the Dstrct Magstrate of the dstrct of Hanale, Kana, who gave udgment for the defendant. The plantff then appealed to the Crcut Court, Ffth Crcut, ury waved. The case was put on the calendar for the Sep tember Term. 694, and was, at the request of defendant, contnued,to the next term. When the cape was called at the March Term, 895, of sad Court t was stated that none of the papers of the case, except the note could be found. Tbe Court was proceedng to hear the plantff's evdence when counsel for defendant obected, on the ground that the Court bad no ursdcton to hear the case, because there were no plead ngs nor papers before the Court, and no proof of los3 of same, nor any proof of the contents of same. These obectons were severally overruled, but the plantff's counsel suppled proof of the loss of the orgnal papers, and, by affdavt, proof of tber contents substantally, also that the appeal had been perfected. These facta all appear n defendant's bll of exceptons. Tbe defects complaned of by defendant's counsel havng been cured as above set forth, we do not consder t necessary to decde whether the Court to pro would have had ursdcton ceed wth the case wthout these proofs beng made. After plantff proofs were n, the defendant moved for nonsut, makng the followng ponts as appear n tho bll of exceptons; that the Lote upon whch the acton s based has been transferred to tho plantff wthout consderaton, and that tbe plantff s not a bona fde holder thereof for van able consderaton. The nonsut beng refused tbe defendant put on evdence and the Court gave udgment n favor of the plantff. The facts sent up are substantally these: At the date of the note, October, 892, was Government Physcan at Hanale, Kaua, and on cond on one Dr.. P. Hugus that he would procure for Dr. Mtamura (defendant), the appontment of Government Physcan at Hanale, defendant gave Dr. Hugus hs promssory note for 200 payable n sx months. Defendant testfed that the condton had not been performed for he had not receved tbe appontment. Ths s not dened. f the acton had been brought by Dr. Hugus t would seem as f ths defense 6hould have prevaled. Tbe note, however, had been transferred to Dr. St. D. G. Walters by ndors The consderaton of the transfer was proved to bo one hun dred dollar3.f the transfer of ths note had been made before maturty the equtes would not be open to the defendant unless they had been brought to bs notce. But f the transfer was made after maturty they would be. Unfortunately there s no evdence npon ths pont, and the presumpton s that t was transferred before maturty, and so the defense of falure of consderaton s not avalable to defendant. 2 Kandolph, Commercal paper, Sec. CSG and numerous cases there cted. The endorsement by Dr. Walters to the plantff Coney, s the ordnary specal ndorsement 4Pav to the order of J. H. Coney." But Coney admtted that ths transfer was made wthout consderaton passng and for collecton merely. Tlo programs were neatly and artstcally prnted at the school. The outsde wa9 graced wth a photograph prnt of the school buldngs, for whch prnt Mr. Terry gave credt to the edtor of the War Cry (San Francsco), and on the other sde the words, "Hawaan Day at Hlo Boardng School, June 23, S93."
