Booth, John K. nch. Judge Gear at 1:30 yesterday after noon charged the grand ury regardng the request made by C. W. Ashford( for an nvestgaton of the Oahu county electon. At the outset he stated that the laws of the Terrtory provded for the conduct of electons and ncluded rules and regulatons havng the force of law. He was not passng upon the subect as a matter of law, but would nform the grand ury that the Organc Act contnued n force the laws of the Republc of Hawa provdng for the purty of electons. They were aware that an electon was held on the thrd of ths month for county offcers. Certan nformaton had been presented to the court, whch would not be read then but would be handed to ther foreman. Nether would the court gve them any nstructons about the regstraton of voters. SNK PARTY FEELT.NG. They were to nvestgate cases relatng to the county electon regardless of all party feelng. A great many wtnesses had been subpoenaed for ther examnaton. The court hoped the grand ury would take up the matter n the sprt n whch t should be taken up, rememberng ther oaths. Ther nvestgaton must not be for the purpose of adng any party or canddate. They must lose sght entrely of all poltcal afflatons they ndvdually mght have. The statutes were those of the Terrtory of Hawa and were for the beneft and protecton of all alke. ACT WTHOUT FACVOR. t was ther duty, f they found that any offenses aganst those laws ha3 been commtted, to brng an ndctment aganst every offender no matter who he mght be. There (were two partes contestng the electon the Republcan and the Home Rule partes. Let no gulty man escape. Lose sght wholly of the poltcal stuaton. The grand ury had the dsposal of the servces of offcers of the court. They mght subpoena any wtnesses they pleased, who they thought would be able to gve lght on the nvestga ton. t mght be ther duty to subpoena wtnesses about whom they knew nothng f they supposed such could furnsh useful evdence1. wanted the.uorney Generals presence. The Attorney General had f a number of wtnesses and t was proper that he should have the opportunty of examnng them. The statement made about the Attorney General and hs department, wth the petton for nvestgaton, had been wthdrawn and, so far as the court understood, tne Attorney General was not connected wth the charges. t mght be proper, n some cases, not to have the Attorney General there. He supposed the Attorney Genral dd not obect to the grand urys examnng nto the matter wthout the Attorney Generals presence. SHOULD RECOGNZE HONESTY. Deputy Attorney General Peters stated that the request Jbf the foreman for nstructons on ths pont was a proper one and came wthn the courts provnce for consderaton. So far as the law was concerned, t was perfectly proper for the grand ury to request hs presence or desre hs absence, but the speaker thought that the request, as well as the nstructons of the court n answerng t, should at least take nto consderaton the honesty of the Attorney Generals department and ts desre to nvestgate the matter fearlessly and honestly. Judge Gear remarked that the grand ury mght act on ts own hook, to whch Mr. Peters responded that such was the law. A JURORS MSGVNGS. A grand uror here asked the court to have the number of the panel ncreased to twentytw o or twentythre e members. There were Home Rulers, Republcans and Democrats on the present small panel, ths uror sad, and three men mght stand out and prevent an ndctment. Judge Gear answered that f any one man or any three men on that grand ury were capable of dsregardng ther oath, let them say so and they would be excused from further servce on the grand ury. He called on them, f any of them would consder hs own party n the nvestgaton, to say so. None of the grand urors responded. COULD NOT CONVCT. Contnung, the court sad that the grand ury could not convct anybody. A man had to be tred, to be convcted or acqutted, by a ury after he was brought nto court under an ndctment. The grand ry were not to pass on the gult or nnocence of a party, but to decde whether there was probable cause to beleve that he commtted the offense on the ex parte evdence before them. f twelve or fourteen men could not agree, t was better to let the man go. CROWD N ATTENDANCE. Wth three ury courts n sesson and about a hundred wtnesses subpoenaed for the grand ury, there was a great crowd ammed about the entrance as well as nsde Judge Gears court room when the charge was beng delvered. Many natves wthout compulson to attendance at court swelled the throng. FREEDOM TO WTNESSES. Shortly after the grand ury retred to the Supreme Court room, Deputy Attorney General Peters came out and released a number of wtnesses untl called by messenger or telephone. Ths regard for the tme of busy men was much apprecated. Several wtnesses were called n durng the afternoon. THE UNTERRFED. Republcans among the wtnesses were not the most serous lookng of the multtude. Boyd gave a very entertanng half hour talk on the subect, to the largest audence whch has attended the clubs meetngs for months. Wth that expendture of money the commttee expected to reach three and a half mllon readers. Comparng the work n Hawa to other advertsng propagandas, Mr. Boyd stated that when the Rook sland sent ts new specal tran to the Pacfc Coast, t spent $110,000 n advertsng before the tran left the Chcago depot. "And yet crtcs here call us extravagant," sad he, "when we expend $15,000 n advertsng beautful Hawa." Mr. Boyd sad he wanted to speak of the personal sde of the tourst propaganda. He sad that no man could be a success n what he taught unless he beleved n t hmself. One thng the Hawa Promoton Commttee struggled for was the sympathy and support of every ctzen of Hawa n the work. Kahaleaahu vs. Manuel S. Perera and S. ANOTHER TREASURE SEARCH FALURE The members of yet another frutless expedton whch has been engaged n the endeavor to fnd the enormous treasures supposed to be hdden on Cocos sland, n the Pacfc, have ust returned to England, says the London Mal. Ther return has been as secret as was ther departure, and although they are all well known members of an mportant West End Club, few people (not even ther ntmate frends) have any noton that they have been engaged n a rsky and exctng exped ton. Dunn Clams That Berrey s Tryng to Collect by Use of Crmnal Process. Thomas Dunn, chef yeoman at the Unted States naval staton, was yesterday commtted to the crcut court for malcous nury by Judge Lndsay. Q. H. Berrey was the complanant and the whole trouble was over a horse owned by Berrey whch he clamed Dunn borrowed wthout leave, and whch ran away. The defendant was afterwards released on hs own recognzance. Berrey clamed that whle he and hs wfe were vstng the volcano, Dunn borrowed Mrs. Berreys horse, and that whle beng drven by Dunn, the anmal ran away, nurng tself and damagng the phaeton. Berrey testfed that Dunn had admtted to hm takng the horse wthout permsson, sayng that he smply wanted t to go to town and hadnt tme to wat for a car. On cross examnaton the defendant attempted to show that Berrey was smply usng the crmnal courts to collect a cvl debt for damages. Berrey admtted under cross examnaton that he was wllng to drop the prosecuton f Dunn had pad hm for the damages. He had agreed to do ths because Dunn sad hs wfe was nervous and ddnt want any trouble. He admtted also that he had agreed to settle for $180 whch was what the horse had cost hm and that everythng had been satsfactory untl Dunn had refused to pay the amount. The defense was that the horse and buggy were not nured malcously and that the defendant had agreed to pay the damages. Dunn dened that he had taken the horse wthout leave but sad that he Wad been asked to take care of the horse by Berreys sster and was attemptng to exercse the anmal when t ran away. He testfed also that he had pad for the repars to the carrage and that he had also agreed to pay for the care of the horse; also that the anmal was not serously nured, smply sustanng a few scratches. Dunn clamed that the horse was htched up for hm by the Japanese servant who had been left by Berrey n charge of the property. A number of wtnesses also testfed to the good character of Dunn. The machne has been kept on board the houseboat "Buzzard," at Wdewater, Va., on the Potomac. As all condtons seemed favorable on the mornng of October 7, Prof. Charles M. Manley placed hmself n the navgators car, and the aerodrome was launched nto space. The bg machne started at the rate of about forty f eet a second ; but almost as soon as t left the houseboat t hovered uncertanly n the ar and plunged nto the rver.
