JAMES ZUCAL The Service Directr reprted n the fllwing: The Service Directr met with Representatives frm W. E. Quicksall and Kelly Ricklic fr the New Philadelphia Schls. We met at the West Elementary tk a walk with the Representative frm the Department f Develpment and lked at ur prject ut there with CDBG and the NRG (Neighbrhd Revitalizatin Grant.) The Service Directr feels: The flks at the New Philadelphia Schls are a great partner in this Prject Service Directr encurages Cuncils supprt. Service Directr thinks this is a wnderful Cntributin t ur Cmmunity, a huge safety issue fr ur students and this will benefit all f us in New Philadelphia fr a lng time. The Service Directr met with representatives frm the Ohi Department f Transprtatin t keep Cuncil and the public infrmed. We are nt happy with the paving that tk place last year. Part f the ODOT paving prject in the dwntwn area tw blcks each directin that was perfrmed by the Shelly Cmpany, the largest asphalt cntractr in the State f Ohi. They did that late in the year, there was sme cld weather; we dn t feel that we received a satisfactry jb. We are wrking with the Administratin at ODOT t get that reslved. We still will cntinue t wrk diplmatically n that prject. The Husing Review Team: Fire Chief, Service Directr James Zucal /Assistant Service Directr Amy Gilland, Directr f Envirnmental Health Lee Finley, reviewed eight Structures last week; we are frwarding sme t the Law Directr lking fr a tear dwn ptential demlitin f several structures. The prperty at 12th St. and Cllege the demlitin was finalized. The Service Directr encuraged all t take a lk at it. Five Pints update: The cntractr is cming back in. Newtn Asphalt did start t make ht mix last week that prject will be finalized with a fresh cat f paving (that wuld be the area frm Five Pints Suth which will wrap up ur Five Pints Prject. The West High Widening Prject will start this year. ODOT will sell that prject that is where we put that prject ut fr bid May 8th, 2014 the starting date will be July 7th, 2014 There will be a tw mnths clsure f West High Avenue frm Five Pints prceeding west t the Railrad Tracks. The mnth f August and September traffic will be detured, businesses will remain pen and yu will see a high vlume f traffic n Frnt Avenue. The Service Directr spke with the Finance Chair and is asking fr additinal funds this year fr paving. We have had the wrst winter n recrd since Our streets are being maintained the Street Department is ding a gd jb by patching We are using three methds durapatcher, cld mix, and ht mix frm Newtn Asphalt. We have t g in and repair sme key areas n Mill Avenue near the New Twne Mall. The Mayr and the Service Directr have wrked diligently n talking t cnstituents thse that are giving feedback s we can put thse streets back where they belng. The Service Directr annunced tmrrw at 11:00 AM in Cuncil Chambers we will be pening up bids fr materials that includes materials fr water, wastewater, and General Services. T further the questin frm Ms. Cx in regard t the Paving List: We have dne it differently this year we specified ur ht mix and paving by square yard and we have sme depth in the amunt f asphalt. We had a lcal cntractr wh is a New Philadelphia Grad, Mr. Jim Demuth. 3

4 Mr. Jim Demuth was very generus in helping us t prvide thse specificatins. He has nthing t benefit he is nt in the asphalt business any mre. We are lking t get a better price by ding that and a better jb. When we get all that finalized tmrrw the Service Directr will prvide t Cuncil and any ne in the public a list f ur paving areas. MARVIN FETE The Law Directr reprted the fllwing: Drafted tw Lease Agreements Lease agreement (request fr the Mayr) with the Tuscarawas Cunty Cnventin & Visitrs Bureau. Currently, at n charge t the City we have sme wrk-ut equipment stred in the basement f the Bureau s facility. We have had fr sme time, an agreement with them t huse that equipment. Fr that the Mayr has allwed them t have three parking spaces in ur parking lt next t the Municipal Building. Because there was n mney invlved we d nt need legislatin drawn up. The City shall assume any and all liability fr any recrds and/r equipment the City stres. 4 The Law Directr drafted a lease and management agreement with QDA (Which shuld have been part f yu packet that went ut) Wrked with Cuncil Member Dan Lanzer fr his Cmmittee Basically we are ging t subcntract with QDA wh is ging t d sme advertising. We dn t have anything in it but we will receive sme benefits frm it. Cmment frm Jhn Zucal: That wuld be QDA Educatinal Fundatin it s perating under its wn 501c3. The Airprt Cmmissin has met and apprved that and made sme minr changes t it Befre the Lease Agreement has gne ut. The Law Directr als drafted a file request fr Default Judgments with regard t ur West High Widening Prject. If yu recall we had a number f hmes that did nt want t agree t what was being prpsed t them by ODOT fr allwing the Widening Prject. As result Mr. Fete had t file a request t Fixed Cmpensatin with the Curt f Cmmn Pleas. Nne f them filed an answer within the apprpriate timeframe. The Law Directr filed request fr Default Judgments n all f them sme f them Judge O'Farrell s Curt Rm and sme are Judge Thmaks Curt Rm. We are currently waiting fr an answer back frm them. At least three did nt file answers but sent the Law Directr letter saying they were fine with What was prpsed. S part f the Default Judgment included the letter and request fr the mney be release t them because we are required t put the mney that we were required t file with the Curt s it is available in the event we are able t reach an agreement shrt f a jury trial. The Law Directr had a phne cnference with the President f the Ohi & Erie Canalway Calitin in regard t a prpsed easement that they had drafted fr the twpath. I gave frm t that prpsal that was drafted because f the help f Cuncil Member Lautenschleger. And I want t thank him fr putting him in tuch with him. Last Thursday had a meeting with Amy Gilland, Jim Zucal in regard t the West High Widening Prject. Purpse f the meeting was t review the escrw agreement and the final cntract and the Final Reslutin which has t be in by April 21st, Mr. Fete is urging cuncil t pass this evening. Mr. Fete reminded all f Captain Skinner s prpsal last fall t have an additin fifty dllars tacked n as part f the fine fr a Disrderly Cnduct which culd defray the cst f tasers.

5 The Law Directr wrte t the Auditr s Office t see if there was a prblem with us ding that they replied April 8th, 2014 stating there is n Cmparative Sectin in the Ohi Revised Cde if Mr. Fete wanted t draft ne they wuld be happy t review it. (The Law Directr is in the prcess f drafting ne.) The Law Directr n April 17th, 2014 will be prsecuting cases in the New Philadelphia Municipal Curt as part f his duties f the prsecutin s ffice. He will have a fllw up meeting with Dug Jacksn last Thursday the Law Directr and Dug Jacksn met with ur Incme Tax Administratr Jel Day t discuss ways we culd better crdinate effrts g after delinquent taxpayers and whether r nt we culd avail urselves better by the Municipal Curt System by filing Civil Judgment and attaching wages t cllect Incme Taxes that way. Will be fllwing up with Dug Jacksn with City Prsecutr Thursday afternn after prsecuting in the mrning Thursday April 17th, 2014 he has a meeting with RITA Representatives at 2:00 PM at the Law Directrs ffice n questins in regard t the cntract that he has yet t apprve. At this time there is ne item n the agenda. BOARD OF ZONING APPEALS.MR. JAMES ZUCAL Mr. James Zucal annunced prviding there is an agenda; the Bard f Zning Appeals will meet Tuesday, May 13th, 2014 at 5:00 PM in Cuncil Chambers. AIRPORT COMMISSION..MR. JOHN ZUCAL Mr. Jhn Zucal reprted that the Airprt Cmmissin did meet Tuesday, April 8th, 2014 at 6:00 PM in the Airprt meeting rm. There is n frmal reprt frm that meeting. We d have n the Legislative Agenda Ordinance that allws the Mayr t enter int the Lease Agreement with Quaker Digital Academy Educatinal Fundatin which will be a separate 501c3 entity. We have passed that as a Airprt Cmmissin we believe strngly in it and we received supprt fr the Airprt Cnsultants which is the Michael Baker Jr. C. ut f Cleveland, Ohi and that Cmpany has in turn turned t the Reginal Office f the FAA in Detrit t make sure we d pass the witness test fr entering int that agreement. Mr. Jhn Zucal said he had spken in recent days t State Representative Al-Landis and he stressed that this is a Bipartisan Prgram and encuraged the vters t apprve it. Ms. Rams said she des nt believe the City Cuncil shuld encurage vter supprt t any issue we shuld nt tell the vters hw t vte. And she wuld be discuraged and vte against if it reached the flr f Cuncil.
