Hodges that is certain to go down as one of the most significant in recent history, ordering formal recognition of same-sex marriage in all 50 states. In his majority opinion, Justice Anthony Kennedy wrote: Their hope is not to be condemned to live in loneliness, excluded from one of civilization s oldest institutions. They ask for equal dignity in the eyes of the law. The Constitution grants them that right. I can already see the next battlefield in the hazy horizon. In an interview with various members of the media, Archbishop William Lori of Baltimore raised the specter of how this ruling may be used to stifle religious freedom. He said that while the ruling recognizes religious groups right to free speech, it doesn't acknowledge the right to follow our teachings when we are intersecting with the broader society. USCCB President Archbishop Joseph Kurtz called the decision a tragic error. I wholeheartedly concur, not out of malice towards anyone, but out of a profound conviction about the very nature of marriage. Many people are unaware that at one time the Commonwealth of Virginia imposed Penalties on pastors of church who performed mixed-race weddings, raising serious issues under the First Amendment s Free Exercise Clause. Who is to say that governments may not try to encroach again? In his dissent, U.S. Supreme Court Justice Antonin Scalia noted: The fundamental right to marry does not include a right to make a State change its definition of marriage. And a State s decision to maintain the meaning of marriage that has persisted in every culture throughout human history can hardly be called irrational. He added: the Court invalidates the marriage laws of more than half the States and orders the transformation of a social institution that has formed the basis of human society for millennia, for the Kalahari Bushmen and the Han Chinese, the Carthaginians and the Aztecs. Just who do we think we are? There is no question that over the past several years, public opinion on same-sex marriage has shifted with remarkable rapidity. Even those minority justices writing the dissent acknowledge this. And part of their dissent was based not on whether they agreed with same-sex marriage, but that it is the domain of the states to enact laws, and not for the justices to impose their will over and against states. The Church s concern is one of the meaning of marriage as a permanent union between a man and woman for the dual purpose of union of the couple and the procreation and education of children. Marriage as a social institution exists to promote the well being of children, the natural fruit of a marriage. Children may only be conceived naturally by means of the union of a man and a woman. And while it is certainly true that at some point, couples are no longer able to conceive children, this is due to nature s design, and the complementarity exhibited between man and woman remains intact in couples beyond childbearing years. Whenever I witness a marriage, immediately following the ceremony the two witnesses come back to the Cathedral sacristy. All three of us sign the civil wedding license, with my name listed as the officiator, and their names listed as the official witnesses. That Catholic wedding also has civil effects. But it is not that way universally. In most European countries there is a civil ceremony requirement. In France, for example, religious marriages must be preceded by a civil ceremony, under rules dating back to the Napoleonic

5 Page 5 Code of Conversely, in Israel and many Middle eastern countries such as Egypt and Lebanon all marriages are conducted by religious authorities, and only then are registered by civil authorities. So the practice varies greatly. I believe it is highly likely that in the years ahead, states will pass laws forcing religious leaders either to agree to marry all couples, or lose their ability to be recognized as authorized witnesses of vows at religious weddings that automatically carry civil effects. In Scalia s brilliant dissent he concludes by quoting from the Federalist Papers of Alexander Hamilton, the best source of understanding the context from which the Constitution was formed in the first place: The Judiciary is the least dangerous of the federal branches because it has neither Force nor Will, but merely judgment; and must ultimately depend upon the aid of the executive arm and the States, even for the efficacy of its judgments. Once again it appears, the Supreme Court did far more than interpret law it created it. Mark your calendars... Archbishop Bernard Hebda will offer his first public Mass during his tenure as Apostolic Administrator next Sunday, July 12, at our parish 10:00 a.m. Mass. We are honored to welcome him and will host a simple reception following the Mass. When New York Yankee Alex Rodriguez surpassed the 3,000 hit milestone recently, he became only the 29 th player out of the 18,130 who have donned a Major League Baseball in history. It paves the way for Ichiro Suzuki, the next closest active player. The 41 year-old needs 114 hits, which probably will require another season. We ll see. As a Nativity School 8 th grader, I think I had two hits for the entire season! When President Abraham Lincoln signed the first ever income tax bill on July 1, 1862, there were two rates: 3% on incomes of $600-10,000 and 5% on those over $10,000. Imagine those rates today! I am proposing a Throwback Friday for next April 15 Tax Day. Jan Hus, a Bohemian priest who was condemned at the Ecumenical Council of Constance in 1415 A.D. and summarily burned at the stake for heresy, is being commemorated this weekend in an ecumenical prayer service that includes a Papal envoy. Pope John Paul II had expressed regret as part of the run up to the Great Jubilee of These events can indeed promote healing, even centuries later. Like many, I was captivated (pun intended) during the three-week manhunt for the two escaped prisoners from upstate New York. The big fear of course, beyond their escape, was how many people they might injure or kill while on the lam. Thankfully, due to great police work no civilians or officers were harmed. CATHEDRAL CHOIR CAMP The Cathedral Choristers Choir Camp (day camp) is a high-quality, safe, choral arts experience for returning and new choristers, boys and girls ages 9 (entering 4th grade) and up. Campers receive intensive musical instruction from the most Ancient bodies of music (Gregorian Chant) to modern. Daily, the instruction becomes a living body of prayer as the choristers sing Evening Prayer (Vespers) and prepare for future liturgies. Directed by Ms. Jayne Windnagel, the Director of the Cathedral Choir School, the Cathedral sacred music and arts staff will teach music theory, vocal pedagogy, and establish an esprit de corps with a high level of learning, spiritual formation, and musical satisfaction. Activities throughout the week include art and games. 7 Page 7 VOICES FROM THE ARCHIVES The Year of Three Rectors Life in the parish settled down to routine after the opening and dedication of the new Cathedral. Archbishop Ireland's Auxiliary Bishop John Lawler, rector of the third Cathedral, continued as rector of the fourth Cathedral. A key member of the Executive Committee, Bishop Lawler often met with businessmen and community groups to promote the Cathedral building fund. In January 1916, Bishop Lawler was appointed third Bishop of the Diocese of Lead, South Dakota. Father Thomas Gibbons, an associate at the Cathedral, was then appointed rector, but served only a few months before his death in July. Archbishop Ireland appointed Father Lawrence F. Ryan as new rector, and 1916 became, according to Hansen, the year of three rectors. Father Ryan served as rector with Archbishop Ireland for only two years before Ireland s death in But his long association with Ireland gave him a close and personal view of the man and his work. Ryan s Historical Sketch: is an important primary source for what we know about Archbishop Ireland and the work of the Executive Committee. After Ireland s death, Msgr. Ryan worked with Archbishop Austin Dowling: Just as the exterior [of the Cathedral] was the result of John Ireland s vision, the interior was the fruit of Austin Dowling s flawless artistic instinct, which suffused the daunting space of nave, transepts, and dome with warmth and serenity. Hansen adds: But if the Archbishop guaranteed the quality of the work, it was the rector of the Cathedral Monsignor Lawrence F. Ryan who kept it going on a day-to-day basis.... Over the next quarter of a century, he brought the interior to a state of near completion, while also constructing a sacristy and a rectory. Excerpts from An Architectural Biography, by Eric Hansen. REMEMBRANCE, THANKSGIVING, CELEBRATION Centennial Works of Mercy: July--One Pint Can Save Three Lives. Friday, July 10: look for the Red Cross van parked on Selby Avenue. While the Red Cross takes care of the medical aspects of blood donation, members of the Divine Mercy Cenacle will be there to provide refreshment and comfort to blood donors. Their participation in this work of mercy is a fitting extension of their weekly meetings of study, discussion and prayer, a perfect union of the spiritual work of prayer and the corporal work of hospitality. You can work for mercy too: if you are at least 17 years old, weigh 110 lbs and in good health, you can donate blood on July 10. REMEMBRANCE, THANKSGIVING, CELEBRATION Centennial Note: The wedding dresses exhibited during the opening of the 100 Years of Marriage Exhibit have been returned to the families and brides who lent them. With the return of the dresses, the Cathedral has received a very special gift. One of the dresses has been offered to parishioners and the public for a donation to Cathedral preservation and restoration projects. This stunning dress, a 1990 off-white satin gown, has a 25 foot satin train with a 30 foot veil of translucent tulle.
