F. BABCOCK N MANLA MANLA, September 7. Whle unloadng lumber tho cargadoros of tho Amercan salng Bhlp W. V. Babcock suddenly came upon an mmense snake. Tho reptle, angered at the dsturbance attacked tho natves fercely, and pandemonum regned untl ne was wth a handspke. t s beleved that the snake got nto the shp and glded down the hold whle the cargo of lumber was beng taken on n Eagle Harbor. Washngton. Ths Bmall port s at the foot of heavly wooded hlls and tho theory s that the snake was brought down wth the tmber conecaled n the branches. Whatever the truth of the theory may be, the presence of the reptllo when vewed yesterday by half a dozen shp hands, and many natve carga-dore- s, body swollen and head rased and fangs dstended n anger, was an ncontrovertble fact. The cargadores were unloadng lumber as usual yesterday mornng. The weather was clear and they were workng fast to make up for lost tme and to take advantage of the smooth seas. The huge tmbers were beng pulled out one by one, hosted up and loaded on lghters wth clocklke regularty. Everythng was gong smoothly when the snake was dscovered colled n a hollow place formed between the ends of the tmbers. Before the astonshed onlookers could recover ther equanmty the snake showed fght and moved ts head from sde to Bde and shot ts fangs n and out wth lghtnng-lk- e rapdty. n less tme than t takes to tell lb had sunk ts fangs nto the legs of ono Flpno cargadore, knocked another down wth a sweep of ts powerful tal, and had jumped at a thrd and was colng about hm. Ths frghtened the other Flpnos so badly that they ran pell mell and yellng to the laddere and began to clmb out of the hold. Ther frantc efforts to get on the deck as far as possble from danger, tryng to go up many rungs of the ladders at one step, and even crawlng up each otlerb backs, would have been ludrcrous were t no(t for the fact that they were leav ng an unfortunate companon behnd them to persh n the slmy embraces of tho enraged reptle. The greater the number of ntellgent, enlghten ndvduals consttutng a communty, the rcher, the more ntellgent s that communty. And the average farmer n the Unted States of today s an ntellgent man. He s a ma versed n many of the scences pertanng to hs vocaton, and s an ntellgent ctzen besdes. Fannng today s no longer mere manual labor. The farmer now s a practtoner of the natural scences and a busness man. The educatonal work of the U. S. Close nqury wll reveal that the mansprng of wealth of the Unted States durng the past decade have been and stll arc the bumper crops produced by the farmers year after year wth ncreasng celerty. "Our clmate, our vast areas of unsettled, productve lands, the nature and quantty of crops ths land s capable of yeldng under proper management, and the vast market at our very door cry to hgh heaven for settlers, for cultvators, for farmers. But thus far the cry was van. Our large and proftable sugar ndustry s merely an ndcaton of what could be accomplshed here n agrculture f ntellgently pursued. We have wated and wated n van for settlers to come to us from other shores. The few that came prospered, but ther number s lmted. And the attracton to others must be equally lmted at least as compared wth others elsewhere of they would have sought our shores more freely. "From among ourselves we had not the opportunty htherto to produce farmers. Farmers mean n the modern sense of a farmer. The farmer that pursues methods of a generaton ago s a falure even n Amerca, the land of hghly ntensve cultvaton and enormous yelds. None but smlar results could be expected from farmers here. The Calfornans that came succeeded because they had the experence of years to back them. They could not but succeed. Tho motlvo of the ndctments s for tho collectng of fnes for volaton of tho nterstate commerce law. The penalty on each count s not less than $000 and not to exceed $20,000. At these fgures should tho defendants be found gulty a3 charged and fned the full extent of the law, the fne of the Southern Pacfc would bo $2,60,000 and of the Pacfc Mal, $ but as the ndctments are for one offense, t s not probable that gult could be establshed on them all. The large shpment of mattng whch has nvolved the two corporatons n ths dffculty wth the government was made on September, 904. On thnt date the cargo left Kobe on the steam shp Mongola, arrvng at tho port of San Francsco on October 4, 904. The mporters of the cargo were James Wld & Co., Taylor, Cooper & Co. and Smth-Bak- er Company, all of whch are Eastern frms. The larger porton of the cargo went through San Fran csco to destnaton wthout stoppng here. Tho cargo was dvded nto lots Of these four lots were stored n San Francsco, and consgnees n every part of tho country reached by tho trade of the mporters were suppled wth parcels, shpped by order of the mporters. n ths way the 00 counts n the two ndctments aganst tho Southern Pacfc were found, each parcel shpped to consgnee callng for a separate count. The nterstate commerce law requres that a rate of $.25 a hundred bo charged for shpment of mattng from Kobe to Chcago, and the two companes under ndctment made tho three mporters a specal rate of $ a hundred. The government consders that t has a good case, and one that wll test the bounds and strength of tho nterstate commerco law; whereas the law department of the Southern Pacfc appears not to attach much concern or mportance to the ndctments. An attorney for the company sad that t would not bo necessary for any of tho hgh offcals of the Southern Pacnc to bo n court; that tho case would soon come oft and that t would not amount to much. That tho jngoes n tho army and navy and n poltcal lfo n Japan would lke to provoke a war wth tho Unted States s admtted, but t s beleved that tho wse counsel of tho Elder Statesmen who rcalzo tho utter hopelessness ot such a struggle, wll preval. How ever, the Amercan Navy s takng no chances. Tho motto of tho servce now s to be n tho hghest state ot cfflcloncy, ready for any emergency. All durng the long cruse around the world tho men of the fleet havo been engaged n ncessant drll and target practce. Tho offcers state that never n the hstory of tho servce have shps crows been traned to such perfecton n drll and tactcs as the 3000 Jackles of Admral Daytons squadron. Tho shps havo stood the long voy ago remarkably well. The only fault that tho men havo to fnd wth the shps s that they are vory wet n heavy weather. As gun platforms and n speed qualtes they have boon en tlrely satsfactory. t s common gossp n the fore castles of tho bg crusers that Japanes employed as mess attendants had free access to the offcers quarters prevous to the dscharge of all Japanese em ploycs, and yere detected attemptng to steal some of tho secret cpher code books, whch nro so carefully guarded There are three separate cpher codes used n the servce, offcally desgnated as Codes A B and C. Code A s ntrusted only to the offcers of the grade of Admral. Code B s gven to all commssoner offcers and Code C to all warrant offcers. AU these codes arc n manuscrpt and are bound n leanden covers. f one of them s lost or mssng tho entre code s mmedately destroyed. Tho offcers of tho fleet postvely refuse to dscuss the matter, but warrant offcers and enlsted men declare that when the Japanese left some of tho code books were also mssng. No confrmaton of the loss pan be obtaned. The wreless apparatus of the prspm tmvp tn hr most pfllnlmt. Wreless communcaton wth the North Head staton at the mouth of the Columba rver was establshed when tho shps were 700 mles away. Communcaton wth the staton on xerba Bucna sland was mado when the fleet was 35 mles off the coast. Captan Ward of tho Pennsylvana announces that the operator of hs Bhp receved a messago whch presumably came from Savannah, Ga., when 000 mles oft the coast. However, he could not read tho message dstnctly. Tho staton sgnal of Savannah was qute clear, and tho shp to whch the message was sent was made out, but tne message was otherwse ndstnct and postve confrmaton of the message s awat ed. t was found that communcaton by wreless nt a dstance of 000 mles was qute easy. Untl tho arrval of Admral Evans Rear-Admrbattleshp fleet from the East, al Dayton wll bo tho rankng naval offcer n the Pacfc, and all ves sels n commsson wll bo under hs command. The two squadrons of the cruser fleet wll probably be kept to gather and San Francsco wll bo ther base. SUPREME COURT.
