The decson affects an act whch the last legslature attempted to pass and whch t fnally ncorporated n the county bll, makng t mpossble for Japanese and other drvers who do not understand Englsh, to secure lcenses. The Hgh Sherff adopted the rule and refused lcensesto Takch Sakta and others, who took an appeal to the Supreme Court on an agreed statement of facts. The decson of thecourt says: "Doubtless the busness of carryng passengers for hre s one for the exercse of whch a lcense may be requred, and one whch may properly be subjected to reasonable regulatons under the polce power. The extent to whch such regulatons may lawfully go has often been the subject of dscusson n ths jursdcton, and t s unnecessary to go over the ground agan n the present case. The only nstance, so far as we know, n whch a language test has been attempted was n the case of The Kng v. Lau Ku, 7 Haw n that case the court held vod an act of the legslature whch prescrbed that no wholesale or retal lcense should be granted to any person except upon the express condton that he should at all tmes keep full, true and correct books of account of all busness transacted by hm n connecton wth the lcensed busness, n the Englsh, Hawaan, or some European language. We refer to these cases partly for the purpose of showng that even f a statute or regulaton mposng a language test n cases of ths knd would be consttutonal, stll t would be of such an extreme nature, or so close to the lne of unconstutonalty that a statute clamed to go to that extent should not be so construed except n a clear case, or should not J be extended by constructon beyond ts plan terms. See especally Ta Kee v. Mnster, Haw., at page 66. The proprety of ths vew s partcularly obvous when, as n ths case, an attempt s made to mpose the test of a sngle language, even though that s the Englsh language, n a cty whch by far the larger porton of the populaton conssts of those, namely, Hawalans, Portuguese, Japanese and Chnese, who naturally speak other languages, many of whom can not speak the Englsh language to any great extent, and most of whom mght naturally desre to engage carrages havng drvers of ther own respectve natonaltes. "t needs no argument to show that one may be a competent drver wthout havng any knowledge whatever of the Englsh language. n order to be a competent drver one need not be conversant wth the language of a partcular porton of the communty n whch he proposes to conduct h busness. Ths beng so, the hgh sherff must be held, upon the facts set forth n the agreed case and n the absence of any showng to the contrary, that the plantffs were competent drvers. Ths provson of the statute-doe- s not tself mpose a language test, nor does t authorze the hgh sherff to mpose one. "The other secton of the statute (Sec supra), t s true, authorzes the treasurer to make rules, and provdes that such rules, when publshed n the manner prescrbed, shall have the force and effect of law, but the scope of such rules s confned to the regulaton of lcensed drvers yd lcensed vehcles, and the fares to be charged by them. Taken lterally, the statute, n so far as t authorzes rules n regard to drvers, confnes them to drvers who are already lcensed, and even f ths provson should be more lberally construed so as to authorze rules n regard to prelmnary examnatons of applcants, such matters covered by such rules woull have to be ncdental to matters relatng to drvers after they were lcensed. Ths provson contemplates rules regulatng the conduct of the busness, and does not contemplate a rule of such on unusual or drastc character as "(that now n queston, dscrmnatng by a prelmnary language test who mght be drvers. The statute tself contemplates that those may be drvers who are competent to drve. "The concluson s that the hgh sherff should ssue the certfcates n queston. Judgment accordngly." SAN FRANCSCO, October 22. The Exqmlner says: George Pepeloy, thrty-fv- e years a leper, has been cured of the malady that through all the ages has been regarded as beyond the reach of medcal skll. Durng the past nne years he has been an nmate of the San Francsco Pesthouse. Before comng here he was for a long tme shut up n a smlar hosptal at New Orleans, fnally makng hs escape. There can be no queston that he was actually afflcted wth leprosy, havng nherted the dsease from hs mother, and nobody who ever saw hm at the nsttuton on Twenty-sxt- h street would have any doubt about t. The Board of Health has declared Pepeloy to be fully cured, after thorough examnaton and extended study of hs case by such surgeons and physcans as Dr. James W. Ward, now presdent of the Health Board; Dr. Howard Morrow and Dr. Fred G. Canney. Although the utmost precautons are taken to keep lepers away from communcaton wth the general publc, even as n past centures the vctms of the "lvng death" were solated, compelled to wear long gray gowns and hoods and to carry wooden clappers for the purpose of soundng warnng that they were lepers, the Board of Health as released the patent and allowed hm to go wherever he pleases wthout survellance or restrant. Nothng s known to the doctors about the means or methods of the cure that astonshes them. The credt s not thers. Snce mracles were performed on earth, the medcal men have regarded leprosy as absolutely beyond the possblty nf cure. Pepeloy, the subject, says that he cured hmself and that the healng s the result of a dscovery never made before. He says that all lepers can be cured; but he has suffered so long, and s now so helpless n the world to whch he s almost a stranger, that he feels he has a rght to make fnancal proft out of hs secret. So for the present the formula s hs alone. "Pepeloy s cured," sad Dr. Ward last nght. "Hs case has been looked nto by physcans whose standng and learnng cannot be doubted, and there s no queston about the matter."
