Among those present were Jack cas, Scotty Meston, Dr. Humphrs, M. F. Prosser, J. D. Ganes, W. C. Peacock, Frank Hatch, Judge Stanley, L. E. Pnkham, S. L. Chjlngworth, Pat Gleason, Judges Kaulukou and Maha-ul- u, Charles Crane, Frank Halstead, C. pkte!yorth, H. M. Ayres, F. E. Thompson, George F. Henshall, C. K. Notley, E. C. Peters, P. W. Mlverton, Harold Gffard, Dr. Monsarrat and many others. County Attorney John W. Cathcart represented tho Terrtory, whlo t. W. Breckons was represented by Knney & Marx, Holmes & Stanley and Thompson & Clemons. Mr. Prosser, of counsel for the defense announced to tho court that Mr. Breckons was unable to- be present, - but that hs counsel were perfectly wllng to go on wthout hm, f the court was wllng. Mr. Cathcart for tho Terrtory then naked the courts permsson to enter a nolle prosequ a the case ofr. W. Breckons as well as for Ah Sam and Wlls. Mr. Cathcart then addressed tho court as follows: MR. Second The Unted States Dstrct Attorneys offce, as well as tho County Sherff, refused to take any acton n the matter when requested to do so by the ones that have been nterested n ths case, and as the two offcals requested to nterfere saw lt to refuse, do not thnk that have any rght to nsst on the defendant beng prosecuted.. Thrd consder that tho acton taken by the complanng wtness n ths case was entrely mproper, n vew ot the fact that, as have sad bqfore, tho people that should have. taken: the ntatve n the matter have refused to do t, then feel that have no rght to nterfere.. The proper course to pursue, now that the grand Jury la n sesson, s to lay tho matter before that body, ana f they fnd that nn offense has been commtted then they wll return.an ndctment, but t they fnd there s not enough evdence to warrant an ndctment they wll return a no blll. dr not consder that the proper course was pursued n havng Mr. Breckons arrested on a bench warrant, and agan ask the court to allow the nolle prosequ.. Mlls wll have to pay, the fne of $0 whch was mposed on hm for contempt e, ot court by Judge or stay n jal for such a perod as tho Dstrct Magstrate may desgnate, as the result of a decson handed down by tho SupremeCourt ths mornng. Ths means that Mlls lght, whch took place wth an opposng attorney n Judge Andrados court about three months ago, wll cost hm n the neghborhood of $25, nstead of $0, whch would have been the amount had he pad tho fne nflcted by Judge Andrade n the frst nstance. The matter came up through a personal dspute whch took place(between Mlls and an opposng attorney, whle they were argung a small cvl case before Judge Andrade. Words led to blows and as soon as the contestants had been separated Judge Andrade found both partes n contempt and ordered each to pay a $0 fne. Whle the other lawyer pad hs fne at once, Mlls refused to obey the order of tho court and was arrested on a bench warrant the next day and remaned n the polce staton over nght. A wrt of habeas corpus was sworn out and Mlls released to appear before thd Crcut Court. JudgeQuarles was retaned by Mlls to represent hm and attempted to ntroduce testmony to the effect that Mlls had acted smply n self-defenand wthn hs rghts n resstng an attack made on ns person. There was a very mportant matter whch came up n relaton to tho ques tons asked by Thompson n regard to. tho credence whch tho jurors would placo n tho testmony of Chnese wtnesses. Tho decson of tho Judge may bo called nto play agan bororo tho matter s fnally settled. Tho solecton of Jurors was a long drawn out fght, tho questonng for tho prosecuton beng conducted by Deputy Attornoy General Larnach and for the defendant by Attorney P. E. Thompson. Ths vew was sustaned by Judgo Do Bolt, and the pettoner then took an appeal to the Supreme Court, whch has now affrmed the decson ot tho Crcut Court Judge., Tho costs of the appeal to tho Supremo Court wll amount to $5, addng tho lno Mlls whl now have to pay makes $25, and Judge Quarles s certanly enttled to an attorney s lee 0 at least $00, whch means that AU3 wll have to pay dearly for the trouble he got nto. Ho also stated that ho would havo no projudlco aganst Lee Lot on account of hs raco. Thompson nuked whether tho fact that Taylor had wrtten stores n regard to tho Loo Lot case n the Advertser would affect hs opnon. Mr. Carter reported that he hud spoken to the hotel commttee about furnshng accommodatons for tho salors who could not afford to stay at hotels when a3horo, but they asked to havo tho matter referred to nnothcr commttee. Tho matter was placed n the hands of tho Commssary commttee, who wll 00k nto t at once. W. P. Dllngham, charman of tho Commssary commttee, asked for an appropraton of $50 for a hootupu. After a very general dlscussjon on flo queston of a ball at whch many remarks passed back and forth between Carter and Waldron, tho matter was fnally settled by a moton by Smth, seconded by Morgan, favorng an appropraton of $2500 for tho ball, Carter and Peck votng aganst ft. Carter reported that $3,975 was n sght for tho general fund. Dscoverng too late to bo cured that he was sufferng from hydrophoba, Wllam H. Marsh, a manufacturer of water meters, s watng, as he beleves, for death at hs home, 74 Ocean avenue, Brooklyn. Acceptng tho verdct of the physcans at the Pasteur nsttute that there was no hope for hm, Mr. Marsn has resgned hmself to what he regards as the nevtable, and s calmly awatng the end. To ease the last hours of Mr..Marsh the physcans about hs bedsde today put hm under the nfluence of opates, and he wll be kept n that condton untl lls death. Mr. Marsh was perfectly conscous and apparently dd not suffer except when sezed wth convulsons. Tho paroxysms became noro frequent last nght, each growng more volent than the precedng one. The physcans feared Hnt ho would begn to rave and determned to releve any sufferng that mght ensue. Between the paroxysms Mr. Marsh bade farewell to hs famly, whch had gathered at hs home n Brooklyn, and arranged hs busness affars. The case s one of the strangest and most pathetc that las ever come to the attenton of the experts of the n sttute. About sx weeks ago a spanel puppy whm bad strayed nto Mr. Marshs offce, at 249 Robnson street, and been permtted to reman a few days, wa,s attacked and btten n front ot the place by a dog sufferng trom rabes. A veternaran who was call ed found that the puppy had been only scratched. Mr. Marsh thought no more about the matter untl ten days later, when the spanel ded n convulsons. Even then he had not the fantest fear that there was anythng wrong wth hm self. Saturday last, however, the dread truth began to reveal tself. NERVOUS ATTACK. On that day he had a strange nervous attack, tho muscles of hs face and throat beng partcularly affected He also dscovered, to hs bewlder ment, that ho could not drnk water. Monday he experenced a mld sort of convulson, and, becomng uneasy, went to a physcan, w.ho nformed Mr. Marsh that he had symptoms of hydrophoba. Mr. Marsl hurred to the Pasteur nsttute, and there the physcan gave hm a thorough examnaton, whch confrmed the dagnoss of hs own physcan. Ho was nformed that he was n an advanced stage of hydrophoba. Mr. Marsl then recalled that at the tme the spanel was btten he fnd a hangnal on one of hs fngers whch was sore. He had permtted the pet puppy to lck hs hand, and n ths way the poson was ntroduced nto hs blood. The physcans at the nsttute gave Mr. Marsh treatment and told hm to return yesterday. On ths second vst t was apparent that the malady was progressng. PHYSCANS GVE VERDCT. The treatment, the physcans told hm, wth tome hestaton, has not had the slghtest effect on you.
