n Supremo Court decson rendered today m J K Sumner vs A V Gear: Ths cause came befores, says tho opnon, on complanants moton to havo the nterlocutory appeal of respondent placed on the calendar and dsmssed for want of prosecuton Whle counsel were argung ths moton the court suggested tho queston as to whether or not the appeal was taken prematurely, and ths latter queston also was argued t appears from the record bent ud that whle the cauce was pendng before the crcut judge on complanants bll and respondents demurrer, respondent, on July 5, 90, fled 3 notce of appeal from the decree rendered n sad cause upon the frst day of July, 90, overrulng the demurrer, whch appeal was allowed by tho crcut Judge The record also shows that on July 7, two days after tho notce of appeal had been fled the crcut judge sgned and fled a decree, dated July overrulng the demurrer f the form of decree was actually sgned on July, but not fled untl July 7, t dd not take effect as a decree untl the latter date Respondent contends, however, that ths decree should be consdered as havng been entered on July Ho bases ths contenton upon tho ground that TRYNG TO Superntendent of Publc Works Marston Campbell has notfed Unted States nternal Kevenuo Collector W F Drake that the quarters tho latters department now occupes n tho mauka Wakltl corner of tno casement of the captol buldng are requred for tho use of the U S hydrographc and topographc survey, and that t Js desred that Drake and hs Federal lquor rovenuo collecton bureau vacate The present quarters of Drake and hs men are rented from tho Terrtory tho Terrtory necessarly ownng the terrtoral captol, but whether or not tho T S nternal Revenue offce wll vacate s an open queston The man queston seems to bo whe FFTY YEARS FEDERAL fll l Mele Kaulan Kapohokalanl ono of tho best known resdents of tho Pauoa dstrct, celebrated her ffteth brthday yesterday, by gvng an elaborate jau at her resdence Moles place s deal for such a functon and the delectable trmmngs of a Hawaan feast After the throng of guests had boon regaled and when Melo had been tlne and tme agan Hartlly "hnnnued," the musc boys played nnd sang and some oj the of thoart of hulalng showed hoy tho tlng should be properly done Tllo vstors, among whom wore the crcut Judge orally overruled tho demurrer on e that "day and that havng been dated the same day, t follows that t should bo consdered as havng beea entered accordngly, although actually sgned by the crcut judge and fled on July 7 n tho case before us t does not appear that ether the court or tho complanant was n any way to blame for or occasoned tho delay Respondent also contends that hs appeal s good on the ground that an appeal les from the supposed oral $ of tho crcut judge, whch he clams was made and noted by the stenographer on July, overrulng the demurrer Be that as t may, we cannot now consder that queston as the supposed oral order or rulng was not made a part of the record sent up, hence, t s not before us n ths respect tho record falls to show that any order, rulng, decson or decree was made or entered on July, or at any tme pror to July 7 Hence, from whatever pont wo vew ths appeal tho concluson seems nevtable that t s nvnlld, bocauso rot taken from the decree actually fled and entered, nor from any decree The moton to dsmss for want of prosecuton need not be consdered The appeal s dsmssed for the reasons stated n the opnon W W Thayer for plantff; W S Edlngs for defendant - OUST OFFCER ther or not the Revenue offce has to get out; that s f t wll bo compelled to move There s plenty of room for opnon here Why should the surveyors above noted, who wll only havo a fow months work, bo gven tho prvlege of oustng a permanent nsttuton such as that of the nternal Revenue offce? Campbell wants Drake to "move about the frst of October, but Drako has nowhero to go wthout gettng stuck for a fancy rental somewhere downtown and, ncdentally, why cant the hydrograpners and topographers hre a hall or an offce as easly as Drake s expected to hre new quarters ncluded several n folks, stayed, most of them, tll along about last-ca- r tme, departng wshng tho amable hostess ffty more years or happness, and ffty more on top or them A PRCELESS POSSESSON f tho supply of Chamberlans Colc, Cholera and Darrhoea Remedy should suddenly becomo lmted, many homes would consder a bottlo of t to be a prceless possesson t s sold n almost every cvlzed country, and never falls to glvo satsfacton For sale by all dealers, Benson, Smth & Co, agents for Hawa NEW ncb MLL The K Yamamoto Rco Mll s the largest as well as tho fnest n the slands All machnery s of tho very latest pattern Two famou Tengu Rco s cloaned at ths mll Wth the large cleanng capacty they are ablo to handle consderable out-sd- e part cular work wncn they guarantee (Assocated Press NEW YORK, August 0 Mayor Gnvnors condton s dmmed snce the frst operaton of extractng half of the splt bullet from hs neck, whch bullet was lodged by J J Gallagher, a dscharged muncpal cmpoye, who charged Gaynor wth beng personally responsble for hs losng hs poston, Gallagher havng fred at Gaynor aboard the S S Wlhelm der Grosse as the mayor was about to leave for a vacaton n Europe The outlook, however, for the recovery of the mayor s very favorable, and there s at present no sgn of blood posonng settng m t s possble that a further operaton, to recover the other half of the splt bullet, whch landed n hs mouth, wll not be necessary PRZ Or EFGHTF BALTMORE, August 0 Gans, the przefghter, s dead of 0SSE SEA N t LONDON, August 0 Robert Lorrane has crossed the Trsh Sea n hs aeroplane, accomplshng eghty mles wthout a stop M 90,000 POWDER Absolutely Pure Tho only bakng powder mado wtt Royal Grapo Cream of Tartar 9 Phosphate Cable ALANCE The Star) UMP ON THE A ft EXPLOSON ORTLAXD, Ore, Aug 0 An exploson n a cellulod collar factory resulted n a fre whch dd!?!)0,000 damage JUNEAU, Aug 0 ndependent Republcan Wckersham wll probably be re elected to Congress, A VRGNA, Nevada, August 0 The surface mne buldngs have been burned, ffty thousand dollars of damage beng done CALCUTTA, August 0 ManyLndus have started for Calforna The governmbnt at Washngton has been warned of the e AVATOR SEROUSLY HURT ATLANTC CTY, N, J August 0 Whllo gvng au exhbton n -- hs flyng machlno here today, Walter B rocklns fell from hs mnchlne and was serously njured NEW GOODS AT SACHS New trmmngs n Persan colors and desgns on slk and net wero rocelvod by the N S Sachs Dry Goods co, per S S Lurlne Strped Madras Wasts, specal $00; Automoble Vels $275; tho new wash fabrc "Luxury Slk" 25c, a yard Ho Alum, No Lme to EDUCATORS 4 Shoe A home for tho feet not a Prson We havo them n all leathers both n hgh and low Especally good for oflco men and clerks Manufacturers Shoe Co, Ltd, 05 Fort St, - Honolulu $

5 TUB HAWAAN STAR, WEDNESDAY, AUGUST 0, 90 By JLV Fnancal and erc 9 MMf WW OrMAdLOJSr LATEST LETTER OF HENRY CLEWS New York, July 30, 90 Tho breakdown of a speculatve clque, whch sought to lnk up a seres of dsconnected lnes nto a now transcontnental system, proved to bo at the bottom of tho collapse n values whch occurred n Mondays and Tuesdays market The takng over of theso securtes by a strong nternatonal bankng syndcate unque3-tonabl- y saved the market from a worse crash, and produced a radcal change for tho better, n the techncal stuaton As soon as the facts became known lqudaton ceased, and a sharp rebound followed whch was materally accelerated by a rush to cover outstandng shorts Tho extreme pessmsm bred by tho mysterous declnes of last week suddenly dsappeared nnd tlo whole market dsplayed a bettor and moro normal tone Another consderaton whch mparted a bettor tone and checked the growng wave of pessmsm was tho report of the Unted States Steel Company, whch showed handsome; profts for the past quarter and a smaller fallng off n orders on hand than was really antcpated, As tho st?el trade s stll consdered one of tho best ndustral barometers, the effect of ths report was naturally stmulatng The monetary stuaton shows further mprovement Local bank resources contnue to rse, and there s much less apprehenson of severe monetary strngency durng the comng fall than at one tme exsted What wth lqudaton n stocks and declnng values n commodtes and securtes, money goes much further than sx months ago, especally n vew of the shrnkage n volume of busness ahd speculaton The last statement of the natonal banks may have been unsatsfactory owng to the small contracton n loans at tho nteror, but recently farraera have been marketng ther crops more freely and lqudaton from ths and other sources wll probably result n a much bettor showng for the nteror banks when the next call s ssued Gold mports contnue on an ncreasng scale, and there s every ndcaton that we wll command all of the precous metal that we need Europes heavy nvestments n our securtes durng the past sx months moro than offset tho shrnkage n our foregn trade j balance The tendency n our foregn trade s towards mprovement, because the declne n commodtes! puts us upon a more favorable export bass and tends to restran mportatons Whle some strngency may be antcpated durng tho crop season, there s much less danger of a crss n ths respect thatt formerly Should any of the bankers agree to form currency assocatons tsat wll be a further protecton aganst a crss, whch n vew of tho nablty of the government to assst the market n an emergency would seem to be a desrable alternatve No one pretends that these assocatons are a fnal euro for our currency evls, but they would at least prove an effcent pallatve untl genune currency reform can bo establshed The crop outlook s not entrely satsfactory The yeld of wheat, cotton and corn s lkely to fall below early calculatons Tho loss n wheat has alreafly been amply dscounted nnd v s not serous Much deteroraton, however, has taken place n cotton, and tho corn crop has lkewse lost crops are stll n danger of early fross and dsaster to ether wpuld under present condtons, have a very serous effect upon busness Tho country was urgently n need of large cotton crop, but tho outlook s now for a 2,000,000 bale yeld, whch s below normal and means contnued hgh prces for cotton The effect of ths upon the domestc ndustry and upon our export trade must bo taken nto consderaton Our man hope regardng the crops stll centers upon corn Should ths prove a bumper yeld t wll do much towards offsettng any loss n wheat and cotton The result, however, wll bo to leave tho agrcultural stuaton spotty Some of our farmers wll enjoy another season of exceptonal profts, whllo others must endure serous loss Tho busness outlook s mxed; both brght ad doubtful n spots A very conservatve dsposton exsts among those who lead n both commercal and ndustral affars Reacton had LQUOR LCENSES COST $40,000,000 WASHNGTON, July 3 t takes over $40,000,000 n the largo ctes of tho Unted States to pay lcense fees und then some more The extent to whch tho drnkng men help to pay tho expenses of government n tho ctes s ndcated by a census report coverng the fnances of the country for tho year 90S n tho ctes havng a populaton of 30,000 or more Thero were at that tme 58 of such ctes, but the complete fgures were avalable for only 5 pf them, and tho fgures showed that n thoso places tho lcense n the drnkng places pad an aggregate of of $4,950,88 Ths was a gan of almost $3,000,000 from the precedng year and of about $,000,00 of the year 905 The ncrease was due to tho large fees exacted by most bf the largo ctes Of the drnkng places sanctoned by law there are no fewer than 67,3 Ths s a decrease wthn three years of about 4,000 Tho fallng off was due largely to tho fact that a number of ctes went "dry" Of the 58 places twenty-fou- r had become " ctes when the canvas was made Tho chango was most marked n the South Atantc States and least n the Rocky mountan regons The states clamng tho largest number of saloons to the populaton were Texas, Wsconsn and New York, whle Pensylvanla, Massachusetts and Nebraska clamed the smallest number n proporton to the people to bo suppled Galveston had one lcensed bar to every 38 of her people, Mlwaukee one to every 4 and Hoboken one to every 75 n Phladelpha, the freest of large ctes, there, was one drnkng place to only every 758 people Lncoln, Neb, had one to every 2028 The report shows many other nter-ycsln- g fact concernng muncpal fnances, ncludng tho total recepts of the 58 ctes n queston whch for 908 were $,288,C25,498 Ths fgure bow-rowewas made up from tax recepts, d money and refunds Of tho total amount $500,905,44 was borrowed Lquor lcenses and taxes formed more than 3 per cent of the general revenues f the ctes of Oho and more than 0 per cent n the ctes of Calforna, New York cty receved : Chcago $7,252JG87, ahd Phladelpha S9C9459 from ths source The only other ctes derlv ng more than $,000,000 from lquor lcenses were St Lous, Boston, ceve land, San Francsco a--;"- ; and Cncnnat tegun wth varyng force n dfferent ndustres Values had been declnng, and t s generally recognzed that ndustral nterests ojf the country must face some readjustment Ths process s unpleasant whle t contnues, but wll n tho end leave both commercal and ndustry upon a sound and stronger bass The reacton whch began n stocks must extend moro or less nto other dvsons of busness n all probablty tho stock market has fully dscounted any ndustral depresson Ths s so regardng the ralroads at least, for the latter havng varous resources nlwaya suffer less n busness depres-so- n han ndvdual ndustres Moreover, tho ralroads are confdently lookng forward to permsson from tho nterstate Commssoners to advance f eght rates later on As for the poltcal outlook, that s stll unsettled Tho fall campagn s Just begnnng and may develop dstrbutng nfluences At tho same tlmo both Government offcals and local poltcans are begnnng to learn that blnd attacks upon captal are qulto lkely to njure ther own prospects ps well as those of ther party Thero has heen a decded tonng down of hostlty towards corporatons, whch betokens more ratonal treatment of tho latter n the future Tho market has now had a sharp rally and on any further advance tha takng of profts would be n order Tno Mg bankng nterests are showng moro confdence n tho future and seem wllng to express ther belef n the general soundness of the present fnancal stuaton, though not nclned to support any prolonged bull movements n such quarters tho present Fltuatlon os to tho busness and crop outlook s well understood, and no dsposton s shown to flnanco any great stock market actvty untl ths monetary and poltcal outlook s clarfed So far as Wall Street s concerned tho outlook has mproved, and the ndcatons pont to n much better market Securtes bought on conservatve lnes are lkely to prove proftable nvestments, Stocks have suffered a shrnkage of nearly durng tho past sx months to a substantal re- and are enttled covery HBNtY CLEWS S L SALES SLUGGSH MARKET Ths has been nnotler dull day n stocks Fgures have remaned about the same, but sellng orders of any sze would probably cause a cave n at almost any pont From all accounts, the San Francsco market for sugar stocks s also dull and lttle or no mprovement s antcpated before September A sale of 6 shares Hawaan Com mercal was reported ths mornng at $4050, after whch $40,375 was bd and 4075 asked Fve shares Olaa found a buyer at $CE0, after whch 50 and 50 shares sold at $C375 At tho close of tho sesson the latter fgure was bd for more, but holders were demandng $650 A sale of 50 Ewa was made at $33-5- succeedng whch the same was bd and $33,625 asked, Fve shares Poneer found a purchaser at $226, after whch $225 was bd and $227 asked Another sale of Walmanalo was made, ths tme the block beng 5 shares and tho prce $220 Tho samo was bd for more, but no stock came out nterestng quotatons wthout sales were: Oahu, $375 bd and $32 asked;
