Applcaton for Resstor Made n May lssuod n London n July. The bg steamshp Chna came nto harbor yesterday flyng tho Hawaan flag, reby hangs a dlemma wth proverbal two horns, tho graspng of er means annoyance for some one. For several weeks past ConsulGener al Wlder, at San Francsco, has been con RECRD BREAKER, NW FLYNG HAWAAN sdered gulty of a seemng ndscreton n ssung an Hawaan regster to ths steamer, but now t transpres that Mr. Wlder s entrely nnocent of any connecton wth case, beyond a VWxy Am. s Au wllngness to comply wth request, had t been made drect to hm. Consul Wlder evdently labored under a msconcepton of hs dutes n premses, for by Moana ths Government receved notfcaton of hs ntenton to ssue a temporary regster when tme came. Furr, he stated that he had promsed t to agents of steamshp company fve months ago, he dd not feel lke breakng fath wth m. And at tme Mr. Wlder was wrtng to hs superors here what he ntended dong. Colonel George W. Macfarlane, rrepressable Chesterfeld of promoters, had been made flag owner of steamer by C. P. Huntngton, was at that very tme speedng hs way across Atlantc wth a "sea letter," ssued by Deputy ConsulGener al Hopkns of London, tucked carefully away between shrts n hs portmanteau. By Col onel Macfarlanes remarkable foresght Consul Wlder was. saved unpleasant experence of beng wrtten down an unwse young man. As early as 1893 Hawaan Consuls were notfed that under no cr cumstances should provsonal Hawa an regsters be ssued to any but Amercan bottoms. Agan n July of ths year se nstructons were emphaszed, though t was hardly necessary, as frst were defnte enough. The sea letter was ssued to Colonel Macfarla ne on July 2d n London; Chna arrved n San Francsco, from Asatc ports, on July 25th remaned re untl August 5th. before t was announced that she would fly Hawaan flag. t wll be remembered that when annexaton treaty was n hs of Foregn Relatons Commttee that body wanted to recommend that no foregn vessels, or than Amercan, should be granted Hawaan regsters whle treaty was pendng refraned from nsertng clause only upon assurances of ths Government to Mnster Sewall, whch were telegraphed by hm to Washngton. t s possble that owners of Chna were not aware ofnhs understng, neglect to make publc fact that Brtsh steamer Chna had been granted, what s practcally a Hawaan regster, untl after Congress had adjourned, was only an oversght of Colonel Macfarlanes. The Cabnet held two sessons yes, te.day to consder what acton to tako n matter of ssung a permanent regster to steamer. t was dffcult to learn any partculars regardng dscusson: most that could bo learned was that rr! not ret la speakng of matter last ngat Mnts tre Cooper sad: "Untl case s defntely settled do not care to speak fully of mat ter. We had a. Cabnet sesson ths afternoon, but Mr. Smth was hot present fnal acton was not taken. So far as am personally concerned, can say that polcy of tho Government n ths matter has not changed. We gavo assurances to Unted State on ths queston, nnd thnk y shold be adhered to. "The matter s now out of my department belongs to Mnster of Fnance. There s no law regardng provsonal regsters; a regulaton of tho Foregn ffce permts a Conaul to ssue a provsonal regster or a sea. letter. Tho former holds good for a perod of months to enable tho vessel, whch may be away n a foregn port, to reach homo port Tho latter pro vdes for a drect voyage to homo port for tho purpose of securng a permanent regster. n case of Chna, hcrs s a sea letter, t s now at an end. "no thng can say, nnd that fa that Mnster Hatch dd not supervse regsterng of Chna. There may be law proceedngs n ths case, t would not do for me to glye what beleve to be ndvdual opnons of Cabnet on ths subject FLAG. can say ths, that we beleve t best to confrm assurances gven n Julyt o Unted States Senators. W do not wsh to nflct an nurr tn tfc owners of Chna, nor do we approve of DeputyCons Hopkns ul actons. He, by way, has but recently been apponted. Tho matter wll be settled early tomorrow, but how or what n my opnon, result wll be declne to say for present f t s decded not to ssue a permanent regster Chna may leave here under Hawaan flag, but she could partcpate not n any of benefts whch a per would ensue from her havng manent regster." n Charge of.murder. The tral of seven natves, on tho charge of murder n second degree, took place n Polce Court yesterday afternoon. Attorney Charles Creghton appeared for defense, Marshal Brown for prosecuton. The case took up nearly whole afternoon. Judge Wlcox found probable cause that a jury mght fnd suffcent cause to convct defendants, bound m over to Supreme Court for tral. The natves were all sent over to ahu Jal for safekeepng, a Crcut Court News. The case of Campbell, Marshall &. Co. vs. Beattee & Harvey, ha3 been ordered strcken from calendar. J. S. Walker, executor under wll of Joseph Lazarus, fled an nventory of estate yesterday mornng, real estate valued at $12,902 personal property valued at $9,374. The accounts of Wllam. Smth, guardan of Hamaku, hers, were fled yesterday. Penguns.Movements. H. B. M. S. Pengun receved orders yesterday to proceed drect to Fannln gs sl. She wll sal on Frday, nstead of today, as prevously decded on, wll not stop to survey tho reef dscovered 60 mles off ths sl on makng for port of Honolulu. HE DD NT G T AUSTRALA. Nothng s easer than to recommend a man to go to Australa. A dozen words or so out of your mouth you have done t. But for hm to act on your advce that s a gray horse of anor color. You see, Australa s halfwa y round world; to pull up stakes here go re famly, nterests, all s a job no man takes n h save for strongest sort of reasons. Yet that s what Mr. Emrys Morgan Prce, grocer tea merchant, of Trehaf Road, Hafod, S. Wales, was advsed to do by a doctor at Merthyr. Now, we dont say but that result, f Mr. Prce had gone, would have proved doctors judgment to be sound; but as t happened Mr. Prce came out all rght n end by just stayng at home. The facts are brefly se: n August, 1881, customary choral competton took place at Abergavenny, Mr. Prce attended. n some way he fals to state how, t doesnt matter he took cold. had a chll. When he arrved home at Dowlas he could scarcely brea. To draw hs lungs full of ar was qute mpossble. n fact, he felt as f he were suffocatng. f course, re was no more thought of sngng; queston was one of gettng breath enough to lve on. He at once tred that good remedy, mustard plasters, puttng m on hs chest perhaps on hs back between shoulder blades. They releved hm for tme, as we mght expect. But mustard plasters do one thng no more. They draw some blood from nflamed parts to surface; thats all. When y have set up a bt of mld y are counterrrtato done; y dont n get down to deep causes. And here re was a deep cause. We wll pont t out presently. There was a constant whstlng nose n hs throat, he says. You hear t n chldren when y have croup. t means that ar passages are contracted breath has to pass volently through a small orfce. Dsease has often strangled people to death that way. "Next," he says, "a volent cough set n. coughed spat up thck phlegm nght day." Ths meant more worse nflammaton, shows us spectacle of Nature tryng to get rd of product phlegm or mucus. But to cough nght day! Thnk of t What becomes of a mans appette sleep? You can magne. No wonder doctor at Merthyr was anxous suggested a change of clmate. Stll, Mr. Prce, as we have sad, remaned at home consulted or physcans, one at Dowlas one at Hafod. All doctors agreed that r patent was sufferng from acute bronchts, very properly treated hm for that. Yet somehow r medcnes faled to effect any real radcal good. That y were temporarly helpful we may not doubt But, you see, bronchts, once seated, s an obstnate progressve alment t has a tendency to take up new ground to get down on lungs, reason beng that lnng of ar passages of the lungs s all one thng. So an affecton of any part of t, HAWAAN GAZETTE: FRDAY, AUGUST 13, SEMWEEKL Y. f not cured, spreads lke fre n dry grass. "As tme went on," says Mr. Prce, " got weaker weaker my breathng became dstressng to hear. Harpers Weekly attempts to tell ts half a mllon of readers what facts are about mm graton dspute, between Japan Hawa. t means to make a correct statement but fals, own g, no doubt, to lack of suffcent nformaton on subject. t states that " rght to emgrate from Japan to Hawa was carefully guarded by treaty;" "emgraton laws were enacted by Japan, whch nstead of pro motng, prevented floodng of sls by Japanese;" "under ths arrangement guarded bv se laws, emgraton went on untl last February, when suddenly Hawaan Government re fused to permt some Japanese to. l, although, as Japanese Government clams, em grants came precsely as ors befoe m had come;" " clams for damages Aere made at once, but pendng negotaton crv was rased that Japanese had hostle ntenton aganst, sls, hastj coucluson of treaty followed;" "under se crcumstances, Japan has certanly rght to expect notce of ntended treaty, a rght to be consulted head n behalf of her people, to complan of decepton prac tsedby Mr. Sherman, who, she asserts, promsed that hasty ac ton should not be taken." Although Harpers Weekly, under nfluence of Mr. Carl Shurz, opposes project of annexaton, t does not ntend to present facts ncorrectly. But t has done so. We admt that treaty rghts, Conventon rghts, rghts labltes under our muncpal laws, on subject of mmgraton are rar confusng, have not yet been clearly stated for publc use. Nor has dplomatc correspondence been fully publshed, sources of nformaton are lmted. t would hardly be far to us, for Harpers Weekly to nfluence ts several hundred thouss of readers, untl t s n possesson of correct facts. We have been told that Ha waan Government commun ty wll not farly state case, must not be beleved. Ths s an error. A correct statement of case wll be made before long, law bearng upon t. The controversy nvolves some ponts whch lawyers would call delcate, but whch average layman wll dspose of n a breath. xne Amercan people were qute chagrned at Behrng sea judgment aganst m. WLL AMERCA GUARANTEE? The steamshp due on Sunday wll probably gve us text of Japans reply to our offer of arbtraton, whch may also contan proposton that Unted States be made a party to t, so far as. to assume oblgatons of Hawa, should arbtrators decde that she s lbale. Japan lolds that her clam for damages s a sort of len on sls, just as n a collson" at sea, a clam for damages aganst vessel n fault, s a len upon her, may be enforced n Admralty. Japan suspects that Uncle Sam may suddenly swallow sls, just as forgers when arrested sometmes swallow counterfet blls, are forced to take an emetc throw m up. Japan naturally feels that Uncle Sam wll close hs mouth, f he swallows sls, refuse any dplomatc emetc, unless he agrees, n advance, to take t f Japan asks that Unted States endorse Hawas note for any debt, t can only be done, through a specal treaty between two countres. To do that, would cause delay n our own negotatons. Presdent McKnley s.ys to Japan : "You know Uncle Som, he does about what s rght, yon just leave t to hm." Japan may be confdng accept offer. We hope ths wll be made satsfactory. Anyone can see that Japan wll hestate to arbtrate wth Hawa, unless she knows who wll pay shot n case to her. damages are awarded THE PRESDENTS WAR SPWEF. There s some confuson of opn on regardng probable acton of commer of Amercan warshps, n event of an "emergency" here, that s, should Japanese do somethng y ought not to do. The same confuson of deas prevaled, when Mr. Wlls demed restoraton of monarchy n December, 93, t caused great needless anxety sufferng. The Presdent of Unted States has no war makng power, under Amercan Consttuton. Hs dutes are clearly defned, no power of ths knd s gven to hm. Congress only has t. The Presdent has no authorty to l any marne force n a foregn State, because that act may be a war act. The lng of marnes n ths town, on several occasons, has been done, wth consent of authortes, or on some evdence of authorty. n event of a cvl war, or rot, a lng mght be justfed as a polce measure only, smple act of protectng lfe property n mmnent danger. The Amercan commer has no more authorty to l forces here, whch may nvolve war, n he has to l troops n France, n order to protect Amercans generally. f he has that rght, n Chnese have rght to l marnes n San Fran csco, n order to protect r peo ple aganst hoodlums. The great Powers take some chances n lng forces n ds turbed countres, but t s done only to protect ndvduals property. Congress alone may authorze an act, whch s n nature of a war act The Presdent mght, under certan crcumstances, act "decsvely," take chances of ratfcaton by Congress of any doubtful N or llegal proceedng. But Presdents of Unted States are not swft to take any chances of ths knd. For ths reason, Amercan Executve has been charged, for many years, wth permttng Amercans to be outraged n foregn countres. The moment Executve acts boldly or promptly n correctng a wrong, n a foregn country, he gets dangerously near exercse of war power. So State Department usually contents tself wth powerful correspondence. The framers of Amercan Consttuton ntentonally ted up hs of Executve n war matters. The people were, are, peaceful dslke fghtng, dsturbance of trade. t s seen n Cuban affar. They lke to abuse wcked Spanards threaten m wth vengeance, but when t comes to. very serous matter of spendng several hundred mllons n war, wth dsturbances n trade whch follow, y cool off very quckly. When Mnster Stevens estab lshed a temporary protectorate here, t was repudated by Government, whch had negotat ed a treaty of annexaton. t was beyond power of Presdent to antagonze t. Presdent Clevel was well aware that he had no authorty to restore monarchy. But he felt that a game of bluff would not.be unconsttutonal, we took hm qute too serously. n June last, n answer to a tele gram from ry Washngton, Labor Commssoner Ftzgerald, sent a full dspatch n whch he stated that "nnetyfv e per cent. of laborers employed n beet felds of Calforna were Asa tcs." Ths telegram was hed to a Senator who put t n hs pocket for furr use. xnar d, Two days afterwards, Mr. actve opponent of Hawa requested obtaned an n tervew wth benator. le stated that Amercan fanner could not compete wth those n Hawa who rased all of r sugar wth Asatc labor, urged Senator to vote aganst recprocty. There was a quet but emphatc antomme. The telegram from Mr. Ftzgerald, Mr. xnard read ng t. he Senator quetly look ng on, ntervew closed wthout furr comments. MMGRATN RESTRCTED. Government Notfes Ths Effect. Japan to The Government seems determned to take a decded st n matter of Japanese mmgraton, mpresson that any number of mmgrants from Japan may eome here must be wped out. n accordance wth a decson of Cabnet, Japan has been requested, through Mnster Shmamura, to re strct emgraton to Hawa, except such as may come under auspces of Board of mmgraton here. Ths means that laborers wll not be admt ted except those whose contracts have been approved by board, Japanese Matches. The London Daly Fnancal News says: Foregn matches, n future, n stead of beng suppled to us from Sweden, wll apparently come all way from Japan. The competton of rentals has already, t s sad, destroyed European match trade n nda, Chna Hongkong, wll soon assert tself n Unuted States. After supplyng r home market, Japanese can send 2,500,000,000 boxes to rest of world, Asa of course, takng most of surplus output. saka, where an Amercan syndcate has purchased one of numerous factores, produced last year 100,000,000 dozen boxes of matches, gvng employment to 3,629 men 9,711 women, besdes thouss of chldren, who earn a few sen per day n work.
