The Frawley Company sad ts last farewell to Honolulu last nght for the present seasona t least. There was a good house, a good play and a general exchange of courteses between the au dence and actors, whch ndcated that the Frawleys have been gven the warmest corner at Honolulu's theatr cal fresde. At the close of the ffth act T. Dan el Frawley made a very neat speech, n whch he expressed the grattude of hmself and hs colleagues for the pleasant recepton accorded them, and very gracefully mentoned the proba blty of hs returnng next year to renew old acquantances. He sad he would come f he found out that he was wanted. Mr. Frawley's suggeston was greeted wth applause whch needed no nterpreter to tell hm that Ho nolulu wll be ready for another treat and the theatergoer s wll buy up the house n advance when he names hs frst nght for the 897 season here. The play of the evenng, "The Jlt," by Don Bouccault, was well adapted to brng nto promnence the leadng peo ple of the company, who n many n stances gave way n prevous productons, so as to gve a far dvson of honors among the several very capable artsts. T. Danel Frawley, as Myles O'Hara, the young rsh gentleman, shone out as the brght partcular star, and hs nterpretaton of the part was to put t very mld, second only to that of Bouccault hmself. To those who have seen the playwrght, the splendd char acter of the true rsh gentleman, lost none of ts charm as portrayed by Mr. Frawley. Hs brogue has that slght touch of Emerald sle character whch s too often ndscrmnately enlarged upon and exaggerated by actors who thnk they know the upperclas s rshman. n hs facal expressons, and the lttle mannersms of everyday lfe, Mr. Frawley certanly has caught the rsh character to perfecton, and he s not lackng n depctng the erup tons of temper called forth by an attack upon the honor of hmself or hs rends. Frank Worthng made a very ex cellent Sr Budlegh Woodstock n the frst two acts, but for some reason fell short n the latter part. As the enthusastc brdegroom ust returned wth the new mstress of the house hold, he was qute equal to the neces stes of the occason. Wlson Enos (Lord Marcus Wyle), the vllan of smooth and ttled cloth, was qute a success, though some m provement could be made n gvng a more dstnctve Englsh to hs cue. Maclyn Arbuckle assumed the role goodnatureof d, the hearty, Col. Tudor, uncle to Sr Budlegh, and father of Geoffrey Tudor (George Lesle). Mr. Arbuckle's part dd not call for any extraordnary dsplay. Mr. Lesle carred hs favorte part of a young man n trouble and n love as well wth hs usual success. George Bosworth's Rev. M. Spooner brought down the house. As an eccentrc and not altogether straghtlace d ecclesastc, Mr. Bosworth s partcularly fortunate n hs portrayals. Harry Corson Clarke made what there was to be made out of James allrou nd Dasy, bookmaker and general gambler, but t s not a part to whch he s partcularly adapted. As the old man of somewhat hgher grade he s more successful. Among the lades of the cast there was a very far dvson of honors. Mss Hope Ross, as Phylls, a young woman of lowly brth, but true heart, was seen n a role that gave more scope to her capabltes than any part she has played durng the engagement. She came n for the usual amount of flghty, tomboy character playng, and was also gven an opportunty to brng out strong womanly characterstcs. At the close of the second act her voln solo was greeted wth a rousng encore. Her beautful rendton of the old rsh ar was a perfect complement to the pretty home scene wth whch the art closed. They have gven the New Hawaan Opera House a very proper "send off," and the people of Honolulu have a kndly aloha for the professonals who have shown themselves capable on the stage and courteous n socety. The twentythr d annual conventon of the Naton al Woman's Chrstan Temperance Unon opened today wth a greater attendance than any one prevously held. At least 500 accredted delegates were present and as many more vstors from every porton of the country. Among the dstngushed workers n the phlanthropc felds n attendance are Mss Agnes Hock of England, secretary of the World's Woman's Chrstan Temperance Unon; Mrs. Maud Ballngton Booth of the Amercan Volunteers, Mrs. Gwyneth, Vaughan of Wales, Mss Rebecca Krkoran of Armena and Rev. C, Nov. 4. Wth the excepton, perhaps, of Charman Mark Hanna, the electon of Mr. McKnley gave more satsfacton to the fve members of the Unted States Supreme Court, who voted aganst the legalty of the ncome tax than to any other men n the country. These dstngushed ursts regard t as a vndcaton of ther course and the upholdng of the dgnty and power of the supreme trbunal of the land. Two of these gentlemen are Democrats. Two members who voted aganst the decson are Republcans. Justce Feld, though commonly understood to be a Democrat, s partcularly pleased at the success of the Republcan tcket. The day after the electon he celebrated hs 80th brthday and new zest was added to the event by the electon returns whch came n durng the day. For 33 years he has been upon the Supreme bench, and could have retred 0 years ago had he desred. As the Court now stands Justces Harlan, Gray, Brewer, Brown and Shras are Republcans. Chef Justce Fuller and Justces Whte, Feld and Peckham are Democrats. Thus the Court stands fve to four n favor of the Republcans. Accordng to precedent, the successor of Justce Feld should be apponted from the Nnth Judcal Dstrct, whch the senor Justce now represents. He should also be a Democrat. But ths unwrtten rule has frequently been gnored and a Presdent usually apponts a Justce of hs own poltcal fath. Presdent Harr son brought down a smallsze d cy clone upon hmself by appontng Jus tce Jackson, a Democrat, to succeed Justce Lamar. Presdent Cleveland apponted Justce Peckham of New York to succeed Justce Jackson of Tennessee. t wll thus be seen that Mr. McKnley would have a precedent for gong outsde the Nnth Judcal Dstrct to select a successor to Justce Feld. A number of men have been suggested as qualfed to fll the vacancy whch, t s certanly expected, the noted Calforna urst wll make on the Supreme bench upon the advent of the Republcan admnstraton. The favorte s Senator Cushman K. Davs of Mnnesota. Mr. Davs has also been suggested for a Cabnet poston, but t s admtted that hs fne udcal mnd better fts hm for a poston on the Supreme bench than for a Cabnet poston. He s a close student, a fne classcal scholar and would no doubt be the peer of any man on the bench. He has a bg practce before the Supreme Court, and s thoroughly n tranng and up to date on all legal matters. The graceful manner n whch he retred n favor of Ma. Mc Knley from the contest for the presdental nomnaton puts the latter under consderable oblgaton to hm. He was also largely nstrumental n makng Mnnesota and the Dakotas safe for the Republcan tcket., t s possble that Senator Davs mght prefer a Cabnet poston, but the honor and dgnty of a place upon the Supreme bench would be far greater than the temporary tenure of a Cabnet offce. The nterpellaton whch s to be ntroduced by the Radcals n the Rechstag on the murder of Herr Selberman by.lcut. von Brusewth at Carlsrhue, and other mltary outrages and scandals, has been set down upon the order of the day for Monday, and wll be submtted after the nterpellaton of the centrst upon the revelatons made by Prnce Bsmarck through the medum of the Hamburger Nachrlchtcn, and t s probable the whole of the week wll bo occuped by ferce debates on both motons. The Centrst moton s ho phrased as to endeavor to nduce the Government to dsclose.the nature of the treaty exstng between Germany and Russa pror to 890. and to explan why t was permtted to lapse. Although the debate on the Centrst moton n regard to the treaty wll be of great mportance, perhaps stll greater nterest attaches to the debate on the mltary reform measures whch wll arse from the Radcal nterpellaton. The mystery connected wth Leut, von Brusewtz's sentence of four years' confnement a fortress and dsmssal from the army, the subsequent denal that he had been condemned, the report that hs Colonel set hm at lberty, rearreand only caused hs st upon orders of hs (the Colonel's) superors, and the other stores of abuse of solders by oflcers requre explanaton, and the Radcals mean to have t f possble. n an artcle on the subect, the Tageblatt says that the Emperor, after speakng to the recruts on the occason of ther beng sworn n on Thursday, addressed the offcers serously n regard to the alleged mltary outrages upon cvlans, but purposely spoke n so low a tone that hs remarks were only audble to those mmedately sur roundng hm. When Superntendent Gllespe of the Mutual Telephone Company arrv ed here four months ago, and n an ntervew stated that "to rd the wres of nducton, was the least of hs troubles," he dd so, ether wth a Pckwckan sense of humor or through gnorance of the condton of affars. The Telephone Company had been payng dvdends and to do so expenses must be cut down. The plant could not be mantaned at a hgh standard of excellence and pay dvdends; the stockholders were to be conclated. Then the subscrbers, and even the subscrbers who were stockholders began to kck and conclaton was agan needed. The offcers fnally determned that the best way to earn money for the stockholders was to mprove the servce for, to use unclass cal an expresson, the servce was rotten When t s mproved there wll be more subscrbers and the wear and tear on the operators and the nstruments wll be materally dmnshed "The mprovements are to be made,"! sad Mr. Gllespe, "wtnout regara to expense. Peterson was one of the ont and several makers of the note declared upon, but he s not mentoned n the declaraton, nor s there anv excuse on suggeston n the declaraton why he was not oned. t s a general and famlar prncple of the common law that where three or more persons execute a promssory note, who contract ontly and severally, they may be sued severally n separate actons, or all ontly one acton. But the credtor cannot sue two and omt the others, for n such case they are not sued ether ontly or severally, as they promsed. n the case before us the defendants sought to be held upon ther ont oblgaton. Counsel for plantff contend that nonond er of a necessary party should be taken advantage of by a plea n abatement, and ths would gve the plantff a better wrt by dsclosng the names of partes who ought to be oned. And f ths plea s not made t wll be consdered as waved. Ths s good law f the declaraton does not dsclose the absence of a proper party. But where on the face of the declaraton t appears that a person not made defendant was a ont contractor wth those who are defendants n the sut, there beng no averment of any reason why such person s not oned, nonond er whether the may be taken advantage of by specal demurrer or by plea n abatement, t s not necessary here to decde. The better practce would be to aver the death of Peterson. But n ths case the defendant Larsen dd not demur on the ground that t appeared on the declaraton that Peterson had sgned the note and was not made a party, but merely that there. was a varance between the declaraton and the note sued upon. But as the note s made a part of the declaraton, the declaraton must be read as f the note was ncorporated n t, and there can be no "varance" between one part of the declaraton and another. The demurrer was properly overruled. Havng gone to tral, the verdct, authorzng udgment aganst Larsen and Hopkns alone, has cured the defect. There s some authorty apparently n favor of holdng that a defect of ths character may be reached by a moton n arrest, notably (llman v. 'Yrv, 0 Pet. 20$. But a dstncton s drawn fn that case that where the declaraton s drawn to recover upon udgments, recognzances and other matters of record, and the defect of s apparent on such record, a moton n nonond er arrest of udgment would be good. Another large and nterested audence lstened to Dr. Ryder's lecture yesterday afternoon. The doctor spoke for an hour and three quarters wthout showng the least sgns of fatgue, and the lades lstened wth the closest at beng constantly renewed, and t? method of repar was by the food taken nto t. Food suppled the waste materal, the heat and strength of the body. The queston of scentfc food was beng largely consdered n Europe and Amerca, and cookng schools were to be found n nearly every cty. Regularty wth regard to eatng was most essental to health. The process of dgeston was descrbed as wtnessed upon an Hungaran woman patent n Prof. Blrotte's clnc n Venna. Hurred meals were strongly condemned. Dr. Ryder sad that the Buddhsts. Mexcans and Brahmns were vegetarans, and she had no hestancy n sayng that the people n ths warm clmate would have better health f they would decrease materally the amount of meat eaten. Many persons suffered from not takng a suffcent amount of mosture nto the system. She advocated a drnk made from grape uce as well as other fruts. At the close of the lecture a number of wrtten questons that had been handed n by members of the audence were read and answered, one of these beng: "s Dr. Ryder a Theosophst, as OF THE FRAWLEY COMPANY, announced n one of the local papers?" Morrow yesterday awarded Joseph Peterson and four other seamen $ each damages, says the S. F. Examner of Nov. 5. Peterson and the other salors shpped n the Vkng for a cruse to the Fannng slands. When Kusae was reached the Captan ordered the supply of bread greatly dmnshed, and substtuted a mxture of flour and copra. The men protested, and as a penalty had sugar cut off the bll of fare. They had to down ther coffee wthout sweetenng, and to eat ther salt meat wthout the ordnary allotment of vnegar or lme uce. Other hardshps were mposed upon them and when they returned to ths cty they sued J. F. Cunnngham & Co., the owners of the vessel, for damages as provded for by the Unted States statutes. Judge Morrow n decdng the case sad that from the testmony of the cook one would be led to suppose that the crew actually suffered from starvaton. " fnd," sad the Judge, "that the allotment of bread was reduced onethr d, and.the allotment of sugar reduced n the same proporton. Wlder hauled over alongsde the Nuuanu street wharf yesterday for the purpose of dschargng the remander of her cargo. The barkentne S. N. Castle fnshed wth her cargo of general merchandse yesterday and moved up to Allen & Robnson's wharf to dscharge her brcks. The Claudne, on the Knau route, returned from Mau and Hawa ports yesterday afternoon. She brought a large number of passengers, and her usual cargo. The Mkahala got away for Mau and Hawa ports on the W. G. Hall's route about half an hour late yesterday mornng. She was n charge of the W. G. Hall's offcers. Old thngs must pass away and gve place to the new. The old nterslan d wharf offce wll be torn down as soon as the new one, now beng erected on the ste of the store room, has been completed. The new one wll be very much of an mprovement over the old n pont of convenence. WHTE ROSE ARRVES. Two Salors Arrested for Msconduct Aboard the Vessel. The Norwegan bark Whte Rose, Aaroe master, arrved n port yesterday mornng, 59 days from Newcastle, N. S. W., wth a full load of coal. Shortly after her arrval n port two of the salors, a Norwegan and an Englshman, were arrested and brought ashore to the polce staton t seems that the Englshman refused duty ust after arrval, but the unruly actons of the Norwegan dat ed back for a much longer perod When about three weeks out ths ndvdual took t nto hs head to be very nsolent to the Captan, and was ordered forward. The Captan says he went there and remaned a month or untl arrval n port. He dd not say anythng further on. that pont, bu hs remark was, to say the least, sug gestve.
