The acton came after Arthur E. Fosse, engneer for Beechwood stated he would fle the plan wth the Town Clerk, and have t regstered despte the board's refusal to sgn t. Fosse sad he could take the acton because, although the board had twce refused to sgn the plan, and a covenant attached to t. those refusals jcame after the deadlne for board acton had passed. He sad that the board's orgnal 3-2 approval of the plan stll held. - After the ntal approval, no one appealed the plan durng the 60-dav perod the board had to act on t. and the plan went back to the board for sgnng Relate Sgnng At that tme board members Edward A Flanagan and George B. Donovan refused to sgn t because t lacked, among other thngs, sdewalks on one sde of sub-dvson streets. Charman Joseph Doherty and Frederck H Baldwn Jr. voted to sgn the plan, but because board member John J Cooney was absent, the vote was 2-2. A majorty s needed for approval of a plan The splt vote was repeated Monday nght, as Cooney was agan absent. Baldwn protested Flanagan and Donovan's refusal, statng that by not sgnng the covenant the board would lose control over the sub-dvson. The developer, he sad, could obtan buldng permts wthout Plannng Board approval. Urges Stgalag Doherty also urged sgnng of the plan and covenant He admtted dssatsfacton wth the plan, but sad the board should sgn t because the deadlne had passed Flanagan countered by movng that the board reject ts earler approval untl the sub-dvson met all board rules and regulatons. Baldwn commented The board then voted to ask the town counsel for an opnon on the matter. Sesame Street The board voted unanmous approval of a plan for the Sesame Street subdvson off Whpple Road on condton that the developer. Unfed Land Development Corp. present a ste plan to the board pror to ssuance of buldng permts. The sub-dvson ncludes 12 lots ULDC was also granted an excepton allowng the frm to forego presentng blans at the meetng that would show the locaton of every tree of four nches n dameter. Mles J. Mahoney. vce presdent of ULDC. orgnally asked an excepton from rules requrng the ste plan. The board agreed only to requre the plan pror to ssuance of buldng permts after Flanagan sad. The Tewksbury Board of Health dscussed the need for a full-tme health agent for the town Tuesday nght. Part-tme health agent John Flemng Jr. wrote the board that health problems were ncreasng wth the town's rapdly-growng populaton. "The town should as soon as possble have a full-tme competent health agent." he added. Charman Everett F Penney Jr commented, " thnk ths year we should exert some knd of effort to get a full-tme health agent." He suggested askng the League of Women Voters, the Fnance Commttee and others to support the need for full-tme health protecton. Penny sad the part-tme agent's salary and present funds from other health areas mght be used so as to fund hrng of the full-tme man wthout ncreasng the town budget.
