The Wlmngton Plannng Board s proposng strcter zonng regulatons, wth whch many parcels of land cannot conform, and the proposals are beng ressted. Callan proposes that there be a type of zonng to take care of those busness lots along Man Street, to be called Central Zonng. n ths way, he sad Monday nght, the Plannng Board can pursue ts studes for a strcter zonng for new busness lots, wthout forcng the older lots nto a non-conformng status. The dscussons took place Monday nght, durng the Wlmngton Fnance Commttee hearngs. The Plannng Board dscussons, whch were vocferously argued, were not the only tme takers durng the 3V hour publc hearng, whch ended after 11 pm. There was a lot of dscusson about the Alderwood Estates n East Wlmngton, and of the old Harnden Tavern, both of whch are proposed for emnent doman takngs. Each artcle n the specal town meetng of next Monday was dscussed - and there are 28 artcles. Alderwood Estates The meetng, by declaraton of Charman Arthur Spear of the Fnance Commttee arrved at a common opnon that the beat thng to do s to take by emnent doman the controversal 30 lots of Alderwood Estates, n East Wlmngton. Only Selectman James Mcell was opposed. Mcel, who was one of the earler speakers, warned that t would be almost mpossble to ascertan the cost of an emnent doman takng. Tre argument was practcally demolshed by Arthur Hardng, chasms* «t UK Plannng Board and Frank Ottatl of the Conserva ton Commsson, plus a few other persons who demonstrated an economy to the town n makng an emnent doman takng. Otut, h part, sad that the takng of the land for the purpose of protectng the qualty of lfe would be a good nvestment. The town could be gven a 50% rembursement by the state he sad, and f subsequent court proceedngs ncreased the prce there could be a subsequent ncrease n the state's half of the mones. He demonstrated to the hearng that, at a prce of $60,000, the town would be payng $30,000 or about $1000 per lot for the land. Ths, he sad would be cheaper than allowng homes to be bult. Ottat sad schools, etc. would cost the town $1,000 per home per year, and that a buyng of the land now would mean a payment of only $1,000 once. John Majesk, actng Town Engneer, descrbed the land and the water easements. The water on the land, he declared, "could only go up". Arthur Hardng, who s town engneer for Sudbury, went through the hstory of the acquston of the property by the Drnkwater brothers, the present owners. They had bought the property for $25,000 and mmedately token out a $15,000 loan from the bank. Pror to that the bank bad foreclosed on a mortgage for $33,200 Hardng sad. A good house lot n Wlmngton s worth over $5,000 accordng to Hardng. Hardng stated Unwllng purchaser Capt. Larz Nelson of the Town Crer s the person who seeks to buy 2800 square feet of land from the town under Artcle 2. He told the Fnance Commttee that he s an "unwllng purchaser", and has to buy the land to protect hs nvestment n land whch he bought n a General Busness Zone, and s now non-conformng, due to Plannng Board acton last year. Hs purpose n seekng to purchase the property s to make hs busness lot conform to the new zonng regulatons, actual and proposed under Artcle 13. He has no use for the land, be told the Fnance Commttee, whch s now beng used by nght tme parsers Ownng the land would mean more beer bottles to pck up. RS Collectons The Town of Wlmngton wll become a tax collector for the nternal Revenue Servce f Artcle 3 s voted n the Town Meetng The nternal Revenue, Town Manager Sterlng Morrs told the Fnance Commttee, s nsstng that the town collect the mones earned by polcemen on off-duty status, drectng traffc or other jobs, and wthhold that porton due for ncome tax. The companes are payng the polcemen drectly, at ths tme, Morrs sad. Charman Arthur Spear handled the matter lghtly, but Morrs was not to be descrbed as happy Morrs sad the town had been advsed t was a volaton of the Federal code and the town would have to vote for the artcle. Mll Brook Culvert Subject for dscusson n the town meetng of Monday wll be Secton 29 of Chapter 91 of the General Laws, whch the Town Manager wants the town to accept. t must be accepted, he told the Fnance Commttee, f publc works are to be performed along Mll Brook, whch crosses the Boston t Man adn Man Street near the Wagon Wheel restaurant, and further down at the Lawrence (Wldcat) branch of the ralroad. Town Engneer Majesk sad a $ project s planned, usng a lot of state funds, for dredgng the brook, and buldng new box culverts. Only a part of the cost wll have to be borne by the town. Money Artcle 5 and 6, Morrs told the Fneom. wll be to accept money from the state n payment of town owned land that was taken for the rght-of-way fro the new brdge, soon to be bult over the Boston & Man Ralroad. Morrs recommended approval of Artcle 8 too, whch s to enable the town to borrow more money. The cost of borrowng money has gond up, he reported, as a part of the general nflaton. The money to be asked for s for the 1974 nterest accounts. Boudreau has predcted Tewksbury's lax rate wll be at least $201, not countng ncreases needed to pay for any authorzatons made by the June 25 specal town meetng Boudreau told hs commttee June 20 that hs estmate was partly based on a $33 mllon tax base for 1(73. based on l(72's fgure of $31.7 mllon, and authorzatons made by the March town meetng. Other factors n hs estmate, Boudreau sad, were already announced state Cherry Sheet tax rembursements to the town and hs own hope water department recepts and other sources of funds for the town wouldn't be below those of Boudreau sad he couldn't predct f town assessors would set the tax rate before the Juae 25 specal town meetng, when $1.5 mllon more n bond ssues and appropratons wll be consdered by voters. f the fnal tax rate does take the specal town meetng's appropratons nto consderaton, and the town meetng approves artcles backed by the fnance commttee, the tax rate should jump another $5. A dollar on the tax rate, based on 1S72 assessments, would represent $33,000 n expendtures. That fve dollar estmate s also based on 1972 assessments, whch won't be n effect for the comng year. Reassessment of the town s complete, and the tax rate set by the assessors wll reflect new valuatons. An estmate taxes would jump, from 1972's $176 tax rate to $206 n 1973, based on 1972's assessments, does gve an dea of the degree of a tax hke on a general level. TEWKSBURY TOWN MEETNG JUNE 25 Fnance commttee backs water artcle The Tewksbury fnance commttee has voted to back a specal town meetng warrau artcle to provde (1.3 mllon to meet the town's water needs for the next decade. The Commtteemen may vote pror Readng Town Meetng n March to the meetng to amend another approved takng of land for ths artcle to allow a possble cut n staton whch should be n servce polce workng hours, by early Artcle 3 n the warrant would authorze $980,000 for a fully equpped water treatment plant, and $510,000 to develop new wells and lay new mans. The water commsson has stated the mprovements are needed to keep pace wth the town's growng populaton. Federal funds ncluded The commttee voted 5-2 to support the artcle, and to authorze $200,000 n federal revenue sharng funds be used mmedately for the treatment plant. Most remanng costs of the plant and other water mprovements would be pad for wth bond ssues. Commtteemen Lyle Wynans and John Budrewlcz were opposed to the acton. They questoned whether the plan wasn't a shortterm soluton that would cost the town more n the long run. Charman Norman O. Shortly after that a garage worker dropped a tre ron and badly lacerated hs head He was off to the hosptal. PLANNNG BOARD SETS SUMMER SCHEDULE A summer schedule of meetngs has been approved by the Tewksbury plannng board. Meetngs wll be held at 8 p.m. June 17. July 9 and 23, and August 6 and 20. Planners expect they may need to hold several other meetngs as the need arses. NOTCE TO RESDENTS The Wlmngton Boosters have not gven permsson to Tme-Lfe, nc. to solct the town on behalf of the Boosters Assocaton. the orgnal bond ssues would have cost the town $163,000 n the frst year. Usng the federal funds to cut one bond ssue, however, would reduce the total frst year's cost of the ssues to $151,000. Artcle 9 on the warrant asks voters to support legslaton to allow the state Department of Publc Health (DPH) to gve the town 90 acres of state hosptal land for a hgh school ste n return for free sold waste dsposal servces. DPH cause of request Permssve legslaton was approved n 1972 to allow the DPH to gve the land to the town f t chose to. Snce then the DPH hasn't gven the land to the town, and has sponsored new legslaton. The new legslaton would repeal the 1972 acton, and would replace t wth permsson to make a new agreement. The new agreement would gve the town the land, but only f the town provded the state hosptal free use of sold waste dsposal facltes wthn the town forever. Commtteemen opposed supportng the DPH's bll for three reasons. They beleved f the 1973 acton sn't approved by the legslature, pressure can be brought on state offcals to make them gve the town the land under the unrepealed 1972 legslaton. Fear waste costs Other factors n the commttee's decson were a fear waste dsposal costs mght quckly ncrease to outrun the $250,000 estmated value of the 90 acres, and concern "wffame vmhln the town Members ponted out the town mght have to shp wastes beyond town borders eventually. Artcle 12, whch would provde funds to survey, engneer and pay legal fees to partly clear road and boundary lne problems n South Tewksbury, also met commttee opposton. Artcle 24. whch would provde a 37.5 hour work week to town polce, won't nclude a recommendaton by the commttee unless Boudreau proposes an amendment at a fneom meetng just pror to the town meetng. Would allow BegotalloM After the commttee splt 3-3 oh supportng or opposng the artcle, Boudreau, who ddn't vote on the matter, sad he would offer an amendment to allow the selectmen and polce to negotate the matter. Boudreau sad the amendment would allow a personnel bylaw change requested by the polce, but only f the selectmen and polce agreed to such a change through negotatons. Artcle 7 would request legslatve approval to hold a referendum on repealng or retanng the town's past approval of a state law gvng polce seven day weeds as a bass for ther vacatons. The commttee supported the artcle. Voters wll be asked at the town meetng to spend $19,050 to'move the hstorc home, excavate a ste and construct a new foundaton for t there. They wll also be asked to approve any school commttee agreement to transfer land on the Foster School grounds to the hstorc commsson for a ste for the buldng. The fnance commttee has recommended artcles to provde for the movng, reconstructon and land transfer be ndfntely postponed (klled). Members questoned whether the home was of real hstorcal sgnfcance, and whether ts value was equal to that of sports and other programs. Fneom Charman Norman O Boudreau was the only commtteeman to back the artcles He sad the buldng was of hstorcal nterest, and lttle of hstorcal value was left n the town. The Wamest Lodge. Af & AM. has offered the buldng to the town free provded the structure s moved from ts present ste n the Tewksbury Center trangle. The buldng was used untl recent years as the Masonc lodge. A gas staton s slated for the ste wthn months, and the buldng wll be torn down f the town doesn't move U Mrs Kelly told the school commttee June 13 that the buldng could eventually be used to house the town's archves, whch are scattered throughout several town locatons. The buldng also has space for a possble town museum and offces for her commsson, she added. The buldng was once the home of a member of the leadng famly n the town durng the colonal perod, the Kttredges. Members of the famly served on almost ever town board durng the 1Mb century, and were key mast n the PAGE TWELVE

Mr. Barton, who was born on November 17, 1883 n Brookeld, New York was the son of the late Hram R. and the late Harret L. (Bennett) Barton. He had resded n the upper New York State area the greater part of bs lfe before movng to Wlmngton V years ago. Pror to hs retrement, Mr. Burton had taught n the Dstrct S School Systems n Westchester County, New York for over 35 years. He was a past offcer of the Peekskll Area Retred Teachers Assocaton and a member of the New York State Retred Teachers Assocaton. He also held membershp n.o.o.f., Brook feld. New York, Loyal Order of Moose, Utca. NY. Lodge No 450. He had served as Dstrct Supervsor for the Boy Scouts of Amerca. Westchester County and Deacon for the Dutch Reform Church, Montrose, New York. Mr. Burton was the husband of the late Dorothy C. (Sonker) Burton and s survved by hs son, Rchard H Burton, ST.; and hs grandson, Rchard H. Burton, Jr. both of Wlmngton. Mrs. Hggns, who was 68 years of age at the tme of her death, was born n London, England, the daughter of the late James E. and the late Laura (Claxton Rutherford. She had lved n Canada durng her youth and had been a resdent of Melrose for over 30 years havng resded on sabella Street pror to movng to Greenwood St., a short tme ago. Mrs. Hbbns, who was a regstered nurse, was a graduate of the Chelsea Memoral Hosptal and had been employed for many years at the Melrose-Wakefeld Hosptal untl her retrement three years ago. She was the wfe of the late J. Allan Hbbns, Sr. and s survved by her two sons: J. Allan Hbbns, Jr. of Readng; Stanley R. Hbbns of Wlmngton; her two daughters: Mrs. Frederdk (Jane M.) Hll of York. Mane and Mrs. Paul (Martha J.) Wasnor of Woburn; her brother. Edward Rutherford of Syracuse, New York; her fve ssters: Mrs. Laura Van Cott of Mlls. Nugent, Sr., husband of Anna D. (Scott) Nugent of 80 Brown St., Tewksbury, ded unexpectedly at a Lowell hosptal June 13. A funeral mass was held for hm June 16 at St. Dorothy's Church, and nterment was n Tewksbury Cemetery. Born n Cambrdge, February 21, 1906, he was the son of the late Wllam B. and the late Mary (Kelly) Nugent. He was a Tewksbury resdent for the past 32 years, and was a member of St. Dorothy's Church n Wlmngton. He was a truck drver for the Caples Truckng Co. n Cambrdge for 43 years, and was an employe of the Lordan Brothers Truckng Co. n Cambrdge for two years pror to hs retrement n He was a member of the Teamsters Unon, Local 25 n addton to hs wfe, he s survved by two sons, George G., Jr., of Plastow. PATRCA SULLVAN KLLED N NEW YORK The body of Patrca A. Sullvan, daughter of Mr. and Mrs. Henry F. Sullvan of Gunderson Road, Wlmngton was found, Tuesday afternoon, n her dormtory room at the C.W. Post College, n Greenvale, Long sland, N.Y. The news of her death shocked the people of Wlmngton. The young lady was well known and popular, a 1970 graduate of Wlmngton Hgh School, who had lved the normal lfe of a person of her age. Born n 19S8, she bad fnshed her junor year at the College, and had planned to stay at the college for the summer. The Newsday, newapaper on Long sland, New York, sad that she had been ted hands and feet, and had been stabbed 21 tmes n the stomach and abdomen. The Chef of Detectves told Newsday that three knves had been found n the room, one of whch was a steak knfe. The medcal examner sad that the wounds could have been nflcted wth such a knfe. Mane to study the seashore. A scuba dvng team under the drecton of Dck Huggns and Bob Radopp learned the fundamentals of Scuba equpment and took a short dve to observe underwater sealfe. A second group, under the drecton of Dan Sprlggs and Pat Bennett studed seashore lfe. Students n ths group collected and dentfed plant and anmal lfe common to all New England shores. The Am of the League of Women Voters Only a few days ago the Massachusetts House of Representatves voted for a queston on the 1974 ballot, askng whether or not the sze of the House should be reduced from 240 to 160 members. Ths s wdely regarded as a vctory for the League of Women Voters. The voter, bulldozed as he has been by a hgh pressure propaganda machne, wll probably vote to reduce the sze of the house, and thereby be robbed of a part of hs brthrght. The lades, by dnt of hard work, have succeeded n convncng the people of ths Commonwealth that the state should be changed. t wll be a mstake, and the handwrtng now seems to be on the wall for at least one more paper - a Boston paper whch also seems to sense that thngs are wrong wth the proposal of the lades. The League of Women Voters n Massachusetts are commtted to the dea of pressure poltcs - the thng that any thnkng ctzen abhors. There s, f the reader wll remember, safety n numbers. The ancent Athenan jures had 512 jurors because 257 was an awful large number of people for even a rch man tq brbe. Wth 240 representatves, nstead of 160, the same safety factor s n the nterest of the people of Massachusetts,.e. t wll be more dffcult for the lobbysts to do ther work, and the average voter can feel more secure. But that s only a pont, and not the most mportant one. More mportant s the representaton of the voter. Ths can be better acheved by more people, not fewer. More representatves can better respond to lots of factors that are mportant - ethnc questons, the needs of the communtes, etc. From a standpont of representaton t s wrong to lump together a bunch of "suburban" communtes wth a "core cty". Those communtes are worthy of representaton. Ther vewponts are dfferent from those of the core ctes. The presdent of the League of Women Voters of Andover s an argument n ths case. She went nto the state house and told the legslators that Andover deserved representaton, and just shouldn't be a part of a greater Lawrence dstrct. The lady s rght. Mr. Boylen hat been partcularly crtcal of toe water rates charged to ndustry, whch he says should be ncreased to allow more money for the Water Department. Most of the dscusson came at the last part of the evenng together wth a dscusson of Artcle 28. Blake was ready to agree that the town does have a problem wth what he termed drty water, and the answer, he sad, was not smple, because of the "ancent ppes" n the water system. All of a sudden, one hot day last June, when everyone had ther water sprnklers on, the problem started, Blake told the hearng. He descrbed how the water department has tred to flush all the "dead ends", and went on to declare that flushng was not a complete answer to the problem whch was caused, he sad, not by an ron rust, but by sort of a flux. Selectman Boylen dsputed the statement about two parts per mllon. He had, be sad, added a drop of acd to some Wlmngton water and found 1000 parts per mllon. The ndustral rates, he sad, were lower than the correspondng rates n surroundng towns. Blake agreed wth Boylen that the water rate for ndustry s lower than n surroundng towns. The settng of the rate, he sad, was governed n part by the ease wth whch the water was delvered. Wlmngton ndustral users use two thrds of the water supply, and pay one thrd of the cost. He went on to say that Avco s now takng water from the brook, for ts coolng systems. Speakng more on the "rust" problem Blake sad t was n the outlyng areas, and was not a "contnual constant thng". These men rsk ther lves every day and nght only to have people gossp and fnd fault wth every move they make. Prvate as well as when on duty. personally thnk f you all took a good look at yourselves and lsten to your own remarks you'd do yourselves a favor. Where to these kds who are n trouble constantly usually get the dsrespect for the law? At home. Parents talk n front of them about everythng and anythng. Then the parents wonder where the chldren heard such awful thngs. They have no respect for law offcers or ther own husbands and wves. How can they blame outsders? have had several occasons to see the Wlmngton Polce Dept. at work snce 've lfed here, and and my famly, say tbey are the best. Mrs. Davd Johnson Dear Captan Nelson: The resdents of Alderwood Estates and West Street have banded together to ask the town to purchase the land that was to be "Alderwood 3" at the Specal Town Meetng on Monday June 25, 7:30 P.M. at the Hgh School Audtorum. Support for our cause hat been pourng n from many part* of town, as well as from town boards lke the Conservaton Commsson and the Plannng Board. Snce the current owner of the land purchased t from the bank, who had taken t over when the frst owner went bankrupt, be has been preparng to buld 29 homes. The fllng and development of ths land would cause severe water problems for the homeowners of both Alderwood Estates and West Street. As one resdent put t: "We mght as well all go and out buy boats now." Asde from the water problems for the people of the area there are the addtonal problems for the rest of the town attendent upon buldng more homes. When he came to Wlmngton and bult there was an oak tree on the corner, a whte oak, and Rocco - well be couldn't adopt t, but he thought t was a nce tree. t was probably over 100 years old, a sturdy specmen. For over thrty years now Rocco has been "protectng" that oak. No one was allowed to cut that tree!. Fred Can began to plan a brdge over the ralroad, to replace the Shawsheen Avenue brdge. When t turned out that the new brdge was to be rght near the restaurant "old" Rocco was very much concerned. He called on Fred - that tree has to stay!
