1 Minutes of 41st meeting of the Empowered Committee held under the Convenership of Principal Secretary, Finance Department on Subject: Regularization of Adhoc/Contractual/Consolidated employees. Reference Jammu & Kashmir Civil Services (Special Provisions) Act; The Empowered Committee held its 41st meeting on under the Convenership of the Principal Secretary to Government, Finance Department. Secretary, Education Department Convenor Member Member Secretary Member Representative Representative Representative (viii) Under Secretary, PHE/&FC Department Representative (vix) Under Secretary, Health & Med.Education Department Representative One hundred and twelve (112) review cases of adhoc/ contractual/ consolidated employees of different Departments were placed before the Empowered Committee for scrutiny in the meeting. 2 Out of one hundred and twelve (112) cases, the Empowered Committee found one hundred and eight (108) cases eligible on the basis of documents, certificates furnished by the concerned Departments. The cases cleared by the Committee are, however, subject to verification of genuineness of certificates/appointment orders and other documents provided by the Department. One case of Forest Department was found ineligible and three (3) cases were found deficient on account of certain information/ clarification or documents from the concerned Departments. The Members/ Representatives of the concerned departments who were present in the meeting were advised to expedite the requisite deficient information / documents in these cases so that the Empowered Committee could decide these cases as well. Abstract details are given in Annexure "A" to thpc::p mini 1tPC:: The case of Ms Rabia Shah (Legal Assistant) Forest Department figuring at 38th ECM S.No. 1, was also placed before the Empowered Committee. t was decided that the Department should refer the case to the General Admn. Department with the observation that the case does not fall within the purview of the J&K Civil Services (Special Provisions) Act, 2010 and as such Empowered Committee has no mandate to decide the same. The case of Ms. Shaheena Rasool (Contractual Computer Assistant) which was earlier cleared and recommended by the EC to the concerned Department for issuance of regularization orders as per the Act. However, Department has again referred the case to the EC for review in view of the objections. During deliberations, the representative of the Department stated that the incumbent has been adjusted against the post of Computer Assistant in the year Thus, the Empowered Committee decided that Ms. Shaheena Rasool shall be eligible for regularization in the year The Department is advised to resubmit the case of the incumbent as and when she completes 7 years of service to the Empowered Committee for consideration. Accordingly, the earlier decision/recommendation of the Empowered Committee conveyed to the Department vide O.M No. PS/DC/Misc-59/12 dated: , shall be deemed to have been annuled.
