That discussion has come up numerous times in my family, so it likely has in others. To answer that question I am using an article in Catholic Answers magazine titled Is Friday Penance Required? as my reference for this bulletin article. The 1983 Code of Canon Law (1251) states that abstaining from eating meat is to be observed on all Fridays according to the prescripts of the conference of bishops. Canon Law 1253 goes on to say that the conference of bishops can determine more precisely the observance of fast and abstinence as well as substitute other forms of penance. In 1966 the U.S. bishop s conference had previously written On Penance and Abstinence that: 1. Maintains that Friday itself remains a special day of penitential observation throughout the year (a time when those who seek perfection will be mindful of their personal sins and the sins of mankind), 2. Encourages Fridays of each week of the entire year to be something of what Lent is, and urges all to prepare for that weekly Easter that comes with each Sunday by freely making of every Friday a day of self-denial and mortification in remembrance of the Passion of Jesus Christ, 3. Even though we (bishops) hereby terminate the traditional law of abstinence as binding under pain of sin, as the sole prescribed means of observing Friday, they still give first place to abstaining from flesh meat. We (bishops) do so in the hope that the Catholic community will ordinarily continue to abstain from meat by free choice The big legal change comes in norm 3 above, where the bishops state that we (bishops) hereby terminate the traditional law of abstinence as binding under pain of sin, as the sole prescribed means of observing Friday, so the obligation to abstain from meat was terminated. The big question becomes: What obligation, if any, did the bishops put in its place to replace it? The phrase as the sole prescribed means of observing Friday could imply the imposition of some other form of penance as a replacement, as argued by some in my family. Throughout the bishop s document the language is of exhortation ( we urge ) rather the language of mandate ( all must ). One thing I learned in my Canon Law class in seminary was that if there is an obligation to do something it will be clearly stated as such, something like: though we have terminated the obligation to abstain, the faithful are nevertheless bound to perform a penance of their choice on Fridays such that the Catholic practice of Friday penance remains in place even though the form penance takes is now left to the determination of the individual, and such a statement is nowhere to be found. Per my seminary professor, the fact that the bishops do not state an alternative obligation indicates that one does not exist. This also seems to be the understanding in the Canon Law Society of America s New Commentary on the Code of Canon Law. The commentary on canon 1253 summarizes U.S. obligations and recommendations without indicating that a legal obligation to do penance continues to exist on Fridays outside of Lent and Good Friday. While the obligation to abstain from eating meat is no longer required, it is
