A federal case said "leeward", as used here, meant to the outside of the islands, or leeward of a ship. The words "thence following the Forbes line to the place of beginning" have been changed to read "thence following the Forbes line until it crosses the waters of the Apalachicola river; thence northerly along the thread of said river to the place of beginning." 35 1919; 2, ch , 1927; RGS 2692; CGL Revision Note: Subsection "Second" of 2692 RGS provides that it shall be "grounds of challenge for cause" if a person called for jury duty "has served as a juror in the court in which he is called at any time within one year when no regular terms of court are held, or at any other time within one year where regular terms are held". This provision has not been expressly amended or changed since the adoption of the RGS. At the time of its adoption 2772 RGS, which. related to the selection of the jury lists, made no mention of the above mentioned "grounds of challenge for cause"; however, ch , 1927, as expressed in its title, was an "act to amend of the revised general statutes of Florida, relating to the qualifications of jurors." The 1927 act inserted in said 2772 by amendment the following provision, to-wit: "The fact that any person so selected had been on a former jury list or had served as a juror in any court at any time shall not be ground for challenge of such person as a juror." The amendment of 1927 seems to be in conflict with 2692 RGS insofar as they both relate to jury service of persons placed upon jury lists, in any year last past. This conflict seems only to relate to such jurors as are selected in the usual manner and not to special. venires summoned from the body of the county or bystanders. However, it seems that 2692 conflicts in part with the later expression in ch , and as 9 of such chapter contains a general repeal of laws in conflict with it, it was superseded to such extent by the conflict. Therefore, it seems that 2692 RGS should be revised so as to eliminate the said ground of challenge for cause, insofar as it relates to jurors selected from jury lists, but said ground should be retained a s to jurors selected from bystanders or otherwise and not from jury lists. The provision probably should be preserved as a protection against what may be described as habitual jurors around courts which have no jury lists. 184, ch , 1939, provides for challenge of jurors in criminal cases and by implication amends or repeals 2692 RGS insofar as they are in conflict RGS has been further revised by changing the word, "criminal" in ~he phrase, "criminal court of record" to 'civil"; thereby making the phrase read: "civil court of record".
