2 Course/Module description: This is an advanced course in contract law. It combines theoretical inquiries with discussion of concrete issues and recent developments in the Israeli law of contracts. On the theoretical level, part of the discussion will deal with economic analysis of law--the most influential school of thought in contract law theory in the past decades. The theoretical part will also discuss the will theory of contract, the conception of contract law as public law, reliance and restitution theories of contract law, relational contracts, distributive justice and paternalism in contract law. Among the specific issues to be discussed are defects in contracting, contract interpretation and supplementation, Illegal contracts and simulation, remedies aiming to restore the contractual equivalence of exchange and disgorgement remedies. Course/Module aims: The course aims to systematically analyze a broad range of theories of contract law against the background of the history of contracts and contract law. The course will also discuss recent developments in Israeli contract law. Learning outcomes - On successful completion of this module, students should be able to: On successful completion of this course, students should be able to use the various theories of contract law to construct policy arguments in contract law and private law in general. The students will also be familiar with the recent developments in Israeli contract law.
