Chairraan Young presided and presented a plaque to Henry Lee in grateful recognition of his fine service as Chairman of the Board of Trustees for the preceding fiscal year. Mr. Lee said he was very pleased and thanked the Board. Joumal of the meeting of Septerataer 13, 1978 (823rd) vras read. Motion made by Mr. Rodefeld, seconded by Mr. Bischof, that same be approved as read. Mr. Young said that Mr. Magidson had asked to address the Board, and he invited him to do so. Mr. Magidson said that he vrished to speak again about a permit issued by the District to the City of University Gity to extend a sewer claimed by Mr. Magidson as his private property. He iterated his position, which he had expressed to the Board on July 26, 1978, that University City had connected into his sewer without a permit frcm the District, and.then the District issued the permit. His position is that the sewer connected into by the City taelonged to him, Mr. Magidson, and that, therefore, the permit should tae revoked. M 1" \^ 'H 0: M -fr ch-, ~J ' uo,''
2 After considerable additional statement by Mr. Magidson and sorae little discussion with several of the Trustees and Mr. Kaiser, the Chairman stated that Mr. Magidson had.been sent a letter by Mr. Flick setting out the District's position and refusing to rescind the permit (copy in Secretary-Treasurer's File). He said that the Board was aware of the content of Mr. Flick's letter, were in agreement with it, and did not intend to overrule Mr. Flick's decision. Mr. Magidson then left the meeting. The Chairman then asked if Mr. Luther cared to speak. Mr. Luther then addressed the Board, stating that he is one of the Trustees of the Tam-0-Shanter Subdivision consisting of about 135 homes located in the Sugar Creek Watershed. He said that it vras their wish to encourage the. District to acquire the South County Sewer Company and they wanted to see about dedicating their 9,000 feet of sewers to the District. The trust indenture states that the sutadivision trustees are the sewer ovmers. There is a maintenance agreement wheretay the South County Sewer Corapanyraaintainsthe sewers, charging fees for this to the residents. He said further that the treatraent facility was grossly inadequate. Mr. Kaiser said that the District has been trying to work with the subdivision residents in order to clean up the problem. There are several such areas that would be incorporated into one system, which would have a new treatraent plant. Mr. Young thanked Mr. Luther for his interest and support. Borghi, Cento, Rodefeld and Young, vras again presented and read, authorizing and directing the Executive Director and Secretary-Treasurer to quit-claira certain real property belonging to The Metropolitan St. Louis Sewer District in St. Louis Coimty, Missouri, to certain abutting ovmers thereof, and to execute and deliver a Quit-Claim Deed for said real property. Mr. Kaiser said that the portion of the lots in question had been granted to the District, but -there has been a request for the retum of such property, to be replaced by easeraents. The District actually prefers the easeraent,taecauseit has little of the probleras that ownership carries and, in addition, there will be a payraent of $1,

Bischof, Borghij- Lee, Eodefeld and Young, -was again presented and read, appropriating-$5, frcm the Mississippi Eiver Subdistrict -Construction Etmd to be used to purchase pipe for the construction of a sanitary sewer force main in the Jefferson Barracks Bridge Sanitary Relocation (S - Jl'62), - in St. Lo'uis County, Missouri. Mr. Enger said that the District's construction of a sanitary force main for the Jefferson Barracks Bridge relocation is being delayed, because of a conflicttaetweentwo of the State's contractors. The District's contractor had bought the pipe for this project in anticipation of the contract's being let and since it could not be and probably not for a year, he has asked if the District would purchase the pipe from hira. Since the District will need this sarae pipe whenever the project can continue, it is conteraplated that -purchase frora the contractor now would save some money in the future, and, therefore, requests authorization. Bischof, Borghi, Lee, Rodefeld and Young, was again presented and read, vacating portions of easeraents in St. Louis County, Missouri. Mr. Sears said that the ovmer of Lot 10 of Patterson Acres wishes to purchase a portion of Lot 11 in order to construct a garage. There is an existing easement over the east five feet of Lot 10 and the west five feet of Lot 11, which precludes such construction, but this easeraent contains no sewer, nor is it expected to be needed. Bischof, Borghi, Lee, Rodefeld and Young, was again presented and read, vacating portions of sewer easeraents in the City of Berkeley, St. Louis County, Missouri. Mr. Sears said that a comraercial sutadivision knovm as Brovmat had erroneously described a roadway in its entirety as an easeraent for sewers. The ovmer is now requesting the vacation of this portion of road not needed for sewers, together with an easeraent running east and west, which was rendered inapropos by theraovingof the lot line. Since there are no sewers within these easeraents, nor expected to be any, the Engineering Department recomraends this vacation. Proposed Ordinance No was presented and read, appropriating $54, frora the Mississippi River Subdistrict Operating Fund to be used for the construction of combined sewers in College-Emma (S-85), in the City of Jennings, Missouri. Mr. Enger referred to a wall map showing the location of the proposed sewer project as extending from an existing sewer in Florence Place northwestwardly to College Avenue near Memorial Park Cemetery in the City of Jennings. He said that this is being financed equally with Jennings and the State and-is a combined sewer. Mr. Kaiser said that the City of Jennings has been accumulating its Comraunity Development funds for about two years and requested iraraediate consideration in order that it might not lose that acquired during the first year. ' Proposed Ordinance No was presented and read, vacating a portion of a sewer easeraent in Lot 74 of St. Ann Hills 5th Addition, in the City of St. Ann, St. Louis County, Missouri. Mr. Sears showed on a wallraaplot 74 of St. Ann Hills 5th Addition in north St. Louis County, lying generally south of St. Gharies Rock Road and east of Ashby Road. He also showed the location of a 66 inch, pipe sewer and a 50 foot easeraent lying over the rear of Lot 74. He said that the District had put a stormwater channel into a sewer and the ovmer of the lot requested the vacation of an 8 foot wide portion of such easeraent. He said it is no longer needed and the Engineering-Departraent has no objection to such vacation. After a short discussion, motion-made bymr. Rodefeld, seconded by. Mr. Borghi, that proposed Ordinance No be introduced.

Mr. McLaughlin referred to a wall map showing, the existing and proposed additions to the structures at the South County Maintenance building on.pardee Road. He said that this forms a part of the planned decentralization of the Construction Division of Maintenance, which originally worked out of Sulphur. He said he is trying to divide the District's area into four, separate zones for construction repairs, in order to save the tirae required to reach the job sites.. Five crews have beenraovedto the South Division and alterations are needed to accoramodate thera. Several pieces of equipment need to tae stored where there can be some heat maintained at least above freezing. They put three men on it in order to save time. - The purpose of the contract has now been settled and we thought that the price was reasonable. Proposed Ordinance Wo was presented and read, authorizing and directing the Executive Director and Secretary-Treasurer to lease a single family residence being part of certain real property of The Metropolitan St. Louis Sewer District, lying in St. Louis County, Missouri, and to execute a leasehold agreement therefor. Mr. Flick showed on a vrall map the land at Wew Baumgartner Eoad in St. Louis County where the District has several lagoons andtarickresidence in one corner. He said there was another old frametauildingand a couple' of shedstaetweenthetarickbuilding and the lagoons, and the frame house was severely vandalized after its tenant moved out. The District is trying to raze these buildings. The resident of the brick house-is moving and rather than sell tha,t, he wanted to re-rent it. After a great deal of discussion as to the rental value, the various alternatives of its use, sale or razing, the value of having someone on the preraises insofar as the lagoons are concerned and questions about other properties the District owns, the Chairman held the item, taut stated that the Executive Director had the authority to rent, the property anyhow. He also asked for a brief report concerning other rental properties -the District has. 17 Mr. Brady said that at theraeetingof August.23, 1978, a Citizens Petition Coraraittee frora the rarea called West Overland sutaraitted a petition requesting a sanitary sewer project. He said he had prepared a report dated Septeraber 20 to Mr. Flick (copy in Secretary-Treasurer's File), which -set out these facts: Approximately 24,000 feet of 8 inch sewers and a lift station are required at a total estiraated cost of $600, The problera, of course, is funding. Although St. Louis County has raade a stateraent as to the possitale 50 percent participation in the Maryland Heights protalem, a nearby area, there has been no comraitraent for this one. Mr. Kaiser coraraented that a sutadistrict should tae formed for almost any type of financing, and the Chairman requested Mr. Brady keep the Board informed of progress. Mr. Kaiser said that many of the private sewer ccmpany's facilities in the new Districttaoundariesare nottaeingraaintainedproperly. The treatment plant serving the Village of Twin Oaks was tauilt with the owner's capital, not that of the users. The treatment facility is a -plant which has primary and secondary- processes.. There has been sorae little negotiation^ which is not. completed. Should this be successful, we. would advance raoney from the General Fund to be reimbursed frora future connection charges. n buying this plant, two or three others nearby could tae consolidated with it. He requested perraission to acquire the facilities serving the ViJlage of Twin Oaks. The Chairraan then called on Mr. Richard Hrach, who stated that he was araeraberof the Board of Trustees of the Village of Tvrin Oaks. The Village wholly supports Mr. Kaiser's statements and would like for the District to own, operate and maintain the treatment plant serving it. After a short discussion. Chairman Young said that he had appointed an Acquisitions Cammittee consisting of Messrs. Cento and Lee to review such proposed acquisitions. Motion made by Mr. Lee, seconded by Mr. Cento, that Mr. Kaiser be authorized to proceed with negotiations toward acquisition of the Twin Oaks system, and upon corapletion thereof, present such agreeraent to the Board for approval in the form of an ordinance. 17

We would take one-half the connection -charges until'-we 'received -$130,000.00, which would be our 10 percent of the cost. There is difficulty with sorae of the line -and-we -would -not want to-raake'-the acquisition if-the' pipe did" not sa-tisfy District standards. -,....,. ^.. Mr. Lietaraann coraraented that in the area along Telegraph Road to Christopher Drive to the river there are 3,500 hemes under construction, just finished or started. Mr. Kaiser said that he wished to carry on the negotiations toward acquisition of the sewer systera and would, of course, do so in conjunction with the Acquisitions Committee-. - 'Mr. Cento.said--ithat he understood that-mr. Kaiser will tae negotiating with the Fenton Sewer- Corapany. Since- one of the ovmers is a friend and business associate, he asked- if the Chairman would excuse him frora that-particular phase of-the negotiations..mr. Young.then asked-. Mr. Bischof if he would serve in Mr'. Cento's place on the Coraraittee for that particular protalera, and'mr. Bischof agreed. Motion raade by Mr..
