Williams, of lawful age, being first duly sworn, upon oath, deposes and says : 1. She is the a ttorney for Applicants, Chesapeake Operating, Inc. and Chesapeake Exploration, L.L.C., and makes th is affidavit on behalf of Appl icants. 2. Based upon information and belief, the name and last-known address of each person or governmental entity, other than Applicants, currently having the right or c laiming to have the right to pa rticipate in production from one or more of the separate common sources of supply involved herein in the 640-acre drilling and spacing unit formed therefor in Section 10, Township 24 No rt h, Range 16 West of the IM, Woods County, Oklahoma, are set fo rt h in Exhibit "A" attached hereto and made a pa rt hereof. Based upon information and belief, Applicants are operators of a well or wells which have been commenced to or are currently produc ing from one or more of the separate common sources of supply i nvolved here in on the tracts of land or drilling and spacing units surrounding said Section 10 and based upon information and belief, the names and last-known addresses of the working interest owners, other than Applicants, in such offset well or wells are set fort h in Exhibit "A" attached hereto. Based upon informat ion and belief, the name and last-known address of each operator, other than Applicants, of a well which has been commenced to or is currently producing from one or more of the separate common sources of supply invo lved herein on the tracts of land or dr i lling and spacing units surrounding said Section 10 are set fo rth in Exhibit "A" attached hereto. 3. Based upon information and bel ief, affiant states that Applicants do not know and with due diligence are unable to ascertain with absolute ce rtainty whether each of the individuals named as a respondent i n this cause is liv ing or dead or his or her whereabouts, except for the last -known addresses set fo rt h in Exhibit "A" attached hereto with respect to certain named individual respondents, and that if any such indiv idual is deceased, Applicants do not know and with due diligence are unable to asce rtain with absolute ce rtainty the names, addresses or whereabouts of the he irs, executors, administrators, devisees, trustees or assigns, immediate or remote, of such deceased individual. 4. Based upon informat ion and bel ief, affiant states that App licants do not know and with due diligence are unable to asce rta in with absolute ce rtainty whether each of the entities named as a respondent in this cause is a partnership, corporation or other association or continues to have legal existence or not, and that if any such entity is a pa rtnership, corporation or other association, Applicants do not know and with due dil igence are unable to asce rtain with absolute ce rtainty whether such ent ity has officers or not, or their names or whereabouts, or if dissolved, the names and whereabouts of the successors, trustees or assigns, if any, of such entity. 5. Based upon information and belief, affiant states that Applicants do not know and with due diligence are unable to ascertain with absolute certainty whether each of the parties designated as a trustee in Exhibit "A" attached hereto is presently acting in such capacity as trustee, and that if any such party is not presently acting in such capacity as trustee, Applicants do not know and with due diligence are unable to ascertain with absolute certainty the names, addresses or whereabouts of the successor or successors to such trustee. Based upon information and belief, affiant states that Applicants do not know and with due diligence are unable to ascertain with absolute certainty whether the party designated as a personal representative in Exhibit "A" attached hereto is presently acting in such capacity as personal representative, and that if such party is not presently acting in such capacity as personal representative, Applicants do not know and with due diligence are unable to ascertain with absolute certainty the names, addresses or whereabouts of the successor or successors to such personal representative. 7. On the 10th day of October 2008, true and correct copies of the application and the notice of hearing in this matter were served on the staff counsel for the Corporation Commission by placing such copies in the container in the office of the Secreta ry of the Commiss ion prov ided by such Secreta ry (and consented to by the staff counsel ) for such service. 8. On the 15th day of October 2008, true and correct copies of the application and the notice of hearing in this matter were placed in the United States mail in Oklahoma City, Oklahoma, first class, postage prepaid, duly addressed to the parties at their respective addresses as set forth in Exhibit "A" attached hereto and made a part hereof. 9. Based upon information and belief, affiant states that Applicants have exercised due diligence in conducting a meaningful search to locate the current address or whereabouts of each respondent named in Exhibit "A" which respondent is shown as "address unknown" or is shown with an address labeled as "last known address" or is shown as "deceased" or is shown as "dissolved," that Applicants were unable to ascertain the current address or whereabouts of each such respondent, that Applicants could not serve by mail or by personal delivery the application and notice of hearing in this matter on each such respondent and that Applicants could not serve each such respondent with process by any method other than by publication. 10. Notice of th is cause has therefore been served pursuant to the applicable ru les of the Commission. Freda L.
