1 SECOND SUPPLEMENTAL TO DECLARATION OF COVENANTS, CONDITIONS, AND RESTRICTIONS STATE OF TEXAS KNOW ALL MEN BY THESE PRESENTS: COUNTY OF GRAYSON This First Supplemental to Declaration of Covenants, Conditions and Restrictions is made and entered into this day of, 2018, by FRANKLIN THOMAS BAKER and CYNTHIA RENEE BAKER (collectively, Bakers or Declarants ). RECITALS: WHEREAS, Bakers are the Declarants under the Declaration of Covenants, Conditions and Restrictions ( Declaration ) recorded, in Grayson County Clerk s File No. in the Real Property Records of Grayson County, Texas; and WHEREAS, Declarants are the recorded owners of that certain acres of land, more or less, in the Samuel Pruitt Survey, Abstract No. 956, located in Grayson County, Texas and being more particularly described in Exhibit A attached hereto and made a part hereof for all purposes, which has been subdivided into six (6) separate lots called Blackthorn Meadow, Phase III, a subdivision in Grayson County, Texas (the Second Supplemental Property ), as evidenced by the Plat (which will be recorded, if not already recorded), attached hereto and incorporated herewith as Exhibit B. WHEREAS, the Second Supplemental Property is adjacent to the Parent Tract Lots as defined in the Declaration and described in Exhibit C, attached hereto and incorporated herein for all purposes, which has been subdivided as evidenced by the Plat of record filed in Instrument No , Plat Records, Grayson County, Texas; and WHEREAS, pursuant to Article IV, Section 4.10 of the Declaration, Declarants desire to add or annex the Second Supplemental Property to the scheme of the Declaration with such complimentary additions and modifications as are set forth herein. NOW, THEREFORE, it is hereby declared that the Second Supplemental Property is and shall be held, transferred, sold, conveyed and occupied subject to all of the terms, conditions and provisions of the Declaration except as specifically set forth below and that the Declaration as amended hereby shall run with and bind the Second Supplemental Property. 1. With regard to the Second Supplemental Property, Article II, Section 2.4.2d shall not apply and the following Section 2.4.2d shall apply: d. Location on Lot. No Residence or Improvement may be built in violation of a front setback line of at least one hundred twenty (100) feet, a side setback line of at least ten (10) feet, and a back setback line of at least twenty-five (25) feet, except as otherwise provided in this paragraph d. Each Residence must face Blackthorn Drive, as shown on the Plat. All Improvements must be located DECLARATION OF COVENANTS, CONDITIONS AND RESTRICTIONS Page 1 of 5
2 behind the front wall of the Residence, except as otherwise provided by this paragraph No outbuildings, except garages, may be visible from any street. "Back setback and side setback lines", respectively, as used in this paragraph, with respect to any two (2) or more contiguous whole lots owned by the same Owner and used as a single building site, shall mean, respectively, the outermost back lot lines and side lot lines considering said contiguous whole lots as one Lot. However, in the event that a single Owner shall own two (2) or more adjacent Lots, and shall thereafter convey one (1) Lot to any third party, the interior lot lines between the Lots then owned by separated Owners shall be burdened by the setback lines described herein. No permanent or portable Improvements such as buildings, decks, doghouses, gazebos, arbors, etc. can encroach into the setback areas, provided however, fences and driveways may be built in the setbacks.
