SHAVUOS A N S W E R S TO FAQ Rabbi Meir Bulman One may not do preparation (dish washing, setting the table, moving chairs from room to room etc.) on Shabbos for Yom Tov or from one day of Yom Tov to the next. One may take a nap on Shabbos in order to be able to stay up on Shavuos night, but they may not verbalize that they are sleeping for Shavuos. One who wishes to change their clothes on Shabbos for Yom Tov or on Day 1 for Day 2, should do so before shkia (sunset) so that they have the benefit of their fresh new clothes on the day they change. There s a question if removing something from a freezer is considered an act of preparation. Therefore, one should: 1) Not take anything out of the freezer on Day 1 for Day 2. OR 2) Store the food one needs for the second night of Yom Tov with the food for the first day (same bag, pan, box) and remove together. OR 3) If the food one would like to remove for the second night is the same as that which one is using the first day meal (i.e. Challah), take out what they need for both meals. If none of these options are viable and the waiting for the food to thaw late at night will compromise one s simchas Yom Tov then one may rely on the opinions that allow the removal of food from the freezer provided they take the food out of the freezer at least a few hours before shkia. After Shabbos/Erev Yom Tov is over (10:01 PM ) one must say המבדיל בין קודש לקודש ברוך (baruch hamavdil bein kodesh l kodesh) before doing anything for Yom Tov. The kiddush on the first night of Yom Tov/motzei Shabbos includes havdalah (use a machzor for the order and formula of the brachos). There are varied minhagim as to what to do for the brachah of מאורי האש.בורא Some just look at the Yom Tov neiros, others hold two candles together (one must be careful not to extinguish either candle). One should follow their minhag. One who takes a nap on erev Shavuos for more than a half hour should have in mind that the brachah of אהבת עולם during Maariv should serve as their ברכת התורה and then learn something immediately after Maariv. Many have a minhag to stay up all night learning Torah. A half hour before עלות השחר (dawn) one may not begin eating a significant amount of mezonos. One should stop eating and drinking at השחר.עלות One may still have coffee, tea, or water if it will enhance one s concentration for davening. After עלות השחר one must wash negel vasser, but one need not stop learning to do so. When one is finished learning one should use the bathroom and then wash negel vasser, then one should. אשר יצר and על נטילת ידים of say the brachos המעביר שינה and אלוקי נשמה,ברכת התורה One who stayed up all night should listen to the brachos of. אמן answer and יהי רצון through the One should not put on/make a brachah on their tallis until משיכיר (5:42 AM) THE THREE WEEKS One may not cut their hair during the Three Weeks. Women may cut their hair for tznius purposes (i.e. hair sticks out from under one s head covering). Women may remove unwanted hair from their eyebrows. Married women and girls in shidduchim may shave their legs. Children should not have their hair cut. In a case of need, consult a Rav. Boys in shidduchim should not shave. One may shave for work if they stand to incur a loss by not shaving. One may cut their nails during the Three Weeks until the week of Tisha B Av. During the week of Tisha B Av, one may cut a child s nails for hygienic reasons and women may cut nails for halachic reasons. One may get a shaitel washed, set and cut up until the Nine Days. One may not listen to music, live or recorded, during the Three Weeks. Most poskim consider acapella music unacceptable for the Three Weeks. Kids story tapes with background music may be listened to in private, as the music is only secondary. One may listen to music if their intent is not the enjoyment of the music, such as one who needs music to effectively exercise or to stay awake while driving. A person who has anxiety and needs music to relax should ask a shaila. One need not be concerned about background music at a store/doctor or their cell phone ringtone. A professional musician may play for non-jews and practice until the week of Tisha B Av. It s best to avoid music lessons during the Three Weeks unless not playing will cause regression or a serious loss of money. In that case, one may have the lessons until the Nine Days. It is customary not to say the brachah of שהחיינו during the Three Weeks. Therefore one should not purchase a new fruit, car, shaitel or clothing requiring a שהחיינו. Many say שהחיינו on Shabbos. One should avoid dangerous activity during the Three Weeks (i.e. elective surgery). THE NINE DAYS As in the Three Weeks, dangerous activities should be avoided. Some have a custom not to travel unnecessarily during the Nine Days, but one may travel as needed. One should refrain from buying things that bring simcha (i.e. new car, new furniture). One should not renovate/decorate one s home during the Nine Days. Repairs are allowed. If a non-jew was already contracted to do renovation work, ask a shaila. One should not landscape or garden. One who regularly mows their lawn may do so, but its best to postpone. One should not go to an amusement park or attend parties. One may not eat meat (including poultry) or drink wine or grape juice. Even if the meat, wine, or grape juice is only an ingredient in a dish, it is prohibited to consume. One may cook in fleishig pots. Even young children (below the normal age of chinuch) should not eat meat or drink grape juice unless it is needed for health reasons. Ask a shaila. One may eat meat and drink wine on Shabbos even if one makes early Shabbos. Children who are served their Shabbos seudah on Friday afternoon, before Shabbos, may eat meat and drink grape juice. When making havdalah on Motza ei Shabbos there are a few options: 1) Make havdalah on grape juice and have a boy aged six or seven drink the grape juice. 2) If that is not possible, make havdalah on grape juice and drink it yourself. 3) Some make havdalah on beer

One should not shower/bathe for pleasure. One may shower/bathe to remove dirt or excessive perspiration. One should try to tolerate mild discomfort and only bathe when necessary. When bathing, one should do so quickly, with water that is cooler than usual and minimal soap and shampoo. One may bathe normally for Shabbos. Swimming is prohibited even if one swims for health purposes. Children under the age of six may swim or run around in a sprinkler. One may not wear Shabbos clothes, even at a simcha unless it is one s own personal simcha. One may not buy or make new clothing, even relatively unimportant garments. If there is a big sale, ask a shaila. One may fix/patch/repair old garments. One may not do any knitting or needlecraft during the Nine Days. Shaitels should not be washed, dyed, or cut to a new style. One should not do laundry nor wear/use freshly laundered garments. This prohibition includes washing, pressing, dry cleaning, and ironing any clothes, linens, tablecloths, towels, etc. One who is having a lot of guests may wash linen between visitors. A non-jew may not wash a Jew s clothes. One must stop a non-jew from washing their clothes. One should wear freshly laundered clothes before the Nine Days so they aren t fresh anymore (about 5 minutes). One who was not able to wear their clothes in advance, in case of need may throw the clothes on the floor to remove the freshness. One may pick up clothes from the dry-cleaners, as long as the clothes were cleaned prior to the Nine Days. Clothes that will become moldy if they aren t washed immediately may be washed to prevent the loss. One may launder clothes for children who constantly dirty themselves (0-9 years old). If one s child older than nine years-old seems to constantly be dirty, ask a shaila. Adults may not launder any of their clothing. One may not throw their clothes in with the kids clothes. An adult who runs out of clothes should ask a shaila. BUY ENOUGH CLOTHES BEFORE THE NINE DAYS! SHABBOS EREV TISHA B AV - actually the 9 th of Av; Erev the Taanis (fast) On Shabbos one may (should) eat meat, and drink wine/grape juice with no limitations. One may sit on a chair, wear leather shoes and wash one s self normally. The other restriction of Tisha B av applies. One should refrain from taking pleasure walks on Shabbos. It is best to learn Tisha B av appropriate Torah on Shabbos afternoon. One who cannot, may learn other limudim (topics). The minhag is not to learn Pirkei Avos. There is no special Seudah Hamafsekes (last meal before Tisha B av). One may have wine and meat, and sing zemiros at Shalosh Seudos. One should avoid having company for Shalosh Seudos. One who drinks water because they are thirsty makes a brachah of שהכל. One who is drinking just to be hydrated for the next day s fast doesn t make a brachah on the water. One should not say that they are eating or drinking to have strength for the fast. According to many poskim, one may take a time release pill on Shabbos to help one with the fast. The prohibitions of eating, drinking and washing begin at shkiah (sunset - 9:13 PM) One may sit on a chair until nightfall - tzeis (10:13 PM) One may not prepare for Tisha B Av until Shabbos is over (10:13 PM - 60 minutes). After Shabbos is over one should say המבדיל בין קודש לחול ברוך - Baruch hamavdil bein kodesh l chol, change out of their Shabbos clothes and shoes and then come to shul for Ma ariv and Eichah (10:35 PM). After Ma ariv, before the reading of Eichah, בורא מאורי האש will be made on a havdalah candle for the whole Shul. One whose wife will not be at Shul should not be yotzei with the Shul and should make this brachah at home (preferably before, but can be after davening). Women should be yotzei with a man s brachah. Dishes from Shabbos should not be washed until after chatzos (1:51 PM) on Sunday unless they will attract bugs. TISHA B AV Men and women are required to fast from shkiah on Erev Tisha B Av (Shabbos, July 21, 9:13 PM) until 50 minutes after shkia on Tisha B Av (Sunday, July 22, 10:02 PM). Because Tisha B Av is a nidcheh (pushed off a day) this year (the 9 th of Av is actually on Shabbos, so the fast is postponed to Sunday) the halachos of fasting for pregnant and nursing women, the elderly, those with medical conditions or not feeling well are more lenient. Ask a shaila. One who is not fasting must make havdalah before eating. Havdalah should be made by a man (even one fasting the whole day) with the person who is not fasting drinking the beverage. In this case, the man making havdalah and the household members who listen in are all yotzei havdalah and need not make havdalah again after the fast. Besamim are not used. Havdalah should preferably be made on חמר מדינה - beer, coffee, or tea (the coffee or tea should not be too hot so that one can drink a mouthful at one shot). If חמר מדינה is not available one may make havdalah on wine/grape juice, but should only drink the minimum shiur (1.6 oz.). Most poskim hold that kids under Bar/Bas Mitzvah do not need to make or hear havdalah before eating. One who is eating (i.e. children) should eat simple foods (not treats - unless there is a special need). One may dry swallow pills. One who must take a medication and can t dry swallow should ask a shaila. One should not brush their teeth on Tisha B Av. One may not wet any part of themselves on Tisha B Av. One may wash their hands to remove dirt, after using the bathroom or for a medical need. One should wash negel vasser only up until the knuckles. The same applies for washing hands before davening and when leaving a cemetery. Men, women and children should not wear leather shoes on Tisha B Av. Leather decorations that do no provide foot support are not a problem. Leather orthotics should be avoided. One may not apply liquids or ointments to oneself for pleasure. Women may not apply makeup on Tisha B Av. One may use deodorant to prevent bad odor, not to apply a good scent. Unscented deodorant is best. One may use hand cream on chapped hands (for healing, not for pleasure). Insect repellent and sunscreen may be used. One may only learn parts of the Torah that do not divert one s attention from churban Bais Hamikdash. Therefore, one may learn Iyov, Eichah, the parts of Yirmiyahu that relate to the churban, Gittin 55b-58a, Sanhedrin 96a-104b, and the third perek of Mo ed Katan. One may also learn hilchos Tisha B Av, hilchos availus, and Kinos. One may also read historical accounts of the churban or Holocaust. One may read and learn things that may arouse one to teshuva like Mussar seforim and stories of tzaddikkim. Even when learning these appropriate selections the learning should not be very in depth. Tehillim for a choleh may be said, preferably after chatzos. One who normally says a part of sefer Tehillim - 6 -

every day should do so after chatzos. Parts of the Torah that are found within davening may be said. One may not greet others on Tisha B Av (i.e. shalom, good morning, good evening ). One may say good night to children going to bed. Nodding one s head in greeting is okay. One may respond to a greeting from someone who doesn t know the halacha in a low and serious tone. One may wish others a Mazal Tov or Refuah Shelaima (it s a brachah not a greeting). One may ask how someone is doing. When answering the phone some avoid saying hello. Others hold that hello isn t a greeting, just a way of letting the caller know that you are listening. One should try to avoid going to work the entire Tisha B Av. Until chatzos (1:51 PM) one may not involve themselves in activities (melachah) that can distract one from the availus of the day (i.e. going to work, washing dishes, housework). If not possible (such as due to financial loss) a shaila should be asked. Even after chatzos, one should do their best to keep their focus on the availus of Tisha B Av (listen to a shiur about Tisha B Av, etc.). One should not spend their time idly sitting around and schmoozing or doing leisure activities. Aside from very public outdoor work, a non-jew may do work for a Jew. One may not sit on a regular chair, couch etc. until after chatzos. One should sit on something 12 inches or lower. Many sit on the floor. One who has difficulty sitting low may sit on a regular chair. When travelling by car one may sit regularly. One should dress simply on Tisha B av. Many have a minhag to reduce their comfort when sleeping (i.e. on the floor, with one less pillow). Kinos are very difficult to understand. It s best to take one s time (even if you fall behind the tzibur) in order to understand as much as possible. When the fast is over one must make havdalah before eating (women should hear it from a man). Only said. are המבדיל and בורא פרי הגפן Wine/grape juice may be used for the havdalah at the end of the fast, but should otherwise not be drunk until the next morning. Eating meat and listening to music are also prohibited until the next morning. One should say Kiddush Levana after Ma ariv. It is best one change their shoes and eat before Kiddush Levana, but not at the expense of saying it with a minyan. All the other Nine Days prohibitions (i.e. haircuts, shaving, showering, laundry, saying שהחיינו etc.) are allowed immediately following the fast. DAF YOMI SIYUM HASHAS CELEBRATION DINNER Hebrew Orthodox Congregation s Daf Yomi shiur, having started its cycle with Zevachim seven-and-a-half years ago, completed Shas and held a gala celebration Siyum for the entire community the next evening, on Sunday, April 15. The inspiring speakers were Mr. Gerry Lerman, Mr. Louis Sandock, Rabbi Kuppel Lindow, Rabbi Meir Bulman, and keynote speaker Rabbi Ephraim Shapiro, mara d'asra of Congregation Shaaray Tefilah of North Miami Beach. Rabbi Eliyahu Simcha Bamberger, National Director of Daf Yomi Commission of Agudath Israel of America was also in attendance and spoke movingly. Hebrew Orthodox Congregation was packed as many members of the South Bend community joined together for a beautiful evening with joyous dancing, an uplifting atmosphere and a delicious meal.

D I V R E I TORAH Torah: Thankfully ours פחד יצחק מאמר ז' Based on Rabbi Meir Bulman When the Jewish people experienced the tremendous miracle of matan Torah (the giving of the Torah) they were terrified for their lives. They were not sure they could survive such an otherworldly experience. Moshe assured them that they would indeed survive matan Torah and that there was purpose אל תיראו כי לבעבור נסות אתכם בא האלוקים said: to this awestriking and overwhelming experience. He לנסות you. The meforshim discuss what the word לנסות - Do not be afraid. Hashem did this )יתרו כ\יז( means in this context. The Ramban says that it means to test. Hashem said that he was giving the Jewish people the experience of His Shechinah to test whether they would recognize the good Hashem had bestowed upon them (by allowing them to experience such closeness with Hashem) and do what they could to reciprocate. The experience of matan Torah was a test of the Jewish people s hakaras hatov thankfulness. Rav Hutner zt l explains the impact of this Ramban. He says that if the goal of matan Torah was to test our hakaras hatov, then it follows that hakaras hatov must be built into the fabric of our relationship with the Torah. Our every interaction with Torah MUST include a sense of thankfulness to Hashem for the Torah! Thus, one can only properly learn and fully digest Torah if the learning is accompanied by a sense of hakaras hatov. Learning Torah without that sense of hakaras hatov is an attempt to fulfill the mitzvah of talmud Torah that is fundamentally lacking. Learning Torah without the sense of hakaras hatov is a flawed fulfillment of the mitzvah. While we must be thankful for all of the mitzvos Hashem gave us after all, they infuse our lives with meaning and are the means of our connection with Him - we do not find that hakaras hatov factors into the essential definition of any of our other mitzvos. Putting on tefillin without feeling hakaras hatov does not render the mitzvah flawed. Only by limud Hatorah (Torah learning) do we find such a condition within the mitzvah. Why did Hashem create this condition specifically within the mitzvah of talmud Torah? Why does specifically this mitzvah require hakaras hatov to make it complete? The pasuk in Mishlei )טו\כז( tells us that מתנות יחי-ה שונא - the hater of gifts will live. This pasuk is doing more than giving good advice as to how to live, the pasuk is DEFINING living and telling us that to truly be alive one must eschew gifts. The Ramchal explains that Hashem created us so that we could experience the ultimate pleasure, closeness with Him. To accomplish that Hashem could not just create our souls and have them be with Him, because gifts and items received for free are not enjoyed as much as something that has been earned. The sense of attachment and fusion with the things we earn, that true sense of possession is what deepens the pleasure of having something. So, HKB H placed us in a world of good and evil with an internal drive for both so that we can be challenged to choose to do what is right and through those choices EARN closeness to Hashem. So the pasuk is telling us that שונא מתנות יחי -ה the foundation of existence and our lives is the rejection of being gifted anything. חיים is all about EARNING. Therefore, to truly live one must reject all forms of gifts and embrace the opportunity of the challenges of life as the means to earn one s ultimate reward. The Maharal התורה פרק ד'( )נתיב adds another layer of understanding to this pasuk that defines life. He connects the word יחי -ה to the term מים חיים - a term used to describe a spring of water that So, - isn t reliant on other sources of water, rather it increases independently. מתברך מיני' ובי' means that one who is truly living is one who is self-reliant. Hashem exhorts us to emulate שונא מתנות יחי -ה HIS middos (traits); just as Hashem is the אלוקים חיים - totally independent and the source of everything, we too are to be self-sufficient and self-sustaining. ואתם הדבקים בה' אלוקיכם חיים כולכם היום - those who cleave to the ways and middos of Hashem are - חיים - self-reliant just like Hashem So human beings are supposed to be self-sufficient earners; not wanting anything handed to us, only to rely on ourselves to achieve and earn our ultimate reward. But that is IMPOSSIBLE!?! Human beings in this world are totally dependent! From birth we are completely helpless and dependent on others (parents etc.) and we are always dependent on Hashem. We are not self-sustaining by any stretch of the imagination. So how are we supposed to feel any natural satisfaction in life if our lives can t be truly and independently lived?!? The answer is hakaras hatov. Recognizing and appreciating the contributions of others and doing what we can to repay our benefactors allows us to alleviate that hated feeling of taking. It allows us to feel that we have paid for the things we have and that they are truly ours. The more a person is an emulator of Hashem and LIVES as a מתנות,שונא the more central the middah of hakaras hatov is going to be to him. Hashem gave the Torah to those who are.בעלי נשמת חיים for אלוקים חיים was designed by תורת חיים seeking to truly LIVE as Hashem desires; emulating Hashem s middos and doing His will. The Torah was designed for the truly refined imitator of Hashem who must burn with a deep hatred of gifts and thereby filled with and driven by hakaras hatov. Hakaras hatov is a necessary prerequisite for the absorption of Torah. Torah cannot be ingested or assimilated by someone who isn t bursting with hakaras hatov. So matan Torah itself was a test of hakaras hatov because only a true makir tov can be truly mekabel the Torah. What follows is that all limud Hatorah must be accompanied by a sense of hakaras hatov because without it Torah would never become part of a person. Chazal tell us that the first 2000 years of the world s existence were years of )תוהו( emptiness that were followed by 2000 years of Torah. The person who lived in the year 2000 and drove the transition from ושמרו את דרך ה' a world of emptiness to a world of Torah was Avraham Avinu about whom the Torah says that the Rambam says means that Avraham spent his life emulating and imitating the middos of Hashem. Avraham was clearly a מתנות,שונא someone who recognized the chesed of Hashem and was driven by his need to be makir tov to spend his life attempting to repay for all he had received. That is why Avraham is the figure that begins the world s ascension to 2000 years of Torah; his emulation of Hashem is the prerequisite for Torah! The gemara tells us that the bais hamikdash was destroyed על שלא ברכו בתורה תחילה because the Jewish people weren t reciting birchas Hatorah before learning. The Maharal asks, the nevi im tell us of many aveiros the Jewish people were transgressing so why does the gemara focus on this seemingly minor detail; there were much worse things going on!? The gemara is explaining the root of their entire problem. That generation was learning so much Torah and yet they were sinning; how could that happen? wouldn t the Torah protect them from doing aveiros? Chazal tell us that their Torah couldn t protect them because although they were learning they were unable to absorb the Torah because they were lacking the middah of hakaras hatov. They learned Torah without making birchas Hatorah revealing the lack of hakaras hatov for Torah that is necessary to ABSORB Torah. The bais hamikdash was destroyed because of the many heinous aveiros they engaged in, but the underlying cause of those aveiros, the reason their Torah couldn t protect them was their lack of appreciation and hakaras hatov. As we approach Shavuos and the time of kabbalas Hatorah we have to prepare ourselves to be able to receive the Torah. We have to make sure we are חיים - LIVING as Hashem intended and the key is to work on our sense of hakaras hatov. HKB H chose us to be His special nation and to represent Him to the world and infused our lives with meaning and purpose. We have to recognize all that Hashem has gifted us with and dedicate ourselves to do our utmost to repay it with our appreciation and our fealty to Hashem s Torah. That will allow us to truly receive the Torah and have it become part of who we are

What Actually Happened on the 6 th of סיון in the Year 2448? By Rabbi Elie Ginsparg The gemara in מסכת שבת דף פו: quotes a dispute as to the date when the Bnei Yisrael received the aseres hadibros. The תנא קמא says that the aseres hadibros were received on the 6 th of Sivan, whereas says that the Bnei Yisrael received the aseres hadibros on the 7 th of Sivan. On the 4 th day of Sivan רב יוסי Hashem said יט:י-יא{ וקדשתם היום ומחר }שמות (and sanctify them today and tomorrow) and (let them be ready for the third day). This means that the Bnei Yisrael are to והיו נכונים ליום השלישי sanctify themselves on the 4 th and 5 th of Sivan, since the aseres hadibros will be given on the third day, the 6 th of Sivan. Moshe told the Bnei Yisrael on the 4 th of Sivan - יט:יד{ היו נכנים לשלשת ימים }שמות (be ready for three days). The תנא קמא equates the expression be ready for three days with be ready for the third עשרת day. Accordingly, Moshe simply was delivering the message he received from Hashem, that the aseres hadibros were to be given on the third day, the 6 th of Sivan. However, רבי יוסי interprets that Moshe added a day of preparation. Hashem had said be ready for the third day, but Moshe said be ready for three days, and on the 4 th day the Bnei Yisrael would receive the aseres hadibros. Since Hashem agreed to Moshe s additional day, it follows that aseres hadibros got ready on the 4 th -6 th of Sivan and aseres hadibros were received on the 7 th of Sivan. The meforshim note that there is a dispute in halacha which is based on the dispute between the תנא קמא and יוסי.רב The psak halacha in that dispute follows יוסי.רב It follows, that according to the accepted halacha, the day the Bnei Yisrael received the aseres hadibros was the 7 th of Sivan. Additionally, it is known that the aseres hadibros were meant to be given on the 50 th day of the Omer. However, by adding a day of preparation it would seem that Moshe caused the aseres hadibros to be received on the 51 st day of the Omer and not the 50 th day. The above conclusions have caused many meforshim to note that it appears that we celebrate Shavuos a day early. We celebrate Shavuos on the 50 th day of the Omer/the 6 th of Sivan, but the Bnei Yisrael received the aseres hadibros of the 51 st day of the Omer the 7 th of Sivan. This question can be resolved with an insight suggested by the Maharal ישראל פרק כז(.)תפארת The Maharal explains that there are 2 components to every gift. There is the giver and the receiver. It is possible for the giver to give a gift on a particular day, yet the receiver only accepts the gift on another day. The Giver of the aseres hadibros, Hashem, gave the aseres hadibros on the 50 th day of the Omer the 6 th of Sivan. However, the receivers of the aseres hadibros (Moshe and Bnei Yisrael) needed another day of preparation before they were ready to receive the aseres hadibros. Therefore, although the aseres hadibros were conceptually given on the 6 th of Sivan, they were only actually received on the 7 th of Sivan. In order to understand how the Maharal s insight answers the question, the difference between a non-jewish and Jewish holiday must be understood. A non-jewish holiday commemorates a historical event. For example, July 4 th commemorates the day the Americans declared independence from the British in However, there is nothing different about July 4, 2018 as opposed to any other day in 2018, other than the fact that July 4 th happens to be the date that the Americans declared their independence back in In contrast, a Jewish holiday is a re-experiencing of a particular influence imparted into the world from Hashem. In other words, Yom Kippur doesn t simply commemorate the day the Jews received forgiveness for the sin of the golden calf. Rather, each Yom Kippur we re-experience Hashem s forgiveness. So too, Shavuos isn t simply a commemoration of the historical event of Bnei Yisrael receiving the aseres hadibros. Rather, each Shavuos we re-experience the particular influence that Hashem imparted into the world when he gave the aseres hadibros. Since we are re-experiencing what Hashem imparted to the world, the date we re-experience it is the date that Hashem gave the aseres hadibros, not the date the Bnei Yisrael received the aseres hadibros. In other words, the date that Bnei Yisrael received the aseres hadibros is a historical event, not worthy of a Jewish holiday. However, the date that Hashem gave and continues to give the aseres hadibros is the date worthy of a Jewish Holiday. - יעלה ויבא With this insight one can understand a couple more peculiar things about Shavuos. In Shavuos is referred to as זמן מתן תורתינו (the time of the giving of the Torah), whereas Pesach is referred to as זמן חרותינו (the time of our freedom) and Sukkos as זמן שמחתינו (the time of our happiness). To be consistent it would seem more logical to refer to Shavuos as זמן קבלת תורתינו (the time of our reception of the Torah). However, based on the above, this would be inaccurate Shavuos isn t when we received the Torah, but when Hashem gave the Torah. Another peculiar thing about Shavuos is that the Torah never describes Shavuos as a celebration of the giving of the Torah. Rather, the Torah always describes Shavuos in terms of being הבכורים.יום It would,(יעלה ויבא seem more logical for the Torah to highlight the main aspect of Shavuos (like it is highlighted in the giving of the Torah, and not the secondary agricultural element of Shavuos. This also can be explained based on the Maharal s insight. The holidays are given from Hashem for the benefit of the Bnei Yisrael. Accordingly, when giving the holiday, the Giver wants to focus on the benefits the holidays have for the recipients. Therefore, the focus on Pesach is the freedom from Egypt, the focus of Sukkos is the protection Bnei Yisrael enjoyed in the desert and the focus of Yom Kippur is the forgiveness Bnei Yisrael get for their sins. However, from the standpoint of the Giver, the Torah is a set of rules that the Bnei Yisrael must live by. It is like a yoke placed around the neck of Bnei Yisrael and described by chazal as being forced upon the Bnei Yisrael as if Mount Sinai was held over their heads threating to bury them if they didn t accept the Torah. Therefore, Hashem didn t want the focus of the Holiday he was making for the Bnei Yisrael to be the giving of the Torah. However, Bnei Yisrael as the receivers, willingly accepted the Torah. Bnei Yisrael תפילות and accepted the Torah out of love for Hashem. Accordingly, Bnei Yisrael in their נעשה ונשמע said can express their joy in having received the Torah given by Hashem on Shavuos, by focusing on the element of Shavuos which is זמן מתן תורתינו even if Hashem, as the Giver, didn t want that to have to be the focus of the holiday. זוכה This Shavuos, let us try to tap into the gift of Torah being offered by Hashem. We should all be to truly feel the experience of the giving of the Torah and develop within us the feelings of love and joy.תורה הקדושה to be the recipients of Hashem s greatest gift, the זוכה that we are Middos 24/7 Rabbi Yoel Yormark There is a well known custom to learn Pirkei Avos between Pesach and Shavuos. The first mishna in Pirkei Avos begins: Moshe received the Torah from Sinai and transmitted it to Yehoshua, and Yehoshua to the Elders, the Elders to the prophets, and the prophets to men of the great assembly. They said 3 things: be patient in judgment, set up many students, and make a fence around the Torah. Why is the very first thing, seemingly the most important, about being patient in judgment, before the importance of having many Torah students to help transmit the Torah? I think one answer is being patient in judgment, not rushing to make decisions about others, exemplifies very good middos. We should always try your best to judge others favorably. Torah! (respect) for others comes BEFORE ד ר ך א ר ץ respect, - Having proper ד ר ך א ר ץ ק ד מ ה ל ת ור ה Maybe this is why Pirkei Avos begins this way. Look at what happened to Rabbi Akiva s 24,000 students. They all died during this period between Pesach and Shavuos, because they were not respectful to each other. Not with just a slap on the wrist, but with death! This shows the crucial importance of good middos and the need to learn mussar every day to help us get these good middos. Pirkei Avos is mainly about good middos, and the first Mishna teaches us: Having good middos is not just a good idea; it is also part of the

.מ ס ינ י Torah which is also In Parshas Bamidbar, we see the exemplary middos of Moshe Rabeinu. There were 22,000 levi im and 22,273 firstborn of ר א ל ב נ י.י ש Hashem commanded Moshe for the firstborn of Bnei Yisrael to be redeemed by the levi im. The extra 273 firstborn of Bnei Yisrael would redeem themselves with 5 shekalim (coins). Rashi points out Moshe realized there was a problem: Moshe said, If I tell a firstborn of Bnei Yisrael to give his 5 shekalim, he will say to me: I was one of those who was already redeemed by a levi and I do not have to give the 5 shekalim. To solve this dilemma, Moshe brought 22,000 tickets, and wrote on each one ן ל ו י,ב and on the other 273 tickets, he wrote on each one מ ש ה ש ק ל ים.ח He then mixed them up - ב ן ל ו י and put them in a box, and each one drew a ticket according to the lottery. Moshe wrote the words 22,000 times, and - ח מ ש ה ש ק ל ים 273 times! How long did it take? Didn t Moshe have better things to do? Look how much work Moshe did to prevent the slightest amount of animosity and friction between them! Shavuos is the only Yom Tov that the date is not mentioned in the Torah. It only connects to Pesach by the counting of the omer. One reason given is because our commitment to learning Torah and having נ ע ש ה ו נ ש מ ע - 7 good middos applies everywhere and all the time, 24/7. As it says in Shemos, perek 24 pasuk Do it 24/7! Improving our middos 24/7 is also a very important part of preparing for the Yom Tov of.מ ת ן ת ור ת נ ו * * * * * מש ה ק ב ל ת ור ה מ ס ינ י, ומ ס ר ה ל יה וש ע - represents the mesorah, which can never be changed in any way. One of the most important " ומ ס ר ה" foundations of our mesorah is א מ ונ ת ח כ מ ים - Accepting what the gedolei hador teach us. Hashem told Moshe Rabeinu in Parshas Yisro: גם בך יאמינו לעולם - The Jewish people will believe your words forever.א מ ונ ת ח כ מ ים referring to the unshakeable foundation of yiddishkeit of The Torah states we must listen to the Rabbis and Torah Judges: "ה שפ ט ב י מ ים ה ה ם" )ד ב ר ים פרק יז, פסוק ט( "ו ה שפ ט ים ב י מ ים ה ה ם" )ד ב ר ים פרק יט, פסוק יז( "י פ ת ח ב ד ור ו כ ש מ וא ל ב ד ור ו צ ר י ך א ת ה ל נ ה וג ב ו כ ב וד" :ראש השנה Rashi teaches us, quoting the gemara in The Torah commands us to listen to the rabbanim, poskim, and talmidei chachamim of the times we צ ר י ך א ת ה ל נ ה וג ב ו כ ב וד - out live in, even if they are not as great as previous generations! As Rashi points We must also give them great honor. When Bnei Yisrael left Mitzrayim, Pharoah convinced his whole army to chase after them. Moshe told Bnei Yisrael to turn back towards Mitzrayim. One would think there would be a negative reaction towards Moshe, because they needed to run away from them, and certainly not go towards them! Nevertheless, the pasuk says: פרק יד,פסוק ד( "ו י ע ש ו כ ן" (שמות- and they did it! Rashi points out this tells us the greatness of Bnei Yisrael, in that they listened to Moshe. This teaches us we must always follow da as Torah and listen to the Rabbis, poskim, and the leaders of our generation, even if we don t understand. The Mishnah in Sanhedrin - י משנה א,פרק says these have no portion in Olam Haba: 1) someone who says Torah is not from Hashem 2) someone who denies ת ח י ת ה מ ת ים is from the Torah 3) An apikores. What is an apikores? The רע"ב on the Mishna says: ש מ ב ז ה ת ל מ יד י ח כ מ ים which means someone who belittles and degrades da as Torah and talmidei chachamim! Most people are not מ ב ז ה the Torah itself, but unfortunately may be lax about criticizing and degrading talmidei chachamim. In other words, one can learn and teach Torah and do all the mitzvos, going to minyan 3 times a day, giving tzadaka, etc but if they constantly belittle, make fun, and degrade da as Torah and talmidei chachamim; it is not only disrespectful and lashon hara, but one is also are an apikores and lose Olam Haba! 11 T E RU M A H & MA ASER Instructions for Separating Terumah and Ma aser חנוכה תשע ז / 2016 Reprinted with permission from the crc - Revised December Periodically, we are fortunate enough to obtain fruits and vegetables from Eretz Yisroel (Israel). Due to the sanctity of Eretz Yisroel there are special obligations that apply to its produce. Namely, before eating the produce we must determine that it is not from shemittah or arlah, 1 and then we separate certain tithes, known as terumah and ma aser. These instructions will explain (a) how to separate the tithes, (b) the wording that should be said, and (c) how to dispose of certain portions of the tithes, for the most common situations. [A bracha is typically not recited, due to the possibility that the separations were already made in Eretz Yisroel.] Furthermore, this procedure will (d) only be effective if the value of the produce is at least 25 (American) cents, and (e) will require the use and eventual discarding of a coin worth at least 5 cents. 1. The following procedure should be performed for each type of food (e.g. clementine, avocado, pepper, parsley) separately. In this example, we will assume the procedure is being performed for clementines. 2. Separate a bit more than 1% of the total clementines and place that portion on a plate. In the coming paragraphs, the clementines on the plate will be conceptually divided into two parts: one part is equal to 1% of the total clementines, and the other part is comprised of the rest of the food on the plate. מ letter 3. Use a permanent marker to mark the designated coin with the Hebrew and place the coin on the plate. 4. Say the following: a. The portion of clementines in the northern side of the plate which is equivalent to the bit more than 1% of the total clementines, is hereby designated as terumah gedolah. b. The remaining portion of clementines on the plate, plus nine additional portions equal to that portion located on the northern side of the clementines which are off the plate, are hereby designated as ma aser rishon. c. The portion of ma aser rishon which is on the plate is hereby designated as terumas ma aser. d. 10% of the clementines which have not been designated and which are located on the southern side of the clementines which are off the plate, shall hereby be designated as ma aser sheini or ma aser ani as appropriate. 2 e. If ma aser sheini was designated, its kedushah, plus the required extra chomesh (25%), should hereby be redeemed onto the coin which is on the plate. * If a person does not have enough time to say the entire wording noted above (a-e), they should say the following abbreviated text: I hereby separate and designate terumos and ma asros and the redemption of ma aser sheini, as needed, in accordance with the details contained on the crc website. 5. The clementine portions which are on the plate may not be eaten or used in any manner. Rather, they should be placed into a bag and disposed of in a dignified manner. 6. The designated coin should be defaced and thrown into a lake or river The above procedure should be repeated for each type of food (e.g. avocado, pepper, parsley) with a separate coin. 1 Special restrictions apply to food which grows in Israel during the shemittah (Sabbatical) year. The most recent of these septennial events was in the year 5775 (Sep Sep. 2015) and the next one will be in 5782 (Sep Sep. 2022). For the first three years after a tree is planted the fruit which grows is forbidden as arlah, and there are special restrictions on fruit which grows in the fourth year. [Arlah applies in a more limited fashion for fruit which grows out of Israel.] 2 During the 1 st, 2 nd, 4 th, and 5 th years of every shemittah cycle (corresponding to 5776, 5777, 5779, and 5780, respectively in the current shemittah cycle) one must designate approximately 9% of each batch of produce as ma aser sheini, and during the 3 rd and 6 th year of the cycle (corresponding to 5778 and 5781 of the current cycle) that amount is instead designated as ma aser ani. 3 This procedure must be completed before Pesach of the 4 th and 7 th year of the shemittah cycle (which will be in 5779/2019 and 5782/2022), but to avoid complications it seems prudent to do it as soon as possible.
