Sir, the day before yesterday, at the fag end of the day, while completing a Business, you had said that the Business listed for a day did not require permission of the House to be carried out after 6 o'clock or 7 o'clock. I draw your attention towards the rule number... MR. DEPUTY CHAIRMAN: I don't remember having said like that.

Since you have raised a question about a discussion which took place two days back, let me first go through that. SHRI MADHUSUDAN MISTRY: Sir, it happened the day before yesterday; not two days back. MR. DEPUTY CHAIRMAN: Now, I don't remember because whatever I had said was on the spur of the moment, maybe off-the-cuff remarks. Therefore, I cannot reply to that now. But, I will tell you as to what I meant, if I am correct. I will make that point very clear and my thinking about that. At 6.00 p.m., if a Business really is being transacted or a discussion is going on, the Chair, suo motu, need not take initiative in asking whether we should continue with it or not because the Chair always tries to facilitate the Business. DEPUTY CHAIRMAN (CONTD.): I believe, it is the duty of the Deputy Chairman or, for that matter, whoever is in the Chair, to try to facilitate the conduct of the House. That day, at 6.00 p.m., the discussion was going on,

8 8 and that was a very good discussion, I remember, a very good discussion in perfect order. At least, I cannot suo motu interrupt, and, then ask, do you wish to continue. What I feel is that when the House is smoothly conducting the discussion, everybody is sitting and listening, everybody is participating, this means that the House wants the discussion. Why should the Chair interfere and ask, do you wish to continue? However,...(Interruptions)... However, had any Member risen at 6.00 p.m. and raised the issue, I would have considered that and I would have taken the consent of the House. Sir, both the pens were supplied officially. And if there were two pens, which one was the official? Then, both had to be cancelled.

Deputy Chairman, Sir, I would like to bring to the attention of the House an urgent and important matter. The Lokpal Act of 2013 covers among others, trustees and senior office bearers of NGOs that receive FCRA over Rs.10 lakhs per year and/or Central Government funding over Rs.1 crore. All trustees and other senior officials of such NGOs are required to disclose assets and liabilities of themselves, their spouse, and dependent children. This information will be placed in the public domain on the competent Ministry's website. A notification issued on June 24 th requires the disclosure to be made before July 31 st, failing which,

29 29 any asset would be presumed to have been acquired through corrupt means, leading to possible penal action. As the disclosures are required to be made before 31 st July, failing which there will be dire consequences, this issue needs to be addressed urgently. While NGOs and charitable institutions work for the public, they are voluntary and regulated by several laws including the Charity Commissioner and the Registrar of Societies and Income Tax and FCRA. Trustees of these NGOs are not public servants because they give their time and some also give their financial support on a voluntary basis. Given that the detailed information about their personal/private assets would be in the public domain, many trustees are apprehensive that they would be subject to possible harassment and potential extortion. Some of them have resigned from the positions to avoid this consequence. Therefore, this could deprive many NGOs from receiving guidance from credible and experienced trustees. In any case, all such NGOs have detailed disclosure procedures. If there are NGOs that are not transparent and corrupt, strong action can always be taken against them. However, to paint all NGOs with the same brush will weaken, disrupt and demoralize the entire voluntary sector. One temporary solution could be to extend the date by a few months from 31 st July. However, this is a short

Expressing the same concerns, we shall keep in mind the sentiments of the House in this regard and see to it that a broad consensus is evolved on this issue and then move forward. 35 35 CONCERN OVER DELAY IN DISPENSATION OF JUSTICE DUE TO VACANT POSTS OF JUDGES IN HIGH COURTS SHRI ANAND SHARMA (HIMACHAL PRADESH): Sir, I want to draw the attention of the House to a very serious situation prevailing in the country with regard to access to justice and dispensation of justice, at a time when there are over five crore criminal and civil cases pending in various courts of India. People are in prison; these are poor people, who cannot even pay for their bail or get a surety and they have been languishing in prisons for a period longer than the sentence to be given to them, if they were to be convicted. But the trials have not taken place. Why is this happening? There is a large number of pendency in the subordinate courts of the country, in the High Courts of the country and even in the Supreme Court of India. Sir, 470 posts of High Court Judges are lying vacant in 24 High Courts of India, as of today. For the last one year, the Collegium, the Chief Justice, have made recommendations to the Government, but after the NJAC judgement, the Government seems to be very angry and on a path of confrontation with the Collegium of the Supreme Court. Therefore, the attempt of this Government is to block the appointments and force a situation where a Memorandum on the Procedure of Appointments (MPA),

36 36 as proposed by the Collegium of the Supreme Court is diluted, so that people owing allegiance to a particular ideology, people having certain leanings, will get accommodated. Sir, the situation is so serious that a few months ago, the present Chief Justice of India, broke down and wept before the Prime Minister of India. Months have passed and the Prime Minister is unmoved. The Prime Minister has not taken any action, nor his Government. Even in the State of UP, which the Prime Minister represents in the other House of Parliament, there are 40 vacancies of the High Court Judges. So this Government, when it talks of justice to all, has to address this issue and explain as to why it is blocking the names which have been recommended by the High Court Collegiums, by the Supreme Court Collegium, and when they will fill these vacancies so that poor people can get justice. 41 41 KS/1J/11.40 SHRIMATI KANIMOZHI (contd.): He was a student of M.D. (General Medicine). He was the first generation graduate from his family. He was the son of a textile worker from Tiruppur. When this boy came to Delhi to join the AIIMS, he was interested in General Medicine, but he could only get admission in Pathology. Still, he did not give up. He went through the first year of his course in Pathology and appeared again in the examination to make sure that he gets into General Medicine. The student s hard work was rewarded and he finally got into General Medicine, and he was very happy about getting into a course of his choice. But this student was found dead. The Police are keen on saying that it was a suicide or a death due to accidental overdose. Sir, there is a foul play. Why would a student, who was very happy about what he was doing, who finally got into his dream course, try to commit suicide? He was a very hardworking student and one who had no history of drug abuse. There is another thing which is very suspicious. He was a right-handed person. 47 47 reached Bangladesh where the origin has been confirmed. Since 1985 this is the first time that this disease has come in South Asia, and that is why there is no knowledge about this disease. This disease is caused by a virus called magnaporthe oryzae about which India has no knowledge. It is supposedly caused by repeated and excessive use of nitrogen and fertizer. It spreads very fast. But, Sir, the Government has already gone on record and said that there is no reason for any panic. This is a wheat fungus and we can take care of it. This disease is also known to resist chemical treatment and genetic treatment. Sir, the damage caused by this disease in various other countries is enough to feed 60 million people every year. Sir, already 15,000 acres of land around West Bengal has been damaged on the Bangladeshi side. We don't know whether it is a matter of few months or days or weeks when this disease will reach West Bengal and other parts of India. Through you, Sir, I would request the hon. Minister to urgently take steps to prevent this disease from reaching India and to make farmers aware as to how to combat this disease because millions of farmers will also be affected.
