Note: I (William Sirman)am the free sole and lawful owner of the above bargained premises and am lawfully seized and possessed of the same in my own proper right as a good perfect and absolute Estate of Inheritance and have in myself good right full power and lawful authority to grant. From whom did he inherit this land? Also, could this be the William Sirman who married Dinah Waggoner-Garrard-Jasper after 1760? She was a sister of William Waggoner (Will: 1755) who sold land to Thomas Surman in 1753.

Consideration: Twelve pounds proclamation money Land Description: a certain lott or parcel of land lying and being in Hyde County aforesaidon the South Side of Mattamuskett Lake being part of a tract of land containing six-hundred acres formerly belonging to Patrick White deceased and now divided between his heirs by Will. The lot containing one hundred and twenty five acres more or less it being the lot between John Butts lot and Caleb Whites lot. Beginning at a marked Gum standing on the said lake next to Butts Lott and running from thence or South East course along a line of marked trees to Patrick Whites back line thence along Patrick Whites back line the courses as the originals patten directs so far as will contain one hundred and twenty five acres to a line between Mastisons (?) D Be it remembered that at the prior Term of the Court aforesaid a writ was brought in said Court by Petitioner in the words and figures following. Hyde County. Court of Pleas and Quarter Sessions November Term To the worshipful?? Justices of the said Court. The Petition of Daniel Murray humbly complaining herewith unto the Court that Peter Sermon late of said County died some time in the year seized and possessed of a tract of land on Mattamuskeet Lake, adjoining the lands of??? D. Hugh Jones and your Petitioner, containing Two hundred and eighty four acres. Your petitioner further shows unto your worships that the said Peter Sirmon left him surviving as his heirs at law, Elizabeth, who intermarried with William Berry, in the lifetime of the said Peter, Hosea Sirmon and Gideon Sirmon, and also Ruben Berry, John Berry, and Rachel Berry, who has intermarried with Sparrow Midgett, and Lavinia Berry, children of Nancy Sirmon said Peter's daughter which said Nancy who intermarried with William Berry and she died before said Peter, leaving her said?? surviving. Your petitioner further shows unto your worshipful Court, that the said Two hundred and eighty four acres of land have been by an order of the Court of Pleas and Quarter Sessions for the County of Hyde at November Term 1830 and continued to August Term 1831, divided unto four Parts and set apart and allowed to the heirs at-law-of the said Peter Sirmon, and that lot number one of said division was set apart and allowed to your Petitioner Daniel Murray, who has purchased from and become the assignee of one of the heirs of the said Peter and lot numbers Two containing by Survey Sixty six acres of land, was set apart and allotted to Reuben Berry, John Berry, Lavinia Berry and Rachel Berry who had intermarried with Sparrow Midgett, all of whom are the children and heirs at law of Nancy Berry daughter of said Peter. Lot number Three and four of the said Tract of land were set apart and allotted to your petitioner Daniel Murray who has regularly purchased the same from and became the assignee of the heirs at law of the said Peter Sirmon, who were entitled to the same as will more fully appear by the report of the commission appointed to divide the same, which is hereunto annexed and your Petitioner prays may be taken and considered as or part fo the Petition. Your petitioner further shows unto your worships that Andrew Shanklin has purchased from and become the owner of the undivided shares and rights of Reuben Berry, and John Berry in and to one half of the said lot number Two containing Sixty Six acres of land and also the right of Rachel Berry whereby he owns 3/4 of said lot and that your petitioner has purchased from and become the assignee of Lavinia Berry who is entitled to one fourth part of the aforesaid sixty six acres of land all by right and where is 1/4 in said lots as here?? To them. Your petitioner therefore prays your worships to appoint five commissioners unconnected with the parties interested in said lands either by?? Or?? With power for them or any three of them to divide the aforesaid sixty six acres of land. Among the persons entitled to the land so that your petitioner

Your petitioner prays your worships to order a copy of the petition and a??? to and be served upon the said Andrew Shanklin to be and appear at the next Term of your worshipful Court to be held for said County on the last Monday of February next, and then and there show cause if any they have why the prayer of your Petitioner should not be granted and that your worships will make such other and further order in the?? Whereupon a copy of the foregoing petition having been issued to the Sheriff of the County of Hyde to be served upon the said Andrew Shanklin and Sparrow Midgett and his wife Rachel accompanied by a subpoena in the words and figures following...viz State of North Carolina To the Sheriff of Hyde County Greeting. You are hereby commanded to summon Andres Shanklin and Sparrow Midgett and wife Rachael, personally to be and appear before the Justices of the Court of Plead and Quarter Sessions to be held for the County of Hyde at the Court House in said County on the last Monday of February next to show cause if any they have why the Petition of Daniel Murray as prayed for within should not be granted, a copy of which is herewith sent to serve them the said Shanklin and Midgett with. Here on fail not and have you then and there this writ. Andrew Shanklin to the Petition of Daniel Murray. Defendant?? to himself all right of exception to the errors and imperfections of the Plaintiffs Petition respectfully?? unto your worships, that he is the owner of the share of land mentioned in Plaintiffs petition a formerly belonging to Larisa Berry, that he has a deed from her for said land executed proven by to the land under which plaintiff and defendant further shows that he is the owner of the shares formerly belonging to Reuben Berry and John Berry and Rachael Midgett and said Murray has no part right to the same. From which verdict and?? the defendant craved and obtained an appeal to the next Superior Court of Law for the County by entering into and giving the Bond and Security herewith sought.
