1 1 By: Karl Kassel, Mayor 2 Introduced: June 14, s FAIRBANKS NORTH STAR BOROUGH 6 ~ ORDINANCE NO ,6 s 9 AN ORDINANCE PROVIDING FOR THE SALE OF REAL PROPERTY to ACQUIRED THROUGH TAX FORECLOSURE WHEREAS, The Fairbanks North Star Borough (Borough) holds annual 13 sales of properties acquired through tax foreclosure; and 14 Is WHEREAS, Those properties listed in Appendix A hereto have been 16 transferred to the Borough for delinquent real property taxes for the year 2015 or earlier; 1~ and I g 19 WHEREAS, Those properties listed in Appendix A are not required for a 20 public purpose and have not been repurchased by the former record owner NOW, THEREFORE, BE IT ORDAINED by the Assembly of the Fairbanks 23 North Star Borough: 24 2s Section 1. Classification. This ordinance is not of a general and 26 permanent nature and shall not be codified. 27 2s Section 2. The Fairbanks North Star Borough Assembly hereby 29 authorizes the Borough Mayor to sell the Borough's interest in the property described in 3o Appendix A hereto, provided all amounts due have not been paid on behalf of the 31 record owner by close of business on August 24, The funds received shall be 32 disbursed as required by Alaska Statutes Fairbanks North Star Borough, Alaska ORDINANCE NO D Page 1 of 21

2 34 Section 3. Sale of such real property shall be by sealed bids submitted 35 to the Financial Services department, Treasury and Budget division. Sealed bids shall 36 be pre-opened beginning at 7:00 p.m. on August 24, 2018, in the Borough's Chizmar 3~ Room, Juanita Helms Administration Center, 907 Terminal Street, Fairbanks, Alaska. 3s The results of these sealed bids will be announced beginning at 12:00 p.m. (noon) on 39 Saturday, August 25, After all parcels that received a sealed bid have been 40 offered, and all agreements to purchase have been signed, all remaining properties 41 shall be offered by outcry auction Section 4. The Borough shall publish a list of parcels for sale and the 44 minimum price for each. The sales amount shall not be less than the sum of: 45 a. The full amount applicable under the judgment and decree with interest as 46 specified therein from the date of entry of the judgment of foreclosure to the date of 47 sale; 4s b. All other delinquent taxes assessed and levied against the property as 49 though it had continued in private ownership; so c. All penalties and interest associated with such delinquent taxes; sl d. All costs of foreclosure and sale applicable to the property. 52 s3 Section 5. All sales shall be on the following basis: 54 a. A down payment in the form of a cashier's check or money order in an 55 amount equal to not less than 25% of the bid amount shall be submitted with each bid. 56 b. The balance due shall be paid by the winning bidder not later than three s~ (3) business days after the bids are opened. After the payment in full has been ss s9 received, the Borough shall execute a Tax Foreclosure Sale Deed in favor of the purchaser. 6o c. A bidder shall forfeit his down payment to the Borough if a parcel is 61 offered to the bidder and the bidder either fails to comply fully with the terms of the sale, 62 or the bidder is determined to be anon-responsive bidder. 3 64 d. All bidders or their agents are required to be present at the opening of the bids. e. The date and time of submittal of each bid shall be recorded. In the event 67 of a tie bid, the bid submitted the earliest will be the winning bid ~o ~l Section 6. Any person eighteen (18) years of age or older, is eligible to participate in this sale, except that the following persons may not participate in their own name or in the name of their spouse, dependent child, or solely-owned or family-owned business: a. Borough Mayor b. Borough Chief of Staff c. Borough Attorney d. Employees of the division of Treasury and Budget and the Chief Financial 77 ~s 79 e.
