I Jarrald Powell of the County of Caswell and State of North Carolina do hereby constitute and appoint this to be my last Will and Testament. In the first place I will unto my wife Elizabeth Powell for and during her widowhood - all the lands, Negroes, Stock of all kinds, and personal property of every description and after her marriage or Death to be Equally divided amongst my Seven Children, to wit: Eliza, James, Jackson, Mary Jane, Mastin, Richard and Francis - It is further my will thatmy said Children have a good plain English Education. POWELL: Will of Mastin Powell, Halifax Co. VA Library of Virginia, Halifax County, Virginia, Will Book #21 pages , dated 27 August 1846, probated 26 October 1846 Will of Mastin Powell In the name of God Amen. I Mastin Powel of the County of Halifax and State of Virginia being of sound disposing mind and memory and knowing the mortality of the flesh that it is appointed for man to die do make, ordain, constitute and appoint this my last will and testament in manner and form following to wit: I will that my Executors herein after named pay all my just debts. 1st Item: Having given to my nine children in money and property to the amount of eight thousand two hundred and forty six dollars and thirty six cents to wit: To my son Carter Powell seven hundred and forty dollars To my daughter Elizabeth Powell eight hundred and twenty dollars To my son Biggers Powell nine hundred and eighty five dollars To my son John B. Yarbrough seven hundred and fifteen dollars 2nd Item: I will that these several amounts be taken from their portions of the division of my estate. 3rd Item: I give to my beloved wife during her natural life all of my Land to be rented out at the direction of my Executors also one third part of my slaves giving her liberty to select such as may suit her also one year's support, two work horses Two good feather beds and furniture. 4th Item: I will that my executors sell the balance of my slaves household and kitchen furniture plantation tools stock of every description and all property I may die possessed of on a credit of twelve months and divide the money equally among the above nine named children. 5th Item: I will that after the death of my wife Mary Powell my executors sell the land and all the life property of her and equally divide the same among by nine above named children. 6th Item: I hereby appoint Isaac Satterfield and my son William Powell executors to this my last will and testament hereby revoking all other or former wills by me made. And on the motion of Isaac Satterfield one of the executors therein named who made oath thereto according to law and with Richard Carter Senior and John N. Satterfield his securities entered into and acknowledged a bond on the penalty of $30,000 conditioned according to law, certificate is granted to him for obtaining probate of said will in due form. Powell of the County of Caswell and State of North Carolina of the one part and William J. Powell of County of Halifax and State of Virginia of the other part. Witnesseth for and in consideration of the sum of fifty Dollars to me in hand paid by the said William J. Powell at or before the sealing and delivery of these presents the receipt whereof is hereby acknowledged the said Mastin Powell doth hereby give, grant, sell and transfer to the said William J. Powell all of the interest in and to the estate of his mother Elizabeth Powell's undivided interest in her father Mastin Powell, deceased, Estate now in the hands of her mother Mary Powell of Halifax County and State of Virginia which she is to hold during her natural life which interest consists of one sixth part of one ninth of said estate to have and to hold the aforesaid interest to him the aforesaid William J. Powell of the County of Caswell and State of North Carolina of the one part and Mastin Powell of the County of Halifax and State of Virginia "; $50 for "a certain piece of parcel of land lying in the county of Caswell State of North Carolina on the waters of little creek adjoining the lands of him the said Mastin Powell, Elizabeth Powell and others containing by survey twenty six acres " William J. Powell Proved by the oath of Carter Powell and ordered recorded 20 March 1843 [Note: The only lot containing 26 acres in the division is lot #6 that went William Powell. The above deed adds the middle initial "J." to the name "William Powell" in the division of lands in the deed in FF This allows us to tie the "Jackson Powell" in the will to the "William Powell" in the division in FF 57-58, and to the "William J. Powell" in this deed. This gives us a full name "William Jackson Powell" and by implication this is also the full name of the William J. Powell who is the son of Mastin Powell and who is refered to as "William J. Powell Sr." in Halifax VA deeds (such as Halifax County Virginia Deeds, Book 56, page 61) with "William J. Powell Jr." who is the William J. Witnesseth that whereas the aforesaid Carter Powell hath advanced to the said Elizabeth Powell the sum of one hundred and seventy three dollars or thereabouts in part of what is coming or due to her from the estate of her father Mastin

9 9 Powell deceased now in consideration of the said advancement made to me as aforesaid and in consideration of the sum of one dollar to me in hand paid by the said Carter Powell at or before the signing sealing and delivering of these presents the receipt whereof is hereby acknowledged she the said Elizabeth Powell doth give grant sell and transfer to the said Carter Powell all of her interest in and to the said estate of her deceased father Mastin Powell now in the hands of Isaac Satterfield, executor out of which the said Carter Powell is to fully satisfy and pay himself for the amount advanced to me as aforesaid together with the accruing interest thereon and also such and further advancements that he may at any time make to me on account of my interest in the estate aforesaid. And should there be any balance in his hands or in the hands of the executor aforesaid when the estate shall have fully wound up and settled the same is to be paid to the said Elizabeth Powell her heirs executors administrators or assigns.
