3 MEMORANDUM To: From: Planning and Zoning Commission Kelvin Knauf, Director of Planning and Community Development Subject: Consider declaring City-owned property located at 1705 MacArthur Drive (formerly use by City maintenance staff) as surplus property and authorize the city manager to proceed with the sale or exchange of the property Date: August 28, 2018 Background The City owns property located at 1705 MacArthur Drive. This is the old fire station that, until Hurricane Harvey, was used by the parks maintenance staff. The staff has since moved to the Armory Building. The sale of this property has been reviewed by the departments and no department has a need for the property. The City Charter requires that before there is a sale or exchange of City property, it must first be submitted to and considered by the Planning and Zoning Commission for a recommendation to the City Council. The Comprehensive Plan does not address the disposal of City property and leaves this issue to the discretion of the Planning and Zoning Commission and City Council. Included in your agenda packet are a ground photo of the property and an aerial photo of the property with a red line showing the area requested to be declared surplus property. The Planning and Zoning Commission should vote on whether or not to recommend that the property at 1705 MacArthur Drive be declared surplus property.

6 PLANNING AND ZONING COMMISSION & CITY COUNCIL MEETING MINUTES TUESDAY, JUNE 5, 2018 The Orange Planning and Zoning Commission and City Council met on Tuesday, June 5, 2018, in the meeting room of the Orange Public Library with the following members present to-wit: Commissioners Present: Weldon Smith Chairman Joe Love... 7 a. Case No. 18:05. Conduct a public hearing concerning a request for a preliminary plat approval submitted by Sam Peveto for the Cypress Shadows Estates Phase II subdivision Mr. Knauf stated that is a preliminary plat filed by Sam Peveto for Cypress Shadows Estates Phase II subdivision and this is located adjacent to the city limits on the north side, just north of Chasse Ridge. He stated this has been discussed for several years now and have been working it back and forth and it actually came before the planning and zoning commission and city council a year ago and there were some problems and that one was ultimately rejected. Mr. Knauf stated since that time, city staff, the drainage district and others have been working with Mr. Peveto to consider the plat and make the necessary changes. Mr. Peveto has also constructed a detention pond out there based upon the drainage study that he paid for and was submitted to the city staff. City staff is in agreement with that study. He stated one of the concerns last year was at that time Mr. Peveto was requesting asphalt streets and since that time, Mr. Peveto is proposing concrete streets and actually had the design cross section for the streets designed by an engineering firm and their design was submitted to the city. Mr. Knauf stated that this is a twenty-two (22) lot subdivision and there will be one entrance off of FM 1130, with a looped street system. A couple of the streets are stubbed out for future extension of those streets should the property adjacent to the residential lots be developed. He stated this is an opportunity for the public to comment on this subdivision in Cypress Shadows Estates Phase II subdivision and give us their comments/questions. It is also an opportunity for the planning and zoning commission and the city council to ask any questions about the preliminary plat as well and the planning and zoning commission will consider recommendation to the city council. Public hearing opened at 5:33 p.m. Rex Peveto 118 Border, Orange, TX: Attorney, Rex Peveto stated that Mr. Peveto has been working on this for quite a while and there were a lot of concerns initially about drainage. For the past year, Mr. Peveto has hired an engineering firm that has worked with the city and has worked with Orange County Drainage District and there has been a lot of back and forth. He stated the detention pond was built, levies were built and different ditches were built to satisfy the engineering plan, to satisfy the drainage district as well as the city and now believes everybody is on board. He stated there was another question in regards to the streets and just adding the concrete streets adds about $27,000 per acre to this project. There is really not a lot of projects going on in the area with regards to neighborhoods so he has decided to go ahead and do the concrete streets. He will have to charge more per acre for the lots and does after talking to real estate agents believe that he will be able to make up that cost. He stated he would be happy to answer any questions today and knows there is some people here from Chasse Ridge next door that have concerns about the drainage and would be happy to answer any questions about that. Mr. Knauf asked Mr. Rex Peveto to go over the variances that he is requesting. Mr. Rex Peveto stated yes. He stated there are some variances that were requested that will go along with other neighborhoods that have been developed recently. He stated the variances that 2 Page 7 of 18

8 they are requiring deal with fire hydrants just due to cost, the requirement that street lights be installed Battlin Bear Estates is another subdivision that Mr. Peveto put in and security lights ended up getting put up every two hundred feet or so and it is well lit so there is a subdivision variance request for street lights. He stated sidewalks asking for a variance and there is one block that in the way the subdivision was put together that is longer than the twelve hundred linear feet but not by much so asking for a variance on that one block and then open ditches. Have discussed all of these variances with the city and don t believe they have a problem with them but again will answer any questions. Chairman Smith asked for any public comments. Michael Hambrick 3220 Chasse Ridge, Orange, TX: Mr. Hambrick stated that their lot backs up to the drainage ditch on the south side and the only question he had was about the retention pond. Understands they did a study but was curious to know if the retention pond was what goes in, goes out and is not really going to change the flow going through the drainage ditch behind their addition. That was a big concern with the sheer volume of drainage that goes through the ditch. David Dubose 6300 Chasse Stone, Orange, TX: Mr. Dubose stated on one hand he would like to see Orange County grow but on the other hand wants to make sure that it grows with good quality places to live. His question is if we have a detention pond, there is a drainage problem but who maintains the detention pond does Peveto maintain the detention pond or does the city council maintain or the city of Orange? Or does Orange County Drainage District or something the county is going to have to manage? So after it is all said and done and the developer has got his money and is gone, who manages the detention pond after that so we can continue to have the drainage of the water? Mr. Knauf stated that the detention pond takes the storm water off of the property and temporarily detains it and then releases it to where it would be released at the same rate as what would natural would be. He stated there is going to be natural runoff on the property anyway, so detention pond slows it so that there would not be any more runoff that what would naturally occur. Mr. Knauf stated as far as maintenance of the detention pond, Mr. Peveto has proposed creating a homeowners association and the homeowners association would be responsible for maintenance of the detention pond. Mr. Rex Peveto stated he believed Mr. Knauf answered but did want to answer one of the questions in regards to the Chasse ditch. There is a levy in place and only two hundred foot of the new subdivision will need to drain into the Chasse ditch, the rest of the water on the whole subdivision drains into the detention pond and comes out to a back ditch along the canal. Chairman Smith stated the two items from the last meeting where they denied it was the flooding concern and the streets. Believes from what has been said, those two items have been addressed and are no longer of concern. Mr. Knauf stated yes that is correct. Chairman Smith stated his next questions were on the other variances and it seems like on the application that there has been 3 Page 8 of 18

9 a variance for every city regulation and would like to ask why. Take them one at a time. Mr. Rex eveto stated that Sam Peveto may have to answer some of those but would do best he could. Chairman Smith stated the fire hydrants some of the concern was the cost of it. Mr. Rex Peveto stated just running the water lines to every lot is cost prohibitive. The Battlin Bear subdivision and the Quiet Country subdivision that he has put in and that are near this one have the same variances on all of them and the requests were granted on those just because of the costs involved. Chairman Smith stated that for fire protection they are going to rely on the volunteer fire department. Mr. Sam Peveto stated yes just like everybody else in the county. Chairman Smith asked about the street lights. Sam Peveto 1299 Kayla, Orange, TX: Mr. Sam Peveto stated in Battlin Bears they put security lights and is actually better than street lights because about every two hundred foot is a pole is set. If you have been in Battlin Bear now, it is well lit. Chairman Smith asked who is responsible for paying for those lights. Mr. Sam Peveto stated the homeowners. Chairman Smith asked if he was a requesting a variance to what was required and is going to put the burden on the homeowners. Mr. Sam Peveto stated yes. Chairman Smith asked about the open ditches. Mr. Sam Peveto stated the only thing about curb and gutter, the bad thing is the concrete in high enough rains it floods. Chairman Smith asked if the reason he is asking for a variance for open ditches because if not his subdivision would flood. Mr. Sam Peveto stated if it was like Chasse it would flood, the water goes in the street and holds in the street and with open ditches all go to the detention pond. Chairman Smith asked if there had been a study done for that variance if they did not have open ditches, that it would flood or how do you know that. Mr. Sam Peveto stated from the engineering study. Chairman Smith asked about the sidewalks. Mr. Sam Peveto stated it is just not feasible with open ditches. Chairman Smith asked about the twelve hundred foot block requirement. Mr. Sam Peveto stated it is just the way the subdivision was cut and on the road survey that was where the sway was and we put the road in the sway and it just ended up being a little further. Chairman Smith referred to the attorney letter where he stated that the variances are needed to make the subdivision an economically viable project and still allow the subdivision to be attractive to buyers of residential property. Chairman Smith asked that some of the reasons for the variances are for economic reasons. Mr. Sam Peveto stated yes. Chairman Smith stated that in the city code of ordinances says that monetary hardship for the subdivider, standing alone shall not be undue hardship which denies us the right to get that variance. Mr. Knauf asked which section he was quoting. Chairman Smith stated 9107 section 2. Vice Chairman Love stated that there is a difference between financial hardship and what is economic too. Mr. Knauf stated that our reading is that financial hardship is not part of that requirement. Chairman Smith stated that so any variance that someone asks for monetary reasons, we are ok to do that. Mr. Knauf stated in platting. He stated there are other variances that go before the Board of Adjustment, that you 4 Page 9 of 18

10 can t have a financial hardship based on reason but in platting there is no reason. Chairman Smith asked what the status of the lawsuit that they had from last year. Attorney John Cash Smith stated dismissed. Commissioner Mortimer stated that some of the variances are probably because what he is seeing here is this is a rural type situation and most of those cases you will see like open ditches, streetlights and that s not his issue but his issue goes back to drainage. He asked that when it comes to building the streets, the final plat would not be issued until those streets are built and approved by an engineer. Mr. Knauf stated that is correct. Under the ordinance he has a choice whether to construct the improvements or whether to file a bond or grant financial instrument and he is choosing to actually construct the improvements. So the construction of those improvements will be on the final plat and the final plat will not come before you until those improvements have been constructed and his engineer has certified that they meet his specifications. Commissioner Mortimer asked about the home owners association being established and covenants. Mr. Rex Peveto stated yes and this has been going on with the Orange County Drainage District as well with the city to prepare the homeowners bylaws as well as that they are going to be required to do certain things and one of which is to keep up the detention pond. Commissioner Mortimer asked so those have already been presented to the Drainage District and to the city. Mr. Rex Peveto stated yes and changes have been made that they requested. Commissioner Mortimer asked if that was acceptable and will take care of our needs. Mr. Knauf stated yes and we are happy with those but do not have authority to actually approve the home owners association but the way they are written, we are happy with them and so is the Drainage District. Commissioner Mortimer asked about the possibility of another phase with the stub outs at the far end of the subdivision and if this drainage plan takes in to account runoff for that. Mr. Rex Peveto stated yes. Commissioner McKenna stated that having sat here before last year on this commission, she appreciates the considerable amount of work by the Pevetos, by the staff and everybody involved in trying to get the best subdivision possible and get the best growth possible for Orange and our extra territorial jurisdiction. She stated it is a tough thing and hard to get all the pieces to fall in to one place and takes a lot of people and a lot of work has been done and appreciates that and looks like it is all in the right direction. Mr. Knauf stated he wanted to point out and asked for Mr. Wolf s confirmation that neither water or sewer are easily accessible to this site to tie in to the city systems as they are a ways away and would be a little bit difficult is his understanding to tie in to the water and sewer systems. Mr. Wolf stated it would have to be extended some distance and agreed it would be a major cost. Mr. Knauf stated so that is one reason utility maintenance and sewer mains are not being proposed is because of distance to tie into the city systems. 5 Page 10 of 18

11 Chairman Smith asked who monitors the building of the road. Mr. Knauf stated the building of the road will be up to his engineer and his engineer will have to certify that they have been built with in accordance with design standards and will be putting his license on the line if they are not. Chairman Smith asked if any city staff will check that. Mr. Knauf stated it is our practice that his engineer does the inspection and gives us a certified letter. Mr. Wolf stated we will require the engineers records are certified built to standards and we will make periodic visits out there as we do with all our projects. Harry Langston 2957 Ben Mac Rd, Orange, TX: Mr. Langston stated he had a couple of observations having recently lost a home due to our friend Harvey, he is not eager to lose another one and so that is why drainage is so important. He stated it occurs to him that any retention pond of any kind once filled no longer serves any purpose once additional water is poured into it and considering that the water shed for considerable acres has been eliminated and is now been replaced by hard man-built structures which provide no absorption by the earth or for runoff. If another hundred year storm or even a fifty year storm might prove disastrous not only for the new development but for those of us who live adjacent to that development. Mr. Langston stated he has not heard the size of the retention pond but heard from another source six acres. Chairman Smith asked how many inches of rain will that retention pond hold. Mr. Wolf stated the hydraulic calculation is based on a hundred year storm and so rainfall probably about five to six inches per hour for the duration of that storm. Mr. Langston stated hurricane Harvey dumped in the neighborhood of five feet of rain and six acres five feet deep doesn t seem like it will hold a lot of water and his concern is if it is adequate or is there some other means like more levies necessary. Commissioner Wilson stated so that everybody understands and has a question since we have used the word detention pond and retention pond and they are not really the same as she just Googled it. She stated it says the main difference between detention and a retention basin is whether or not it has a permanent pool of water like a traditional pond and the water level is established by the low flow orifice. Most of the time the orifice is part of a metal or concrete structure called a riser and a detention or dry basin has a orifice at the bottom level of the basin so that all of the water eventually drains out. It remains dry between storms hence a dry basin. She stated that this goes to the question about drainage and so are you starting out with a wet pond and it rises or a dry pond or a dry basin. Mr. Knauf stated it is a detention pond and it drains out. Commissioner Wilson stated so that when we have heard the word retention, we have just been misspeaking. Mr. Knauf stated right it is a detention pond and there is a pipe to allow it to drain out at the same rate as what it would normally drain. Mr. Duhon stated he has been associated with home owners associations all his life and it is like pulling teeth when you have to go get someone to maintain something. To maintain the roads, the ditches whatever it happens to be. He asked we have a home owners association that is going to be established and is there going to be money set aside from that homeowners association that allows for inflation so that when streets go up and detention pond that we still have some drainage 6 Page 11 of 18

12 or is it something we will be fighting for. Mr. Duhon asked if there is inflation built in to it. Mr. Rex Peveto stated yes the fees are set initially and then the home owners association will establish the cost. Mr. Duhon asked so that the homeowners association will have to vote each time to raise it. Mr. Rex Peveto stated it is up to the homeowners association to have the correct amounts and they are going to be legally responsible and it is a requirement to take care of the pond the way that the city wanted it done and the way that Orange County Drainage District wanted it done. Chairman Smith asked who monitors that. Mr. Rex Peveto stated the court system and if there is some floods going on or something that the city looks at and they are not keeping it up the way they are supposed to you can file suit to enforce that. Attorney J. Smith stated that if there are citizen complaints the city will monitor and get involved and will enforce it against the homeowners association if they are not doing their job. Mr. Duhon asked so the city is responsible. Attorney J. Smith stated no, what we are saying is that if they fail at taking responsibility for the pond, we will enforce it and make them do it. Mr. Hambrick asked who is responsible for the maintenance of the Chasse ditch as he believes they have been out to dig that ditch out recently. Mr. Wolf stated the Chasse north ditch, the ditch that runs east/west on the south side of the Peveto subdivision is in the City of Orange. The City of Orange along with the Drainage District in unison maintains that ditch and we don t dig it out deeper because it is on a profile grade and has to go over to a box culvert under Meeks Drive. It makes no sense to make it any deeper until that culvert is widened in the future. Mr. Wolf stated we try to maintain it and keep it clean out and grass mowed. He stated the discharge coming out of the detention pond is not allowed to go into that ditch and it runs north/south basically along SRA canal and into box culvert under MLK Drive. Commissioner Mortimer stated he was sorry about Mr. Langston s home as he was also out of his home along with a lot of people in Orange County. The concern that he has because right now we are so close to that event and if we planned everything according to that particular storm then we could just stop this meeting and not have any in the future because places that have never flooded and may never flood again. People that may have never had water in their home for fifty years had four to five feet of water and that is an issue. He stated our biggest concern was coming here to talk about that drainage plan and Orange County Drainage District. The city is good with what they came out with and the maintenance of that facility with some mechanism of a homeowners association to make sure that is taken care of and enforced. Mr. Knauf stated he wanted to respond to the one variance request regarding the twelve hundred foot on the block and showed the board on the plat the explanation. Chairman Smith asked for any other comments. None were made Chairman Smith closed the public hearing at 6:05 p.m. Mayor Spears asked for motion to adjourn City Council Mayor Pro Tem Pullen motioned 7 Page 12 of 18

13 Council Member Burch 2 nd City Council Adjourned at 6:05 p.m. DISCUSSION/ACTION ITEMS a. Case No. 18:05. Consider a request for a preliminary plat approval submitted by Sam Peveto for the Cypress Shadows Estates Phase II subdivision Commissioner Mortimer motioned to accept the preliminary plat with the variances requested Commissioner Ledet 2 nd Vote: 6 0 Motion Carries b. Consider a recommendation to the City Council to amend the Future Land Use Map for Lots 7, 8 and 9 of Block A of the L.T. Grubbs Subdivision also known as 1402, 1404 and th Street from Residential to Commercial. Mr. Knauf stated this is the future land use map for the city and this is general use zoning map for planning not zoning. He stated this indicates how we see the city developing in the future, years out. He stated it is the city s practice that whenever we rezone a personal property that we amend the future land use map that way we keep the future land use map updated. He stated rather wait and look clear back and research all the zonings that have been done, it s our recommendation that you vote to amend the future land use map to reflect what was residential and the zoning was changed to commercial. Chairman Smith stated we are here to update the planning map. Mr. Knauf stated yes. Commissioner Ledet motioned to approve Commissioner McKenna 2 nd Vote: 6 0 Motion Carries c. Consider a list of recommended capital improvements that in the opinion of the Commission are necessary or desirable during the forthcoming five (5) year period. Mr. Knauf stated the city charter requires the planning and zoning commission to annually make recommendations to the city manager on things that you might see the city would need in the next five years as far as capital improvements things like street improvements, park improvements, drainage improvements and those kinds of things. He stated this is your opportunity to provide input into anything you think the city may want to look at over the next five years. 8 Page 13 of 18

14 Chairman Smith asked for any comments. Commissioner Mortimer asked about hurricane facility improvements. Mr. Knauf stated that could be a possibility. Commissioner Mortimer asked him to describe what that might be. Mr. Knauf stated it might be like a levy along the Sabine River or it might mean more detention ponds to catch run off or could even be like the city s own emergency operations center to build a whole new EOC. Chairman Smith asked about in the past what recommendations have actually been acted upon. Mr. Knauf stated there weren t any if he recalls right any specific recommendations but P&Z wanted to tie park improvements to economic development. He stated he doesn t recall any specific streets or park improvements that were made plus the discussion was they want economic development before we do any park improvements. Chairman Smith stated he thinks there has been some discussion at council meetings about street improvements. Mr. Knauf stated yes council is working on the next bond issue and knows street improvements and also a pavilion at the boat ramp has been discussed by the council. Chairman Smith stated he thinks a suggestion would probably to focus on Interstate 10 for development and whatever we can do to attract businesses. Mr. Knauf asked for any action to focus on I-10 development. Commissioner Mortimer motioned Commissioner Wilson 2 nd Vote: 6 0 Motion Carries APPROVAL OF MINUTES Chairman Smith made a request for the minutes of the April 17, 2018 special call meeting to be approved. Mr. Knauf stated we have had a couple workshops on the fence ordinance and would like to summarize what we have talked about so far. 1 Page 16 of 18

17 Review on fence height in commercial districts being same height of six (6) feet Review on accounting for some natural barriers like a street or something in areas where it is required to be placed Review on dumpsters needing to be screened Review on six foot fences in the front that can t go past the front façade of the adjoining structure Review on keeping front yard four foot fences non-opaque Review of six foot opaque fences on side and rear yard where commercial is adjacent to residential Review of no barbed wire Review on in the Historic Preservation District having a two foot offset for the fence lines to leave room between the side walk and fence for maintenance and to keep the fence from becoming a wall along the street or along the sidewalk Mr. Knauf stated he had a couple more things to discuss and would end this meeting no later than 6:30 p.m. Discussion on keeping razor wire on top of fences and barbed wire in industrial and commercial areas or take out completely doing more research on other cities Discussion on definitions on front yard, rear yard, side yard, interior side yard and corner side yard and adding to zoning ordinance with diagrams Discussion on definition of front door of property Mr. Knauf stated we are looking at changing the zoning ordinance itself and adding definitions. He stated it would not require sending out letters like in changing a zoning on a particular property but would require a public hearing and published in the newspaper at least fifteen days before the public hearing. Mr. Knauf asked if they are ready for him to craft the changes to the ordinance and bring to P&Z and council. All present agreed. Mr. Knauf stated it would take him a little while and do more research. Chairman Smith adjourned the P & Z meeting at 6:00 p.m. Mayor Spears asked for motion to adjourn 2 Page 17 of 18
