2 MEETING MINUTES OF ST. MARYS CITY COUNCIL PRESIDING OFFICER: James J. Harris Council President 6: 30 P.M. Council Chambers ROLL CALL: Bubp, Koverman, Christman, Willoughby, Fitzgerald, Uhlenhake, Fleagle Absent: Willoughby Resolution No was presented to Council for a first reading. RESOLUTION NO A Resolution of Sympathy to the Family of Joe Diamond Motion by Mr. Bubp, seconded by Mr. Uhlenhake to read Resolution No Motion passed Motion by Mr. Uhlenhake, seconded by Mr. Bubp to pass Resolution No Motion passed Mayor McGowan presented the Resolution to family members in attendance in memory of the contributions Mr. Diamond made to the community. Motion by Mr. Koverman, seconded by Mr. Christman to accept the Minutes of the May 22, 2017, meeting. Motion PETITIONS & COMMUNICATIONS: Mr. Harris read a request from the Planning Commission to rezone a parcel of vacant ground that is situated in the north part of Outlot 118 located in the Southwest quarter of Section 2, St. Marys Township, in the City of St. Marys containing acres of land more or less also regarding the rezoning of acres that consist of single family residence and a cemetery and an acre tract of vacant land. Mayor McGowan addressed Council to remind our citizens that dogs must be on a leash if they are outside of a fenced yard. He has had several complaints from citizens trying to walk. Mayor McGowan also presented an update on the status ofthe Grist Mill. There are two approaches. The first approach advocated by LJB Engineering is to take the mill down; take the adjoining shed buildings attached to it, totally disassemble, and completely rebuild it to the original structure. The second approach from Doug Morgan, a contractor specializing in old barns and buildings, is to take it down to its super structure, replace some of the timbers that are in the skeleton part, and replace those putting original type materials back on to button up the building. So, we are looking at tear down and reassemble, or tear off and reassemble. Both using new and old materials. Doug Morgan has a lot of experience with old buildings. It is expected to have his proposal next week. The Ohio Historical Society has been an obstacle to this project. The representative for the Ohio impossible Historical Society has refused to come and visit the site and wanting to know information that is to provide. He has to approve every tear off of the building and he wants to know a time line when each addition was added to the structure. We have to go back and review sketches and historical material to determine a time line. Once this information is submitted to Mr. Palmer, we can submit to the state to find out if we have financial approval to move forward. Council previously approved $ 650,000 of the Revolving Loan Fund for this. Mayor McGowan said he told Mr. Palmer the building is deteriorating. Mr. Noble stated it is dangerous to have someone go in to button it up. Mr. Noble believes they can have a time line for the structural additions of the building in a week or so. The history ofthe building shows the oldest industry in Some St. Marys of the first additions constructed that in were 1847, on two the years after the canal was built. This was a working mill. building have since been torn down. Things have been. added and subtracted from the original structure. With photographic evidence and news articles, we believe we have a fairly good idea of the time line.

3 Page 2 Mr. Andrew Augsburger, a candidate for the next Judge of Auglaize County Municipal Courts, addressed Council to introduce himself. He has served Auglaize County as the Assistant Prosecuting Attorney for the past 20 years. Councilman John Bubp addressed Council members stating he would like to have a recycling place in St. Marys to take cardboard. He is aware this can be taken to the St. Marys Township recycling but is looking for another outlet in the City. He would like to see something in St. Marys that would be more convenient for residents. He proposed taking this to the Solid Waste Committee for further discussion. Kraig Noble asked Doug Metz about the discontinuance of the Saturday recycling. Doug Metz said there is a lack ofnon-profit groups to work the facility. The commodity prices have been so low that there is no money in it so the volunteer groups no longer want to work it. It was asked ifthere was another option for cardboard. Doug Metz stated just at the township. Mr. Bubp asked if there was an option to do this in St. Marys. Mr. Metz responded we would have to see how much room we would have after the additional General Services building is completed. He also said you need somebody to manage it. Mr. Bubp stated he would like to see the thought entertained. If not now, in the near future he would like it discussed. Mr. Fleagle commented he would like to discuss this, but has concern with having added costs in the Solid Waste Department since residents can take their recycling to the township or county recycling. Mr. Fleagle stated the City set up the curbside recycling program to have a low cost alternative for residents within the corporation limits. The volunteer recycling center was put in place for residents outside the corporation limits and to allow for items that cannot be picked up on the truck. There is only so much room on the recycling truck. That is why they can' t pick up cardboard. Mr. Fleagle also stated when the recycling center was developed in 1994, it was determined that as long as the volunteer groups would run the operation we were okay because it wasn' t much cost for the City. If we are not getting the volunteer groups any more, he is not sure it would be cost effective. Mr. Metz stated another reason the Saturday recycling dropped off is because the County put the drop off at the township house. He said a lot of the Saturday business was coming from residents in that area. Mr. Bubp brought up the possibility of the County putting a drop off in the City. It was mentioned this could be an option to check into. Mr. Metz also stated there is a person at the St. Marys Township drop off several hours a week that takes care of the site and breaking down the cardboard. There was further discussion among members before motion was made to take to Solid Waste Committee. John Bubp made a motion, seconded by Dan Uhlenhake to take this to the Solid Waste Committee. A meeting will be scheduled at a later date. Jim Harris noted the City received a letter of notification from the Ohio Department of Transportation that we did not receive the Small City Program grant for the Spring Street Reconstruction project. Mr. Foxhoven added we are disappointed, but not surprised. We believe we have a good chance at receiving the grant we applied for on the pedestrian bridge project. We will discuss the Spring Street application with the state and make changes and will reapply. REPORTS OF CITY OFFICIALS, COMMITTEES, ETC.: The Mayor' s Report was presented. The Tax Commissioner' s Report was presented. The Director of Public Service and Safety' s Report was presented. COMMITTEE REPORTS There were no committee meeting reports. ORDINANCES & RESOLUTIONS: Amended Resolution No was presented to Council for a second reading. AMENDED RESOLUTION NO A Resolution Authorizing Transfer of a Residential Lot to the Resource Opportunity Center Motion by Mr. Fleagle, seconded by Mr. Uhlenhake to amend Resolution No Motion

4 Page 3 Mr. Foxhoven explained that Mr. Noble added Section 2 amending the resolution stating the Resource Opportunity Center (ROC) has to prove to us they have the funds available to construct the new residence. If they don' t, the City then has the option if another non-profit organization comes forward. The property was gifted to the City in 2013 and the structure was razed using Ohio Moving Forward Grant money. We feel confident the ROC will be able to move forward on this project. The amended resolution will be back for a third reading. Ordinance No was presented to Council for a first reading. ORDINANCE NO An Ordinance Rezoning Acres of Land Located in Part of the East Addition to the City of St. Marys and Part of Outlot 118 in the Southwest Quarter of Section 2, St. Marys Township in the City of St. Marys Motion by Mr. Koverman, seconded by Mr. Christman to read Ordinance No Motion Mr. Foxhoven explained this request came from the Planning Commission concerning a little over 28 acres of property. The three properties are currently zoned R- 1. Section 1 of the ordinance deals with property owned by the hospital. They are simply looking for consistency and are requesting it be rezoned Office- Medical Facilities. Section 2 of the ordinance is private property being requested to be rezoned from R- 1 Single Family Residence to R-3 Single Family Residence. R-1 is one home; R-3 is one home up to four units, such as a duplex or apartments. This affects four property owners. We have made contact with all property owners with none of them have any issues with this request. Section 3 of the ordinance deals with property that we own. The 18 acres was purchased in April We will retain possession of the property and would like to have it rezoned to R-PUD Planned Unit Development). This is the least restrictive zoning we have. It gives us more options. The ordinance will be back for a second reading. Ordinance No was presented to Council for a first reading. FISCAL OFFICER' S CERTIFICATE ORDINANCE NO Providing for the Issuance and Sale of Bonds in the Maximum Principal Amount of $68, 500 for the Purpose of Paying the Property Owners' Portion, in Anticipation of the Collection of Special Assessments, of the Costs of Improving Spruce Street Between Certain Termini, by Constructing Curbs, Gutters, Sidewalks, Combination Sidewalks and Curbs, Drive Approaches, Asphalt Pavement and the Repair Thereof, Together With the Necessary Related Improvements and Appurtenances Thereto, and Declaring an Emergency Mr. Harris read the Fiscal Officer' s Certificate Motion by Mr. Bubp, seconded by Mr. Fitzgerald to read Ordinance No Motion passed Mr. Foxhoven explained this ordinance pertains to property assessments for the Spruce Street reconstruction project north to McKinley Road. We had a short-term one- year note to pay the property owners' share of the costs. That note is due July 8th. The property owners' share not paid will be assessed to their taxes over the next five years. Mr. Foxhoven requested this be passed under suspension of rules. Motion by Mr. Koverman, seconded by Mr. Christman to suspend the rules for Ordinance No Motion Motion by Mr. Uhlenhake, seconded by Mr. Fleagle to pass Ordinance No as an emergency. Motion

5 Page 4 Ordinance No was presented to Council for a first reading. ORDINANCE NO Ordinance Authorizing the Execution of Remaining Requirements Energy Supply Schedule With American Municipal Power, Inc. (" AMP") Motion by Mr. Fitzgerald, seconded by Mr. Fleagle to read Ordinance No Motion John Courtney of Courtney and Associates explained this ordinance would extend the remaining energy requirement arrangements through AMP for 2017 and 2018 extending that period to 2024, and allow the City to take advantage of current unique market rates. He said about fifteen percent of our energy is received through the current arrangement, but at the end of 2018 we will be begin looking at about fifty percent of our energy. Courtney and Associates concurs it would be good to adopt this ordinance and take advantage of that market. John Bubp asked what the City is currently paying. Mr. Courtney responded the City is paying$ 42 per megawatt hour for the current remaining requirement. AMP is anticipating we will get a lower price partly due to market price drop from the time we entered the agreement in 2016, and also by pulling in a seven by 24 block. Mr. Courtney also stated this is energy only; it does not include capacity. The ordinance will be back for second reading. Ordinance No was presented to Council for a first reading. ORDINANCE NO An Emergency Ordinance Repealing Ordinance Motion by Mr. Fleagle, seconded by Mr. Uhlenhake to read Ordinance No Motion Mr. Foxhoven explained we need to repeal Ordinance pertaining to TSC' s franchise. TSC will reapply in the fall. This will have no impact on the City financially, and requested the ordinance be passed under suspension of rules. Mr. Noble added TSC got ahead of themselves. They can only apply so many months before the franchise ends. The ordinance says they applied when they haven' t. Motion by Mr. Koverman, seconded by Mr. Christman to suspend the rules for Ordinance No Motion Motion by Mr. Fleagle, seconded by Mr. Christman to pass Ordinance No as an emergency. Motion Ordinance No was presented to Council for a first reading. ORDINANCE NO An Emergency Ordinance Authorizing Obtaining Consulting Assistance for CHIP Home Program Income Motion by Mr. Fleagle, seconded by Mr. Uhlenhake to read Ordinance No Motion Mr. Burkholder explained this ordinance would allow him to solicit vendors for our CHIP program. The ROC has expressed an interest to tap into those funds. Mr. Foxhoven added this goes along with the property ordinance on the agenda and requested the ordinance be passed under suspension of rules. This is the same process we went through with the first ROC house. Motion by Mr. Fleagle, seconded by Mr. Fitzgerald to suspend the rules for Ordinance No Motion Motion by Mr. Fleagle, seconded by Mr. Uhlenhake to pass Ordinance No as an emergency. Motion

ORDINANCE NO An Emergency Ordinance Authorizing the Director of Public Service and Safety to Purchase a Factory Demonstrator or New Model Refuse Collection Truck for Use by the City of St. Marys Solid Waste Department Without the Taking of Competitive Bids and to Offer Certain Collection Truck for Sale Motion by Mr. Koverman, seconded by Mr. Fitzgerald to read Ordinance No Motion Doug Metz, Superintendent of Solid Waste Operations explained to Council members that the department is in need of a new refuse truck. The model he is trying to replace is currently eleven years old. A new truck was budgeted for in 2016 but we were unable to come up with a truck for replacement. The funds were moved to Ohio A truck has been located through a Perrysburg, dealer. Three quotes were obtained for various trucks. A truck in Iowa is the best deal. Auglaize County Solid Waste has shown interest in purchasing one of our old trucks. They will be using it to pick up cardboard. We have already spent $ 15, 000 in the first six months of this year on repairs on the truck we are currently using. It is in the shop now at a cost of another 6, 000. We need to get this truck off the road and put it in back up status, and move forward on the purchase of a new truck. The purchase price of the new truck is $ 163, 400 minus $27, 500 for the sale of a truck to Auglaize County. Mr. Foxhoven stated we did budget $ 168, 000 that was carried over from last year for a new truck. We did receive a new recycling truck last year using grant funds. Motion by Mr. Bubp, seconded by Mr. Fleagle to suspend the rules for Ordinance No Motion Motion by Mr. Koverman, seconded by Mr. Christman to pass Ordinance No as an emergency. Motion MISCELLANEOUS BUSINESS: A Streets and Sidewalks Committee Meeting was scheduled for June 19, 2017, at 5: 15 p.m. Motion by Mr. Fitzgerald, seconded by Mr. Fleagle to excuse Robin Willoughby.
