Both new lots will be served by this single access, which shall be formalized in a permanent shared access easement for the two new lots. A drainage easement over the floodplain and riparian area to an elevation of two (2) feet above the base flood elevation as it crosses the subject property shall be required. The existing access off Twin Silos Drive be gated and used only for garbage removal and emergency vehicle access. There shall not be more than eighty (80) tuition paying students allowed to occupy or otherwise be engaged in instructional classes on the premises at any one time during the hours of operation. The hours of operation shall be between 7:30 a.m. to 10:30 p.m., Monday through Sunday, and special events hours to be from 7:00 a.m. to 12:00 a.m. An additional twenty (20) marked and delineated, on-site parking spaces provided and maintained at all times for sole and exclusive use of students and instructional staff. 5, The Special Use shall be limited to and be made proprietary to the Fine Line Creative Arts Center and would not accrue to any successors or assigns entitled to the property. Fine Line shall be allowed limited sales customary to an arts center, including and with limitation, sales attendant to classes conducted at the center (to students, faculty, board members, etc) and gallery shows and workshops. Fine Line shall be allowed special events customary to an arts center, including such special events as gallery openings, community outreach (not to exceed fifteen (15) per year) and local student education. The amended Special Use limitations would not become effective until the new access off of Bolcum Road, including related landscaping, parking, stormwater detention and the installation of a gate at the existing access has been constructed and approved. The address of the Fine Line Arts Center will be changed from 6N158 Crane Road to a new address on Bolcum Road upon completion of the new access. 5 STATE OF ILLINOIS COUNTY OF KANE RESOLUTION NO RECOGNITION OF FEBRUARY AS BLACK HISTORY MONTH WHEREAS, February is designated nationally as Black History Month; and WHEREAS, it is desirable and appropriate that we reflect upon the contributions of African Americans to this country in the areas of Arts, Sciences, Politics, Education, Culture and Law, and WHEREAS, it is periodically appropriate to focus on the significant contributions of African Americans; and WHEREAS, the list of exceptional African Americans includes James Baldwin, most prolific Black play writer, essayists and novelists of modern times and Langston Hughes an outstanding poet and novelist, Josephine Baker, most colorful dancer and singer. In the area of science, Dr. Charles Drew, founder of blood plasma, director of Red Cross Blood bank, Matthew Henson, first man to set foot on the North Pole and Dr. Daniel Hale Williams performed the first successful heart surgery. Politicians Shirley Chisholm the first black woman to run for president, Andrew Young who was the first black ambassador to the UN and Eric Holder the first black attorney general. Educators Benjamin Mays, President of Morehouse College, George Washington Carver, founder of Tuskegee Institute and Marva Collins the founder of the Westside Preparatory School in Chicago. Oliver Brown addressed segregation in the Brown vs. the Board of Education and Marian Anderson an American contralto. There was Adam Clayton Powell Jr, the first black congressman from New York and Joseph Hayne Rainey the first Black seated in the U.S. House of Representatives presiding over that House. Let us not forget our local heroes, Cynthia Latimer, Assistant Superintendent Division of Teaching and Learning in District 129, Marie Wilkerson, founder of the Marie Wilkerson Daycare Center and Food Pantry and long time community activist, Dr. Deslyn Browne, African American physician at Rush Copley Hospital and Wilbert Walters, educator and founder of the non-for-profit Aurora Sundowners track club which has been in existence for over 42 years. NOW, THEREFORE, BE IT RESOLVED that the Kane County Board wishes to recognize Black History Month and the contributions those African-Americans have made to American society. And Public Safety Budgeted: El Yes El No Z N/A If not budgeted, explain funding source: Appropriation: Summary: There is a cellular tower located on the old jail property on Fabyan Parkway. Until 2010, this property was owned by the Public Building Commission (PBC). In 2008, the Director of Facilities and legal counsel negotiated the first amendment to this cell tower lease on behalf of the PBC. In 2010, this lease expired and the property ownership formally transferred from the PBC to the County. Staff has negotiated an extension to this lease, based on the 2008 amendment. This tower is utilized by the County 911 Center at this time. Staff anticipates terminating the utilization of this tower by 911 in approximately months. The lease will generate approximately $1,500 in revenue each month for the County. 14 STATE OF ILLINOIS RESOLUTION NO AUTHORIZATION TO EXTEND CELLULAR TOWER LEASE WHEREAS, Kane County owns the former County jail facility property, common address 777 E. Fabyan Parkway, and WHEREAS, said property has a cellular tower operated by Pinnacle Tower LLC, operated under a tower site lease agreement, entered into by the Kane County Public Building Commission on May 17, 1979, with said agreement being amended by the "Reinstatement of and Amendment to Tower Site Lease" agreement on July 1, 2008; and WHEREAS, said agreement has expired. An amendment titled First Amendment to Tower Site Lease Agreement has been negotiated and approved by the Administration and Judiciary and Public Safety Committees with a term through June 3Q 2013 with a one year extension optiorl and WHEREAS, said tower is utilized by the County and it is in the best interest of the County to extend said cellular tower lease. Executing said lease produces revenue for the County and requires no financial commitment by the County. NOW, THEREFORE BE IT RESOLVED by the Kane County Board that the Chairman is hereby authorized to execute the First Amendment to Tower Site Lease Agreement, for the cellular tower located at 777 E. Fabyan Parkway. A copy of said contract shall be kept on file with the Kane County Auditor. They have also met the Counties Vehicle Replacement Policy by supplying adequate and appropriate documentation to the Administration Committee. The Sheriff is now requesting to utilize the RTA tax money to replace 14 fully equipped Ford, Crown Vic's, squad car and will be purchased through the State of Illinois bid process. 16 STATE OF ILLINOIS COUNTY OF KANE RESOLUTION NO VEHICLE REPLACEMENT KANE COUNTY SHERIFF'S OFFICE WHEREAS, the Sheriff's Office has provided the Kane County Board with a 5-year vehicle replacement plan; and WHEREAS, the Kane County Sheriff's Office is to receive $391,000 in FY 2011 of the Public Safety Tax towards vehicle replacement; and WHEREAS, the Sheriff's Office is requesting to dispose of 16 (sixteen) vehicles and purchase 14 (fourteen) new vehicles. All 14 vehicles will be front-line squad cars; and WHEREAS, the Sheriff's Office has complied with the Kane County Vehicle Replacement Program Ordinance and has supplied adequate and appropriate documentation to the Administration Committee. NOW, THEREFORE, BE IT RESOLVED by the Kane County Board that the Sheriff's Office continue to follow the 5-year vehicle replacement plan utilizing the Three Hundred Ninety One Thousand Dollars ($391,000) of Public Safety Tax fund. 18 STATE OF ILLINOIS MR RESOLUTION NO PURCHASE OF TWO (2) 2011 FORD ESCAPES KANE COUNTY DIVISION OF TRANSPORTATION WHEREAS, bids have been solicited and received by the Kane County Purchasing Department for two (2) 2011 Ford Escapes for the Kane County Division of Transportation (hereinafter the "vehicles"); and WHEREAS, Freeway Ford, th Street, Lyons, Illinois was the low bidder for the vehicles with the amount of $39, less trade-in allowance of $3, (Unit #37) and $3, (Unit #77) for a net cost of $32, NOW, THEREFORE, BE IT RESOLVED by the Kane County Board that the low bid for said vehicles from Freeway Ford of Lyons, Illinois in the amount of Thirty Two Thousand, Ninety Eighty Dollars ($32,098.00) be accepted and that the County of Kane purchase said vehicles from Freeway Ford. 22 STATE OF ILLINOIS COUNTY OF KANE RESOLUTION NO EXTENDING THE REFUSE REMOVAL CONTRACT FOR THE COUNTY GOVERNMENTAL FACILITIES WHEREAS, bids were solicited and received in late 2008 for the refuse material pickup and removal for all County government facilities; and WHEREAS, the lowest responsible bidder per the bid specifications was Allied Waste Systems, which includes the following County complexes, Government Center, Third Street Courthouse, Sixth Street Center, Circuit Clerk Complex, Judicial Center, Juvenile Justice Center, and Aurora Health Department located at 1240 Highland Avenue, for the grand sum total of Forty Thousand, Nine Hundred Fifty Six Dollars ($40,956.00) per year with no rate increases for this refuse removal service. 24 STATE OF ILLINOIS i1uwis1jni RESOLUTION NO AERIAL IMAGERY WHEREAS, the County of Kane intends to continue efforts to maintain accurate, reliable, and up-todate geographical data; and WHEREAS, the aerial imagery serves as a framework for the County's Geographic Information System and supports the decision making process for many important issues currently facing Kane County, including real estate development and land use, transportation infrastructure, storm water and watershed management and analysis; and WHEREAS, the 2011 collaborative aerial imagery project currently being managed by the Cook County Department of Technology as governed by a contract with Merrick & Company for Cook, DuPage, Kane, Kendall, Lake, McHenry & Will Counties to develop a standard specification for 6 inch pixel color digitally captured Aerial Imagery. Illinois law does not permit competitive bidding of such notifications but instead provides for a flat rate regardless of comptetition; and WHEREAS, the cost of publication of reassessments costs the taxpayers of the County of Kane in excess of $250,000 a year; and WHEREAS, Metro Counties estimates the metropolitan area counties have expended nearly $5 million over the past four years on such publications; and WHEREAS, publishing a list of individual assessment changes in local newspapers is no longer a cost-effective approach for notifying taxpayers of such changes; and WHEREAS, House Bill 9 permits the use of web sites to publish assessment lists on the Internet while retaining the publication of a general notice, without the appurtenant list, in a local newspaper; and WHEREAS, House Bill 9 would provide for wider dissemination of annual assessment changes at a significantly reduced cost to the taxpayers; NOW, THEREFORE, BE IT RESOLVED by the Kane County Board that Kane County supports House Bill 9 as currently introduced and pending. 52 Inter-Agency Memorandum of Understanding Re: a 2011 Kane County Community Health Assessment Page 2 of 4, Res. #11-35 Whereas, the parties to this agreement declare their mutual interest in, and commitment to, the health and well-being of the residents of, and Whereas, the parties wish to better identify and understand the health-related community assets, needs and priorities of Kane County residents in the most comprehensive way possible by conducting a community health assessment, and Whereas, the parties seek to use the results of this community health assessment to then work collaboratively amongst themselves and with other interested parties in Kane County to improve the health and well-being of Kane County individuals, families, population groups and the community as a whole; Now, therefore be it resolved that the parties to this agreement: Have established a 2011 Kane Community Health Assessment Committee made up of one representative from each agency that is a party to this agreement. Have agreed to make Committee decisions by consensus whenever possible. When consensus cannot be reached, the parties agree that each agency is entitled to one vote and that the position receiving a majority of votes shall constitute the decision for the Committee. Have agreed that the Kane County Health Department will convene and facilitate the Committee's work and perform all administrative duties delegated to it by the Committee, including acting as fiscal agent for any contracts jointly agreed to by the Committee. Have agreed to jointly contract with the Public Opinion Laboratory of Northern Illinois University to: a) complete 2,000 adult interviews using the 2011 Behavioral Risk Factor Surveillance System questionnaire (approximately 25 minutes in length); b) following that interview, in households having children, sample one child under age 18 and conduct a 20-minute interview with the most knowledgeable adult about that child's health; and c) provide a summary of the survey methodology, a weighted survey data file, and a data file codebook. 53 Page 3 of 4, Res. #11-35 Have agreed that the Kane County Health Department shall collect and analyze the most current socio-demographic, morbidity, mortality, natality and health care utilization data available to it on Kane County residents. Have agreed that the Kane County Health Department shall analyze all of the data resulting from the services itemized in # 4 and the sources in # 5 and create a community health assessment of Kane County, each of its three planning districts (North, Central and South), and each of the parties' primary service areas. Where statistically appropriate, comparisons will be made between Kane County residents as a whole and appropriate demographic subpopulations and its three planning areas and the residents of the northeastern Illinois region, the state of Illinois and the United States. In addition, Kane County Health Department shall compare data for residents of each parties' primary service and the residents of Kane as a whole and the Kane planning district in which the majority of the primary service area falls within. Have agreed that each of the parties will have the opportunity to meet with Kane County Health Department's epidemiology and health planning staff to discuss the findings and analysis of the data from their primary service area. Have agreed to advise and support the Kane County Health Department in convening other community stakeholders to review and discuss the community health assessment findings and work jointly with these additional community stakeholders to identify community health improvement priorities and strategies. Have agreed that the Committee will jointly review and discuss the assessment findings and the identified community health improvement priorities and strategies, advising the Kane County Health Department on the final development of the Kane County Community Health Action Plan for submission to the Kane County Board/Board of Health no later than December 1, Have agreed that the Kane County Health Department will provide a customized Community Health Assessment for each of the parties' primary service areas no later than December 1, The customized assessment will be provided as an electronic file in a format that will be ready to print. Each party to this agreement, except INC Board NFP, has agreed to contribute $3, to the Kane County Health Department to help defray the costs incurred by the Department in facilitating this community assessment process and creating both the Kane County Community Health Action Plan and the custom primary service area assessments. The Kane County Health Department will invoice each party for this amount at the time it delivers the customized assessment report to the party. Have agreed to support the Kane County Health Department in seeking funding from the United Ways and Community Chest organizations serving Kane County residents to help defray the costs incurred by the Department in facilitating this community assessment process and creating both the Kane County Community Health Action Plan. Any funds in excess of $10, received by the Kane County Health Department for this purpose from United Ways and Community Chests in 2011 shall be evenly divided amongst the parties in order to defray the parties' costs in contracting with the Public Opinion Laboratory of NIU. Have agreed that the parties and their employees shall be free to publish papers or make professional presentations dealing with the results of the community assessment process conducted under this agreement. In any publications or professional presentations resulting from this process, all parties shall be given full credit and acknowledgement for their specific roles, and joint financial support provided to the process. Have agreed to indemnify and hold harmless each other and their employees and agents against any and all costs, damages and expenses, including attorney's fees, arising from any claims,

The typical roadway cross section calls for one 12' lane in each direction (north and southbound) with curb and gutter. A 42' wide boulevard type median is also proposed. The wide median will allow for the addition of a second 12' wide through lane in each direction when warranted in the future. The new lane addition would occur within the wide median avoiding any need for new right of way. A new railroad grade separation structure will carry Anderson Road over the Metra rail yard and the UP RR tracks. Other improvements include a 10' wide multi-use path along the west side of Anderson Road, new traffic signals at each end of the project, landscaping and pavement markings. In order to construct the project right of way acquisition from 13 parcels is needed. 70 STATE OF ILLINOIS COUNTY OF KANE RESOLUTION NO AUTHORIZING ACQUISITION OF HIGHWAY RIGHT OF WAY ANDERSON ROAD FROM KESLINGER ROAD TO IL ROUTE 38 KANE COUNTY SECTION NO BR (THIRTEEN PARCELS - PARCEL NO. 0001; PARCELS NO ) WHEREAS, the County of Kane is authorized by law, pursuant to Illinois Compiled Statutes, 605 ILCS 5/5-801(2010) to acquire by negotiated purchase or eminent domain proceedings, real property for highway purposes; and WHEREAS, the County of Kane deems it necessary and appropriate to improve and extend Anderson Road between Illinois State Route 38 and Kane County Highway No. 41 (also known as Keslinger Road); and WHEREAS, Anderson Road and the planned improvements thereto, have been surveyed, laid out and projected over certain lands situated in.
