DESTINY & FREE CHOICE And when all of these events come upon you, the blessing and the curse that I have set before you, you shall take it to heart amongst the nations where Hashem your G -d has banished you. And you shall return to Hashem your G-d (Teshuva) and listen to His voice following the instructions I give you today... (30:1-2) Ramban (30:11; Vayikra 26:16) sees this verse as not simply instructing the Jewish People to do Teshuva, but indeed promising that they will do so. Rambam (Laws of Teshuva 7:5) interprets similarly, explaining that the verse is alluding to the ultimate redemption which will only occur after the Jewish People do Teshuva. Teshuva is apparently inevitable. Yet on the other hand Teshuva is usually seen as the ultimate expression of free choice and the ability to change one's own direction. How do we reconcile this with the inevitability of Teshuva described here? Note that in the previous chapter (6:5) the Rambam asked a similar question about the Torah's prediction of the corruption of the Jewish People's faith and its relationship to free choice. There the Rambam reconciles the difficulty by explaining that the Torah predicts no specific individual's failure, only the inevitability that some will fail. Is such an answer applicable here to Teshuva on a national level? HALACHA OF THE WEEK: A FEATURE OF THE BJSZ DAILY HALACHA HATARAS NEDARIM ON EREV ROSH HASHANA There is a well known custom to perform Hataras Nedarim on Erev Rosh Hashana. Even though one has already declared in the Kol Nidrei of the past year the desire to annul all vows one may make in the coming year, the vows may still be binding for various reasons. Hataras Nedarim is a process in which a court of three men can annul vows. The Hataras Nedarim of Erev Rosh Hashana can be used only for vows which one does not remember making. If one is cognizant of his vow, he must undergo a different process of Hataras Nedarim in which he goes to a court of three men and informs at least one of the judges of the specific vow he made and why he regrets making that vow. The judges then use a system called charata or pesach to annul the particular vow. There are a few reasons given for partaking in Hataras Nedarim specifically on Erev Rosh Hashana. One reason given is that we wish to approach the Day of Judgment in a favorable light, and the gravity of the sin of ignoring one s vows, even unintentionally, would jeopardize a virtuous judgment. Another approach draws a parallel between the system of annulling a vow and the T shuva process. Through appropriate regret and a G-d dictated process, Hashem erases the vow, just as He does with one s sins. May we all merit a T shuva Shleima this year.
