The Praise is for Allah azwj Lord azwj of the Worlds, and Blessing be upon our Chief Muhammad saww and his saww Purified Progeny asws, and greetings with abundant greetings. Chapter 72 Al-Zahaar (likening the wife as a mother) باب الظ ه ار ع ل ي ب ن إ ب ر اه يم ع ن أ ب يه ع ن اب ن م ح ب وب ع ن أ ب ي و ا لد ال ح اناط ع ن ح م ر ان ع ن أ ب ي ج ع ف ر عليه اللمام ا إ ان أ م ي ر ال م ؤ م ن ين عليه اللمام ا إ ان ام ر أ ة م ن ال م ل ل م ين أ ت ت ر ل و ا للا ىلا للا عليه وهله ق ا ال ت ي ا ر ل و إ ان ق ما نا ز و ج ي د ن ث ر ت ل ه ب ط ن ي و أ ع ن ت ه ع ل ا د ن ي اه و هخ ر ت ه ق ل م ي ر م ن ي م ك ر وها و أ ن ا أ ش ك وه إ ل ا ا للا ع از و ج ا و إ ل ي ا م اما ت ش ت ك ين ه ال ت ل ه إ انه ا ل ي ال ي و م أ ن ت ع ل اي ح ر ام ك ظ ه ر أ م ي و د أ خ ر ج ن ي م ن م ن ز ل ي ق ان ظ ر ق ي أ م ر ي Ali Bin Ibrahim, from his father, from Ibn Mahboub, from Abu Wallad Al Hannat, from Humran, (It has been narrated) from Abu Ja far asws having said that Amir Al-Momineen asws said: A woman came over to Rasool-Allah saww, so she said, O Rasool-Allah saww! So and so husband of mine had married me. I gave him my belly for seeding (giving birth), and I supported him upon his world and his Hereafter, so he did not see from me anything he disliked, and I complain about him to Allah azwj Mighty and Majestic, and to you saww. He saww said: From what are you complaining? She said to him saww, He said to me today, You are prohibited unto me like the back of my mother, and he has thrown me out from my house. So look into my matter. ق ا ا ر ل وو ا للا ىولا للا عليوه وهلوه م وا أ ن وز ا للا ع ل و اي ك ت ابوا أ وي ب وه ب ي ن و و ب وي ن ز و ج و ال م ت ك ل ف ين ق ج ع ل ت ت ب ك ي و ت ش ت ك ي م ا ب ه ا إ ل ا ا للا و إ ل ا ر ل ول ه و ان ى ر ق ت و أ ن وا أ ك ور ه أ ن أ ك وون م و ن So Rasool-Allah saww said: Allah azwj has not yet Revealed a Book to me saww to judge with between you and your husband, and I saww dislike that I saww become from the pretenders. So she went on weeping and complaining of what was with her, to Allah azwj and His azwj Rasool saww, and dispersed. ق ل م ع ا للا ع از و ج ا م ح او ر ت ه ا ل ر ل ول ه ىلا للا عليه وهله ق ي ز و ج ه ا و م ا ش ك ت إ ل ي ه ق أ ن ز ا للا ع از و ج ا ب ذ ل ر هنا ب ل م ا للا ال ارح من ال ارح يم د ل م ع ا للا و الات ي ت جاد ل ق ي ز و ج ها و ت ش ت ك ي إ ل ا ا للا و ا للا ي ل م ع ت حاو ر ك ما ي ع ن ي م ح او ر ت ه ا ل ر ل و ا للا ىلا للا عليه وهله ق ي ز و ج ه ا إ ان ا للا ل م يع ب ى ير. الاذ ين ي ظاه ر ون م ن ك م م ن ن لا ئه م ما ه ان أ امهات ه م إ ن ا ل ال امائ ي و ل د ن ه م و إ انه م ل ي ا ول ون م ن ك را م ن ال ا و و ز ورا و إ ان ا للا ل ع ف و غ ف و ر أ امهات ه م إ So Allah azwj Mighty and Majestic Heard her argument to His azwj Rasool saww regarding her husband, and what she complained to him saww. So Allah azwj Mighty and Majestic Revealed with that a Quranic (Verse) [58:1] Allah has Heard the words of her who pleaded with you about her husband and complained to Allah, and Allah Knows the contentions of both of you; surely Allah is Hearing, Seeing. [58:2] (As for) those of you who put away their wives by likening their backs to the backs of their mothers, they are not their mothers; their mothers are no others than those who gave them birth; and most surely they utter a hateful word and a falsehood and most surely Allah is Pardoning, Forgiving. 3 out of 35

So he saww said to her: Come to me saww with your husband. So she came with him. So he saww said to him: Did you say to this wife of yours, You are prohibited unto me like the back of my mother? He said, I had said that to her. So Rasool-Allah saww said to him: Allah azwj Mighty and Majestic has Revealed regarding you and regarding your wife, a Quran. So he saww recited to him what Allah azwj had Revealed from His azwj Words [58:1] Allah has Heard the words of her who pleaded with you about her husband up to His azwj Words and most surely Allah is Pardoning, Forgiving. So cuddle your wife to yourself, for you have spoken an evil from the speech and a fallacy. Allah azwj has Pardoned you and Forgiven for you, therefore do not repeat. ق ان ى ر ف ال ارج و ه و ن اد م ع ل ا م ا ا ل م ر أ ت ه و ك ر ه ا للا ذ ل ل ل م ؤ م ن ين ب ع د ق أ ن ز ا للا ع از و ج ا و الاذ ين ي ظاه ر ون م ن ن لائ ه م ث ام ي ع ود ون ل ما ال وا ي ع ن ي ل م ا ا ال ارج ا ل او ل م ر أ ت ه أ ن ت ع ل اي ح ر ام ك ظ ه ر أ م ي ا ق م ن ال ه ا ب ع د م ا ع ف ا ا للا و غ ف ر ل ل ارج ا ل او ق إ ان ع ل ي ه ق ت ح ر ير ر ب ة م ن ب أ ن ي ت م ا الا ي ع ن ي م ج ام ع ت ه ا ذل ك م ت وع ظ ون ب ه و ا للا ب ما ت ع م ل ون خ ب ير. So the man left and he was regretful upon what he had said to his wife, and Allah azwj Disliked that for the believers afterwards, so Allah azwj Mighty and Majestic Revealed [58:3] And (as for) those who put away their wives by likening their backs to the backs of their mothers then withdraw what they said, Meaning what the man first said to his wife, You are prohibited unto me like the back of my mother, so the one who says it after what Allah azwj had Pardoned him and Forgiven to the man firstly, so upon him should free a captive before they touch them Meaning copulate with them that is what you are Advised for; and Allah is Aware of what you doing. ق م ن ل م ي ج د ق ى يام ش ه ر ي ن م ت تاب ع ي ن م ن ب أ ن ي ت م ا الا ق م ن ل م ي ل ت ط ع ق إ ط عام ل ت ين م ل ك ينا ق ج ع ا للا ع ا وب ة م ن ظ اه ر ب ع د ال انه ي ه ذ ا و ا ذل ل ت ؤ م ن وا ب ا ا لل و ر ل ول ه و ت ل ح د ود ا للا ق ج ع ا للا ع از و ج ا ه ذ ا ح اد الظ ه ا ر [58:4] But whoever has not the means, let him Fast for two months successively before they touch them; then as for him who is not able, let him feed sixty needy ones. So Allah azwj Made a Punishment or the one who does Zahaar after this Prohibition, and Said that is in order that you may have faith in Allah and His Rasool; and these are Allah's Limits. So Allah azwj Mighty and Majestic Made this a Limit for the Zahaar. ا ح م ر ان ا أ ب و ج ع ف ر عليه اللمام و ل ي ك ون ظ ه ار ق ي ي م ين و ل ق ي إ ر ار و ل ق ي غ ب و ل ي ك ون ظ ه ار ا ل ع ل ا ط ه ر ب غ ي ر ج م اع ب ش ه اد ة ش اه د ي ن م ل ل م ي ن. إ Humran (the narrator) said, Abu Ja far asws said: And Zahaar does not happen during a vow, nor during harming, nor during anger, and Zahaar does not happen except upon purity without copulation, with two Muslim witnesses. 1 1 Al Kafi V 7 The Book of Divorce Ch 72 H 1 4 out of 35

5 ع ل ي ب ن إ ب ر اه يم ع ن أ ب يه ع ن اب ن أ ب ي ع م ي ر ع ن اب ن ب ك ي ر ع ن ع ب ي د ب ن ز ر ار ة ع ن أ ب ي ا ل م ا أ ر يد ب ه الظ ه ار. ا ل م ا أ ر يد ب ه ال اطما ق و ل ظ ه ار إ ط ما ق إ ع ب د ا للا عليه اللمام ا ل Ali Bin Ibrahim, from his father, from Ibn Abu Umeyr, from Ibn Bukeyr, from Ubeyd Bin Zurara, (It has been narrated) from Abu Abdullah asws having said: There is no divorce except what is intended by it is the divorce, nor a Zahaar except what is intended by it is the Zahaar. 2 ع ل ي ع ن أ ب يه ع ن اب ن م ح ب وب ع ن اب ن ر ئ اب ع ن ز ر ار ة ا ل أ ل ت أ ب ا ج ع ف ر عليه اللمام ع ن الظ ه ار ق ا ا ه و م ن ك ذ ي م ح ر م أ م أ و أ خ ت أ و ع امة أ و خ ال ة و ل ي ك ون الظ ه ار ق ي ي م ين ل ت ق ك ي ف ي ك ون ا ي ا و ال ارج ل م ر أ ت ه و ه ي ط اه ر م ن غ ي ر ج م اع أ ن ت ع ل اي ح ر ام م ث ظ ه ر أ م ي أ و أ خ ت ي و ه و ي ر يد ب ذ ل الظ ه ار. Ali, from his father, from Ibn Mahboub, from Ibn Raib, from Zurara who said, I asked Abu Ja far asws about the Zahaar, so he asws said: It is from everyone who is with close un-marriageable relationship, a mother, or a sister, or a paternal aunt, or a maternal aunt, and Al Zahaar does not happen during a vow. I said, So how does it happen? He asws said: The man is saying to his wife, and she is pure (from menstruation) from without copulation, You are prohibited unto me like a back of my mother, or my sister, and he is intending the Zahaar by that. 3 م ح امد ب ن ي ح ي ا ع ن أ ح م د ب ن م ح امد ع ن اب ن ق اا ع ن اب ن ب ك ي ر ع ن ر ج م ن أ ى ح اب ن ا ع ن ر ج ا ل ت ل ب ي ال ح ل ن عليه اللمام إ ن ي ل ت ل م ر أ ت ي أ ن ت ع ل اي ك ظ ه ر أ م ي إ ن خ ر ج ت م ن ب اب ال ح ج ر ة ق خ ر ج ت ق ا ا ل ي س ع ل ي ش يء ق ا ل ت إ ن ي و ي ع ل ا أ ن أ ك ف ر ق ا ا ل ي س ع ل ي ش يء ل ت إ ن ي و ي ع ل ا أ ن أ ك ف ر ر ب ة و ر ب ت ي ن ا ل ي س ع ل ي ش يء و يت أ و ل م ت ا و. Muhammad Bin Yahya, from Ahmad Bin Muhammad, from Ibn Fazzal, from Ibn Bukeyr, from a man from our companions, from a man who said, I said to Abu Al-Hassan asws, I said to my wife, You would be unto me like the back of my mother if you go out from the door of the chamber. So she went out. He asws said: There is nothing upon you. So I said, I am (financially) strong enough to expiate. So he asws said: There is nothing upon you. I said, I am strong enough to expiate by freeing a neck and two necks. Muhammad Bin Yahya, from Ahmad Bin Muhammad, from Ibn Abu Najran, from Ibn Abu Umeyr, from Abdullah Bin Al Mugheira and someone else who said, Hamza Bin Humran married a daughter of Bukeyr, So when it was the night of consummation, the women said to him, You do not care about the divorce, and it is not with anything in your presence, and we will not let her come to you until you do Zahaar from the mothers of your children. So he did it. So he mentioned that to Abu Abdullah asws. So he asws ordered him that he should go near them. 6 أ ب و ع ل ي ا ل ش ع ر ي ع ن م ح امد ب ن ع ب د ال ج ابار و أ ب و ال ع اباس ال ار ازاز ع ن أ ي وب ب ن ن وح ج م يعا ع ن ى ف و ان عن اب ن أ ب ي ع م ي ر ع ن ع ب د ا للا ب ن ال م غ ير ة ا ت ز اوج ح م ز ة ب ن ح م ر ان اب ن ة ب ك ي ر ق ل اما أ ر اد أ ن ي د خ ب ه ا ا ل ه الن ل اء ل ل ن ا ن د خ ل ه ا ع ل ي ح اتا ت ح ل ف ل ن ا و ل ل ن ا ن ر ا أ ن ت ح ل ف ب ال ع ت ق ل ان ل ت ر اه ش ي ئا و ل ك ن اح ل ف ل ن ا ب الظ ه ار و ظ اه ر م ن أ امه ات أ و ل د و ج و ار ي ق ظ اه ر م ن ه ان ث ام ذ ك ر ذ ل ل ب ي ع ب د ا للا عليه اللمام ق ا ا ل ي س ع ل ي ش ي ء ار ج ع إ ل ي ه ان. Abu Ali Al Ashary, from Muhammad Bin Abdul Jabbar, and Abu Al Abbas Al Razzaz, from Ayoub Bin Nuh, altogether from Safwan, from Ibn Abu Umeyr, from Abdullah Bin Al Mugheira who said, Hamza Bin Humran married a daughter of Bukeyr. So when he intended to copulate with her, the women said to him, We will not let her come over to you until you swear an oath to us, and we will not be pleased if you oath with the emancipation (liberation of a slave), because you do not see it as anything, but oath for us with the Zahaar, and do Zahaar from the mothers of your children, and your neighbours. So he did Zahaar from them. Then he mentioned that to Abu Abdullah asws, so he asws said: There is nothing upon you. Return to them. 7 أ ب و ع ل ي ا ل ش ع ر ي ع ن م ح امد ب ن ع ب د ال ج ابار ع ن ى ف و ان ع ن أ ب ي ال ح ل ن عليه اللمام ا ل أ ل ت ه ع ن ال ارج ي ى ل ي ال اىما ة أ و ي ت و اأ ق ي ش ق يه ا ب ع د ذ ل ق ي ا و إ ن أ ع د ت ال اىما ة أ و أ ع د ت ال و وء ق ام ر أ ت ه ع ل ي ه ك ظ ه ر أ م ه و ي ح ل ف ع ل ا ذ ل ب ال اطما ق ق ا ا ه ذ ا م ن خ ط و ات ال اشي ط ان ل ي س ع ل ي ه ش ي ء. Abu Ali Al Ashary, from Muhammad Bin Abdul Jabbar, from Safwan, (It has been narrated) from Abu Al-Hassan asws, said, I asked him asws about the man who Prayed the Prayer, or performed ablution, so he doubted with regards to it after that, so he is saying that if he were to repeat his Prayer or repeat his ablution, so his wife would be unto him like the back of his mother, and he swears upon that with the divorce. So he asws said: This is from the footsteps of the Satan la. 7 Ali Bin Ibrahim, from his father, and a number of our companions, from Ahmad Bin Muhammad, from Usman Bin Isa, from Sama at, from Abu Baseer, (It has been narrated) from Abu Abdullah asws, said, I heard him asws saying, A man came over to Rasool-Allah saww, so he said, O Rasool-Allah saww! I have done Zahaar from my wife. He saww said: Go, so emancipate a neck. He said, There isn t anything with me. He saww said: Go, so Fast for two months consecutively. He said, I am not strong enough. He saww said: Go, so feed sixty poor ones. He said, There isn t with me (enough money). So Rasool-Allah saww said: I saww shall give charity on your behalf. So he saww gave him some dates for feeding sixty poor ones. He saww said: Go, so give in charity with it. So he said, By the One Who azwj Sent you saww with the truth, I do not know anyone between these mountains anyone more needy for it than myself and my family. He saww said: So, go, eat and feed your family. 9 ع ل ي ب ن إ ب ر اه يم ع ن أ ب يه ع ن اب ن أ ب ي ع م ي ر ع ن ج م ي ب ن د اراج ا ل ت ل ب ي ع ب د ا للا ل م ر أ ت ه أ ن ت ع ل اي ك ظ ه ر ع امت ه أ و خ ال ت ه ا ه و الظ ه ا ر عليه اللمام ال ارج ي ا و Ali Bin Ibrahim, from his father, from Ibn Abu Umeyr, from Jameel Bin Darraj who said, I said to Abu Abdullah asws, The man is saying to his wife, You are unto me like the back of either his paternal aunt or his maternal aunt. He asws said: It is the Zahaar. ا و ل أ ل ن اه ع ن الظ ه ار م ت ا ي ا ع ع ل ا ى اح ب ه ال ك افار ة ق ا ا إ ذ ا أ ر اد أ ن ي و ا ع ام ر أ ت ه ل ت ق إ ن ط لاا ه ا ب أ ن ي و ا ع ه ا أ ع ل ي ه ك افار ة ا ل ل ا ط ت ع ن ه ال ك افار ة He (the narrator) said, And we asked him about the Zahaar, when does the expiation occur upon its perpetrator? So he asws said: When he intends to copulate with his wife. I said, Supposing he divorces her before he copulates with her, would there be an expiation upon him? He asws said: The expiation does not drop off from him. ل ت ق إ ن ى ام ب ع ا ق م ر ض ق أ ق ط ر أ ي ل ت ا ب أ م ي ت م م ا ب ا ي ع ل ي ه ق ا ا إ ن ى ام ش ه را ق م ر ض ا ل خ ر ي و ما أ و ي و م ي ن ب ن ا ع ل ا م ا ب ا ي ال ت ا ب و إ ن ز اد ع ل ا ال اشه ر I said, So if he were to Fasts some, so he falls sick, so he breaks the Fasting, shall he start again or he has to complete what remains upon him? He (the narrator) said, And I asked him asws about the Zahaar upon the free woman and the slave woman. So he asws said: Yes. It was said, Supposing if he did Zahaar in Shaban and did not find what he could emancipate? He asws said: He should wait until he Fasts the Month of Ramazaan, then he should Fast for two months consecutively. And if he had done Zahaar and he is a traveller, he should wait until he returns home. 10 I said to Abu Abdullah asws, The man is saying to his wife, You are unto me like the back of my sister, or my paternal aunt, or my maternal aunt. Some of the ones in your asws Wilayah are alleging that the man, when he speaks with the Zahaar, the expiation is Obligated upon him, violating an oath or not violating an oath, and they are saying that his lie is his speaking with the Zahaar, and rather the expiation is made to be upon him as a Punishment for the speech; and one of them is alleging that the expiation does not necessitate until he is lying regarding something which he has sworn upon, for the lying Obligates the expiation upon him, or else there is no expiation upon him. He asws said: And a man from the Helpers from the Clan of Najjar came over to Rasool-Allah saww, so he said, I did Zahaar from my wife, then I copulated with her before I expiated. So he saww said: And what carried you upon that? He said, When I did Zahaar, I saw the glitter of her anklets and the whiteness of her legs in the moonlight, so I copulated with her before I expiated. Abu Ali Al Ashary, from Muhammad Bin Abdul Jabbar, or someone else, from Al Hassan Bin Ali, from Ali Bin Uqba, from Musa Bin Akeyl Al Numeyri, from one of our companions, (It has been narrated) from Abu Abdullah asws regarding a man who did Zahaar, then divorced. He asws said: The expiation is dropped off from him when he divorces before he repeats the copulation. It was said, Supposing he reverts to her? He asws said: If it was such, rather he divorced her in order for the dropping off of the expiation from him, then he reverted back to her. Al Husayn Bin Muhammad, from Moala Bin Muhammad, from Al Hassan Bin Ali, from Aban, from Al Hassan Al Sayqal who said, I spoke to Abu Abdullah asws about the man who did Zahaar from his wife. He asws said: So let him expiate. I said, Supposing he copulates before he expiates? Ali Bin Ibrahim, from his father, and Muhammad Bin Ismail, from Al Fazl Bin Shazaan, from Ibn Abu Umeyr, from Abdul Rahman Bin Al Hajjaj, (It has been narrated) from Abu Abdullah asws having said: The Zahaar is of two types. In one of them there is the expiation before the copulation, and the other one after it. So that which he has to expiate before the copulation is the one in which he is saying, You are unto me like the back of my mother, and is not saying, If you were to do such and such. 14 Muhammad Bin Abu Abdullah Al Kufy, from Muawiya Bin Hukeym, from Safwan, from Abdul Rahman Bin Al Hajjaj who said, I heard Abu Abdullah asws saying: When the man swears an oath with the Zahaar, so he has sinned. He asws said: Yes, she is his wife. So if he were to revert back to her, it would Obligated upon him what Obligates upon the perpetrator of Zahaar from before they touch each other. I said, So if he were to leave her until she is free from her term and she is in control of herself, then he marries her after that, would the Zahaar necessitate upon him before he touches her? He asws said: No. She was irrevocably divorced from him, and in control of herself. I said, So if her does Zahaar from her, and does not touch her, and leaves her, not touching her except that he sees her naked from without touching her, would anything from that necessitate upon him? So she was irrevocably divorced from him. Is there an expiation upon him? Ali Bin Ibrahim, from his father, from Salih Bin Saeed, from Yunus, from one of his men, (It has been narrated) from Abu Abdullah asws, said, I asked him asws about a man who said to his wife, You are unto me like the back of my mother, or like her hand, or like her belly, or like her private part, or like herself, or like her heels, does that happen to be Zahaar, and does it necessitate him in it what necessitates the perpetrator of Zahaar? So he asws said: The perpetrator of Zahaar, when he does Zahaar from his wife, so he says she is like the back of his mother, or her hand, or like her feet, or like her hair, or anything from her, meaning by that the prohibition, so the expiation necessitates upon him in everything little from it or more, and similar to that is when he says it to some close relatives, so the expiation is necessitated upon him. 36 Chapter 73 The cursing باب الل ع ان ع ادة م ن أ ى ح اب ن ا ع ن ل ه ب ن ز ي اد و ع ل ي ب ن إ ب ر اه يم ع ن أ ب يه ع ن اب ن أ ب ي ن ى ر ع ن ع ب د ال ك ر يم ع ن أ ب ي ب ى ير ع ن أ ب ي ع ب د ا للا عليه اللمام ا ل ي ا ع الل ع ان ح اتا ي د خ ال ارج ب أ ه ل ه. 16 Al Husayn Bin Muhammad, from Moala Bin Muhammad, from Al Hassan Bin Ali, from Aban, from Muhammad Bin Muslim, (It has been narrated) from Abu Ja far asws having said: Neither does cursing happen, nor the swearing except after the copulation. 38 ع ادة م ن أ ى ح اب ن ا ع ن ل ه ب ن ز ي اد ع ن أ ح م د ب ن م ح امد ب ن أ ب ي ن ى ر ع ن ال م ث انا ع ن ز ر ار ة ا ل ئ أ ب و ع ب د ا للا عليه ا ل أ ن ف ل ه م ا ه و ال ا اذ ف الاذ ي ي ا ذ ف ام ر أ ت ه اللمام ع ن و ا للا ع از و ج ا و الاذ ين ي ر م ون أ ز واج ه م و ل م ي ك ن ل ه م ش ه داء إ ا ل أ ن ي م ي ق ي ش ه د ع ل ي ها أ ر ب ع ش ه اد ات ب ا ا لل إ ان ه ق إ ذ ا ذ ق ه ا ث ام أ ار أ انه ك ذ ب ع ل ي ه ا ج ل د ال ح اد و ر ادت إ ل ي ه ام ر أ ت ه و إ ن أ ب ا إ ل م ن ال اىاد ين و ال خ ام ل ة ي ل ع ن ق يه ا ن ف ل ه إ ن ك ان م ن ال ك اذ ب ين A number of our companions, from Sahl Bin Ziyad, from Ahmad Bin Muhammad Bin Abu Nasr, from Al Musna, from Zurara who said, Abu Abdullah asws was asked about the Words of Allah azwj Mighty and Majestic [24:6] And (as for) those who accuse their wives and have no witnesses except for themselves. He asws said: He is the slanderer who slanders his wife. So when he has slandered her, then he accepts that he had lied against her. He would be whipped the legal penalty (Hadd), and his wife would be returned to him. And if he refuses except that he stands by it, so he should testify against her with four testimonies by Allah azwj that he is from the truthful ones, and fifthly he should curse himself in it, if he was from the liars. ق إ ن أ ر اد ت أ ن ت د ق ع ع ن ن ف ل ه ا ال ع ذ اب و ال ع ذ اب ه و ال ارج م ش ه د ت أ ر ب ع ش ه اد ات ب ا ا لل إ انه ل م ن ال ك اذ ب ين و ال خ ام ل ة أ ان غ ب ا للا ع ل ي ه ا إ ن ك ان م ن ال اىاد ين ق إ ن ل م ت ف ع ر ج م ت و إ ن ق ع ل ت د ر أ ت ع ن ن ف ل ه ا ال ح اد ث ام ل ت ح ل ه إ ل ا ي و م ال ا ي ام ة So if she intends to repel the punishment from herself, and the punishment is the stoning, she should testify with four testimonies with Allah azwj that he is from the liars, and the fifth that the Wrath of Allah azwj would be upon her if he was from the truthful ones. So if she does not do that, she would be stoned, and if she does do it, it would stave off the legal penalty (Hadd) from her, then she would not be Permissible for him until the Day of Judgement. ل ت أ ر أ ي ت إ ن ق ر ق ب ي ن ه م ا و ل ه ا و ل د ق م ات ا ت ر ث ه أ م ه و إ ن م ات ت أ م ه و ر ث ه أ خ و ال ه و م ن ا إ انه و ل د ز ن ا ج ل د ال ح اد ل ت ي ر د إ ل ي ه ال و ل د إ ذ ا أ ار ب ه ا ل و ل ك ر ام ة و ل ي ر ث ا ل ب ن و ي ر ث ه ا ل ب ن. I said, What is your asws view if there is separation between the two of them and for her is a child, so it dies. He asws said: Its mother would inherit it, and if its mother dies, its maternal uncles would inherit it, and the one who says that he is a son of adultery would be whipped the legal penalty (Hadd). I said, Would the child be returned to him if he accepts it? 17 Ali Bin Ibrahim, from his father, from Ibn Mahboub, from Abdul Rahman Bin Hajjaj who said, Abbad Al-Basry asked Abu Abdullah asws and I was present, How does the man curse the woman? So Abu Abdullah asws said: A man from the Muslims came over to Rasool-Allah saww, so he said, O Rasool-Allah saww! What is your saww view, if a man were to enter into his house, so he finds a man copulating with his wife, what should he do? So Rasool-Allah saww turned away from him, and that man went away, and that was the man who was afflicted by that from his wife. ا ق ن ز ع ل ي ه ال و ح ي م ن ع ن د ا للا ع از و ج ا ب ال ح ك م ق يه م ا ق أ ر ل ر ل و ا للا ىلا للا عليه وهله إ ل ا ذ ل ال ارج ق د ع اه ق ا ا ل ه أ ن ت الاذ ي ر أ ي ت م ع ام ر أ ت ر ج ما ق ا ا ن ع م ق ا ا ل ه ان ط ل ق ق أ ت ن ي ب ام ر أ ت ق إ ان ا للا ع از و ج ا د أ ن ز ال ح ك م ق ي و ق يه ا He asws said: So a Revelation descended upon him saww from the Presence of Allah azwj Mighty and Majestic with the judgement regarding both of them. So Rasool-Allah saww sent a message to that man calling him over. So he saww said to him: Are you the one who saw a man with your wife? So he said, Yes. So he saww said: Go and come to me saww with your wife, for Allah azwj Mighty and Majestic has Revealed the Judgement with regards to you and regarding her. ا ق أ ح ر ه ا ز و ج ه ا ق أ و ف ه م ا ر ل و ا للا ىلا للا عليه وهله ث ام ا ل ل ازو ج اش ه د أ ر ب ع ش ه اد ات ب ا ا لل إ ان ل م ن ا للا ق إ ان ل ع ن ة ا للا ال اىاد ين ق يم ا ر م ي ت ه ا ب ه ا ق ش ه د ث ام ا ل ه ر ل و ا للا ىلا للا عليه وهله أ م ل و و ع ظ ه ث ام ا ا اتق ش د يد ة ث ام ا ل ه اش ه د ال خ ام ل ة أ ان ل ع ن ة ا للا ع ل ي إ ن ك ن ت م ن ال ك اذ ب ين ا ق ش ه د ث ام أ م ر ب ه ق ن ح ي He asws said: So her husband presented her. So Rasool-Allah saww paused both of them, then said to the husband: Testify with four testimonies by Allah azwj, that you are from the truthful ones, regarding what you are accusing her with. So he testified. The Rasool-Allah saww said to him: Wait, and he saww advised him, then said: Fear Allah azwj, for the Curse of Allah azwj is intense. Then he saww said to him: Testify the fifth that the Curse of Allah azwj be upon you if you were from the liars. So he testified. Then he saww commanded for him to stand aside. ث ام ا ل ل م ر أ ة اش ه د ي أ ر ب ع ش ه اد ات ب ا ا لل إ ان ز و ج ل م ن ال ك اذ ب ين ق يم ا ر م ا ب ه ا ق ش ه د ت ث ام ا ل ه ا أ م ل ك ي ق و ع ظ ه ا و ا ل ه ا ا اتا ي ا للا ق إ ان غ ب ا للا ش د يد ث ام ا ل ه ا اش ه د ي ال خ ام ل ة أ ان غ ب ا للا ع ل ي إ ن ك ان ز و ج م ن ال اىا د ين ق يم ا ر م ا ب ه ا ق ش ه د ت Then he saww said to the woman: Testify four testimonies that your husband is from the liars with regards to what he is accusing you with. So she testified. Then he saww said to her: Wait. So he saww advised her and said to her: Fear Allah azwj, for the Wrath of Allah azwj is intense. Then he saww said: Testify the fifth that the Wrath of Allah azwj be upon you if your husband was from the truthful ones with regards to what he is accusing you with.
