Abu Ali Al Ashary, from Muhammad Bin Abdul Jabbar, from Safwan, from Ibn Muskan, from Abu Baseer, (It has been narrated) from one of the two (5 th or 6 th Imam asws ), said, I said to him asws, The Words of Allah azwj Mighty and Majestic [2:178] O you who believe! The retaliation is Prescribed for you in the matter of the slain, the free for the free, and the slave for the slave, and the female for the female. So he asws said: The free would not be killed due to the slave, but he would be whipped with intense whipping, and would be fined his value as wergild for the slave. 1 ع د ة م أن أ أصح اب ن ا ع أن أ أحم د أبن أ ب ي ع أبد للا ع أن ع أ ثم ان أبن ع يس ى ع أن س م اع ة ع أن أ ب ي ع أبد للا ( عليه السالم ) ي أقت ل ا ألع أبد ب ا ألح ر و ل ي أقت ل ا ألح ر ب ا ألع أبد و ل ك أن ي غ ر م ث م ن ه و ي أضر ب ض أربا ش د يدا ح ت ى ل ي ع ود. ق ال ق ا ل A number of our companions, from Ahmad Bin Abu Abdullah, from Usman Bin Isa, from Sama at, (It has been narrated) from Abu Abdullah asws having said: The Slave would be killed due to the free, and the free would not be killed due to the slave, but he would be fined his value, and he would be whipped with an intense whipping until he does not repeat. 2 ع ل ي أبن إ أبر اه يم ع أن أ ب يه ع ن ا أبن أ ب ي ع م أير ع أن ح م اد ع ن ا ألح ل ب ي ع أن أ ب ي ع أبد للا ( عليه السالم ) ق ال ق ال ل ي أقت ل ا ألح ر ب ا ألع أبد و إ ذ ا ق ت ل ا ألح ر ا ألع أبد غ ر م ث م ن ه و ض ر ب ض أربا ش د يدا. Ali Bin Ibrahim, from his father, from Ibn Abu Umeyr, from Hammad, from Al Halby, (It has been narrated) from Abu Abdullah asws having said: The free would not be killed due to the slave. 4 Muhammad Bin Yahya, from Ahmad Bin Muhammad, from Ali Bin Al Hakam, from Ali Bin Abu Hamza, from Abu Baseer, Abu Abdullah asws has said: The free would not be killed due to a slave, even if he kills him deliberately, but he would be fined his price and would be whipped with an intense whipping when he kills him deliberately. And he asws said: The wergild of the slave is his value. 4 ع ل ي أبن إ أبر اه يم ع أن م ح م د أبن ع يس ى ع أن ي ون س ع ن ا أبن م أسك ان ع أن أ ب ي ع أبد للا ( عليه السالم ) ق ا ل د ي ة ا ألع أبد ق يم ت ه ف إ أن ك ان ن ف يسا ف أ أفض ل ق يم ت ه ع ش ر ة آل ف د أره م و ل ي ج او ز ب ه د ي ة ا ألح ر. Ali Bin Ibrahim, from Muhammad Bin Isa, from Yunus, from Ibn Muskan, Abu Abdullah asws has said: Wergild of the slave is his value. So if he was precious, so the highest of his value would be a thousand Dirhams, and the wergild of the free would not be exceeded by it. 5 ي ون س ع أن أ ب ان أبن ت أغل ب ع م أن ر و اه ع أن أ ب ي ع أبد للا ( عليه السالم ) ق ال إ ذ ا ق ت ل ا ألع أبد ا ألح ر د ف ع إ ل ى أ أول ي اء ا ألم أقت ول ف إ أن ش اء وا ق ت ل وه و إ أن ش اء وا ح ب س وه و إ أن ش اء وا ا أست ر ق وه و ي ك ون ع أبدا ل ه أم. Yunus, from Aban Bin Taghlub, from the one who reported it, Abu Abdullah asws has said: When the slave kills the free, he would be handed over to the guardians of the killed. So if they so desire to, they kill him, and if they so desire to, they imprison him, and if they so desire to, or leave him and he can be a slave to them. 6 ع ل ي أبن إ أبر اه يم ع أن أ ب يه ع أن ح م اد أبن ع يس ى ع أن ح ر يز ع أن ز ر ار ة ع أن أ ح د ه م ا ( عليهما السالم ) ف ي ا ألع أبد إ ذ ا ق ت ل ا ألح ر د ف ع إ ل ى أ أول ي اء ا ألم أقت ول ف إ أن ش اء وا ق ت ل وه و إ أن ش اء وا ا أست ر ق وه. Ali Bin Ibrahim, from his father, from hammad Bin Isa, from Hareyz, from Zurara, (It has been narrated) from one of the two (5 th or 6 th Imam asws ) regarding the slave when he kills the free, he would be handed over to the guardians of the killed one, so if they so desire to, they kill him, and if they so desire to they keep him (as a slave for them). 7 م ح م د أبن ي أحي ى ع أن أ أحم د أبن م ح م د ع ن ا أبن م أحب وب ع أن ه ش ام أبن س ال م ع أن أ ب ي ب ص ير ق ال س أ ألت أ ب ا ج أعف ر ( عليه السالم ) ع أن م د ب ر ق ت ل ر ج ال ع أمدا ف ق ال ي أقت ل ب ه ق ال ق ألت ف إ أن ق ت ل ه خ ط أ ق ال ف ق ال ي أدف ع إ ل ى أ أول ي اء ا ألم أقت و ل ف ي ك ون ل ه أم ر ق ا إ أن ش اء وا ب اع وه و إ أن ش اء وا ا أست ر ق وه و ل أيس ل ه أم أ أن ي أقت ل وه ق ال ث م ق ال ي ا أ ب ا م ح م د إ ن ا ألم د ب ر م أمل وك. Muhammad Bin Yahya, from Ahmad Bin Muhammad, from Ibn Mahboub, from Hisham Bin Salim, from Abu Baseer who said, I asked Abu Ja far asws about the Mudabbir (slave promised freedom upon the death of his master), who killed a man deliberately. So he asws said: He would be killed due to it. I said, So if he killed him in error? 5 ج the guardians of the killed one, so he would happen to be a slave for them, if they so desire to they can sell him, and if they so desire to they can keep him, and it is not for them that they kill him. Then he asws said: O Abu Muhammad! The Mudabbir is a slave. 8 ع ل ي أبن إ أبر اه يم ع أن أ ب يه ع ن ا أبن أ ب ي ع م أير ع أن ج م يل ق ال ق ألت ل ب ي ع أبد للا ( عليه السالم ) م د ب ر ق ت ل ر ج ال خ ط أ م أن ي أضم ن ع أنه ق ال ي ص ال ح ع أنه م أول ه ف إ أن أ ب ى د ف ع إ ل ى أ أول ي اء ا ألم أقت ول ي أخد م ه أم ح ت ى ي م وت ال ذ ي د ب ر ه ث م ي أر جع ح ر ا ل س ب ي ل ع ل أيه و ف ي ر و اي ة أ أخر ى و ي أست أسع ى ف ي ق يم ت ه. Ali Bin Ibrahim, from his father, from Ibn Abu Umeyr, from Jameel who said, I said to Abu Abdullah asws, A Mudabbir (Slave promised freedom upon the death of his master), who killed a man in error, who is responsible from him? He asws said: His master has to reconcile from him. But, if they refuse, he would be handed over to the guardians of the killed one to serve them until he dies, the one who had promised him freedom. Then he is returned as free, there not being a way against him. And in another report: And he has to work regarding his value. 9 م ح م د أبن ي أحي ى ع أن أ أحم د أبن م ح م د ع ن ا أبن م أحب وب ع أن أ ب ي م ح م د ا ألو اب ش ي ق ال س أ ألت أ ب ا ع أبد للا ( عليه السالم ) ع أن ق أو م أقر ار ا ألع أبد ع ل ى س ي د ه ف إ أن أ ق ام وا ا ألب ي ن ة ع ل ى م ا اد ع أوا ع ل ى اد ع أوا ع ل ى ع أبد ج ن اي ة ي ح يط ب ر ق ب ت ه ف أ ق ر ا ألع أبد ب ه ا ق ال ل ي ج وز إ ا ألع أبد أ خ ذ ا ألع أبد ب ه ا أ أو ي أفت د ي ه م أول ه. Muhammad Bin Yahya, from Ahmad Bin Muhammad, from Ibn Mahboub, from Abu Muhammad Al Wabishy who said, I asked Abu Abdullah asws about a group which claimed upon a slave for a crime which (the damage of which) was more than his value. So the slave accepted with it. He asws said; The confession of the slave upon his master is not allowed. So if the proof is established upon what is being claimed upon the slave, the slave would be seized for it, or his master has to ransom him. 10 ع د ة م أن أ أصح اب ن ا ع أن س أهل أبن ز ي اد ع ن ا أبن م أحب وب ع ن ا أبن ر ئ اب ع ن ا ألح ل ب ي ع أن أ ب ي ع أبد للا ( عليه السالم ) ق ال إ ذ ا ق ت ل ا ألح ر ا ألع أبد غ ر م ق يم ت ه و أ د ب ق يل ف إ أن ك ان أت ق يم ت ه ع أشر ين أ ألف د أره م ق ال ل ي ج او ز ب ق يم ة ع أبد د ي ة ا أ ل أحر ار. A number of our companions, from Sahl Bin Ziyad, from Ibn Mahboub, from Ibn Raib, from Al Halby, (It has been narrated) from Abu Abdullah asws having said: When the free kills the slave, he would be fined his value, and be disciplined, so even if his value was twenty thousand Dirhams. 6 And from him, and Ali Bin Ibrahim, from his father, both together from Ibn Mahboub, from Ali Bin Raib, from Al Fuzayl Bin Yasaar, (It has been narrated) from Abu Abdullah asws having said regarding a salve having injured a free: If the free one so desires to he can retaliate from it, and if he so desires to he can seize him, if it was such that the injuries exceeded his freedom (price), and if it did not exceed his freedom price, his master has to ransom him. So if his master refuses to ransom him, there would be for the free one, the injured, a wergild of the measure of his injuries sustained, and the remainder would be for the master. The slave would be sold, so the injured would take his right, and return the remainder upon the master. 12 ا أبن م أحب وب ع أن ع أبد ا ألع ز يز ا ألع أبد ي ع أن ع ب أيد أبن ز ر ار ة ع أن أ ب ي ع أبد للا ( عليه السالم ) ف ي ر ج ل ش ج ع أبدا م وض ح ة ق ا ل ع ل أيه ن أصف ع أشر ق يم ت ه. Ibn Mahboub, from Abdul Aziz Al Abdy, from Ubeyd Bin Zurara, (It has been narrated) from Abu Abdullah asws regarding a man who fractured a bone of a slave. He asws said: Upon him is half of the tenth of his price. 13 ا أبن م أحب وب ع ن ا ألح س ن أبن ص ال ح ق ال س أ ألت أ ب ا ع أبد للا ( عليه السالم ) ع أن ع أبد ق ط ع ي د ر ج ل ح ر و ل ه ث ال ث أ ص اب ع م أن ي د ه ش ل ل ف ق ال و م ا ق يم ة ا ألع أبد ق ألت ا أجع أله ا م ا ش أئت ق ال إ أن ك ان ق يم ة ا ألع أبد أ أكث ر م أن د ي ة ا أ ل أصب ع أين الص ح يح ت أين و الث ال ث أ ص اب ع الش ل ل ر د ال ذ ي ق ط ع أت ي د ه ع ل ى م أول ى ا ألع أبد م ا ف ض ل م ن ا ألق يم ة و أ خ ذ ا ألع أبد و إ أن ش اء أ خ ذ ق يم ة ا أ ل أصب ع أي ن الص ح يح ت أين و الث ال ث أ ص اب ع الش ل ل Ibn Mahboub, from Al Hassan Bin Salih who said, I asked Abu Abdullah asws about a slave who cut-off the hand of a free man, and for him were three paralysed fingers from his hand. So he asws said: And what is the value of the slave? I said, Make it to be whatever you asws like. He asws said: If the value of the slave was more than the wergild of the two correct fingers, and the three paralysed fingers, the one whose hand was cut off has to return to the master of the slave whatever was the remainder from the value, and seize the slave; and if he so desire to he can take the value of the two correct fingers and the three paralysed fingers. ق ألت و ك أم ق يم ة ا أ ل أصب ع أين الص ح يح ت أين م ع ا ألك ف و الث ال ث ا أ ل ص اب ع ]الش ل ل [ ق ال ق يم ة ا أ ل أصب ع أين الص ح يح ت أين م ع ا ألك ف أ ألف ا د أره م و ق يم ة الث ال ث ا أ ل ص اب ع الش ل ل م ع ا ألك ف أ ألف د أره م ل ن ه ا ع ل ى الث ل ث م أن د ي ة الص ح ا ح I said, And how much is the value of the two correct fingers along with the palm, and the three paralysed fingers? 7 He asws said: And if it was such that the value of the slave is less than the wergild of the two correct fingers, and the three paralysed fingers, the slave would be handed over to the one whose hand was cut off, or his master has to ransom him, and he can take the slave. 14 ع ل ي أبن إ أبر اه يم ع أن م ح م د أبن ع يس ى ع أن ي ون س ع م أن ر و اه ق ال ق ال ي ألز م م أول ى ا ألع أبد ق ص اص ج ر اح ة ع أبد ه م أن ق يم ة د ي ت ه ع ل ى ح س اب ذ ل ك ي ص ير أ أرش ا ألج ر اح ة و إ ذ ا ج ر ح ا ألح ر ا ألع أبد ف ق يم ة ج ر اح ت ه م أن ح س اب ق يم ت ه. Ali Bin Ibrahim, from Muhammad Bin Isa, from Yunus, from the one who reported it, said, He asws said: It necessitates a master of the slave (to accept) the retaliation of an injury of his slave from the value of his wergild upon the accounting which comes to compensate for the injury; and when the free injures the slave, the value of his injury is from accounting of his (own) value. 15 ع د ة م أن أ أصح اب ن ا ع أن س أهل أبن ز ي اد ع أن أ أحم د أبن م ح م د أبن أ ب ي ن أصر ع أن ج م يل و ع ل ي أبن إ أبر اه يم ع أن م ح م د أبن ع يس ى ع أن ي ون س ع أن م ح م د أبن ح أمر ان ج م يعا ع أن أ ب ي ع أبد للا ( عليه السالم ) ف ي م د ب ر ق ت ل ر ج ال خ ط أ ق ال إ أن ش اء م أول ه أ أن ي ؤ د ي إ ل أيه م الد ي ة و إ ل د ف ع ه إ ل أيه أم ي أخد م ه أم ف إ ذ ا م ات م أول ه ي أعن ي ال ذ ي أ أعت ق ه ر ج ع ح ر ا و ف ي ر و اي ة ي ون س ل ش أيء ع ل أي ه. A number of our companions, from Sahl Bin Ziyad, from Ahmad Bin Muhammad Bin Abu Nasr, from Jameel, and Ali Bin Ibrahim, from Muhammad Bin Isa, from Yunus, from Muhammad Bin Humran, (It has been narrated) both together from Abu Abdullah asws regarding a Mudabbir (slave promised freedom upon the death of his master), who killed a man in error. He asws said: If his master so desires to he can pay the wergild to them, or else hand him over to them, for him to serve them. So when his master dies, meaning the one who (promised to) free him, he would return as free. And in another report of Yunus: There would be nothing upon him. 16 ع ل ي أبن إ أبر اه يم ع أن أ ب يه ع ن ا أبن م أحب وب ع أن ن ع أيم أبن إ أبر اه يم ع أن م أسم ع أبن ع أبد ا ألم ل ك ع أن أ ب ي ع أبد للا ( عليه السالم ) ق ال أ م ا ألو ل د ج ن اي ت ه ا ف ي ح ق وق الن اس ع ل ى س ي د ه ا و م ا ك ا ن م أن ح ق وق للا ع ز و ج ل ف ي ا ألح د ود ف إ ن ذ ل ك ف ي ب د ن ه ا ق ال و ي ق اص م أنه ا ل ألم م ال يك و ل ق ص اص ب أين ا ألح ر و ا ألع أبد. Ali Bin Ibrahim, from his father, from Ibn Mahboub, from Nuaym Bin Ibrahim, from Misma a Bin Abdul Malik, Abu Abdullah asws has said: A (slave) mother of the child, her crimes regarding the rights of the people are upon her master, and whatever was from the Rights of Allah azwj Mighty and Majestic regarding the legal penalties (Hadd), so that would be upon her body; and there would be retaliation from it for the slaves, and there would be no retaliation between the free and the slave. 17 ع أنه ع أن أ ب يه ع ن الن أوف ل ي ع ن الس ك ون ي ع أن أ ب ي ع أبد للا ( عليه السالم ) ق ال ق ال أ م ير ا ألم أؤم ن ين ( عليه السالم ) ف ي ع أبد ف ق أ ع أين ح ر و ع ل ى ا ألع أبد د أين إ ن ع ل ى ا ألع أبد ح د ا ل ألم أفق وء ع أين ه و ي أبط ل د أين ا ألغ ر م اء. 8 (It has been narrated) from Abu Abdullah asws having said: Amir Al-Momineen asws said regarding a slave who blinded an eye of a free, and upon the slave was a debt: Upon the slave is a legal penalty (Hadd) for the blinding of his eye, and it would invalidate the debt of the creditors. 18 أ ب و ع ل ي ا أ ل أشع ر ي ع أن م ح م د أبن ع أبد ا ألج ب ار ع أن ص أفو ان ع أن إ أسح اق أبن ع م ار ق ال س أ ألت أ ب ا ع أبد للا ( عليه السالم ) ع أن ر ج ل ل ه م أمل وك ان ق ت ل أ ح د ه م ا ص اح ب ه أ ل ه أ أن ي ق يد ه ب ه د ون الس ألط ان إ أن أ ح ب ذ ل ك ق ال ه و م ال ه ي أفع ل ب ه م ا ي ش اء إ أن ش ا ء ق ت ل ه و إ أن ش اء ع ف ا. Abu Ali Al Ashary, from Muhammad Bin Abdul Jabbar, from Safwan, from Is haq Bin Ammar who said, I asked Abu Abdullah asws about a man for whom were two slaves. One of the two killed his companion, is it for him that he can retaliate with him besides the ruling authorities, if he so likes that? He asws said: He was his property. He can do whatsoever he so desires to with him. Ali Bin Ibrahim, from his father, from Ismail Bin Marrar, from Yunus, from Al Khattab Bin Salama, from Hisham Bin Ahmad who said, I asked Abu Al-Hassan asws about a Mudabbir (slave promised freedom upon the death of his master), who killed a man in error. He asws said: Which thing are you all reporting with regards to this? I said, We are reporting from Abu Abdullah asws having said: He would be completely handed over to the guardians of the killed one. So when the one who promised his freedom upon his own death were to die, he is free. He asws said: Glory be to Allah azwj! So the blood of a Muslim person has been invalidated? I said, This is how we are reporting it. He asws said: You are mistaken upon my asws father asws. He would be completely handed over to the guardians of the killed one. Ali Bin Ibrahim, from Muhammad Bin Isa, from Yunus, from Aasim Bin Humeyd, from Muhammad Bin Qays, (It has been narrated) from Abu Ja far asws having said: Amir Al-Momineen asws judged regarding a contracted slave who was killed. He asws said: It would be counted what (proportion) he was free from it, so he (the killer) would pay the wergild of the free, and what (proportion) he was still enslaved from it, is a ransom of the slave. 22 م ح م د أبن ي أحي ى ع أن أ أحم د أبن م ح م د و ع ل ي أبن إ أبر اه يم ع أن أ ب يه ج م يعا ع ن ا أبن م أحب وب ع أن أ ب ي و ل د ا ألح ن اط ق ال س أ ألت أ ب ا ع أبد للا ( عليه السالم ) ع أن م ك ات ب ا أشت ر ط ع ل أيه م أول ه ح ي ن ك ات ب ه ج ن ى إ ل ى ر ج ل ج ن اي ة ف ق ال إ أن ك ان أ د ى م أن م ك ات ب ت ه ش أيئا أ أغر م ف ي ج ن اي ت ه ب ق أدر م ا أ د ى م أن م ك ات ب ت ه ل ألح ر ف إ أن ع ج ز ع أن ح ق ا ألج ن اي ة ش أيئا أ خ ذ ذ ل ك م أن م ال ا ألم أول ى ال ذي ك ات ب ه Muhammad Bin Yahya, from Ahmad Bin Muhammad and Ali Bin Ibrahim, from his father, both together from Ibn Mahboub, from Abu Wallad Al Hannat who said, I asked Abu Abdullah asws about a contracted slave, his master stipulated a condition upon him when he contracted him, he would pay to a man he commits a crime against. So he asws said; If he has fulfilled something from his contract, he would be fined for his crime in accordance with what he has paid from his contract, to the free. So if he was frustrated from (paying) anything from the right of the crime, that would be taken from the wealth of the master who had contracted him. ق ألت ف إ أن ك ان ت ا ألج ن اي ة ل ألع أبد ق ال ف ق ال ع ل ى م أ ثل ذ ل ك د ف ع إ ل ى م أول ى ا ألع أبد ال ذ ي ج ر ح ه ا ألم ك ات ب و ل ت ق اص ب أين ا ألم ك ات ب و ب أين ا ألع أبد إ ذ ا ك ان ا ألم ك ات ب ق أد أ د ى م أن م ك ات ب ت ه ش أيئا ف إ أن ل أم ي ك أن أ د ى م أن م ك ات ب ت ه ش أيئا ف إ ن ه ي ق اص ا ألع أبد م أنه أ أو ي غ ر م ا ألم أول ى ك ل م ا ج ن ى ا ألم ك ات ب ل ن ه ع أبد ه م ا ل أم ي ؤ د م أن م ك ات ب ت ه ش أيئا. I said, If it was that the (compensation of the) crime was for the slave? So he asws said: A similar amount would be handed over to the master of the slave whom the contracted slave injured, and there would be no retaliation between the contracted slave and the (owned) slave when it was that the contracted slave had paid something off from his contract. 10 I asked Abu Ja far asws about a contracted slave who killed a man in error. So he asws said: If it was the case that his master had stipulated upon him when he contracted him, that if he was frustrated (from paying), so he would return it with regards to the slave, so he would be at the status of the owned slave. He would be handed over to the guardians of the killed one, so if they so desire to they can kill him, and if they so desire to they can sell him. And if it was that his master, when he contracted him, did not stipulate upon him, and it was such that he had paid something off from his contract, so Ali asws was saying: He would be free from the contract in proportionate to what he has paid off from his contract. ف إ ن ع ل ى ا أ ل م ام أ أن ي ؤ د ي إ ل ى أ أول ي اء ا ألم أقت ول م ن الد ي ة ب ق أدر م ا أ أعت ق م ن ا ألم ك ات ب و ل ي أبط ل د م ا أمر م أسل م و أ ر ى أ أن أدر أول ي اء ا ألم أقت ول ي أست أخد م ون ه ح ي ات ه ب ق م ا ب ق ي ع ل أيه و ل أيس ل ه أم أ أن ي ب يع وه. ي ك ون م ا ب ق ي ع ل ى ا ألم ك ات ب م م ا ل أم ي ؤ د ه ر ق ا ل Thus it would be upon the Imam asws that he asws pays the wergild to the guardians of the killed one in accordance to what he has been freed from the contract, and the blood of a Muslim person would not be invalidated. Ali Bin Ibrahim, from his father, from Ismail Bin Marrar, from Yunus, from Abdullah Bin Sinan, (It has been narrated) from Abu Abdullah asws having said regarding a contracted slave who killed a man in error. He asws said: Upon him from his wergild, is in proportion to what he is free, and upon his master is what remains from the value of the price. So if the contracted slave is frustrated (from paying), so there is no blood (compensation) for him. Ali Bin Ibrahim, from his father, from Al Hassan Bin Mahboub, from Al Hassan Bin Salih, (It has been narrated) from Abu Abdullah asws regarding a free man who kills a slave who value is twenty thousand Dirham. ( عليه السالم ) ق ا ل د ي ة ا ألي ه ود ي و Ali Bin Ibrahim, from Muhammad Bin Isa, from Yunus, from Ibn Muskam, Abu Abdullah asws has said: Wergild of the Jew, and the Christian, and the Magian, is eight hundred Dirhams. 27 و ع أنه ع ن ا أبن م أسك ان ع أن أ ب ي ع أبد للا ( عليه السالم ) ق ا ل إ ذ ا ق ت ل ا ألم أسل م ي ه ود ي ا أ أو ن ر د وا ف أضل د ي ة ا ألم أسل م و أ ق اد وه. أصر ان ي ا أ أو م ج وس ي ا ف أ ر اد وا أ أن ي ق يد وا And from him, from Ibn Muskan, Abu Abdullah asws has said: When the Muslim kills a Jew, or a Christian, or a Magian, so they intend that they retaliate, they have to return the excess wergild to the (guardians of the) Muslim, and retaliate him. 28 و ع أنه ع أن ز أرع ة ع أن س م اع ة ع أن أ ب ي ع أب د للا ( عليه السالم ) ف ي ر ج ل م أسل م ق ت ل ر ج ال م أن أ أهل الذ م ة ف ق ال ه ذ ا ح د ي ث ش د يد ل ي أحت م ل ه الن اس و ل ك أن ي أعط ي الذ م ي د ي ة ا ألم أسل م ث م ي أقت ل ب ه ا ألم أسل م. And from him, from Zurara, from Sama at, (It has been narrated) from Abu Abdullah asws regarding a Muslim man who kills a man from the Zimmy people. So he asws said: This is a harsh Hadeeth, the people cannot bear it, but the Zimmy has to give the wergild of the Muslim, then the Muslim would be killed due to it. 29 م ح م د أبن ي أحي ى ع أن أ أحم د أبن م ح م د ع أن ع ل ي أبن ا ألح ك م أ أو غ أير ه ع أن أ ب ان ع أن إ أسم اع يل أبن ا ألف أضل ق ال س أ ألت أ ب ا ع أب د للا ( عليه السالم ) ع أن د م اء ا ألم ج وس و ا ألي ه ود و الن ص ار ى ه أل ع ل أيه أم و ع ل ى م أن ق ت ل ه أم ش أيء إ ذ ا غ ش وا ا ألم أسل م ين و أ أ ظه ر وا ا ألع د او ة ل ه أم ق ال ل إ ل أ أن ي ك ون م ت ع و دا ل ق أتل ه أم Muhammad Bin Yahya, from Ahmad Bin Muhammad, from Ali Bin Al Hakam, or someone else, from Aban, from Ismail Bin Al Fazl who said, I asked Abu Abdullah asws about blood of the Magian, and the Jew, and the Christian, is there anything upon them and upon the one who kills them, when they overcome the Muslims and display enmity to them? 12 He (the narrator) said: And I asked him asws about the Muslim, would he be killed due to the Zimmy people, and the People of the Book, when he kills them? He asws said: No, except if it happens to be habitual for that, not leaving killing them, so he would be killed due to it, and he would be belittled. 30 ع ل ي أبن إ أبر اه يم ع أن م ح م د أبن ع يس ى ع أن ي ون س ع أن م ح م د أبن ا ألف ض أيل ع أن أ ب ي ا ألح س ن الر ض ا ( عليه السالم ) م أ ثل ه. Ali Bin Ibrahim, from Muhammad Bin Isa, from Yunus, from Muhammad Bin Al Fuzayl, (It has been narrated) from Abu Al Hassan Al Reza asws similat to it. أ ب و ع ل ي ا أ ل أشع ر ي ع أن م ح م د أبن ع أبد ا ألج ب ار ع أن ص أفو ان أبن ي أحي ى ع أن م أنص ور أبن ح از م ع أن أ ب ان أبن ت أغل ب ق ال ق ألت ل ب ي ع أبد للا ( عليه السالم ) إ أبر اه ي م ي أزع م أ ن د ي ة ا ألي ه ود ي و الن أصر ان ي و ا ألم ج وس ي س و اء ف ق ال ن ع أم ق ال ا ألح ق. Abu Ali Al Ashary, from Muhammad Bin Abdul Jabbar, from Safwan Bin Yahya, from Mansour Bin Hazim, from Aban Bin Taghlub who said, I said to Abu Abdullah asws, Ibrahim is alleging that the wergild of the Jews, and the Christians, and the Magians, is the same. So he asws said: Yes, he said the truth. 31 ع ل ي أبن إ أبر اه يم ع أن أ ب يه ع ن الن أوف ل ي ع ن الس ك ون ي ع أن أ ب ي ع أبد للا ( عليه السالم ) أ ن أ م ير ا ألم أؤم ن ين ( عليه السالم ) ك ا ن ي ق ول ي أقت ص ل لن أصر ان ي و ا ألي ه ود ي و ا ألم ج وس ي ب أعض ه أم م أن ب أعض و ي أقت ل ب أعض ه أم ب ب أعض إ ذ ا ق ت ل وا ع أمدا. A number of our companions, from Sahl Bin Ziyad, and Ali Bin Ibrahim from his father, bother together from Ibn Mahboub, from Ibn Raib, from Zureys Al Kunasy, (It has been narrated) from Abu Ja far asws regarding a Christian who killed a Muslim. So when he was seized, he became a Muslim. He asws said: He would be killed due to it. It was said: And if he had not become a Muslim? 13 A number of our companions, from Ahmad Bin Muhammad, from Al Husayn Bin Saeed, from Fazalat Bin Ayoub, from Abu Al Magra, from Abu Baseer, (It has been narrated) from Abu Abdullah asws having said: When the Muslim kills the Christian, so the family of the Christian intend to kill him, they can kill him and pay the excess of what is between the two Wergilds. 34 ع ل ي أبن إ أبر اه يم ع أن أ ب يه و م ح م د أبن ي أحي ى ع أن أ أحم د أبن م ح م د ع ن ا أبن م أحب وب ع ن ا أبن ر ئ اب ع أن م ح م د أبن ق أيس ع أن أ ب ي ج أعف ر ( عليه السالم ) ق ال ل ي ق اد م أسل م ب ذ م ي ف ي ا ألق أتل و ل ف ي ا ألج ر اح ات و ل ك أن ي أؤخ ذ م ن ا ألم أسل م ج ن اي ت ه ل لذ م ي ع ل ى ق أد ر د ي ة الذ م ي ث م ان م ائ ة د أره م. Ali Bin Ibrahim, from his father, and Muhammad Bin Yahya, from Ahmad Bin Muhammad, from Ibn Mahboub, from Ibn Raib, from Muhammad Bin Qays, (It has been narrated) from Abu Ja far asws having said: A Muslim would not be retaliated regarding the killing, nor with regards to the injuries, but (the compensation) for his crime would be taken from the Muslim for the Zimmy, in accordance with the wergild of the Zimmy, eight hundred Dirhams. 35 ا أبن م أحب وب ع ن ا أبن ر ئ اب ع أن ب ر أيد ا ألع أجل ي ق ال س أ ألت أ ب ا ع أبد للا ( عليه السالم ) ع أن ر ج ل م أسل م ف ق أ ع أين ن إ ن د ي ة ع أين الن أصر ان ي أ أرب ع م ائ ة د أره م. أصر ان ي ف ق ا ل Ibn Mahboub, from Ibn Raib, from Bureyd Al Ajaly who said, I asked Abu Abdullah asws about a Muslim man who blinded an eye of a Christian. Ali Bin Ibrahim, from Muhammad Bin Isa, from Yunus and a number of our companions, from Sahl Bin Ziyad, from Muhammad Bin Isa, (It has been narrated) from Yunus who presented to Abu Al-Hassan Al-Reza asws a book of the wergild, and there was in it for the loss of the hearing, all of it, a thousand Dinars, and (the loss of) the voice, all of it, from the sound of the nose and the hoarse sound, to be a thousand Dinars, and the paralysis of the two hands, of both of them, and the paralyses, all of it to be of a thousand Dinars, and paralyses of the two feet being a thousand Dinars, and the two lips when severed, being a thousand Dinars, and the back when it humps, a thousand Dinars, and the manhood when it is severed, a thousand Dinars, and the two testicles being a thousand Dinars, and regarding the temple of the man when it is hit, so he is not able to turn except by swerving, is half the wergild, five hundred Dinars. So when he intended to copulate with her, she kicked him with her leg and ruptured his testicles, so they became swollen. So after that he copulated with her and she gave birth to a child for him. So I asked Abu Abdullah asws about that, and about a man whose navel was ruptured. So he asws said: Regarding all ruptures is a third of the wergild. 49 ع د ة م أن أ أصح اب ن ا ع أن أ أحم د أبن م ح م د ع ن ا ألح س أين أبن س ع يد ع ن الن أضر أبن س و أيد ع أن ه ش ام أبن س ال م ع أن س ل أيم ان أبن خ ال د ق ال س أ ألت أ ب ا ع أبد للا ( عليه السالم ) ع أن ر ج ل ك س ر ب أعص وص ه ف ل أم ي أمل ك ا أست ه ف م ا ف يه م ن الد ي ة ف ق ال الد ي ة ك ام ل ة A number of our companions, from Ahmad Bin Muhammad, from Al Husayn Bin Saeed, from Al Nazar Bin Suweyd, from Hisham Bin Salim, from Suleyman Bin Khalid who said, I asked Abu Abdullah asws about a man who broke his tail bone (coccyx), so he lost control of his excretion, so what was with regards to it from the wergild. So he asws said: The complete wergild. ق ال و س أ ألت ه ع أن ر ج ل و ق ع ب ج ار ي ة ف أ أفض اه ا و ك ان أت إ ذ ا ن ز ل أت ب ت ألك ا ألم أنز ل ة ل أم ت ل أد ق ال الد ي ة ك ام ل ة. He (the narrator) said, And I asked him asws about a man who copulated with a slave girl, so he was rough with her, and when she came down from that situation, she could no longer give birth. He asws said: The complete wergild. 50 ع ل ي أبن إ أبر اه يم ع أن أ ب يه ع ن ا أبن م أحب وب ع أن إ أسح اق أبن ع م ار ق ال س م أعت أ ب ا ع أبد للا ( عليه السالم ) ي ق ول ق ض ى أ م ي ر ا ألم أؤم ن ين ( عليه السالم ) ف ي الر ج ل ي أضر ب ع ل ى ع ج ان ه ف ال ي أست أمس ك غ ائ ط ه و ل ب أول ه إ ن ف ي ذ ل ك الد ي ة ك ام ل ة. Ali Bin Ibrahim, from his father, from Ibn Mahboub, from Is haq Bin Ammar who said, I heard Abu Abdullah asws saying: Amir Al-Momineen asws judged regarding the man who was struck upon his lower area, so he could no longer withhold his faeces nor his urine - regarding that is the complete wergild. 51 ع ل ي أبن إ أبر اه يم ع أن أ ب يه ع ن الن أوف ل ي ع ن الس ك ون ي ع أن أ ب ي ع أبد للا ( عليه السالم ) ق ال ق ال أ م ير ا ألم أؤم ن ين ( عليه السالم ) ف ي ذ ك ر الص ب ي الد ي ة و ف ي ذ ك ر ا ألع ن ين الد ي ة.
