1 Airdrie, Alberta May 16, 2014 MY FILE: Item #4 Ms. Suzanne Legault The Information Commissioner of Canada Place de Ville, Tower B 112 Kent Street, 7th Floor Ottawa, Ontario K1A 1H3 Dear Ms. Legault: Re: NATIONAL DEFENCE FILE: A Item #4 Reference is being made to my pervious delay complaint letter dated January 21, 2014 asking for your help in expediting the response from the Department of National Defence. I needn't have worried. Yesterday, I received the department's 17-page response dated May 8, 2014 and any useful information was exempted. I wish to complain about the sections of this response that were blanked out pursuant to sections 21 and 23 of the Access to Information Act. I'm also questioning whether or not the department used their "best efforts" in the search for these documents as stated in their May 8th covering letter. It appears their search for the requested records was focussed on "complaints and witness accounts" filed by the public rather than "complaints and witness accounts" filed by the more than 330 Canadian Armed Forces personnel deployed in High River between June 20, 2013 and June 27, Members of the Princess Patricia Canadian Light Infantry (PPCLI) made up the bulk of the Canadian Forces personnel deployed in High River during the flood. After they returned to their home base, a number of soldiers (of various ranks) were telling their friends of the despicable acts they witnessed being committed by the RCMP while on duty in High River. It's hard to believe that some of these service men and women didn't also complain to their superiors. We also know of at least one incident where two members of the Canadian Forces, while under RCMP supervision, were seen kicking in a door to a High River home and leaving with two long-guns in their hands. We received no record of this event in the department's response. We understand that Canadian Forces personnel are duty bound to report the above types of incidents. 2 Airdrie, Alberta January 21, 2014 MY FILE: 054 Ms. Suzanne Legault The Information Commissioner of Canada Place de Ville, Tower B 112 Kent Street, 7th Floor Ottawa, Ontario K1A 1H3 Dear Ms. Legault: Re: NATIONAL DEFENCE FILE: A Item #4 Reference is being made to my delay complaint dated January 20, While your investigators are looking into the delay complaint, there is some vital information they should be aware of that was provided to me by the National Defence ATIP officer, Tina-Lyne Lajoie. Attached is an I received from Ms. Lajoie dated October 22, 2013 in which she states: "However, I must let you know that I have seen records that could be related in your file A which is your #4 on your list: (4) Copies of reports, documents and correspondence, communications, e- mails, text messages of complaints and witness accounts of any inappropriate or illegal action observed while working in High River." I don't know if it possible for you to expedite an investigation but if it is, this is one investigation that the people of High River need quickly. As you may know, over a eight day period in June, the 230 RCMP officers kicked in the doors to more than 1,900 homes, searched these homes without even trying to get a warrant, seized hundreds of firearms and tens of thousands of rounds of ammunition. The Commissioner for Public Complaints Against the RCMP is investigating these human rights complaints but have no authority to ask the more than 300 National Defence personnel what they saw and did in High River. What these soldiers saw is critical to everyone knowing the truth about what happened and why. The Complaints Commissioner will issue his report in February or March; therefore, it is absolutely critical that we find out what these soldiers witnessed as soon as possible. While you're at it do these extensions for this file seem reasonable? See attached summary. If you need copies of the extension letters from National Defence, please let me know.
