2 14 2 //D.o,n *Angel de-1-4artos y Navarrete' Lieutenant Colronel,.of the R,oya;l Armies, Governor and Captain General of this Province of Texas, New Philippines, its Presidios, Conversions and Frontiers, by the Kingm Our Lord may God Guard him,. Inasmuch as with the communication of the news that outside of this presidio there are mules carrying tobacco and goods taken out from the presidio, of S:,a,n Juan Bautista of Nachitos under. the governme~it of the New Louisiana. And this being against the royal cedule of His Majesty, i.ssued, on the twenty-sixth day of January of the ^year,aone thousand seven hundred and thirty, which strongly commands that without exception.or tolerance, proper patrolling should be given to all kinds of illicit trade, because of the tremendous prejudices that will be followed against those in America and Spain; and to proceed against the guilty ones with the corresponding punishment ignoring their status and condition, and to impose and carry out the punishment provided by Law seven, book nine' title twenty-seven' and law, eightl book thirdl title thirteen; Therefore, by its consequence I, the said governor should command and do command that the Sergeant of this Company' Domingo Chirinos, with a corporal and three

3 15 soldiers, go as soon as possible after the said mules, with the understanding that wherever he finds them, he should search, in the presence of those accompanying him, the cargo that the m.ules, are carrying. And upo,n verifying it to be of the tobacco from t he presidio of Nachitos or of another kind', he should confiscate it in the name of His Majesty and should bring the mules, back, giving provisions to transport the contrabrand, 2v on other mules to this presidio. And he should //know about its content, witbout.omitting all the people found driving the said mules' with the understanding that he will be severely punished for everything considered deffective in the com:pletion of his orders^ as for lesser omissions another sergeant pertaining to this matter, was punished. In the said Royal Presidio of Our Lady of Pilar of Los Adaes7 on the nineteenth day of the month of November, of this year of one thousarid seven hundred and sixty-six^. &cting as delegate judge before my attesting witnesses for lack of notary, public or royal, and in this common;paper for lack of another kind. 5 17 In the said royal presidio, on the first day of December of this present yearl I^ the said ^governor' hav:i.ng Sergeant Chirinos a,rr-ivmed to it at eleven 'o'clock, on the said day, gave me the memorandum of all that by my command he had confiscated before the place named Elhlurasnotrail of the house of the Indian Thomas, and brought it on the same mules that was being transported to the guard of this said presidio. And approving of what was done, I should command and do command, that thepprovisional lieutenant Dro,n. 0 Jr,ose,ph Gonsales^ because I myself am not able to attend personally to this proceedings due to a severe illness, he should appear to examine and to certify that what has been brought on the said mules, agrees with that expressed in the said memorandum; and finding no discrepancy, he should deposit the contraband, in the warehouse of this mentioned Presidio, taking the mules to the st able. After doing this, he should give me a corresponding report, which will be added to the.said memorandumm This I provided, commanded and signed with my mentioned attesting witnesses. 7 19 In the said royal presidio, said dayl month and yearg appeared before mer the said Governor, the already msentioned lieutenant Don Joseph Gonzales,and said, that having done what was commanded to him, he transported the cargo to the guard of this presidio, and verified it as the one expressed in the memorandum and finding no discrepancy, he had it introduced in the warehouse of this said Presidio, leaving the mules ready to be -out in the rplace, next to it. 8 20 //Memorandum of the effects that II Dorningo Chirino?a^ Sergeant of the Presidio of Los Adaes, upon having verified the goods, as of contraband, confiscated and seized the^u from the father conductor of the Mission of Texas, Fray Francis,co Zedano, about half a league from the place namedel durasrioj,'t,rail of the house of the indian'vidais named Thomasl Itodaygthe twenty-fifth day of November of this year of one thousand seven hundred and sixty-six; Two hundred and ninety-nine bundles of good tobacco like"the one from.^.tachitos, ccarried,, in ten.trunks and. two sacs. Eight varas and three fourths,,aboutseven yards and six inches, of crimson velvet. Twenty narrow and ordinary rolls of fine linen. Two rolls of linen Twenty-five small pieces of cloth. Three packages of narrow braidz of fine gold of about five pounds in weight. One roll of coarse brown linen wrapper. A.small barrel of aguardiente of about -ten or twelve asumbres. :One asumbre about 2 7_iters, Ten links. Three bundles of white beeds, all of about three 0 pounds in weight.

9 21 Thirty-eight dozen of metal rings rwrapped, in a small cloth. Four more rolls of fine linen. Eight varas about seven yards and four inches, of Dontibi in two pieces. Four small cloths in addition to the abovementi_oned. Four varas about three yards and seven inches, of red indiana. Five more varas about four yards and twenty in.ches, of blue stripped indiana. Fourteen more varas rabout twelve and one fourth yards, of fine linen in two pieces. Seven mules of the Mission of Aix brand. And so as to be of record, I not knowing how to sign, it was done upon my requestz by the corporal Joaquin Ruiz, and Christobal Carabajal. 10 22 In the said royal presidio^,said day9 month,and {'k year, I,Asaid Governor having seen these proceedings, and having agreed on the manner proceeded about the inspection and embargo of the effects referred to in this prec ^ding information, should.command and do command that the cor^^spondix^g inquiry be made, ques^ tioning the said Ser//geant Ghirino-s and the other sol.diers that accompanied and assisted him on the mentioned judicialproceedings. 11 23 Immediately thereafter I, the said gotrernor, for the effect of the information that pro-,ceed.s the decree which heads this inquiry, summoned the Sergeant of this Company Domingo Chirinos, whom I certify I know, to appear before meo In the presence of my attesting witnesses I administered an oath to him which he took in the name of God our Z,ord., and a sign of His Holy Cross in the prescribed manner of the law, under penalty of which he promised to.tell the truth insofar as he knew and might be questionedm Upon being questioned about the contents of the decree.which heads this inquiry, he replied that :he,, having arrived abotzt four in the afternoon on the twenty fifth day of last November to a place in which, encamped with several mules was the father conductor Fray Francisco Zedano, and that it was about half a league before the place, called''el Durasnotrail of, the settlement of the indianvidari named Thomas, he told the said father, after greeting him, that having arrived there with the pūrpose of inspecting the mentioned cargo he would start, upon no embarrasment, to do so a Upon asking the father if the sergeant had a search warrant from his superior, the witness answered he had it from me, the lovernor, and. ^!^ virtue of it

12 and by order of His IVlajesty he demanded to let him carry out the mentioned order, to which the said father complied with. him to proceed. Upon his consent, the witness ordered some men that were thereq whomq replied. //the said father to be arrimados, to untie the cargo, A;t which they did; and upon searching it'tiwas found what the corresponding memorandum states, and which.,the ser.gqant, had given to me; the said overnor, written by the corporal Joachin Ruiz by his own handwritting, not knowing the witness neither how to write nor how ike to read. And having inspected and aprehended,=,said cargo.' he had it transported to this said presidio on the same mules that to the above-mentioned place had it transported. Being the witness questioned about how many men were going with the said Father Zedano and about their names, and the reasons why he did not insured their names,, he replied that the persons were Christobal Casi?las,.Agu:stin Rodriguez, Juan Palacio' Jrose,ph de Andal and. other two, named one Ysidro and. the other Joseph Antonio, which last names he ignores; and the reason why he had not insured their names had come from the fact, that worrying about transporting the said cargo so nothing would be lost, he had paid no attention to do so, and wyien he.th,oragh.t of doing it,

13 J they had already arrived (as be had known) to the Mission of Aix. He stated, that everything he has said and declared is the truth under the oath taken, which he affirmed and ratified. After this, his statement, had been read to him word: by word and in a clear and intellegible voice,he again affirmed and ratified it, saying, that contained therein is just'the same that he had said and dec'_ared, y concerning he has nothing to add or withdraw. He said he was fifty-two years of.age9 little more or less$ He did not sign because he said he did not know how. 14 In the said royal presidio, said day, month and 5V year' I, the said Governor //nor in order to continue with these proceedings,; and 61 virtue of that decided by me in the prece^ding judicial decree, summoned the corporal of squad Joachin Ruiz to appear before mea In the presence of my attesting witnesses I administered an oath to him which he took in the name of God our Lord, and asign of His Holy Cross in the prescribed manner of the law, under penalty of which he promised to tell the truth insofar as he knew and might be questioned. Upon beir^g questioned about the contents of the said decree, he replied that on the twenty fifth day of the month, of November he arrived, in company of the^ser$eant\,domingo Chirinos and the other soldiers that were accompanying him, to a place about half a league apart from the one called.1\ esl durasnor, 'trail of the settlement of the indian Vidais named Thom.as. Upon having the said sergeant greeted the father conductor Fr^;.ay, Pranrcis,co Zedano that was there,,the sergeant, told him that with his permission he was going to search. the cargo that was there. The said father asked him to get off the horse so he could eat because lunch was ready. To which the 0 said sergeant replied that he was very grateful but

15 27 it was already late, and he was there only to do what he had already told him. Upon asking the,,.fath.er to the sergeant if he had a search warrant from his.superior' and answering the said sergeant that he did notp but that he had itjf_rom me, the said governor, - and. virtue o..f it and in the name of His IKajesty9 to let him proceed, to which the said father complied with him to proceed. Having th.e sergeant, asked the father for his muleteers tto untie the cargo,, the father replied that he did not have an,y9 that those going with him 0 were arrimados, to whom the se.rgeant ordered to do it, which they did. Upon ve.rifying the cargo to be of contraband, as stated in the memorandum that the witness wrote, for not knowing the said sergeant how, and upon his orders; the sergeant, confiscated and. embargoed the said cargo, and had it transport.ed to this presidio, He statsd, that eve^y^thing he has said and declared is the truth un//der the oath taken, which he affirmed and ratified. After this, his statement, had been read to him word by word and in a clear and intellegible voice, he aga.in aff'irmed and ratified it one, two and three times, and all the times prescribed 0 him by law, saying, that oontained therein is just

17 29 In the said royal presidio, said day, month and year, I, the said (governor summoned Christobal Carabajal soldier of this company, to appear before me. In the presence of my attesting witnesses I administered an oath to him which he took in the name of God our Lord, and a:sign of His Holy Cross in the prescribed manner of the law, under penalty of which he pro.mised to tell the truth insofar as he knew and might be questioned. Upon being questioned about the contents of the said prece-(3d.a.ng decree, he replied that the sergeant,._.. 20 In the said royal presidio, on the said day^ month and year, I, the said governor summoned Thade.o 7 Ramos, soldier of this company, to appear before me.// In the presence of my attesting witnesses I administered an oath to him which he took in the name of God our Lord, and a sign of His Holy Cross in the prescribed manner of the law, under penalty of which he promised to tell the truth insofar as he knew and might be questioned. Upon being questioned about the contents of the said decree which heads this inquiry, he replied that in company of the sergeant Domingo Chirinos, corporal Joachin Ruiz, Christobal Carabajal, and Facundo Mansolo, all going under Chirinos' command, arrived at the pla.ce. about half a league from the r one called, ^ e l durasno trail of the settlement of the indian'vidais named. Thomas, in which they found father conductor Fray Francisco7edanok H"aving the said sergeant greeted,the fath.er, whom returned the greetings, the sergeant told him that with T)ermission of his Y;a.te.rnidad, he was going to search the cargo that was th.ere And having asked the said father for the ser.geant, to get off the horse, so he crould eat because the food was ready, the said 0 sergeant indicated that he was very grateful, but he

Upon inquiring the father if the sergeant had. a search warrant from his president, the said sergeant said that he did not, but he had it from me; the said Governor, by which and in the name of His Majesty was asking him to let him proceed in the manner that had been ordered, to which the father complied with him to proceedm Having the said sergeant asked the father, for his muleteers to untie the cs.rgo,, the father signified that he had none, that those men there were a.rrimados, to whom the sergeant ordered to untie the said cargo' which, they immediately did. And having taken inventory of its content, and verifying it to be of m ntraband, the said sergeant confiscated and embargoed the said cargo,, and had it transported to this presidio. 23 In the said royal presidioj on the said day, month and year, I, the said %overnor, to conclude the proceedings in which I am engaged, summoned the soldier of this company Facundo Mansolo, to appear before me^ In the presence of my attesting witnesses I administered an oath to.hi.m which he took in the name of God our Lord, and a sign of His Holy Cross in the prescribed manner of the law' under penalty of which he promised to tell the truth. insofar as he knew and might be nuestioned.. Upon being questioned about the contents of the decree which heads this inquiry he replied; that on the twenty-fifth day of November he arrived with sergeant Domingo Chirinos and the rest accompanying him, to the place where encamping was the father conductor FraV Francisco Zedano, which place is about half a 1_eague before the so, called 'el durasno^^ trail from the house of the indian Vidais named Thomas. Having the said sergeant greeted the father, he told him that with his permission he was going to search the cargo that was there. Having the father asked the sergeant to get off the horse so he would eat4 because the food was ready, the said sergeant replied that he was very grateful but it was already late and he had gone there only to fulfill the mentioned

24 order which he intended to do before rdoing, anything else, 8 And then// the said father asked r,:the sergeant, if he had a search warrant from his president to do so, to -which the said sergeant repl.ied.that he did not-4 but that he had it from me' the said governor, and in the name of His Majesty to let him fulfill it, to which the said father complied with him to proceed. This was done by the said sergeantl asking the father, for his muleteers to fulfill his comission, to which the said father replied that he was carrying none, that those being there were arrimados' and to wh.mm the said sergeant ordered to untie the said cargo, which they promptly did* There was found what it is expressed in the said memorandu?n written by the corporal Joachin Ruiz. And that upon verifying it to.be of contraband, the said sergeant confiscated and embargoedrthe^: said cargo, and had it transfered to this presidiom,he states, that everything he has said and declared is the truth under the.oath taken, which he affirmed and ratified. 30 In the said royal presidio, on the third day of the said month and year, I, the said governor' having appeared before me Joseph Vicente de Anda, one accompanying the father conductor Fr at, Francisco Zedano$ tn the presence of my attesting witnesses, I administered an oath to him, which he took in the name of'god our Lord and a sign of His Holy Cross in the prescribed manner by the law, under penalty of which he promised to tell the truth insofar as he knew, and might be c^luestioned. Upon being questioned about the contents of the decree thqt heads this inquiry, he replied: that while encamping on a'trail that goes to the settlement of the indian Thomas, arrived the sergeant Domir,go Chirinos accompanied by four more soldiers and greeted the father conductor, which greeted ehim, in return And that the sergeant told the father, that with his permission he was going to -search the cargo that was therea The said father asked the sergeant to get off the horse. so he would eat because the food was ready, to which the sergeant replied that he was very grateful but he had gotten there only for the purpose already mentioned. 33 45 In the said royal.._ presidio on the said day, month and year, I, the said governor considering that the effects expressed in the memorandurn registered in these procedi_nbs, can spoil seriously by delaying its expenditute, and, being necessary to prevent what could happen for this very reason, I should command and do command that an evaluation should be made by Lieutenant D,.d,n Joseph Gonsales and master tailor Bernardo Zerbantes, being the only persons knowing about these matters, and. that would be able to perform this order with the required formality. Selling, the pound of tobacco at six reales, trying for the rest of the goods, to be sold to peop..le able to pay the corr:esponding price.
