IlII JUN 30 Z014 Amy.S.Cressy, Clerk St. Joseph Superior Court affirming under the penalties for perjury, states that: I am a Deputy Prosecuting Attorney in and for the 60 th Judicial Circuit,St. Joseph County, State of Indiana, and make this affidavit after reviewing verified South Bend Police reports which were submitted tome. On or about June 9, 2014, Inv. Robert Wise and Sgt. Timothy Medichofthe Metro Special Operations Section (MSOS used a Confidential Informant (C.I. to make a controlled purchase of synthetic drugs, specifically synthetic marijuana, from Sam's Food Martlocated at 1336 Lincolnway West, South Bend, Indiana. Inv. Wise and Sgt. Medich met with the C.Lat a predetermined location and searched hislher person and vehicle for weapons,. illegal drugs,. and drug paraphernalia. Finding none, the Col.was given twenty dollars ($20.00 in United States currency to use for the purchase. The C.1. was given video and audio recording devices and transported to1336 Lincolnway West. Olice in the area of Sam's Food Mart, the C.I. exited the officers' vehicle. The officers maintained constant surveillance on the C.I. as he/she walked to the store. The C.I. entered the store and after a few moments exited and returned to the officers' vehicle. 1
4 The C.I. then handed Inv. Wise a package marked with the brand name "iblown" and five dollars ($5.00 in United States currency. The C.I. advised Inv. Wise that he/she entered the store and made contact with a male clerk~ The clerk asked the C.I. what he/she wanted. The C.1. responded "Crazy." ("Crazy" is short for "Crazy Monkey." "Crazy Monkey" is a known brand name of synthetic drugs, specifically synthetic marijuana. The C.I. stated that he/she handed the clerk the $20.00 supplied to him/herby MSOS. The male clerk took the money and walked to the window area. The male clerk returned and handed the C.I. the package of "Crazy Monkey." The clerk ran the transaction through the cash register and handed the C.I. five dollars in change. The clerk was later identified as SERGIO CARRILLO DELREAL. Inv. Wise performed a field test on the substance inside the "Crazy Monkey" packet. The. substance field tested positive for the presence. of synthetic drugs. The substance was weighed inside its original packaging. The total gross weight was over 2 grams. Later in the day of June 9, 2014, lawenforcement officers from multiple agencies executed a search warrant at.sam'sfood Mart. SERGIO CARRIL~O DELREAL was located. inside the store along with Bernardo Carrillo Delreal. During the search of the business, officer located over three hundred packets of suspected synthetic drugs, including additional bags of "Crazy Monkey." Inv. Wise performed a field test on a sample of the additional "Crazy Monkey" packets and. received a positive result for the presence of synthetic drugs. The total gross. weight of the packets recovered during thesearch.warrantwas in excess of two (2 grams. 2
5 SERGIO CARRILLO DELREAL was advised of his Miranda rights and agreed to speak with Sgt. Juan Lora and Sgt. James Maxey. SERGIO CARRILLO DELREAL admitted that he sells synthetic marijuana products from the store. He stated that he averages twenty (20 to thirty (30 synthetic marijuana transactions per day. The price for a packet of synthetic marijuana is fifteen dollars ($ All of the above. happened in St. Joseph County, Indiana.
