PA IS FAX: February 15, 2018 Supreme Court of Pennsylvania 601 Commonwealth Avenue, Suite 4500 Harrisburg, PA ruatr of jennigtuauia costapasenate.com wwwsenatorcostacdn To the Chief Justice and the Justices of the Pennsylvania Supreme Court, On January 22, 2018 this Court issued an Order declaring Pennsylvania s Congressional Redistricting Act of 2011 (2011 Plan) unconstitutional under Pennsylvania s Constitution and enjoining its use in further elections for the Pennsylvania seats in the United States House of Representatives beginning with the May 15, 2018 Primary Election. League of Women Voters of Pennsylvania, et aat., v. Commonwealth of Pennsylvania, et a,., No. 159 MM (League of Women Voters) This Court Order gave the General Assembly until February 9, 2018 to present legislation to the Governor containing a congressional districting plan that meets the requirements of Pennsylvania s Constitution. Instead, Pa. House Speaker Michael C. Turzai and Senate President Pro Tempore Joseph B. Scarnati, Ill ( Legislative Respondents ) filed a proposed map with this Court. Legislative Respondent s Brief filed February 9, I am a duly elected member of the Senate of Pennsylvania representing the 43rd Senate Legislative District. I also was elected by the members of the Senate Democratic Caucus (Caucus) to serve as the Democratic Leader for the 2017 and 2018 Sessions of the General Assembly. As the elected leader of the Caucus, I represent and advocate for the interests of the Democratic members of the Senate of Pennsylvania.

2 Pursuant to my counsel s conversations with this Court s Prothonotary s Office, I am submitting the attached proposed congressional redistricting map and supporting documentation on behalf of the Pennsylvania Senate Democratic Caucus (Caucus) for this Court s consideration pursuant to its January 26, 2018 Order in the League of Women Voters case. The Caucus has an interest in this case because the question before this Court involves the constitutional requirements of redistricting legislation developed by the General Assembly. This Court s January 22 Order provided the General Assembly with an opportunity to fulfill its constitutional responsibility by submitting a new redistricting plan to the Governor by February 9, Regrettably, the Assembly chose not to fulfill its responsibility. We believe the Court would benefit from the of the Senate Democratic Caucus perspective regarding new congressional districts at issue in this case. As required by this Court s January 26 Order the Caucus submits the following documents: a. A 2010 Census block equivalency and ESRI shape file expressing the proposed plan. b. A report detailing compactness of the districts according to each of the following measures: Reock; Schwartzberg; Polsby-Popper; Population Polygon; and Minimum Convex Polygon. c. A report detailing the number of counties split by each district and split in the plan as a whole. d. A report detailing the number of municipalities split by each district and the plan as a whole. e. A report detailing the number of precinct s split by each district and the plan as a whole. f. A statement explaining the proposed plan s compliance with this Court s order of January 22, 2018.

3 Additionally, the Caucus submits the following information in support of its proposed map: 1. A Population Summary Report. 2. A Legal Description of each district 3. A Ward Split Report 4. Four maps; a statewide map of the proposed districts, a map of the proposed districts in Northeastern Pennsylvania, a map of the proposed districts in Southeastern Pennsylvania, and a map of the proposed districts in Southwestern Pennsylvania. (Please note: the residents of incumbents appear as a red dot on each map.) 5. A comparison of the political subdivision splits contained in: the Caucus proposed map, the Legislative Respondents Joint Submission, and the 2011 Plan. 4 Received 2/15/2018 3:17:58 PM Supreme Court Middle District Statement of Compliance with this Court s Order of January 22, 2018 for the Senate Democratic Caucus proposed plan. This Court s January22 Order stated: [Tb comply with this Order, any congressional districting plan shall consist of: congressional districts composed of compact and contiguous territory; as nearly equal in population as practicable; and which do not divide any county, city, incorporated town, borough, township, or ward, except where necessary to ensure equality of population. The Senate Democratic Caucus proposed plan consists of congressional districts as nearly equal in population as practicable and satisfies the requirements of the Voting Rights Act of 1965 as compared to former districts under the Congressional Redistricting Act of 2011 (2011 Plan). The proposed plan includes only five (5) of 18 districts that deviate from equal population by 1 person in each of the five (5) districts. Regarding minority voting age population in Congressional District 1, the proposed plan includes a nearly identical combined African American and Latino Voting Age Population (VAP) population to that of District 1 in the 2011 Plan. Similarly, in Congressional District 2, the proposed plan includes a nearly identical percentage of African American VAP to the 2011 Plan. In accordance with the Court s direction, the proposed plan is also composed of compact and contiguous districts with fewer county, municipal, ward and precinct splits than contained in the 2011 Plan. It does not include any point contiguous districts. Finally, the proposed plan does not displace any incumbents running for re election in 2018 or candidates running in the March 13, 2018 Special Election in Congressional District 18.
