The community has the blessings of the Ahlebait (AS). Who are the sources of all knowledge and wisdom. However, of late it is felt that the community is losing the lustre of its image as a learned community. The Storage and medium of exchange of uloom, the books, are seldom reached and read. The community is spread all over the country while the books are available only in some pockets The writers and publishers of these precious books complain of missing reading habits among the community members. 6 From the President s Desk SalaamunAlaikumWaRehmatullahWa Ba Rakato As President of IWCA for the third consecutive year, I would like to thank all our members for the continuous support. It has been 10 years since the inception of IWCA, and we have come a long way since then. I hope the association only grows further in future. In order to cater to affordable healthcare, IWCA - with the blessing of 14 Masoomeen (A.S) - was successful in opening a Pathology Lab in OkhlaVihar for the underprivileged. This has been a great success since the time it was inaugurated. I would like to encourage all health practitioners to contribute towards this cause through their medical knowledge, time, or support. Imam Ali said for his father: I swear by ALLAH (SWT) who sent MOHAMMAD (SAWW) as a Prophet that if My Father intercedes for all of the sinners on earth, ALLAH (SWT) will accept it. Each of these past years, I have used this platform to enhance my own knowledge of Hazrat Abu Talib s life, learn from hadith about him, and emphasize on his quintessential qualities that are the need of the hour for our society today. This year won t be any different, however I want to highlight few key areas that we Shias need to focus on today. Islam today is viewed as a danger and Muslims seen as terrorists - the mainstream media strive to create diversion from the actual facts. Hence, I encourage all of you to keep yourself updated with the most current events happening all over the world. Social media today offers plenty alternate & reliable channels. The information is available it s just a matter of finding the right sources. Let us also focus on creating awareness at the right portals - spread the true concept of Islam. Secondly, I feel there is immense need in our society today to groom our children in the right way. Hazrat Abu Talib s upbringing - the sons that he brought up who were immense lovers of Ahlul Bait (AS) - shows what a true believer he was. We need to focus on inculcating similar values in our children from a very young age. Encourage them to excel in all fields (education, sports, entrepreneurship etc.), but at the same time focus on the importance of religious values as well. Hazrat Abu Talib was a part of a tribe called the Haneefs they were the ones from the pure line of Hazrat Ibrahim who believed in the original monotheistic concept of One God. Hence he is known for his firm belief in Allah (SWT). His poetry further emphasized on his true understanding of Allah. Hence, the most valuable lesson we can learn from his life is his imaan or unshakeablefaith. I would like to end my note by quoting Imam Ali (A.S) from NahjulBalagha: Islam means obedience to Allah, obedience to Allah means having sincere faith in Him, such a faith means to believe in His Power, to believe in His Power means recognizing and accepting His Majesty, acceptance of His Majesty means fulfilling the obligations laid down by Him and fulfilment of obligations means actions On these lines, I would like to reiterate the importance of our actions: faith is not faith unless we ACT UPON IT. Let Hazrat Abu Talib, the personality most firm in Tawheed at his time, inspire us to carry out the message of Allah in our daily lives so the world can clearly identify the true followers of Prophet Muhammad (A.S) and Imam Ali (A.S.). 7 Aims and Objectives of the Association The aims and objective of IWCA : 1. To organize seminars and discourses throughout the year to highlight sacrifice made by Masoomeens (A.S.) and other eminent historical personalities in achieving the true goal of humanity. 2. To educate people about the virtues of non-violence, human values and spiritualism by two-way interaction between eminent scholars and general mass. 3. Helping needy and destitute in finding gainful employment. 4. To help financially poor and needy students in pursuit of higher education. 5. To provide financial assistance to the needy and poor families for the medical treatment. 6. The Association intends to float scholarship schemes for economically weaker students who have finished their plus two after high school in acquiring technical knowledge such as computer courses, refrigeration and air condition repairing and installation, electrician, plumbing etc. so that they can be financially secured and also help their families. 7. 10 An abstract from the article The Holy Prophet by Late Allamah Syed Saeed Akhtar Rizvi sb ABU TALIB (a.s) Because of the prestige of Abu Talib, Quraish did not dare to kill the Holy Prophet. But they were making him suffer as much affliction as possible, no less was the heartache caused to him by the sufferings of the helpless Muslims. He himself said: "No prophet was ever made to suffer such afflictions as I was." All along, Islam was gaining adherents not only from Quraish but also from the neighboring tribes. The oligarchy of Mecca was now desperately trying to stem the movement. The forbearance of the Holy Prophet was making the Quraish wonder as to why a man should put himself in such a precarious situation. Their outlook was materialistic; their ideals were wealth, beauty and power. They, naturally, ascribed the same motives to the Holy Prophet. 'Utbah ibn Rabi'ah, father-in-law of Abu Sufyan, was sent to him to convey the message of Quraish: "Muhammad! If you want power and prestige, we will make you the overlord of Mecca. Or do you want marriage in a big family? You may have the hand of the fairest maiden in the land. Do you want hoards of silver and gold? We can provide you with all these and even more. But you should forsake this nefarious preaching which implies that our forefathers, who were worshipping these deities of ours, were fools." The Quraish were almost certain that Muhammad would respond favorably to this offer. However, the Holy Prophet (s.a.w.a.) recited Sura 41 in reply, which, inter alia, contained the following warning: But if they turn away, then say: 1 have warned you of a thunderbolt like the thunderbolt of the 'Ad and the Thamud. (Qur'an, 41:13). Utbah was overwhelmed with this ringing warning. He did not accept Islam but advised the Quraish to leave Muhammad alone and to see how he fares with other tribes. Quraish said that he, too, was bewitched by Muhammad. Then a deputation was sent to Abu Talib. They demanded that Abu Talib should either persuade his nephew to desist from his mission or hand him over to suffer the extreme penalty or be prepared to fight the whole tribe. Finding the odds too heavy against him, Abu Talib said to the Holy Prophet:"O son! Do not put such a burden on my shoulders which I am unable to bear." The Prophet's reply to his uncle gives an indication of his indomitable will, his profound trust in God and confidence in his Mission. Said he:"o uncle! If they placed the sun on my right hand and the moon on my left to persuade me to renounce my work, verily I would not desist there from till God makes manifest His cause or I perish in the attempt." Saying this, he was overwhelmed with grief. Abu Talib was moved by this reply and said:"by Allah, the Quraish can never reach thee in spite of their great number till I am buried in the earth. Therefore, pronounce what order thou hast; nobody can do any harm to you; be happy with this (promise) and keep thy eyes cool (i.e. be consoled)." 10 IWCA Souvenir 2015

11 In their final attempt, they took a young man, 'Ammarah ibn al-walid, to Abu Talib and offered to exchange him with Muhammad. They said to him:"this young man is a well-known poet of the tribe; he is also very handsome and wise. You better exchange Muhammad with him. You may adopt him as your son: he will be a good helper to you. And give us your Muhammad; we will-kill him. Thus, you will not suffer any loss because you will have 'Ammarah in place of Muhammad, and by eliminating Muhammad, all this strife and friction in the tribe will come to an end." Abu Talib was extremely furious on hearing this outrageous proposal. His voice was raised in wrath. He said:"what a worst bargain have you proposed! Why, you want me to give you my son, so that you may kill him, and are giving me your son so that I should feed him and look after him? Go away! This bargain is nothing if not foolishness." Ban on the Clans of Hashim and Muttalib Frustrated, the idolaters decided to ostracize the whole clans of Hashim and Muttalib and thus destroy them completely. An agreement was signed to boycott these two clans. It was written by Mansur ibn 'Ikrimah and was hung in the Ka'bah. The agreement stated: "they would neither take the daughters of these two clans nor will they give them their daughters in marriage; they would neither sell anything to them nor buy anything from them. Not only that, they would not have any contact with them nor even allow any food or drink to reach them. This boycott would continue till these clans agree to hand over Muhammad to Quraish." Abu Talib had no alternative but to take these two clans (who had always stood together) into the mountain trail called Shi'b Abi Talib. It was adjacent to Jannatu '1-Ma'la. It was a place in Mount Hajun, which belonged to Abu Talib. There were 40 adults in the clans. For three long years, they were beleaguered. It had begun in Muharram, 7th year of Bi'that (Declaration of Prophet hood) and continued up to the beginning of the 10th year. They were made to undergo the most acute hardships and privations, so much so that at times they had nothing but tree leaves to sustain them. Only twice a year did they dare to come out: in the months of Rajab and Dhul-Hijjah, when every type of violence was taboo according to the Arabian custom. If any relative sent them any food, and the news leaked out, that relative was publicly insulted and put to shame. The Quraishites used to express their pleasure on hearing the cries of the hungry children. During all these years of sufferings, Abu Talib had only one worry: how to keep the Holy Prophet out of the harm's way. Historians unanimously say that it was the habit of Abu Talib to awaken the Holy Prophet after all people had gone to sleep and to take him to another place and order one of his own sons or brothers to sleep in the bed of the Holy Prophet. This was done so that if an enemy had seen where Muhammad was sleeping, and if an attack was made on him at night, his own son or brother would be killed while the Holy Prophet would be saved. All of them suffered these hardships and did their utmost to save the life of the Holy Prophet. History is unable to produce another example of such devotion and loyalty. And imagine that this continued not for one or two days or weeks, but for three long years. One day the Holy Prophet said to Abu Talib: "I have been informed by Allah that the agreement of the Quraish has been eaten up by insects, and no writing has been left therein except the name of Allah." And as the historians write, Abu Talib never had any doubt about any saying of the Holy Prophet. Thus he came out of his place at once and went to Masjid ul-haram where Quraish had gathered. As luck would have it, the subject of discussion was the same boycott. Hisham, son of 'Amr, Zubayr, and a few others who were related to Khadijah and the clans of Hashim and Muttalib and whose houses were near the Shi'b of Abu Talib used to hear the cries of the children day and night. They had decided to persuade the Quraish to abrogate the infamous agreement. The arguments became very heated and reached a climax when they saw IWCA Souvenir

12 Abu Talib approaching. Abu Jahl and others who opposed the idea of abrogating the boycott, said:"abu Talib is coming! It seems that now he is tired and wants to hand over Muhammad to us. Thus, the boycott would end to the satisfaction of us all. Let us keep silent and hear what he wants to say." But Abu Talib had gone there not to surrender but to challenge them. He stood before the gathering and said: "My son says that the agreement which you had written has been eaten up by insects, and that nothing remains therein except the name of Allah. Now look at that paper. If the news given by my son is correct, then you must end your injustice and high-handedness, and if the news is wrong then we will admit that you were right and we were wrong." The agreement was taken out and opened, and lo, there was nothing left of it except the name of Allah in one place. Now Abu Talib's voice thundered on as he condemned them for their tyranny. Those who wanted that boycott ended said that now there was no agreement at all to adhere to. Abu Jahl and others tried to outwit them but failed and the boycott ended with a total moral victory for Islam over the infidels. If we think about the early history of Islam, without the prestigious influence of Abu Talib, we cannot see how the life of the Holy Prophet could have been saved. And if we were to take out the wealth of Khadijah, we cannot think how the poor Muslims could have been sustained, and how the two Hijrats of Abyssinia could have been financed. It is not the place here to fully explain the share of Abu Talib in the foundation of Islam. The best tribute, therefore, would be to quote some of his poetry lines which overflow with love of, and devotion to, the Holy Prophet. Abu Talib has said these poetic lines: And you have called me and I know that you are truthful and, in fact, you were truthful and trustworthy from the beginning. And I certainly know that the religion of Muhammad is the best of all the religions of the world... It was the policy of Abu Talib to keep the Quraish in suspense about his true belief: Had he announced that he had accepted the religion of Muhammad, his position as a respected leader of the tribe would have been undermined. And then he could not extend his protection to the Holy Prophet. Thus, while always declaring his firm belief that Muhammad could not tell anything but the truth, exhorting his children and brothers to follow the religion of Muhammad, he assiduously refrained from declaring in so many words that he himself was a Muslim. Thus he maintained his position with the hierarchy of Quraish and protected the Prophet through his influence. Abu Talib died at the age of 85 in the middle of Shawwal or Dhul-Qa'dah, 10 Bi'that. Imam Ja'far al-sadiq (a.s.) said: "The ancestors of the Holy Prophet will be in Paradise and 'Abdul-Muttalib will enter Paradise having upon him the light of the Prophets and the dignity of kings, and Abu Talib will be in the same group." 13 Questions & Answers About Jama at Prayer Q. 1 What is the ruling about a person who prays separately (Furada) in the masjid while jama at is going on? A. 1 Doing furada prayer inside the masjid while jama at prayer is going on is not permissible since it amounts to insult of the imam of the jama at by your action you are announcing that you don t believe the imam to be adil or competent for leading prayers. Some mujtahids consider such a prayer to be invalid while others say that the prayer is okay but the act entails a sin. Q. 2 I am in the jama at prayer but my connection to the imam is through a non-baligh child? A. 2 If the child knows the basic rules of prayers and knows how to pray, then he can be a sufficient link in the connection to the jama at. Bulugh is not a condition for the validity of the connection in jama at. However, if non-baligh children are in the same row of jama at, then keep them apart with a baligh person in between. Q. 3 I am in the jama at prayer at a Shia masjid and my connection to the jama at is through a non-ithna-ashari shia. Is my connection to the imam valid? A.3 A non-ithna-ashari Shia praying besides you or in front of you is a sufficient link to the Jama at; it is not necessary that the link be a Shia Ithna-Ashari Muslim. Q. 4 If I am connected to the jama at by a person who is saying his prayer in sitting position (because of illness), is my connection to jama at valid? A. 4 Such a connection to the jama at is not valid. The person doing the prayer is sitting position should not sit in a place where he is the only link to the others in jama at. He should sit at the end of the line or in middle rows. The same applies to a person who is praying on a chair. Q. 5 If my only link to the jama at is a traveler who is doing qasr (shortened) prayer, is my connection valid? A. 5 A person doing qasr cannot be a sufficient link in the jama at. A traveler should either sit at the end of the first line or in the middle rows so that he does not disconnect the link of others after his shortened prayer. (Of course, if he stands up again in the 3rd rakat to join in for doing his other wajid (ada or qaza) prayer, then his connection is valid. Q. 6 What should I do if I am in nafila prayer while the congregational prayer has already started? A. 6 It is better for you to stop the nafila prayer and join the jama at at the first takbir of the imam. Q. 7 If I go to a mosque run by the non-ithna-ashari shia, can I participate in their jama at prayer? A. 7 There is no harm in participating in a prayer led by a non-ithna-ashari shia Imam with one important difference: when you pray behind a Shia Ithna-Ashari Imam, you do the niyyat of jama at and you yourself don t recite the surahs; but in this case, you do the niyyat of furada and you must recite the surahs by yourself. Of course, in this case, you should recite the surahs silently even if it is fajr, maghrib or isha prayers out of respect of the jama at. Q. 8 I had already recited the maghrib prayer at home by myself and then I came to the mosque and saw that the same maghrib congregational prayer has started late can I repeat my prayer in jama at form? A. 8 Yes, you can repeat the prayer in jama at form. However, if you have a qaza prayer due upon you, then it is better to do that with the niyyat of qaza. Q. 9 Salatu I-Juma (Friday Prayer): Wajib ayni or takhiri? A. 9 During the the ghaybat (Occultation) of the Present Imam al-mahdi (a.s.), the Friday prayer is wajib takhiyri. What does wajib takhiyri mean? It means that you have a choice between two obligatory deeds: you must do one of them, you cannot miss both. In the present case, it means that you have the duty of doing either the Noon (Zuhr) prayer or the Friday (Juma) prayer. - Nonetheless, it is preferable to do the Friday Prayer even during the ghaybat. And whenever you do the Friday Prayer, then you will do it with the niyyat of wajib; and after that you do not have to recite the Zuhr Prayer. - The Friday Prayer, whether in form of ayni or takhiyri, is Wajib upon the men who are resident of that city, in good health, and not elderly. Q. 10 What if I missed the Khutbas before Jum a Prayer or Joined in the 2nd Rakat? A. 10 The two khutbas delivered by the imam of jum a are essential parts of the prayer.however, if a person missed the khutbas, he can still join the Friday Prayer and it will be considered sufficient. If you come late for the Friday prayer, then you can still join in the 2nd rak at before the ruku and count that as your 1st rak at and complete the 2nd rak at on your own. 14 NGOs in India This write up in your hand broadly tries to summarise the Laws Governing Charitable Organisations in India. The word NGO is being interchangeably used for, NPO-Not for Profit Organisation, NGO-Non-governmental organisation, VO-Voluntary organisation, CSO-Civil society organisation, CBO-Community based organisation, Charitable organisation, TSO-Third sector organisation Under the Indian law there are three basic types of charitable organisations Namely: (i) Trusts: Trusts and charitable institutions registered under the Registration Act, 1908; Charitable Endowments Act, 1890, Wakf Act 1995 (ii) Societies: Registered under the Societies Registration Act, 1860 and Various state Acts. (iii) Companies: Registered under section 8 Companies Act 2013 ( erstwhile section 25 of Companiesd Act 1956) Charitable organisations are also required to follow the provisions of law as applicable to their functional areas. For example, those working in the health sector need to follow the laws applicable to that sector. Similarly, organisations working on environment protection will have to abide by the Water (Prevention and Control of Pollution) Act, 1974, the Air (Prevention and Control of Pollution) Act, 1981 and the Forest (Conservation) Act, 1980 etc. Trust : A Trust is a special form of organisation which emerges out of a will. The will maker exclusively transfers the ownership of a property to be used for a particular purpose. A Trust is created if a person wishes to set apart either property or income for a charitable purpose so that the income may be devoted in perpetuity for the fulfilment of the charitable purpose The trust has primarily three parties: the donor/s, the trustees and the beneficiaries. It is usually created through a trust deed. In India, a public charitable trust can be set up under the general law, i.e., registration of the Trust deed with the registrar. Or under the public trust act of the state, if any. A trust unlike a society and a company is not a separate legal entity. Societies : A society is an association of persons (seven or more) united together to achieve some common purpose. Such objects are normally charitable, scientific, literary etc. A society is a distinct legal entity entirely independent of the members constituting it. Thus, it can sue or be sued independent of its members. No member either independently or jointly, can claim ownership rights in the assets of a society during its existence. Along with having the flexibility to undertake a wide range of activities, a society also has a more democratic set up with membership and an elected body to manage it. The original members can continue to remain in control as long as they are elected to the managing committee. The society can exist beyond its original members and there is a possibility of a complete renewal of members and objects can be modified easily. A society is registered under the Societies Registration Act, In addition various states have framed their respective acts and rules for ensuring propriety in functioning of societies, including provisions for compulsory division, amalgamation or dissolution. The registration is done under the auspices of the various state governments in whose territories the organisation is located. An organisation can be registered in any district of India with the Registrar of Societies within that district. Section 8 Companies (Companies Act, 2013) (Erstwhile Section 25 Company of Companies Act, 1956): A charitable organisation can be set up under Section 8 of the Companies Act of Companies can be registered under Section.8 if: 1) They have their objects the promotion of, commerce, art, science, sports, education, research, social welfare, religion, charity, protection of environment, any such other object 2) They intend to apply profits or other income in promoting their objects; 3) They intend to prohibit the payment of any dividend to their members. 14 IWCA Souvenir 2015

15 A Section 8 company has a distinct legal entity, entirely independent of its members and has perpetual succession. While the non-profit companies enjoy limited liability like a limited company or society they don t need to use the words limited in their name. No member can independently or jointly claim ownership rights in the assets of the company during its existence and cannot distribute profits or assets to its members. Routine Compliances Under the registration authority Trusts: There is no compliance requirement for trust under the registration law. Societies: Once in every year, on or before the fourteenth day succeeding the day on which, according to the rules of the society, the annual general meeting of the societies is held, or, if it rules do not provide for an annual general meeting, in the months of January, list of the names, addresses and occupations of the governors, council, director, committee, or other governing body then entrusted with the management of the affairs of the society shall be filed with the Registrar. Section 8 Companies: Compliances requirement under the Companies Act are enormous and need sspecialized professionals to ensure it. Under Income tax act An NGO needs to register itself with Income Tax Department U/s 12AA for availing exemption of its income from income tax. In order to register you need to apply to the Commissioner of Income Tax of your area within one year of creation of the trust. Such an application should be made in Form no. 10A. In case of delay, the registration will be allowed from the financial year in which such application is made and for earlier years the society will have to pay the Income Tax at the usual rate. Once registered under section 12A the NGO can get registration under setion 80G for the benefit of its donors. Under FCRA (Foreign Contribution (Regulation) Act 1976) An organisation having a definite cultural, economic, educational, religious or social programme shall accept foreign contribution, only after such organisation obtains a certificate of registration from the Central Government. Any person, if it is not registered with the Central Government, can accept foreign contribution only after obtaining the prior permission of the Central Government and such prior permission shall be valid for the specific purpose for which it is obtained and from the specific source. The multiplicity of charity laws in India has prevented evolution and growth of a proper institutional framework in this sector. While, voluntary organisations often feel harassed in complying with various legal obligations, institutions of the government too have not been effective in regulating the sector and securing legal compliance. Instances of misuse of tax provisions, fraud and poor governance have become frequent. There is need to create an effective institutional mechanism which would provide a supportive environment for the growth and development of charities in this country. Diversity of laws across the States has given rise to emergence of nonuniform practices in the management of voluntary organisations. If an institution registered in one State desires to expand its activities to any other area, it needs to comply with a different set of legal requirements. The governening echelons have now woken and is in the process of tightening their grip over the third sector.
