PUBLIC HEARING - SUP MULEDEER FINANCIAL, LLC. PROPOSED SPECIAL USE PERMIT: 20,000 SQ. FT. PACKAGE STORE 1.61 ACRES AT 735 PLEASANT HILL ROAD DIRECTOR OF PLANNING & ECONOMIC DEVELOPMENT The Public Hearing for this agenda item was held on April 13. You do not have to open the floor for discussion. The applicant has submitted additional conceptual renderings of the exterior showing compliance with design criteria of the Highway 29 Overlay. The subject property is an outparcel that has never been developed at the former Lowe s store and is currently zoned CB. It was annexed through legislation in December of The Applicant intends to construct a 20,000 square foot package store on property zoned Commercial Business (CB). The Special Use Permit is to allow a retail package/liquor store. The site is located at a signalized intersection of Pleasant Hill Road and the entrance to the former Lowe s. Access to the property is provided from within the site with no new curb cuts proposed onto Pleasant Hill Road. The site complies with all of the required provisions. The building s size and lot area far exceeds the City s minimum. The Planning Commission concurred with the Staff s analysis and recommended approval. Council may want to add a condition to the approval subject to construction beginning within a certain amount of time. Staff recommends a motion to approve Ordinance # approving SUP subject to meeting the architectural requirements of U.S. 29 Corridor Overlay District. PUBLIC HEARING SUP CARMEN ARROLIGA PROPOSED SPECIAL USE PERMIT: AUTO & TRUCK SERVICE CENTER: ACRES, LL150, PARCELS 129 & PART OF 014 AT 3926 BURNS ROAD DIRECTOR OF PLANNING & ECONOMIC DEVELOPMENT ZONING HISTORY The subject property was annexed through legislation in December of 2011 and is currently zoned CB, Commercial Business. The property has been proposed for a multitude of businesses, mostly auto related. The site was developed in 1982 and one other suite within the building is occupied by a granite installation business. APPLICANT S INTENT There is an existing 6,800 sf metal frame building on the site divided into 3 suites. The applicant intends to occupy 1 of the suites as an auto and truck service center. There are no proposed changes to the building. See applicant s letter of intent for details. ANALYSIS OF SPECIAL USE PERMIT REQUEST The property is commercially zoned (CB). The Special Use Permit is required to allow auto and truck repair in CB zoning district. Similar uses are located nearby, all of which were approved by Gwinnett County prior to annexation into the City. More importantly, the other automotive uses were approved with additional architectural requirements to improve the aesthetic of the use. Access to the property is provided from Burns Road with no new curb cuts proposed. The following are the specific provisions of the zoning resolution pertaining to the SUP request. Auto/Truck Service includes lubrication, oil change, and tune up facilities. No body/paint repair. It is felt that if the special use permit is approved, many aesthetic improvements should be made. It is recommended the building standards of the Highway 29 Overlay should apply. Below are highlights from Section 501 of the Zoning Ordinance relating building standards of the U.S. 29 Overlay District as follows: Provide decorative lighting consistent with the Lilburn Town Center Master Plan. Landscaping shall be in compliance with the Lilburn Buffer, Landscape and Tree Ordinance. Dumpsters shall be screened. Decorative, commercial-quality bicycle racks, benches, and trash receptacles shall be required. Architectural design guidelines shall apply including massing and modulation changes which could include changes in height, horizontal plane, building projections/recessions, roof from and/or other architectural elements. Building materials shall be constructed of brick, stone, and glass with textured concrete masonry block, stucco, cement-fiber siding as accents, roof parapets shall be articulated to provide visual diversity, all mechanical, HVAC and like systems shall be screened. Signage shall meet the standards of the Lilburn Sign Ordinance. Lilburn Police have no objections to the proposal. The Planning Commission concurred with the Staff s analysis that the proposed use will be suitable in view of the surrounding properties, the zoning proposal should not adversely affect the use of the surrounding properties, the subject property has a reasonable economic use as currently zoned, the proposed use will not cause a burdensome impact on existing infrastructure, is in conformity to the policy and intent of the Land Use Plan, and there are supporting grounds for approval of the request. 4 Based upon the above considerations, Staff recommends APPROVAL of the request with the following conditions: 1. The SUP shall apply to the acre portion of the Special Use Permit site plan by Juan P. Del Rio dated described as Tract All building façades visible from Burns Road shall comply with architectural requirements of U.S. 29 Corridor Overlay District. 3. Parking and vehicular access drives shall be completely resurfaced. 4. Repair includes lubrication, oil change, and tune up services only. 5. All repair activities shall occur indoors. 6. No body/paint repair. 7. No automobile or truck sales. 8. No outdoor storage of parts or dismantling of vehicles. 9. A 5-foot sidewalk shall be installed along the frontage of the property to E. Johns Road. Staff recommends a motion to approve Ordinance # approving SUP with conditions. PACKAGE STORE: 4.25 ACRES AT 5712 LAWRENCEVILLE HIGHWAY DIRECTOR OF PLANNING & ECONOMIC DEVELOPMENT ZONING HISTORY The subject property was annexed and rezoned in 2009 and has never been developed. It is currently zoned CB, Commercial Business. APPLICANT S INTENT The Applicant intends to construct a 10,500 square foot package store. See applicant s letter of intent for details. ANALYSIS OF SPECIAL USE PERMIT REQUEST The property is commercially zoned (CB). The Special Use Permit is to allow a retail package/ liquor store. The site is located just west of the Harmony Grove Road intersection. Access to the property is proposed from Highway 29 and Braden Drive. According to traffic counts found on Gwinnett DOT s website, 33,000+ vehicles pass this site daily. The following are the specific provisions of the zoning resolution pertaining to the SUP request. Section 727. Retail Package Liquor Store Retail package liquor stores are permitted in the Commercial Business District subject to a Special Use Permit and the following conditions: 1. 5 2. Minimum lot area of 20,000 square feet required. 3. Minimum 8000 square feet gross floor space. 4. Comply with any other City ordinances pertaining to licensing requirements for a retail package store. As proposed the site complies with all of the required provisions. The building s size and lot area exceeds the City s minimum. All distance requirements as set forth in the city code are met. The site is subject to the Highway 29 Overlay, the purpose and intent of which is to provide a pleasing aesthetic/visual quality in landscaping, architecture and signage. 6 X. AGENDA 4. CITY OF LILBURN OPEN RECORDS POLICY CITY CLERK The purpose of the policy is to provide procedures for open records requests for the City of Lilburn. Currently there isn t an Open Records Policy in place for the City of Lilburn as a whole. There aren t any set procedures for open records that are received by City Hall, Police, or the Planning and Zoning departments. Setting procedures for the city to follow as a whole would be beneficial not only to the City Clerk, but also to the citizens that are requesting the open records. The new procedures require every department to submit the open request to the City Clerk (open record designee) who will then respond directly to the requester. The process will make sure that requests are responded to in the time frame required by law. The new procedures will also make the process more efficient because all requests will need to go through the City Clerk, who will keep track of them in a spreadsheet, and not be delegated to different departments.
