1 REGULAR COUNCIL MEETING A Regular Council Meeting was held on at 6:00 p.m. in the meeting room of the Zephyrhills Library. President Smith called the meeting to order. Roll call was taken. Present were members Ken Burgess, Alan Knight, Charlie Proctor, Lance Smith, and Mayor Whitfield. Councilwoman Jodi Wilkeson was absent. City Manager Steve Spina was present. City Attorney Matthew Maggard was absent. Staff present: Police Chief Derek Brewer, Utilities Director John Bostic, Public Works Director Shane LeBlanc, Building Official Bill Burgess, Director of Planning Todd Vande Berg, Airport Manager Nathan Coleman, Assistant Planner Rodney Corriveau, Assistant City Clerk Jessica Carter and City Clerk Lori Hillman. Alan Knight asked for a moment of silence in memory of Brantley Smith and Henry Nesbitt. Alan Knight gave the Invocation. The Pledge of Allegiance followed. Charlie Proctor moved the minutes of the September 24, 2018 Regular Meeting be approved. Seconded by Alan Knight. Motion passed unanimously. CONSENT ITEMS 1. Jones Edmunds TA Sunburst Water System Preliminary Engineering Evaluation 2. Kimley Horn WO Design & Engineering Services - US 301 and Pretty Pond Road Councilman Burgess requested Consent Agenda Item 1 be pulled for further discussion. Councilman Knight moved to approve Consent Agenda Item 2. Seconded by Charlie Proctor. Motion passed unanimously. Councilman Burgess requested Utilities Director John Bostic explain the purchase of the Sunburst Water System. Spoke from the floor: Utilities Director John Bostic City of Zephyrhills Mr. Bostic advised the Sunburst Water System is in the northeast corner of the City s proposed service area with lines running to the south serving the Sunburst System. He proposes to connect the Sunburst System on Old Lakeland Highway at the T installed by the City to connect to 301 at Centennial Road. Jones Edmunds will perform an Engineering Study on the infrastructure. Due to customers on the existing water line, a Cost Benefit Analysis Study will follow which will be performed by Raftelis Financial Consultants, Inc. Dr. Spina added the City of Dade City and the City of Zephyrhills have an imaginary service line at Centennial Road. The two cities and Pasco County met to divide the service area between the three entities in an effort to eliminate duplicating costs and coverage of water lines. Zephyrhills and Dade City will provide water to a larger area east of 301 with north/south connectors and Pasco County will provide water west of 301 with east/west connectors. Dr. Spina stated Utilities Director John Bostic is looking at the viability of the Sunburst Water System only, the City is not annexing any property. Councilman Burgess moved to approve Consent Agenda Item 1. Seconded by Alan Knight. Motion passed unanimously. BUSINESS ITEMS PUBLIC HEARING 1. First Reading RESOLUTION NO A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ZEPHYRHILLS, FLORIDA, ELECTING TO USE THE UNIFORM METHOD OF COLLECTING NON-AD VALOREM ASSESSMENTS FOR MORE THAN ONE YEAR LEVIED IN ZEPHYRHILLS, FLORIDA; STATING A NEED FOR SUCH LEVY; PROVIDING FOR THE MAILING OF THIS RESOLUTION; AND PROVIDING FOR AN EFFECTIVE DATE. Resolution No was read by title. Dr. Spina advised Resolution No publicly announces to the Florida Department of Revenue, the Pasco County Property Appraiser, and the Pasco County Tax Collector of the City s intent to possibly levy a Fire Assessment Fee beginning October 1, A public hearing was held and there were no comments from the floor. Alan Knight moved to approve Resolution No Seconded by Ken Burgess. Motion passed unanimously on the first reading.

2 Page Two PLANNING DIRECTOR S REPORT 2. Sarah Vande Berg Tennis Center Alternate Architectural Plan This item was withdrawn from the agenda and will be added to the October 22 nd Agenda. 3. Silverado Ranch Subdivision Phase 5A This item was withdrawn from the agenda and will be added to the October 22 nd Agenda. CITY MANAGER S REPORT 4. Cancel November 12, 2018 Meeting Dr. Spina advised Monday, November 12 th is a City Holiday in observance of Veterans Day and requested the be canceled. He reminded Council a Workshop will be held on Monday, November 5, 2018 to review the Land Development Code Use Table. Alan Knight moved to cancel the November 12, Seconded by Charlie Proctor. Motion passed unanimously. 5. Grant Agreement with FEMA for Hurricane Irma Dr. Spina advised the City will be receiving reimbursement through FEMA for the two projects mentioned in the Grant Agreement in the amount of $210,000. The City anticipates a total reimbursement in the amount of $450,000 in hurricane related costs. Dr. Spina recognized Karen Miller, Jessica Carter, Tamela Davis and Thomas Shotts for their efforts in compiling and completing the necessary information. Spoke from the floor: Assistant City Clerk Jessica Carter City of Zephyrhills Ms. Carter advised the City will recover 100% of Category B Emergency Services costs associated with emergency preparedness prior to the storm and cleanup efforts following the storm. 6. Five Year Capital Improvement Plan Dr. Spina advised the Five Year Capital Improvement Plan is tied to the Comprehensive Plan and budget process. Projects are funded for the first three years and year four and five are projects planned for the future. Dr. Spina reviewed each item by department. Charlie Proctor moved to approve Business Item 6. Seconded by Ken Burgess. Motion passed unanimously. CITY ATTORNEY S REPORT 7. Simons Road Developer s Agreement Dr. Spina presented a Developer s Agreement between the City of Zephyrhills and David Waronker for projects on the east and west sides of Simmons Road. He explained Exhibit A, Parcel 1 refers to the Links at Silver Oaks on the east side; Exhibit A, Parcel 2 refers to the Oaks at Pasco on the east side; Exhibit A, Parcels 3 and 4 refer to the Cottages also known as the District at Abbott s Square on the west side; and Exhibit A, Parcels 5 and 6 refer to the Daniels Property. Exhibit B is the Simmons Road Survey, Exhibit C is a sketch of the design of Simmons Road, and Exhibit D is the legal description for the Sarah Vande Berg Tennis Center. The projects are consistent with City regulations and are compliant with public health, safety and welfare. The projects comply with legal requirements, permitting, and all zoning and comprehensive plan issues. Property will be dedicated to the City as needed for utility relocations. Discussions took place regarding park impact fees, transportation impact fees, traffic studies, Sarah Vande Berg Tennis Center deed, contract delays, Simmons Road, retention and the basin of special concern.

3 Page Three Spoke from the floor: Planning Director Todd Vande Berg City of Zephyrhills Mr. Vande Berg stated a problem was encountered with Duke Energy relating to utility easements. The north section is ready to go pending permit approval by Pasco County for the connection to Fort King Road and the north/south section is nearing completion pending rectification of the Duke Energy pole. Councilman Smith said there are a lot of unresolved questions and he would be reluctant to sign the agreement with the absence of the City Attorney. Charlie Proctor moved to table Item 7 for the October 22, 2018 Meeting. Seconded by Alan Knight. Motion passed unanimously. CITIZEN COMMENTS This item was moved to this place on the agenda. Presentation by Luis Rivera with Wiregrass Lions Football and Cheer Mr. Luis Rivera of the Wiregrass Lions thanked Council for their support the last two years and presented a Wiregrass Lions football jersey to Council to be displayed at City Hall as a token of his league s appreciation. Dr. Spina said $10,000 is budgeted annually for local youth leagues. The Wiregrass Lions receive $3,000, ZPAL receives $3,000, Zephyrhills Little League receives $3,000 and the Zephyrhills Athletic League receives $1,000 for their basketball program. Spoke from the floor: Jacob Gill 8619 Key Biscayne Drive Tampa, FL Mr. Gill said he is a U.S. Representative from the Amendment 2 Political Committee. For the past ten years, there has been a 10% cap on assessed value increases on non-homesteaded properties as long as the owner remains the same which will expire January 1, Amendment 2 would make the cap permanent with no expiration date. The two largest impacted groups are residential and commercial properties. He said Amendment 2 is not the most exciting Amendment out there but it is incredibly important in maintaining a stable market. Spoke from the floor: Executive Director Melonie Monson - Zephyrhills Chamber of Commerce Ms. Monson announced the 2 nd Annual Zephyrhills Economic Development Summit is scheduled for Wednesday, October 24 th in Council Chambers at City Hall from 9:00 a.m. to 1:00 p.m. This year s summit will focus on education and will host speakers such as Superintendent of Schools for Pasco County Kurt Browning, Senator Tom Lee, Representative Danny Burgess, and Zephyrhills High School Principal Angie Stone. This item was moved to this place on the agenda Go Party Live - Request for Alcohol Sales at Zephyrhills Park Dr. Spina advised Xavier Hill with Go Party Live sent an that he is stuck in traffic on I-4. Dr. Spina explained Go Party Live, a for profit company, submitted a Special Event Permit to host the Zephyrhills Seafood Festival in Zephyr Park on Saturday, November 3 rd. The event was approved by Site Plan Review and forwarded to Council for the sale of alcohol. Discussions occurred relating to beer and wine sales at Zephyr Park, Special Event Permitting procedures for events at Zephyr Park, nonprofit versus for profit companies, Airport Venue, City costs for staffing, and parking. Councilman Knight said he doesn t feel the event should be held at Zephyr Park. He said above and beyond the alcohol, this is a park for children. Spoke from the floor: Building Official Bill Burgess City of Zephyrhills Mr. Burgess said he told the applicant at Site Plan Review all events with alcohol require

4 Page Four Council approval prior to moving forward. He said the Airport Venue was mentioned at Site Plan Review as a better location with electric setup for food vendors. Mayor Whitfield suggested staff look at Zephyr Park as a community park, a family park where children go to play. He suggested steering events for promotional use away from Zephyr Park in the future unless they are nonprofit and added the City has established a venue for events at the airport. Council concurred to approve the Zephyrhills Seafood event hosted by Go Party Live with no alcohol. MAYOR ANNOUNCEMENTS - Mayor Whitfield reminded everyone to be prepared for Hurricane Michael and recognized former Youth Council Member Cameron Jones who was in attendance. Mayor Whitfield acknowledged Lance Smith for delivering a tribute to Brantley Smith through his eulogy. CITY MANAGER ANNOUNCEMENTS Dr. Spina announced staff moved into City Hall. He said he wasn t able to attend the services for Brantley Smith but recognized the remarkable job Brantley and his family did with the design and architecture of their ranch to create a premier golf course. They had the foresight to create a premier neighborhood with canopy covered streets which was the start of change in the Zephyrhills community. He added the Smith family donated five acres to the City to build the YMCA in The family changed hundreds of thousands of kids and families lives through their contribution. He remembers Brantley as the friendliest, nicest person he ever met who made a big difference in this community. CITY ATTORNEY ANNOUNCEMENTS NOT PRESENT CITY COUNCIL COMMENTS Councilman Burgess expressed his appreciation to Fire Chief Swartout, Police Chief Brewer and their staff for attending National Night Out. He said the people in attendance seemed to be having a good time. He said Brantley Smith was considered a Zephyrhills icon. He explained Brantley s generosity made high school coaches jealous when Brantley opened up the golf course year-round for free to boys and girls on the Zephyrhills High School golf team. He said other high school coaches had to beg to find a place for golf teams to play. Councilman Proctor expressed his inspiration of Brantley who always treated him with respect and dignity when he moved to Zephyrhills in the late 80 s. He said Lance and Brantley always took him at face value, gave him work and were there when he needed them. He recognized Cameron Jones, former Youth Council member, who is visiting from college with his grandmother, Karen. He said Cameron is involved in politics and we may see Cameron on the national league one day. Councilman Knight said for years he ran the Summer Recreation Program and Brantley Smith brought watermelons to the kids because he said it was too hot them outside. He said he can still see the watermelon lines all over the school ground. He said Brantley was one in a million. He also recognized Henry Nesbitt as a true pioneer and unbelievable fast pitch softball player who attended every sporting event up until he got sick. He said two great men are gone from our community. Councilman Smith said he and City Manager Steve Spina were figuring out a way to bring a YMCA to Zephyrhills and he approached his family to sell some land cheaply. He said in speaking with his family, they wanted to donate the land. He said the impact to others is more important to his family than how much money they have in their pocket at the end of the day. He said he and his family have received a wonderful outpouring of love and thanked everyone from the bottom of his heart. He said he and his father, who is wheelchair bound, went to visit Brantley last week and when they arrived Police Chief Brewer, Police Captain Reggie Roberts, and Police Sergeant Billy Adams were visiting. He expressed his appreciation to the officers from himself and his dad. He said this is why he loves this small community, if somebody needs something or is hurting, the community rallies for support.

5 Page Five Councilman Smith said the Sarah Vande Berg Foundation Event opened his eyes to the future of the facility. The tennis center will be supported by an international market, people will attend the facility from all over the world. He acknowledged Todd Vande Berg for the tremendous job he did speaking at the event. Dr. Spina said Todd Vande Berg spoke at the Sarah Vande Berg Foundation Event and echoed Lance s appreciation of the community. Mr. Vande Berg said the tennis center would not have happened if he lived in Tampa. He said the community rallied and made it happen. Meeting adjourned 7:28 p.m.
