1 MINUTES KAMAS CITY COUNCIL MEETING TUESDAY, SEPTEMBER, 0 :00 p.m. Kamas City Hall, N. Main Kamas, UT 0 Mayor Lewis Marchant opened the meeting welcoming those in attendance: COUNCIL MEMBERS: Dan Littledike, Kevan Todd, Rod Atkinson, Diane Atkinson, and Rod Smith. STAFF: City Planner, Jackie Blazzard; Deputy Recorder, Dori Snyder; Engineer Scott Kettle. OTHERS IN ATTENDANCE: Gus Sharry, Ronald & Mechelle Harrington, Kim Steed, Insa Riepen, Richard Lisonbee, Dianne Bayles, and Julie Viar. OPENING CEREMONY, INVOCATION/READING/THOUGHT Invocation/Reading/Thought by Councilor Diane Atkinson Mayor Lewis Marchant led the public in the Pledge of Allegiance. RECYCLE UTAH, BEER LICENSE REQUEST FOR HARVEST FESTIVAL TO BE HELD OCTOBER, 0. Insa Riepen from Recycle Utah introduced herself and explained this is a new event to celebrate the boards in Summit County. She said Sean Wharton was going to have a party, which got so big, they checked into holding the event at High Star. There will be demonstrations, highlighting food grown in Summit County. She said anyone can attend, but only goods made in Summit County can be sold or displayed. This will show what isn t here yet, but also will show what we do have and what we can be proud of. Wharton was going to attend tonight and has put a lot of work into this. FFA students can bring their animals to the arena. There will be races and games for the kids. Squatters and Wasatch Beer are local breweries that have donated beer to this event. She explained all the people involved in this event and said they are hoping it will grow and become an annual event. Her challenge is the vendor fee. She would like those fees waived. The vendors won t come if they have to pay the vendor fees. Mayor Marchant said they are talking about two separate issues said they would need to discuss and motion for each one. Page September, 0

2 0 0 0 Councilor Rod Smith asked how many vendors she has lined up. Insa said they don t have very many yet, they are still trying to round them up. They have space for 0, but will be lucky to have. Councilor Rod Atkinson asked if just the companies will serve the beer. Mayor Marchant asked if the beer is to be sold. Insa said she has volunteers to serve the beer, and it will be sold as a fundraiser for Recycle Utah. She explained the process she has gone through with Wharton, and talked about raising pigs, and reducing food waste. MOTION: Councilor Rod Smith moved to approve a onetime beer license for the Harvest Festival to be held at High Star Ranch. Councilor Rod Atkinson seconded the motion. Mayor Marchant told Insa to let the office know if she needs any approval for the State. FINAL PLAT APPROVAL FOR KAMAS WEST SUBDIVISION PHASE II, 0 N. 00 W. City Planner Jackie Blazzard reviewed the staff report, reminding the council of hearings, site visits, and approvals that have occurred. A retaining wall has been added. Wetlands have been approved and recorded. Beaver Shingle Creek has given a letter of approval. The utility easement issue with Rob Martin has not been resolved yet, although a meeting between Martin, the Mayor, and the City Engineer took place in September. The Engineer s redline letter is attached. Storm drain changes have been requested. A plat note states that no basements will be allowed. Planning Commission recommended one street light be installed at entrance, while Kettle and Siddoway recommend an additional light be installed in the cul-de-sac. City Engineer Scott Kettle reviewed the letter from Martin asking him to come to Oct, 0 meeting to allow him to respond before condemnation. The storm drain would be better as a pond, so it will be located on the north property line on lot. The plat can be modified. Councilor Rod Smith confirmed that if the drain overflows, it will then run back into the creek. Kettle said the lights will be the ones discussed and approved at the meeting weeks ago. Gus Sharry thanked Blazzard, Kettle, and Planning Commission for all their work into this process. They want to begin the fall 0 schedule. They have a limited season. If approved tonight, they will work until the 0 th of November, and then leave it until spring. They will do street lights if the council wants. They thought the house lights would be enough. They hope Martin can cooperate and get the utility easement issue Page September, 0

3 0 0 0 resolved. He spoke about the extra feet helping with the flow. They helped the city with the pipe job on Hawthorne and are using the fill. They hope to get the utilities buried underneath the box and everything in place this fall. Then it can settle. Councilor Rod Atkinson asked the size of the box. Sharry said ft. tall and ft. wide. Councilor Dan Littledike said the extra feet should help with the water flow. Councilor Kevan Todd said regarding the lights in the subdivision, he would recommend just because the homes will not be in there for awhile. It will increase safety until the homes get in. Sharry asked if there is a standard. Kettle said Kamas City wants them to install similar lights as the lights in the parking lot. Mayor Marchant said that these particular lights don t put out too much light. Councilor Littledike said the spacing is 0 ft., which will help keep consistency in town. Julie Viar said her question was about the street lights, which they just answered. Dianna Bayles asked dirt pile, she said that is an awful lot of dirt. Sharry said the land will be raised ft. it will not affect anyone s view. Richard Lisonbee wanted to make sure that dirt pile will be gone because it is right in his view. Sharry said he appreciated his attitude, and they will have all of the dirt gone soon and it will not block his view. Bayles asked Sharry to please remind their truck drivers to watch the stop signs as there are a lot of kids in that subdivision. Councilor Rod Atkinson also reminded him to keep dust down by watering. Viar said they don t want to cause problems; they just want to be informed. Councilor Smith asked where they are at with the street lights. Mayor Marchant said there were varying opinions within the planning commission, but they recommended one at the entrance. Councilor Smith said these lights will not destroy the night sky, and he would like two for safety purposes. He wishes the council would have required another one up at the Beaver Creek Subdivision. Ronald Harrington said they have no problem with two lights. Kettle said to mention in the motion the condemnation issue in case it needs to be brought back to the city council. MOTION: Councilor Rod Smith moved to approve the final plat for Kamas West II at 0 N. 00 W. with street lights required, with note that utility easement condemnation may need to be addressed by the City Council again, no basements allowed, and redlined issues resolved. 4 0 0 0 AMENDMENT TO THE KAMAS CITY BUSINESS LICENSE ORDINANCE 0-0 Mayor Marchant reviewed the business license ordinance, discussing how to include a special event. The current ordinance has only the word nonprofit, which excludes profiting special events. It is located under section ; temporary licenses. The fee requires $.00 per business or concession stand. Recycle Utah is now asking for that fee to be waived. They need to amend the ordinance if they want to waive this fee. The ordinance may be out of date. He asked if any other changes needed to be made. Insa Riepen read Summit County s Special Event regulations and fees. She said all of the events she puts on have the fees forgiven. She is the one responsible for all the vendors. Mayor Marchant said he agrees with that and would rather charge the sponsor instead of having staff track down each vendor. Dori Snyder gave examples of fees from other cities, officers on duty, liability, having sponsor pay fee instead of vendor after researching this issue in other ordinances from other cities. She said most cities have changed fees to charging one fee instead of per vendor. This would then leave the permit holder responsible for all the vendors instead of the city. Another idea she found was other cities charging for police officers to be on site, and staff, depending on the number of attendees. Mayor Marchant asked how much other cities charge for that. Snyder read $ for staff fee for 00 people, or $0 for 00 people, which requires uniformed officers on site. This particular event will most likely not be that large, but the council may want the wording in place in the event that larger functions are applied for in the future. Mayor Marchant asked for council comment. Councilor Littledike said farmer s markets would fall into this category and are becoming more common. Mayor Marchant asked for liability and security. Riepen said she provides insurance proof. Mayor Marchant said he wants it clear that the city is not to be held liable. Snyder said they have already added proof of insurance holding Kamas City clear of liability to the application. Councilor Littledike said he is concerned about forgiving fees. Where does it end? Mayor Marchant said they could add something to that effect. Riepen said they should only waive fees that are non profit organizations with their proper documentation. Mayor Marchant explained they are mixing profit and non profit. Wharton and other restaurant owners will be making a profit. Councilor Smith asked if the city required $0, would that make or break this event. Page September, 0

5 0 0 0 Riepen said she would just like to see the vendor fee waived. They can do the rest. She would encourage them not to charge more than the county which is $0. It will affect their revenue, but it can be done. Mayor Marchant explained an officer will need to be able to respond. He asked what the county charges. Riepen explained most of her events fees are waived and she hopes they will not need an officer. Councilor Smith doesn t like to set a precedence. He would like to set a fee set and stick with it. He doesn t like the council judging what event should have their fees waived. Councilor Todd said they could add wording that if it is Summit County sponsored, they could waive fees. Snyder said they should keep a fee in place. The license fee is not to generate revenue for the City. Licenses are to keep control and consistency of events and business being held in the Kamas City limits. She could get a sponsor for that fee if they need to. Otherwise, many events will claim to be non profit. An officer will need to be on standby regardless of whether they need them or not. She noted that this application will be a work in progress, because they will not know what is needed until certain issues come into play. Councilor Littledike said he worries about inappropriate vendors. Riepen said to hold the applicant responsible. All of her people are certified to serve beer. Snyder said to add the word it on the application that each vendor must meet state and city laws. She said they could add the vendor sheet and staff can check business names online. The council read, discussed, and made changes to the ordinance. They decided $0 for a one day and $00 for multiple day events. MOTION: Councilor Diane Atkinson moved to amend the Kamas City Business License 0-0, section, number to include special events one day $0, multiple day $00. See attached amended ordinance. Permits are to be approved by the city council, and signed off by the Business Licensing Administrator and the City Planner. Councilor Rod Smith seconded the motion. Councilor Dan Littledike voted aye. DEPARTMENT REPORTS ENGINEERING Scott Kettle updated the City Council on the progress of the water line installation on Hawthorne and gas line and water line depth. Kettle met with Beaver Shingle Creek Irrigation Company. They will contribute $0,000 to help with the upsizing of the box culvert. Staker Paving will do the paving properly and will do it on the days with the best Page September, 0

6 0 0 0 weather. Smith asked if the asphalt that was roto-milled off is reusable. He wants it hauled off. Kettle said yes, that was the plan. MAINTENANCE Gary Siddoway was excused. MAYOR Mayor Marchant reminded the City Council about the Land Use Training in Oakley tomorrow night.
