Parents, William Preston and Kimberly Darlene (Moore) King, were told a day before Maddie s first birthday that she has leakemia. We are asking everyone to place Maddie on their church prayer list. She will remain in the hospital for approximately one month, and must have treatments for a year. Maddie is shown above with brother, Eric. A full recovery is anticipated with your prayers. Also, you are asked to pray for the men and women soldiers who are now serving in the Middle East. SEARCH CONTINUES FOR FAMILY BIBLES You are asked to report the whereabouts of a family Bible? The documents referenced the possible fate of many slaves, CHILDS, COF (CUFF?), DINAH, HANNAH, MARY, ALEXANDER, ISAM, JORDAN, AMIS, ELIJAH, DILLY, CANADA, FRANBY, HENRY, ELI, and ELIJAH. Now, the transcription of the Answer of John Fogleman to the Bill of Complaint filed against him in said Court (Orange County, NC) by Peter Fogleman, is as follows: North Carolina } Orange County } In Chancery To the Honorable the Judge of said Court The Answer of JOHN FOGLEMAN to The Bill of Complaint filed against him in said Court by PETER FOGLEMAN T Defendant saving and reserving to himself the benefit of excepting to the numerous errors and uncertainties in complainants Bill contained for answer thereto or to so much thereof as he is advised it is material or necessary for him to answer unto answering sayeth He admits that the complainant is the legal representation of PETER FOGLEMAN decd who died in the year (date left blank) and intestate and he admits that the deceased PETER FOGLEMAN was once the owner of the Negroes DINAH and HANNAH mentioned in complainants Bill But he does not admit on the contrary he expressly denies, that at the time of the death of the said PETER FOGLEMAN or at any time after the 3 rd of September 1801,? the said PETER had any right to said Negroes or either of the, either at law or Equity He states to your Honor that the said PETER FOGLEMAN having occasion to raise money applied to t defendant to sale (sell) him the two said Negroes DINAH and HANNAH and that t Def. Did accordingly purchase them, giving for the Negro DINAH the sum of $84 and for the said HANNAH the sum of $200 which two sums t Deft. Paid to the said PETER FOGLEMAN and the said PETER at the time of making the sale gave to t Defendant two Bills of Sale one for DINAH and the other for HANNAH bearing date the 3 rd of September 1801 both of which has been duly recorded and t Defendant has read, to produce whensoever required by t Honorable Court T Defendant expressly was that the contract between him and the said PETER FOGLEMAN was a contract of sale absolute and unconditional that it was not intended by the said PETER FOGLEMAN or by t Defendant to be a conditional one or that any power was to be an actually was reserved to the said PETER FOGLEMAN offer deeming said Negros or either or them on the contrary the sale was absolute in its nature and intended so to be at the time and so understood by both the parties Further answering t Deft would state that in opinion the prices be paid for said Negroes were fully and fairly their value that he took HANNAH immediately into possession upon making purchase and the Negro DINAH after the death of EVE HOLT the widow of NICHOLAS HOLT dec d who had a life interest in her, - and that the said EVE HOLT died in the year 1807 and that since taking possession of said Negroes they have remained in possession to the present time and used them as property, solely, and unconditionally and denies that they were put into possession to secure any money but by t Defdt to said PETER FOGLEMAN. PETER FOGLEMAN died in the year (date left blank) and never to the knowledge of t Defdt ever set up any claim to said Negroes after the sale to Deft in 1801 if he did it was unknown to Defdt FACTS ABOUT FOGLEMANS Slaveholders and Slaves continues on page 2.

2 Page 2, Vol. III, Issue No. 4 June 2004 Fogleman Newsletter CORRECTIONS & CLARIFICATIONS An article in the Fogleman Newsletter, September 2003 issue about FACTS ABOUT FOGLEMANS - The Old Homeplace contains inaccuracies. It indicated that the property as highlighted in the example shown on the right, was believed to be the homeplace of George Fogleman, and that the property was located on Kimesville Road around Barnhardt Lane. It is not the original tract owned by George Fogleman, and inherited by son, Henry. The error was the result of Henry Fogleman s name appearing on the some of the undated hand drawn plats. Since that time, a document dated 1832 referring to Henry;s home where a local election was being held. The latter Henry was the son of John and grandson of George Fogleman. The hightlighted property in question did belong at one time to brothers, John S. and Henry Fogleman. A chain of title and deed search continues on the McCulloh-Willock / George Fogleman tract of land. Some of the Fogleman s land has been drawn by William C. Moran, a map maker, in Burlington, NC. Pending the result, the Moran drawing and the title search may be included in the September 2004 newsletter. It is the mission of the Fogeman Newsletter to pursue the truth aggressively. Our policy, in doing so, is to correct mistakes promptly and to clarify information reported in less-than-clear context. An Alamance County, North Carolina GIS map that inadvertedly shows the area of property owned by George Fogleman, and inherited by Henry Fogleman. T particular property was owned by brothers, John S. and Henry Fogleman. FACTS ABOUT FOGLEMANS Slaveholders and Slaves continued from page 1. Further answering Deft states that PETER FOGLEMAN being brother he did from time to time (offer the sale and purchase of said Negroes), advance and pay for him various sums of money which have never been repaid him that being security to HENRY COBLE for the purchase of a horse he was sued and the money collected from him by THOS WHITTED the amt was 47.7 ($235.16) that he paid several executions in favor of HENRY LONG against dec d and t Defendant in being brother the said PETER on the 23 rd Sept ($43.38) and that he paid another expense against said PETER and himself in being security for ($56.81) and on the 9 th Oct 1813 he paid on LONG, not against said PETER $17.40 that the above sums amt to ($466.87) no part of which was ever repaid by the said PETER FOGLEMAN or Admr the Complainant but the whole is still due t Defdt over to bear the sums before mentioned t Deft has paid various other sums for which he has at t time no vouchers or the vouchers for which are mislaid Further answering t Defendant would show unto your Honor that (illegible words that were marked through) previous to the time when he obtained Bills of Sale from PETER FOGLEMAN for the Negroes DINAH and HANNAH he had bargained for and paid for them that an execution was levied on said DINAH by SAMUEL TURRENTINE in favor of GEORGE LEA against PETER FOGLEMAN and the interest of said PETER in said Negro sold to SAMUEL DICK that after said sale and after the sale by said PETER FOGLEMAN to t Def d the said DINAH had a child called MARY who together with her mother was conveyed by JOHN COOK the attorney in part of SAMUEL DICK to NICHOLAS HOLT, and t Deft tho the title to said DINAH and MARY were in him, yet he thot it better to bury peace that to engage in a hideous lawsuit in accordingly purchased the Negro girl MARY from the said NICHOLAS HOLT not because he doubted title, but for the reason above expressed - Your Order denies the fact to be as set forth in complainants Bill that the said MARY had been mortgaged by PETER FOGLEMAN to the said NICHOLAS HOLT if the fact was so he did not know it, and claims therefore to be a purchase for a valuable consideration and without notice, deed from the said HOLT he has made, to produce whensoever called on by t Honorable Court T Defendant admits that the children of DINAH and HANNAH and MARY are correctly set forth in complainants Bill and that they are in possession Denying all fraud he prays however to be dismissed with reasonable costs in t case unjustly sustained and as in duty bound will pray to. A Call to Appear in the case of PETER FOGLEMAN, plaintiff, and JOHN FOGLEMAN, defendant, as follows: STATE OF NORTH CAROLINA To Michael Holt and John Stafford, Esquires, of the county of Orange Greetings: We, reposing special trust and confidence in your integrity, do authorize and empower you to cause JOHN EULIS, DANIEL THOMAS, HENRY EULIP (EULIS), BARNEY CLAPP, DANIEL SHOFFNER, GOERGE ISLEY, GEORGE FOGLEMAN, PETER SHOFFNER, FRANCIS HOLT AND BOSTIAN SHARPE to appear before you, at such time and place as you may appoint, and there on oath to examine touching all such matters and things as they shall know of concerning a certain matter of controversy in our Superior Court of Law and Equity for the county of Orange pending, wherein PETER FOGLEMAN Adm &? is plaintiff, and JOHN FOGLEMAN is defendant. And these depositions in writing by you so taken, the same to transmit, sealed with your seals, to our court to be held for the said county, on the second Monday of September next, to be read in evidence in behalf of the Complainant in said controversy. Witness: James Webb, Clerk and Master of our said court, the second Monday of March, JAMES WEBB, CME 1 Was my father, PETER FOGLEMAN, Sr. in circumstances self present to bring suit for considerable property from the time JOHN FOGLEMAN, Sr. had the Negroes now in dispute in possession unto the death of the said PETER, Dec d? ANSWER: I think he was not, I would not have been security in a suit or any other way from the time I became acquainted with circum stances unto death, further t deponant sayeth not. The depositions continue: State of North Carolina Orange County In pursuance of the annexed communication to us directed, we have caused BARNEY CLAP, JAMES HOLT, HENRY EULIS, DANIEL THO- MAS and BOSTIAN SHARP and JOHN EULIS To appear before us at the house of MICHAEL HOLTS in the County of Orange aforesaid on the 4 th day of August 1830 and they being sworn duly do dispose the gtruth the whole truth and nothing but the truth touching a certain matter of controversy depending in the Court of Equity for Orange County aforesaid wherein PETER FOGLEMAN administrator is Complainant and JOHN FOGLEMAN, SR. is Defendant did depose and say as follows to wit; BARNEY CLAP being duly sworn deposeth and sayeth question by the Complt: Was my father, PETER FOGLEMAN,? in circumstances by? to bring suit for considerable property from the time JOHN FOGLEMAN, SR. had the Negroes now in dispute in possession unto the death of the said PETER, dec d ANSWER: I think he was not, I would not have been security in a suit or any other way from the time I became acquainted with circumstances unto death further t deponant sayeth not. JAMES HOLT being duly sworn deposeth and sayeth, That in a conversation with PETER FOGLEMAN, dec d, he said that if he was to take the Negroes from JOHN FOGLEMAN, Sr. that he was so in debt that some other person would take them (take them) from him, and he added that he had as leave JOHN FOGLEMAN should have them as any other person further the deponant sayeth not MICHL HOLT, J.P. (SEAL) JOHN SHOFFNER, J.P. (SEAL) James Holt HENRY EULIS deposeth and sayeth that he was well acquainted with PETER FOGLEMAN dec d and was in good circumstances at one time, but from the time he failed unto death he was in all appearance a poor man and had not the appearance of any property about him further the deponant sayth not. MICHL HOLT, J. P. (SEAL) Henry X Eulis DANIEL THOMAS after being duly sworn deposeth and sayeth, that he heard JOHN FOGLEMAN say that he had purchased the Negroes in dispute, and had paid for them, and in a conversation (at another time) with PETER FOGLEMAN, eight or ten months before he died, he said that the Negroes was mortgaged to JOHN FOGLEMAN for about seventy five dollars, and that he owed him something more over & above, the seventy five dollars, not excluding one hundred dollars in all, and whatever he paid the money seventy five dollars he would have the Negroes and their increase, the worth of the Negroes was to go for interest. (SEAL) Daniel Thomas (Daniel Thomas in German Above written) BOSTIAN SHARP after being sworn deposeth and sayeth that riding in company one day with JOHN FOGLEMAN the deponant told the said JOHN FOGLEMAN that he had heard that right to the Negroes in disposition was not a good title, Fogleman answer was that he had paid well for one of them that the Sheriff had levied on; the name of the Negro he the deponant does not recollect, but recollects that it was a female name further the deponant sayeth not. (SEAL) Bostian Sharp JOHN EULIS after being sworn deposeth and sayeth, that he was security for a debt oweing by PETER FOGLEMAN dec d and he the said deponant went to the said PETER FOGLEMAN with an officer to levy on some property to discharge the said debt which he the deponant was security for at that same time PETER FOGLEMAN said that brother ought to pay the debt, that he had let brotherjohn FOGLEMAN Sr. have a Negro and that he had not given him the worth of it further the deponant sayeth not T 4 th day of August 1830 MICHL HOLT, J. P. (SEAL) John X Eulis T ends the content of the deposition documents. It unfortunate at t time that we do not have the Order by the court about its direction to Peter Fogleman and John Fogleman about what will happen to the slaves. Ginger Haithcock, a researcher at Hillsborough, NC, has searched for the response by the Court. The result of the search indicates that a note found in the front of one of the record books stated that the records had been sent for microfisching at the State Archives, Raleigh, NC. A search will continue for t information. An Orange County (NC) Deed Book 13, page 409, 20 February 1808, Peter Fogleman of Orange to John Cook (no residence given), one hundred pounds paid or secured to be paid, Negro girl named PEGGY, about 16 years old (born abt 1792), signed: Peter Fogleman, wit.: Isaac Holt, proved November Term 1810 by Isaac Holt. Historically designating George as an early pioneer in the Alamance County (formed from Orange in 1849), North Carolina, is important to our heritage, and the topic will be discussed during the Fogleman Reunion in October The fact that George settled in t area in the early 1760 s is so important that someone has suggested the formation of a Historical er Committee to consider the wording for such a marker near the Kimesville Road property, and to think about a second marker at the home place. The Alamance County Historic Properties Commission has been contacted about an application requesting their approval for a county or state torical plaque in commemorating t giant step made by a Fogleman descendant to date. T marker project will require the financial support of at least sixteen hundred dollars ($1,600.00). You may contact a Reunion Committee Member if you are interesting in serving on t project.
