5 Upon commencing at 10:24 a.m. 4 5 OPENING COMMENTS BY THE CHAIRPERSON: 6 THE CHAIRPERSON: Okay. So we'll open 7 the session, then, and good morning, again. My name is 8 Willard Hagen. I am Chair of the Mackenzie Valley Land 9 and Water Board. 10 So today we are reconvening by 11 teleconference to hear statements from the Chief, 12 councilors, and any other community members that may 13 wish to talk. This is on the water licence of land use 14 permits applications from Canadian Zinc to operate the 15 Prairie Creek mine. 16 Firstly, before we get into 17 introductions and statements, which we've already 18 gotten introductions and we will shortly get the 19 statements, I will provide a short background on the 20 Board. We are responsible for land use permitting and 21 water licensing in the Mackenzie Valley under the 22 Mackenzie Valley Resource Management Act and the 23 Northwest Territories Waters Act, respectfully. 24 Last week, we held three (3) days of 25 hearings in Fort Simpson. And unfortunately, due to

6 1 weather, we're unable to come to your community up in 6 2 Nahanni Butte. 3 This hearing a panel of the Mackenzie 4 Valley Land and Water Board has been established in 5 accordance with Section 104 of the MVRMA to make the 6 decision on the terms and conditions that should be in 7 the water licence on land use permits for Canadian 8 Zinc. 9 The report of environmental assessment 10 has already concluded that the project is unlikely to 11 have any significant environmental impacts and can, 12 therefore, proceed to permitting. 13 The panel includes my colleagues, Sabet 14 Biscaye and Floyd Adlem, here with me in the room, and 15 Pat Larocque on the phone from Hay River. I also have 16 with me our staff, and legal counsel is on the phone. 17 We are recording this meeting so that we 18 can produce a transcript. If anybody has objections to 19 recording, please speak now. 20 It is very important for the re -- the 21 record that each time someone speaks, you start by 22 stating your name. We will conduct the proceedings in 23 English, and due to the technical challenges, we will 24 be unable to provide a simultaneous translation. 25 However, if anyone does wish to speak in Slavey, we do

7 1 have an interpreter with us here so we can provide a 7 2 translation for the Board and the transcript if 3 necessary. 4 We do wish for this meeting to be as 5 smooth as possible. However, the conference call will 6 make things a little challenging, and I would ask that 7 we all would direct questions, statements, and comments 8 to the Chair. If you must interject at any point, 9 please state your name and that you wish to speak, and 10 I will allow comments and questions at the appropriate 11 time. 12 The order we will work in today is 13 outlined on the agenda that distributed. First, we 14 will hear a statement from Chief. Then we will open 15 the floor for any statements from the members of the 16 council, band council, or any community members from 17 Nahanni Butte. 18 Following these statements, we will 19 allow opportunity for the Board staff and legal counsel 20 to ask questions to the Naha Dehe Dene Band. Then we 21 will invite the Chief to make a closing statement. And 22 finally, Canadian Zinc will have the opportunity to 23 make the closing statement, and the Chair will close 24 the hearing. 25 During my closing comments, we will

8 1 provide information on the date the Board will be 8 2 releasing the draft licence and the new submission 3 dates submission dates and the expected date of licence 4 issuing. 5 Before we proceed, I think I actually -- 6 I have confirmed who is on the pho -- on the phone. 7 And -- and so unless there's any other questions, I 8 would like to invite the Chief of the Naha Dehe Dene 9 Band to make your opening statement. Thank you OPENING COMMENTS BY NAHA DEHE DENE BAND: 12 CHIEF CLAYTON KONISENTA: Okay. Thank 13 you, Mr. Chair. It's Chief Konisenta from the Naha 14 Dehe Dene Band. And I would just like to open by 15 saying I thank you all for this conference call, and I 16 thank you for giving us the time to -- to give our our concerns and our -- our questions. And -- and I 18 guess the meaning of this conference call is -- is just 19 to -- just for us to -- to tell the Review Board if 20 they could just proceed on with their schedule and that 21 hence that they weren't in Nahanni because due to 22 weather that this conference call would be a -- a sort 23 of a consultation with Nahanni Butte and the members 24 and just to, like I said, not to let anything be 25 stalled or -- or be on hold because of the -- the

9 1 weather. 9 2 And -- and, yeah, we -- we did have a -- 3 a presentation done by Parks Canada on the -- on 4 Tuesday, and they -- they showed us some information 5 and the community did some -- some questioning. And it 6 was good info and insight. 7 And like I said, I -- I'm happy to be 8 here at this conference call. And if any of the 9 council members have anything else to say, I'll pass it 10 on to them 11 THE CHAIRPERSON: Great. Thank you, 12 Chief. And just for the record, we are the Mackenzie 13 Valley Land and Water Board. You had mentioned a 14 review board, that's who did the environmental 15 assessment on -- on this project, just for 16 clarification. 17 CHIEF CLAYTON KONISENTA: Oh, okay. 18 Yeah. Yeah, okay. All right COMMENTS AND QUESTIONS FROM THE PUBLIC: 21 THE CHAIRPERSON: Yeah, and thank you 22 for that. And so we'll go to any -- any statements 23 from anybody from Nahanni Butte on the phone (BRIEF PAUSE)

10 1 THE CHAIRPERSON: And if you do have a 10 2 statement from Nahanni Butte residents on the phone, if 3 you could state your name in advance, please, for the 4 record. 5 6 (BRIEF PAUSE) 7 8 MR. GEORGE BETSAKA: Hello. 9 THE CHAIRPERSON: Yes, we're here. 10 Good morning. And if you could just state your name 11 for the record and any statements you might have to to anybody around the table. We're all on the phone. 13 MR. GEORGE BETSAKA: Hello. This is 14 George Betsaka from Nahanni Butte. I'm a member of the 15 Nahanni Butte band. 16 THE CHAIRPERSON: Yes, thank you. 17 Please proceed with your statement or a question -- or 18 a statement in this case. 19 MR. GEORGE BETSAKA: We asked Nahanni 20 Butte members that have worked at Prairie Creek, Neal 21 Konisenta, Herb Betsaka, Jean-Marie Konisenta, Delores 22 (phonetic) and Eileen (phonetic). And we'd like to 23 hear some of the results in regards to the -- the 24 decision that the Water Board is making, or have, or 25 did they?

11 1 THE CHAIRPERSON: I'll let the 11 2 executive director, Zabey Nevitt reply in response to 3 that. Thank you. 4 MR. ZABEY NEVITT: Oh, it's Zabey 5 Nevitt, the executive director with the Mackenzie 6 Valley Land and Water Board. The hearing that we held 7 in Fort Simpson last week and the attempts we made to 8 come to Nahanni Butte, and so the replacement hearing 9 we're having today, is the -- one (1) of the last 10 stages in the licensing process. 11 So the next step is the Board is going 12 to develop a draft water licence land use permit, which 13 will be sent out for review. The -- the plan is that 14 that water licence and the land use permit will be 15 issued sometime in the next few months. 16 We're doing our -- our job after we the environmental assessment is finished. That's all 18 been done. And so this is the last stage in the 19 licensing before we -- we go towards issuing a permit 20 and licence in the near future. 21 What we're hoping today is to hear any 22 comments or statements from residents on what kinds of 23 terms and conditions you might want to see in that 24 water licence and land use permit. Part of our role is 25 to ensure that we've heard what people think should be

12 12 1 in that licence and permit, so that's what we're hoping 2 to hear today. 3 THE CHAIRPERSON: Thank you, Zabey. 4 Further from Nahanni Butte? 5 MR. GEORGE BETSAKA: Yeah. Yeah, this 6 is George again. We've waited long enough. So if we 7 could proceed with the permits and so forth, because 8 the first time I've ever been up there was 1980, and 9 it's been thirty-two (32) years now and I'm not getting 10 any younger. Maybe we'll get -- have the Water Board 11 and Aboriginal Affairs to take that seriously and give 12 us some economic, eh? (BRIEF PAUSE) THE CHAIRPERSON: Thank you, yes. We 17 hear you loud and clear. We're following the process 18 that's laid out in the Acts that we're under. And the 19 final decision on the water licence, Type A water 20 licence, will be sent to the Minister of AANDC, who 21 makes the final decision on this. And hopefully it 22 will all turn out positive. 23 Anything further MR. GEORGE BETSAKA: Yep, thank you. 25 Thank you -- there's no more comments, we're here at

13 1 the conference anyways THE CHAIRPERSON: Okay. And thank you 3 for your remarks. Is there anyone further from Nahanni 4 Butte who has a statement to make? 5 6 (BRIEF PAUSE) 7 8 THE CHAIRPERSON: I take it by the 9 silence that perhaps there isn't any further 10 statements. 11 Then next on our agenda, we'll go to 12 questions to the Naha Dene Band from Board staff, 13 technical advisors, and legal representation. So over 14 to Board staff QUESTION PERIOD: 17 MR. ZABEY NEVITT: Zabey Nevitt, the 18 executive director with the Board. When we were in 19 Fort Simpson last week, we -- we asked the Company and 20 also your consultants some questions about the 21 engagement and consultation that Canadian Zinc was 22 doing with community residents and the Chief and 23 council and -- and how appropriate you felt it was, and 24 also the processes that they were thinking about and 25 the ongoing engagement that they were proposing to do

14 1 with the community during the life of the project We wanted to know if you felt that what 3 they were proposing was -- was adequate and if it was a 4 process that they proposed some committees and if you 5 felt that that -- those mechanisms in place, those -- 6 those ways of consulting with you, were going to be 7 appropriate through the life of the mine. 8 So I just wanted to hear from -- from 9 the Chief, council, and any community members that may 10 want to speak to that whether you felt that you think 11 that there will be adequate ongoing engagement and if 12 there's any specific ways of doing that you'd like to 13 see through the life of the project. 14 THE CHAIRPERSON: Thank you, Zabey. So 15 back to NDDB and members, if they have any questions. 16 CHIEF CLAYTON KONISENTA: Thank you, 17 Mr. Chair. It's Chief Konisenta here, and I'd just 18 like to remark on that. 19 When we did sit down the day that the 20 review -- the Mackenzie Valley Land and Water Board was 21 supposed to be in Nahanni but due to weather, we sat 22 down with Canadian Zinc we -- we just sat down and just 23 talked about we said, Well, how can we -- how can we 24 communicate better in the future and for tomorrow and 25 for the life of the mine? And we haven't really --

15 1 really stated anything on paper, but we agreed that 15 2 once a week we'd -- we'd contact and each other and -- 3 and have a communication that way. 4 I believe we settled on once a week, 5 Thursday, I believe, in the afternoon. So that's a 6 start of just keeping contact with Canadian Zinc and 7 the members of Nahanni Butte Dene Band. That's all I 8 got there. Thank you. 9 THE CHAIRPERSON: Thank you, Chief. 10 That sounds like a great start. 11 Is there further questions to NDDB from 12 Board staff or legal? 13 MR. JOHN DONIHEE: It's John Donihee 14 here. No -- no questions from counsel. 15 THE CHAIRPERSON: Okay, thank you then. 16 So then we will go to questions to NDDB from any Board 17 members. Elizabeth, do you have something? 18 MS. ELIZABETH BISCAYE: Ah, no -- no 19 thanks. I don't have any questions, Mr. Chair. 20 THE CHAIRPERSON: Thank you. Floyd...? 21 MR. So 3 then if we could have some closing statement from NDDB. 4 5 CLOSING COMMENTS BY NAHA DEHE DENE BAND: 6 CHIEF CLAYTON KONISENTA: All right. 7 Okay. Thank you. It's Chief Konisenta. Thank you, 8 Mr. Chair. I just like to start by -- with my closing 9 statement for -- on behalf of Nahanni Butte Dene Band 10 is that if there was any confusion in the past to any 11 of the parties that are involved in this licensing is, 12 we haven't -- we haven't given Canadian Zinc any form 13 of letter of support when we met. All we stated was 14 that we -- we were trying to go the route of working 15 bet -- working more together and having a better 16 communication and -- and I just -- to -- to quote my 17 Chief -- my council, Jim Betsaka, which is not present 18 on the conference call, he stated that Nahanni Butte 19 and -- as -- as council, his -- his family stated that, 20 along with the members, that they don't support the 21 load-based method. 22 And we're still standing with -- with 23 what we said in the beginning, and we're still standing 24 on the sides of -- of the -- of Parks Canada and the 25 Aboriginal Affairs. And just for the record, we -- we

17 1 haven't changed our mind or anything. We're still 17 2 standing with what we said, and that is to protect the 3 water and -- for the future and -- and for -- for many 4 more years to come as the mine is -- through the mine 5 life. Yeah. Thank you. 6 THE CHAIRPERSON: Thank you very much 7 for those remarks there, Chief. And so we'll go to 8 closing statements then from Canadian Zinc CLOSING COMMENTS BY CANADIAN ZINC: 11 MR. ALAN TAYLOR: Mr. Chairman, this is 12 Alan Taylor. I just want to check that you can hear me 13 on this line okay? 14 THE CHAIRPERSON: Yes. You're not 15 quite as -- not booming in, but we can hear you. 16 MR. ALAN TAYLOR: Okay. Thank you, Mr. 17 Chairman. Canadian Zinc would firstly like to thank 18 Chief Konisenta and the council and members of Nahanni 19 Butte for participating in this public hearing 20 teleconference. And also -- I also wish to thank 21 Mackenzie Valley Land and Water Board for arranging 22 this all. Perhaps I can reflect on the -- the project 23 a little bit. I won't be long. 24 The original discovery of Prairie Creek 25 eighty-five (85) years ago was led by a guide from

18 1 Nahanni Butte, and much work has been completed prior 18 2 to Canadian Zinc's involvement. 3 Canadian Zinc has worked for over 4 fifteen (15) years on the Prairie Creek project. And 5 during this time we have maintained that the closest 6 communities -- that being Nahanni Butte -- should have 7 the greatest opportunity to benefit from the operation 8 of project. 9 During the course of our site activities 10 we have learned much about the project's unique 11 environment and have proposed an operation that 12 harmonizes the environment with development. Much time 13 has passed along with the ebb and flow of exploration 14 and development, and we were very pleased with this 15 (INDISCERNIBLE) and impact benefit agreement recently 16 signed in During the advancement of mine 18 development, we have initiated many training programs, 19 social programs, employment for the mine site and 20 information -- information sessions to further assist 21 Nahanni in understanding the mine operation. It is our 22 intent to continue this initiative. 23 As a follow-up to our public hearing in 24 Fort Simpson, as Chief Konisenta mentioned, we met with 25 Nahanni Butte Chief and council on February 1st, the

19 1 day of the scheduled public hearing in Nahanni Butte We further explained our load-based 3 water management proposal and also offered to prepare 4 the -- the site for a second water storage under the 5 understanding that it would only be built if deemed 6 necessary. 7 We maintain that the load-based approach 8 and the flexibility it provides is essential to this 9 project. We realize that the amount of documentation 10 relating to this regulatory application was somewhat 11 overwhelming for the band, and we have tried to relieve 12 some of that challenge through constant dialogue 13 between us. 14 While the understanding of some of the 15 details of water management required some expertise, 16 our objective remains the same, and that is to create a 17 viable mining operation at Prairie Creek which ensures 18 there is no significant adverse environmental impact 19 and that we maintain the quality of the receiving 20 environment, which is the water that flows into Prairie 21 Creek and, ultimately, (INDISCERNIBLE). 22 Thank you, Mr. Chairman. 23 THE CHAIRPERSON: Thank you for those 24 closing statements. Just before I make my closing 25 remarks and I close, is there anyone else who has

20 1 anything further to add? (BRIEF PAUSE) 4 5 CHIEF CLAYTON KONISENTA: Yeah, Mr. 6 Chair. It's Chief Konisenta again. 7 THE CHAIRPERSON: Yes. Proceed. 8 CHIEF CLAYTON KONISENTA: Oh, I'd just 9 like to say, yeah, we -- I just -- all parties knew how 10 long of a struggle that it's been through to get you up 11 to this point, but it seems to me like things are are happening and things are moving along and -- but it 13 took a while, like everything else. And I'd just like 14 to thank all the parties for all their time and all 15 their work for -- for all they've done. 16 And we're -- we're all involved one (1) 17 way or another because of the environment and the 18 protection of the environment and the water. I'd just 19 like to go on statement and on record just to say I'd 20 like to thank all the parties for all their hard work 21 and all -- all the respect for the -- the -- for Mother 22 Nature and the water that keeps us alive today. Thank 23 you CLOSING COMMENTS BY THE CHAIRPERSON:

21 1 THE CHAIRPERSON: Thank you very much, 21 2 then. So if -- in closing, then, I'd like to thank 3 Chief, council, and members from Nahanni Butte for 4 their participation and -- in these hearings. And 5 thanks to AANDC; Parks Canada; Joe Acorn; Environment 6 Canada also, sorry; and -- and Peter, of course; and 7 then thanks to Canadian Zinc for everybody's 8 contribution to this public hearing. It's what makes 9 the process work. And thanks to all the MVLWB staff: 10 Zabey Nevitt, executive director; our technical legal; 11 Pido; Mr. Hope, our interpreter, who has a pretty easy 12 job today; and -- and especially the Board members: 13 Sabet, Floyd, and Pat. 14 And I just thank you all. So it makes 15 this -- these public hearings much better. And is 16 there a further statement? 17 And so with that, then, I'm going to 18 pass it over to Julian, who will give us -- everybody 19 the time line that we're looking at before we send the 20 water licence out to that -- at some point to the 21 minister and the -- and the land use permits that we 22 approve ourselves. Thank you. 23 MR. JULIAN MORSE: Hi, everyone. It's 24 Julian Morse. Yeah, I just wanted to let everybody 25 know that when we originally issued the -- the work

22 1 plan back in September, there was pretty vague dates 22 2 for the post-hearing process. So we thought we'd put 3 out a post-hearing work plan to give Can Zinc a bit 4 more of -- well, to give everybody more clarity as to 5 what time everything is going to be going down. 6 I'll just give a quick verbal update as 7 to what we've come up with, and I'll be ing this 8 out to the distribution list shortly after this. So 9 you don't have to write these down. You'll be 10 receiving them in your shortly. 11 So we've already agreed upon the post- 12 hearing process. It's going to be February 8th, which 13 is today, public hearing undertakings are due. Written 14 closing statements are going to be due from Intervenors 15 one (1) week following that, on February 15th. A 16 written closing statement is due from Canadian Zinc on 17 February 22nd. And three (3) weeks following that, the 18 Board will be issuing the draft water licence and land 19 use permit. That's going to happen on March 15th. 20 Reviewers will have four (4) weeks to 21 review the permits and get their comments back to us, 22 and the deadline for comments is due on April 12th. 23 The deadline for the Proponent response to comments 24 will be one (1) week following that, April 22nd. And 25 the Board decision on the water licence and land use

23 1 permits is expected to happen in mid-may So the final water licence decision from 3 the Minister of Indian Affairs and Northern Development 4 will be expected to take place up to sixty (60) days fi 5 -- following that, so it will be between June and July And, as I said before, I'll be ing 8 out a letter to that effect just right after this 9 meeting. 10 THE CHAIRPERSON: Thank you, then, 11 Julian. So that brings the public hearing of Canadian 12 Zinc Prairie Creek mine to -- to an end then. And so 13 we will adjourn the -- the hearing.
