1 MEETING MINUTES The Vanderburgh County Council met in session this 5 th day of April, 2017 in room 301 of the Civic Center Complex. Vanderburgh County Council President John Montrastelle called the meeting to order at 3:30 p.m. President Montrastelle: Good afternoon everyone. For everyone here in person, thank you for taking time to be at our County Council meeting dated April 5 th. And, for those watching via the TV or streaming it through Granicus, welcome to you as well. We ll start with roll call, please Kathy? PLEDGE OF ALLEGIANCE & INVOCATION President Montrastelle: We ve got some special guests. We re going to start off the meeting with some special, we ve got two deputy sheriffs who were hired probably a few years back as Confinement Officers and these two deputies have just been promoted to actually Deputies. And, I d like for, for them to come up and lead in the Pledge of Allegiance, Pledge of Allegiance, Josh Heisler and Lucas Ray. And, then Angela, if you would do the Invocation, please? Councilmember Koehler Lindsey: Yes, sir. (The Pledge of Allegiance and Invocation were given.) President Montrastelle: Thank you. And, Josh and Lucas, thank you so much. I understand that you, you ve both recently graduated from the Indiana Law Enforcement Academy in Plainfield, Indiana on February 16 th. And, now you re currently going through your orientation. (Everyone claps) President Montrastelle: Thank you. We also have in attendance today, a couple of college interns. One from the University of Southern Indiana, Megan Grisham and Sara from Indiana State University. Welcome to you as well. Councilmember Koehler Lindsey: Go trees! Right?

APPROVAL OF MINUTES March 1, 2017 President Montrastelle: Okay, moving on. Everyone should have received the minutes dated March 1 st. Are there any corrections or questions to the minutes? (No corrections or questions.) President Montrastelle: Hearing none. Councilmember Koehler Lindsey: Motion to approve. President Montrastelle: The motion, or minutes are approved as printed. Thank you. TREATMENT COURT REQUEST TO VACANCY President Montrastelle: First up is Personnel Requests. We ve got one from Superior Court to fill a vacancy, full-time Administrative Assistant position. Councilmember Goebel: Motion to approve. Councilmember Koehler Lindsey: Second. President Montrastelle: Those in favor say aye. All Councilmembers: Aye. President Montrastelle: Anyone opposed? (Motion approved 7-0) CLERK REQUEST TO CREATE AND FILL POSITION OF SUPERIOR COURT CLERK President Montrastelle: Next up, our Clerk, who has a request to create and fill a position of Superior Court Clerk. Clerk Carla Hayden: Carla Hayden, County Clerk. And, I have with me, Kelsey Hall, who is the Supervisor of Circuit and Superior Court. President Montrastelle: Okay, what do you have

3 Page 3 of 38 Clerk Carla Hayden: Okay, you should have received a letter that I wrote on March 13 th explaining the need for this new position. And, what caused the need to arise. The Council often asks how we can help with the Jail over-crowding? How we can move through court faster? And, the members of my staff, the Judges staff, Sheriff Deputies have come together with an idea of something that we re already doing in three of the felony hearings each day is to have one of my deputies in the court room there with them. So, that they can process all the paperwork and everything that s necessary in there and transmit it electronically to the Jail so if the Judge orders somebody to be released on their own recognizance, they already have that information. And, they can get that person out of the Jail. If they sentence them to the Department of Corrections, they can process that paperwork and get that guy out of the Jail and on the road to the prison where he is going to serve his term. Unfortunately, people seem to notice that I have 50 employees, but this department has 14 employees. And, they re serving 8 of the Judges. So, they re trying to do all the paperwork, all the, everything that comes through those. Plus, as I said I already have three people who are attending hearings. To pull another person off the desk would just cripple my department. So, I can t fill that request by the two Judges without crippling the department. So, that s why I m asking for the other position. President Montrastelle: Okay. Questions? Councilmember Shetler: I President Montrastelle: Tom? Councilmember Shetler: The question I have, it s sounds to me that you were making the argument that there would be some efficiencies that we would have through the County, and you know, save some money by moving the prisoners along at a faster pace and getting them either cleared out or up to Indianapolis or wherever. And, get them at least off of our $35 a day Clerk Carla Hayden: Right. Councilmember Shetler: payroll deal. So, do you have an estimate of how much that might save us? Because this position s going to cost Clerk Carla Hayden: Right. I, I Councilmember Shetler: the County about $50,000. Clerk Carla Hayden: At this point, I don t, I don t have firm numbers or anything like that. Like I said, it s something we re already doing in three of the hearings. This would add two more hearings, um, a day to that number that we re working on. Councilmember Shetler: I guess, not a question, but a point, and that is last year what did we end up with, $16,000 cash at the end of the year? Yeah, and this is going to cost us $50, $55,000. Auditor Brian Gerth: It was closer to $6,000. Councilmember Shetler: I don t know where that money is going to come from. Councilmember Koehler Lindsey: Say that again. Auditor Brian Gerth: It was like $5,900 unappropriated. Councilmember Shetler: $5,900? President Montrastelle: Angela? Councilmember Koehler Lindsey: Um, a question for Counselor Ahlers, um, if this, I know it s not exactly creating a new position and it s reinstating a new position, how would this work through Job Study? Um, is this something we need to approve? Counselor Ahlers: Is it already in a budget line item?

4 Page 4 of 38 Clerk Carla Hayden: There were previously some positions that were eliminated under the previous Clerk. But, I, they did create a new line item in the Auditors Office for this. So Counselor Ahlers: So, there s an existing line item for this position? Councilmember Shetler: No. Counselor Ahlers: There s not? Councilmember Raben: There was a year or two (inaudible comment microphone was not on.). Clerk Carla Hayden: Yeah. Councilmember Shetler: Three or four years ago. Councilmember Raben: (Inaudible comment microphone was not on.) Counselor Ahlers: Well I guess that, I mean, if there s an existing, if there was an existing line item, I don t think you need to go to Job Study. I suppose if you re creating a new position, um, that s probably the appropriate thing to do. However, ultimately, Council does have the authority to do whatever it wants to do. So, you know, if, if you re, if you re creating a new position, you need to get the position, you know, you know, rated and classified and set a salary and do all that. Job Study s probably the most appropriate place to do that. If there is already a position and you re wanting to do something, that would be your prerogative as well. So, I d just do whatever, I guess unless there is a reason not to follow protocol, I d just do whatever the protocol is for this type of thing. Councilmember Koehler Lindsey: Do you we have a job description created for the position? Clerk Carla Hayden: We have a similar position under Circuit Court Clerk that is; this would be a Superior, under Superior Court. But, it s the same job duties as the one that s the Circuit Councilmember Koehler Lindsey: Is it the same job rating? Is it the, is it a Pat, Comot, whatever? Clerk Carla Hayden: The pay would be the same. The Comot level would be the same, Comot IV. All of those things would be the same. Councilmember Koehler Lindsey: Okay, so I would, I would say that it s the pleasure of Council, yeah. I want to hear what you ve got to say if you want me to take it to Job Study or not. President Montrastelle: Mike? Councilmember Goebel: Well I was wondering, Carla, this, none of these funds can come from your Perpetuation Fund, correct? Clerk Carla Hayden: Not for this position because it doesn t fall under the criteria for that. As Council is aware, that Perpetuation Fund is kind of in limbo a little bit right now because, um, three of the five dollars is due to sunset in July. Right now, there s a bill to extend that. Right now it s to That it s gone through, it started in the Senate. It has been to the House. It was approved in the House. It s going back to the Senate with amendments. So, that s still in limbo. So, if those funds drop down to $2.00 a case rather than the $5.00 where they currently are, then those funds are going to start depleting pretty fast. Councilmember Goebel: Do you know what your balance is in that account? Clerk Carla Hayden: Um, I don t have that with me. Councilmember Goebel: (Inaudible comment.) Clerk Carla Hayden: Right now $22,000 a month goes to what used to be called Kinder Access for storage and retrieval of documents.

Councilmember Raben: I would recommend that we stick with our protocol and have the job evaluated and, um, make sure that it falls under the guidelines that it s being requested at. So, I don t know, do we have a meeting scheduled? Do we have anything? Councilmember Koehler Lindsey: We do not have a Job Study meeting scheduled currently. So, it would, it had, I guess it would have to then come back next month. So, I don t know what the timing is on that. Sarah, when do you think? Unidentifiable person: (Inaudible comment.) Councilmember Koehler Lindsey: Yeah. Uh-huh. Counselor Ahlers: What s the, what s the time table here? I mean can you? Clerk Carla Hayden: Well, they would ve like to have it a month ago. But, but right they re, they re holding off. There is one piece of the technology puzzle that they re still having to put together for that, for that program. Councilmember Koehler Lindsey: Okay, and do we know of any, um, grants or any other funding if this is being requested by the Courts? Is there anything in their funds that could be put towards this in any way? I just kind of spit balling to see how we could Clerk Carla Hayden: And, I don t know what funds they have available to them. The one thing that I did put in the, in my letter, was that with e-filing, it s possible that down the road here that I may be able to reduce my staff through attrition at a later point. Right now, it s so influx and something changes every day that I can t necessarily offer up somebody saying that, that I ll have somebody immediately. Um, as an example, we, we went to e-filing, which means we don t have to file away papers and everything any more. We went to e-noticing today and we had 1,200 notices that had to be folder and put in envelopes. Which is something we didn t used to do. So, for where we re dropping off on work in one area, we re picking it up in another one. So, until that shakes out and settles down, I don t know necessarily what I have. Councilmember Terry: You also, you mentioned in your letter about the, I guess the possibility of moving a position into the Perpetuation Fund? Clerk Carla Hayden: That, that was another position in my office, it s the Archivist. Because, I had been asked if there was somebody I could potentially pay out of that Fund and that would be the Archivist. Now, if we could hang on to the funds and everything I may be able to offer that up, but again, that s something that s in flux and if that drops to $2.00 then those funds are going to pretty fast. Councilmember Goebel: Then we ll hope for the best. But, I concur with Councilman Raben, I think it should go to Job Study. President Montrastelle: (Inaudible comment.) Councilmember Raben: Yeah. President Montrastelle: I have, I also agree with Councilman Raben. Why don t we follow that procedure and I think as soon as you can call a Job Study meeting. Perhaps this month? And, you know, as soon as you can and we ll follow that procedure. Clerk Carla Hayden: Someone will have to help me that process because I ve not been through that one since coming in. Councilmember Koehler Lindsey: What s that? Unidentifiable person: (Inaudible comment.) President Montrastelle: Do we want to vote on going to? Okay. And, did you second, Mike? Okay. (Motion approved 7-0) PROSECUTOR REQUEST TO FILL VACANCY FOR DEPUTY PROSECUTOR President Montrastelle: Next up is our Prosecutor who has a request to fill a vacancy for a Deputy Prosecutor. Nick Herrmann: This is an existing position. Someone that left the office. I m just asking to fill it. The person coming in can start I believe on the 17 th of April if the Council allows us to fill the position. Councilmember Raben: positions? How does that rate fall with the other Deputy Prosecutor Nick Herrmann: What s that? (Inaudible comments.) How does the rate fall? Councilmember Raben: Uh-huh. Nick Herrmann: Um, it falls, um, about a Step 3, I believe. So, about anyone with 5 years experience. Councilmember Raben: (Inaudible comments.) Nick Herrmann: Yes, it s an unclassified position. Councilmember Raben: (Inaudible motion to approve. Did not have the microphone on.) President Montrastelle: Okay. Councilmember Koehler Lindsey: Inaudible second. Did not have the microphone on.) 7 Page 7 of 38 COOP EXENSION REQUEST TO FILL VACANCIES FOR 3 4-H SUMMER ASSISTANTS President Montrastelle: Next up is COOP Extension of Purdue University to fill vacancies for three 4-H Summer Assistants. Randy Brown: I m Randy Brown with Purdue Extension. This is something we do every year. We hire college students to work for us during the summer. They work 12 weeks and we ve got money in line item to pay for them. President Montrastelle: You have what? Randy Brown: We have money in our line item to pay for them. President Montrastelle: Right. Councilmember Goebel: I ll move approval. Councilmember Terry: Second. President Montrastelle: All those in favor say aye. All Councilmembers: Aye. President Montrastelle: Those opposed? (Motion approved 7-0) WEIGHTS & MEASURES REQUEST TO FILL VACANCY AND RECLASSIFY President Montrastelle: Next up is our Weights and Measures request to fill a vacancy and to reclassify. And, we have, honored to have Commissioner Ungethiem and Commissioner Shoulders with us today. Commissioner Ungethiem: Good afternoon. Commissioner Bruce Ungethiem. Last night the Commissioners voted to move Jacob Murphy from his previous position as the Director of Burdette Park on a cross training assignment over to Weights and Measures. And, what we are asking here is that, as a part of that move, that we attempt to get Mr. Murphy rate retention from one position to the other. And, in order to do that, we need to adjust the position classification and the salary range. So, that s what this is, what this request is. President Montrastelle: Okay. Angela? Councilmember Koehler Lindsey: Thank you. Same question, different department. Is this; would this need to go to Job Study since we are reclassifying a position? And, I assume this is going to also be an increase in the current salary? Councilmember Raben: His position is already has a, it s factored, it has a job description written. Councilmember Koehler Lindsey: It has a job description? Councilmember Raben: Yeah.

8 Page 8 of 38 Councilmember Koehler Lindsey: I didn t know since we re going from Pat to Unclassified how that works. Councilmember Raben: I know we only have two Commissioners here today, but both of you are in support of this request? Commissioner Ungethiem: Yes. Councilmember Raben: Okay. Councilmember Terry: Has he accepted the position? Councilmember Goebel: What is the difference in the salaries? Does anybody know that we re asking? I mean Loretta did Councilmember Raben: The old salary was about $16,000 or maybe higher more than this salary. (Inaudible comments.) Councilmember Shetler: I think the past person was paid at about 64ish. Commissioner Ungethiem: Yeah. Councilmember Shetler: And Commissioner Ungethiem: Almost $65,000. Councilmember Shetler: That s because of seniority. Commissioner Ungethiem: Right. Councilmember Shetler: And, basically even though this position calls for about 48, 49? Commissioner Ungethiem: According to the seniority level, I think it was about $48,000, yeah. Councilmember Shetler: And, we re looking at setting it at $53,000. We re looking at setting it at $53,000. Councilmember Raben: It s a little over $12,000 savings. Councilmember Shetler: Yeah. Commissioner Ungethiem: From the previous... Councilmember Raben: From the previous Councilmember Koehler Lindsey: Okay. President Montrastelle: And, and Councilmember Goebel: So, it will match his old salary at Burdette, but not Commissioner Ungethiem: Not the current salary. Councilmember Goebel: Okay. Councilmember Koehler Lindsey: Correct. President Montrastelle: And, you re asking for it to be unclassified so there wouldn t be step increases until, until Commissioner Ungethiem: Until they get caught up. President Montrastelle: Until they catch, he catches up. Commissioner Ungethiem: Yeah. President Montrastelle: Yeah. Commissioner Ungethiem: In a previous life, we, I worked for a company that did this quite often. They would, they would, they promoted cross training opportunities and when

9 Page 9 of 38 the salaries didn t line up, we would, we would allow people to go over to range, to obtain rate retention, but you would stay at that rate until you caught up to where you were, where you should have been. And, then you move forward. President Montrastelle: Okay. Councilmember Koehler Lindsey: Okay. That s what I was going to ask if it was going to stay the same. So, cool. President Montrastelle: Anybody? Councilmember Koehler Lindsey: I will make a motion to approve. Councilmember Terry: Second. President Montrastelle: Very good. Let s have a Any other questions? Commissioner Shoulders: I think it s subject to this. Commissioner Ungethiem: It s subject to this, but, um, we have, um, discussed it with Mr. Murphy and he has accepted it, yes. Councilmember Koehler Lindsey: Um, Mr. President? President Montrastelle: Yes? Councilmember Koehler Lindsey: One other question then, um, so, has paperwork then, I m going to assume paperwork has not been filed yet with our office? But, once this goes through then all of that will go into motion? Commissioner Ungethiem: Yeah, my understanding is, once we follow this process, then the paperwork will follow in behind it. I for one am happy to keep Jacob on the County books. He s a good employee. He s done us well at the, at Burdette Park. Commissioner Shoulders: Thank you. (Motion approved 7-0) JAIL REQUEST TO CREATE POSITIONS FOR 16 CONFINEMENT OFFICERS AND 6 SUPERVISORS President Montrastelle: Okay, next up is our Sheriff. Sheriff, Dave Wedding come on up. The Sheriff s got a request to, to, for 16 Confinement Officers and 6 Supervisors. Sheriff Dave Wedding: Okay, well as everybody knows, I, I mailed or sent electronically a letter on March 9 th advising you of my intentions to seek 16 Confinement Officers and 6 Supervisors for the Vanderburgh County Jail. We know that when we built the Jail in 2005, we were short of staff. We lost another seven Confinement Officers throughout the years to lack of funding because they were paid out of a User Fee Account, which is no longer there. We ve had multiple job staffing analysis conducted by two independent sources and they both recommended that we have additional staffing to make the Jail safe. Not to have fluff. As a Sheriff, I think I owe it to my staff and inmates inside the Jail to have the adequate staffing to run that place adequately. And, right now we certainly aren t doing that. So, um, we ve talked about it and we talked about it. I know this has been informally discussed for years, and, it s not gone anywhere. So, I m just going on record now, in the event something was to happen, and then I m on record showing I need this and I m formally requesting additional staff to make that place adequate to work. President Montrastelle: Sheriff, I know this past week you were up at the State House, you met with the Governor and some Senators and some Representatives, and your trying your dangdest to seek funding from that level to help us down here in Vanderburgh County. Um, can you give us a feel for, um, what they re telling you? And, how, what they, perhaps can do for us? Sheriff Dave Wedding: Well I think we re making very small inroads into securing funding. I know with the Attorney General and other people around the Country, they re talking about getting tougher on crime. Getting tougher on the drug users, drug sellers, the heroin epidemic. If you get tougher on all these people, they re going to land in my Jail. So, often times you hear the sexy part, that we re going to go out and arrest, we re going to get tough on crime. But, if you make these arrests on serious crime, then they have to be lodged somewhere and that s going to be in an overcrowded jail. I support getting these heroin dealers and getting these other violent criminals off the street. We are in a situation where we re overcrowded, under staffed. We met with multiple people at the State. I ve got a group of Sheriffs that are going to continue to go to the State House. We ve got a meeting with the Department of Corrections Commissioner. And, we have another meeting with the Attorney General, which he likes to talk about fighting crime. I don t know how much influence he has on securing dollars for local government. I was told that he s a good man and I like talking to him. But, I just don t know what his power is to generate funds. President Montrastelle: Who is that again? Sheriff Dave Wedding: I think it s Carter* is his name. The Attorney General.

11 Page 11 of 38 President Montrastelle: Okay. Sheriff Dave Wedding: Um, and he s a newly elected Attorney General. He has spoken with the Sheriff s Office several times. And, he seems to be pro-law enforcement. But, they said they don t know if he has the power to secure the funds for law enforcement. President Montrastelle: Angela? Councilmember Koehler Lindsey: You re a brave man. And, we appreciate your hard work. You know, just running the numbers, if, it so stressful to sit up here because we all know that we need, we need what you re asking. We all know that, that what Carla just came up and ask for is much needed. But, the reality, the harsh reality that we re faced with is $5,900 was left over at the end of last year. And so, today we ve heard a request that is, you know, twenty something thousand dollars, whatever it s going to cost for Carla s position and now $1.8 for this. So, I, it, I, I don t know how we d make the math work. I mean I m just a music teacher and I can only count to four. But, um, we re going to really have to put our heads together to figure out what to do to make this safe. And, I would, I guess maybe, we ve got the newspaper here and TV that just plead to all of us to continue to work together. Our state people and we ve got to figure out a way to alleviate this problem. We don t have the funds here in the County to do it. So, we got to, we got to figure something out. Sheriff Dave Wedding: What we don t need is for the Federal Government to come in and tell us how to build a Jail and staff a Jail. Lake County now a 200 guards guarding less inmate than Vanderburgh County. So, we don t want to foot that bill. Councilmember Koehler Lindsey: Right. Sheriff Dave Wedding: And, and I think if we keep tinkering with this, we can eventually get into a state of somebody coming in and telling us how we re going to build. And, then they ll tell you to fund it. And, you have no choice. So, I m just saying we need to be moving forward somehow or another. And, I will continue to battle. And, I plan on making many trips to the State House because I think there is funding in Indianapolis to help us get out of this dilemma. We just have to convince them to maybe shift funds from certain programs to local jails and (inaudible comment). We re not the only Jail in Indiana with a problem. There s about five or six that have horrendous jail over-crowding. Marion County being one of them. Vigo County being one of them. And, they ve got inmates housed everywhere. President Montrastelle: Councilmember Goebel? Councilmember Goebel: With your speaking with the State Officials, I know you ve gone up and we ve had meetings here, what is your sense? Do they care? Sheriff Dave Wedding: Well I mean, we get a reasonable reception until we start talking about the money exchange. Then everybody kind of backs away. But, but I think our talks are progressing. And, I think if we keep and, I think the Senate members and the House of Representative can also help because they will work with the Governor and the DOC. The Governor is over the Department of Corrections and if we can get with him and have him address the funding issues. Councilmember Goebel: I don t know what the legal description of a county jail is compared to a state prison? Is there a difference? Sheriff Dave Wedding: There s, there s a tremendous difference. A county jail is a short term housing facility that s normally for minor crimes or transient criminals. And, that s in the Black Law Library. Now, a prison is where we send sentenced felons. Back in the 80 s we sent, sentenced misdemeanors to the Indiana Department of Corrections. And, they decided against that. And, so they told local Sheriff s Offices to hold sentenced misdemeanants. With the House Bill 1006, now we ve been asked to house level 6 felons. And, I was talking to the Commissioners earlier today and I, I would like to see the Department of Corrections give us a least one time capital improvement expenditure to build on to house their prisoners. They re not Vanderburgh County prisoners, these are people that are actually sentenced to the State Prison that they ve deferred to us. And, right now it s at or near 100. We could house them if they would give us capital. And, I m

12 Page 12 of 38 also seeking to the per diem for inmates from what it was 30 plus years ago to today s dollars which help us offset the cost of running the Jail. President Montrastelle: Sheriff, who did you, who did you Councilmember Goebel: You know this would President Montrastelle: I m sorry. Councilmember Goebel: this would be extreme perhaps, but since the State is mandating we hold state prisoners in our County Jail, is there any legal recourse we might have from the County level? I m not talking, hope not lawsuit, but something like that. Counselor Ahlers: Recourse in terms of? I mean, we get reimbursed. Councilmember Goebel: Suing the State. Counselor Ahlers: Well, I mean we get paid for prisoners that we house that are Councilmember Goebel: 35 bucks Counselor Ahlers: from the State. Councilmember Goebel: doesn t cover it. Counselor Ahlers: Well, I think it does, doesn t it? Councilmember Goebel: They re clearing money on every prisoner we hold. Sheriff Dave Wedding: Right. Counselor Ahlers: Well, well, let me say this, I don t... Councilmember Shetler: Yeah, (inaudible comment) anyway. Counselor Ahlers: I don t think you want to ask me a legal question on the record, but I think the State has the authority to make laws and Sheriff Dave Wedding: Right. Counselor Ahlers:...they are what they are and they re paying what they re paying. So, you know, absent Sheriff Dave Wedding: Well, to go with your question, there s no definitive number that says it costs this amount because we re not, we re housing boxes at $4.00 a box. Each inmate presents a different cost based on their need. If you have a very compliant inmate, very little cost. If you have a non-compliant inmate, it s a tremendous cost. Um, I ve spoken to some Sheriff s in Indiana that have had to send their prisoners to the Department of Corrections for safekeeping or special needs. And, they re charged anywhere from $53.00 to $ per day for the Department of Corrections to house their prisoners when they re doing them a favor. So, it s, it s, it s a shell game, I guess. No one can put a number exactly what it costs. Senator Vaneta Becker, she said that she was told by the Department of Corrections that it costs them $20,000 per year to house a person in the Department of Corrections. That s approximately $54.00 per day. And, but, now a smaller jail and often times they house inmates at the $35.00 a day and they make money. You know, Henderson County is a prime example, they charge more, but Henderson County is almost self-sufficient holding other peoples prisoners. Councilmember Raben: Yeah, but not with debt service. Councilmember Shetler: Yeah, debt service is another 12 bucks. Councilmember Raben: $35.00 a day covers your staff and meals. Councilmember Shetler: Right, right. Councilmember Shetler: Right. Councilmember Raben: Maybe pays your light bill. But not your debt service.

13 Page 13 of 38 Sheriff Dave Wedding: Right. Councilmember Raben: Um, I had a question and we re not going to decide anything here today. And I, and, I do want to congratulate you or at least thank you for forward thinking and taking the case to the State. Um, and I hope that a lot of other Sheriff s are rallying behind you. So, great job on that. Um, but, this would average out on these 22 at about $82,000 per Correction Officer. And, I m not sure that that s accurate because I looked, and your average is probably plus benefits. I mean Sheriff Dave Wedding: Right. I Councilmember Raben: probably and we (inaudible comment). Sheriff Dave Wedding: We figured around $50,000 per Councilmember Raben: Yeah. Sheriff Dave Wedding: employee. Councilmember Raben: Um, let me ask you this, one thing, you know, as we come, as we continue to have this dialog, one of the things, you know, we ve got $400,000 budgeted in just overtime for Correction Officers for We, usually late fall, end up adding more to that. Sheriff Dave Wedding: Yes, we do. Councilmember Raben: Um, why don t you look at how many people we could bring on and reduce our overtime. Let s cut it back to less than 45 hours. How many people would we need to realize the savings in overtime? And, how many people would that buy us? I mean, it s possible that we could add overnight 12 people. Eliminate our overtime completely. And, you know, so we re not looking at $1.8 million. Councilmember Shetler: Right. Sheriff Dave Wedding: Right. Councilmember Raben: So, you know, again we re not going to decide this today. And, I know you don t want us to. You re not expecting us to. But, if you could get back with us on some of that? And, you know, that, that makes all this a little easier package to Sheriff Dave Wedding: Sure. Councilmember Raben: to understand. So, or support... President Montrastelle: Councilman Shetler? Councilmember Shetler: Yeah, I agree totally with James. That s the way we need to go through that approach. If we could figure out a way take that, because we ve got to, I mean, we re basically at about $48 million. I think, a few years when I started, we were at $52 million in the General Fund and it s down into that $48 million. So, we ve done our job here of reducing down to what the State is, to use your, handcuffed us Sheriff Dave Wedding: Right. Councilmember Shetler: that we can t raise taxes. We can t do anything much more than what s being done today. I mean, we re, we re really at the limit of being able to raise the money we can. So, we either have to cut, if you want to hire 19 people or 22 people, whatever it is, then we have to go over and cut 22 people off Sheriff Dave Wedding: Right. Councilmember Shetler: somebody else. Sheriff Dave Wedding: Right. Councilmember Shetler: It s that kind of give and take. Sheriff Dave Wedding: And, and, but I m not here asking

14 Page 14 of 38 Councilmember Shetler: Overtime is a good way of looking at it. Sheriff Dave Wedding: for the money. Councilmember Shetler: Right. Sheriff Dave Wedding: I know it s not in our pocket. And so, I m Councilmember Shetler: Right. Sheriff Dave Wedding: just bringing the problem Councilmember Shetler: Right. Sheriff Dave Wedding: here so we can work on a solution. Councilmember Shetler: So, I mean, I, again Councilmember Raben: He wanted to make sure we hadn t forgot. Councilmember Shetler: Yeah, just like everybody else has said, you know, you ve been the cheerleader Sheriff Dave Wedding: Right. Councilmember Shetler: for us at the State level to undo the handcuffs a little bit so we can find other sources of revenue to get the job done. Sheriff Dave Wedding: Right. Councilmember Shetler: The other thing, though, that, um, I, I point out here is that, um, today with, you know, the funds as tight as they are and stuff, I think James brought up an excellent point. And, you know, if we can find other places that we are spending money that we can take out of or reduce quite the overtime. That s a good simple way of doing it. And, I think, I don t know about 12, but we could at least, I think you could come with 8 Sheriff Dave Wedding: Right. Councilmember Shetler: pretty easily out of that. Councilmember Raben: I don t have our true spend for the last two or three years, but just what s budgeted before we appropriate, more, you can probably afford 8 Sheriff Dave Wedding: Yeah. Councilmember Raben: if we eliminated overtime. And, and Councilmember Shetler: Yeah, we ll, we will probably need something in there, maybe $100,000, or something. Sheriff Dave Wedding: Right. Councilmember Shetler: But, I would say that s a major way of Sheriff Dave Wedding: And, we ll investigate that and find out that we re averaging in the last 36 months in overtime for Jailers. Councilmember Koehler Lindsey: Sheriff, do you want to just hold this or you know Sheriff Dave Wedding: I don t mind you saying no. I didn t expect this to be agreed upon today. I just want to be on record, in the event that something happens at the Jail that I have not set back and been indifferent to the problem. Councilmember Raben: And, we don t Sheriff Dave Wedding: I owe it to everybody to address the problem. Councilmember Raben: And, we don t want to be on record saying no. So

15 Page 15 of 38 Councilmember Koehler Lindsey: I don t know, I, I Councilmember Raben: from a legality standpoint, we don t. President Montrastelle: No, we don t. I agree. Councilmember Raben: So, let s come back. We re going to Sheriff Dave Wedding: Right. Okay. Councilmember Raben: continue this dialog is how we re Councilmember Koehler Lindsey: Well, I don t know there might be some validity to us just saying no we can t afford it. Sheriff Dave Wedding: Right. Councilmember Koehler Lindsey: But, um, I get where you re going. So, um, I would say come back in a month. Sheriff Dave Wedding: I don t know what, what your peoples position are with our Legislators because I m telling you there is several $100 million in Indianapolis that they re using for Community Corrections based programs. And, and in my opinion as a Sheriff, they re pulling the cart before the horse. You know, we got a house on fire and they re teaching fire prevention. We need the firetruck to put the fire out. And, I don t know who has the leverage to talk to some of these Legislators. To get to the Governor s Office and say we need to earmark this money appropriately. Because, even though on the Level 6 felons, and as a Sheriff, I think the State owes to us to send us capital money to build a wing on the Jail to house the prisoners. I don t know how we could collectively combat that with them. Councilmember Raben: Do you want to come back next month? Is that too early to come back with some of these other Sheriff Dave Wedding: Oh yeah. Councilmember Raben: recalculations? Or Sheriff Dave Wedding: We can do it. Councilmember Raben: Yeah, let s, let s keep this dialog alive. And, again thanks for all you re doing trying to Sheriff Dave Wedding: Well, I appreciate the work my Council does. You ve been very good to me while I ve been the Sheriff. So, I m just bringing a problem, I ve told my Jailers years ago that I would fight for them, they re kind of complaining about all of the long hours. The 16-hour shifts. And, it is kind of tough having a woman with a newborn baby trying to leave at 10:00pm at night and we make her stay until 6:00 and they come back at 2:00pm. That s tough. President Montrastelle: Yep. Councilmember Raben: You know, um, one last comment, the other thing is, is there any, is there any way at all, and I know your woes with trying to keep your staff, that you re allocated today. Is there any way or is there anybody you can put that s purely just talent acquisition or something that to try to keep your, what are you allowed? Ninety, is it eighty-nine or ninety? How many Corrections people Sheriff Dave Wedding: Our total staff is 95. Councilmember Raben: But, you usually run around 80, I think. Sheriff Dave Wedding: Yeah. Councilmember Raben: You ve usually got a dozen vacancies. Sheriff Dave Wedding: We ve hired 17 this year already.

16 Page 16 of 38 Councilmember Raben: Vacancies? Sheriff Dave Wedding: We ve hired 17 to replace Councilmember Raben: Yeah, but, that would be helpful if you could just maintain closer to that 90. Sheriff Dave Wedding: Yeah. Councilmember Raben: And, that would reduce the overtime automatically. But, okay. Alright. President Montrastelle: Okay, thank you Sheriff. Sheriff Dave Wedding: Thank you very much. Councilmember Koehler Lindsey: So, does this just get held? President Montrastelle: We re going to, it ll just Councilmember Koehler Lindsey: It ll just continue until next month? President Montrastelle: Moving on. It s alive. Councilmember Koehler Lindsey: It s still alive? Okay, I just wanted to make sure of the proper procedure. HIGHWAY REQUEST TO VACANCY FOR TRUCK DRIVER President Montrastelle: Next up, we ve got our Highway request to fill a vacancy for a truck driver. Councilmember Raben: I ll move approval. Councilmember Raben: Let s a President Montrastelle: Do you want to talk a little salt? Councilmember Raben: Yeah, we. President Montrastelle: Come on up Scot. Councilmember Koehler Lindsey: Yeah, we should talk this so we don t get caught up (inaudible comment) and do it by again. President Montrastelle: I know you, I know you ve given the Commissioners just recently, um, an update on that. Because Bruce, Mr. Ungethiem and I ve Scot Wichser: Yes. President Montrastelle: been talking. But, do you want to speak to that a little bit, please?

17 Page 17 of 38 Scot Wichser: We had the, we had the salt bid come up, I think it was week or the week before. We requested 1,300 ton. Being so, if we take 80%, we re only looking at about a 900 and some odd ton. If we get a really bad winter, it ll be around 1,500. So, we had ordered 2800 the year before. So, you can see we re less than half. President Montrastelle: Uh-huh. Scot Wichser: And, we just ordered that little extra to just in case because President Montrastelle: Uh-huh. Scot Wichser: you never know. Next winter we could have snow every weekend. Then we ll be sitting with nothing. So, we re keeping the same amount of salt we always try to keep... President Montrastelle: Uh-huh. Scot Wichser: on hand. Um, around 4,000 tons is what we ve always tried to keep available. Councilmember Raben: But, we ve never been that high. But, I mean, we spread this year with a wheelbarrow probably what we spread. Scot Wichser: Well, we, we ve, we were a little bit more than what people think. I mean, we had that one when we had everybody out there a few times that they, we had a few flurries, slick spots. We go out, we have to hit the bridges. We have to, you know, there s a little bit more even though you guys climb in your vehicle and take off and the roads look fine, we still got to be out there looking for slick spots, bridges and anything else. So, we all, we do put some down that people don t even realize. Councilmember Raben: So, how many tons did you spread then this year? Scot Wichser: How many tons did we spread? Councilmember Raben: Yeah. Scot Wichser: Probably around 900. Councilmember Raben: Wow. Scot Wichser: If that much. You know, I don t have an exact total right now because I m working on that. Councilmember Raben: Why I do know, I think, I do kind of remember like 2,800 is what we approved for last year. And, there was salt on the ground with that 2,800. Scot Wichser: Well, we Councilmember Raben: was where that 2,800 arrived. Scot Wichser: Well, our main barn was almost totally empty. Councilmember Raben: How many, how many tons are on the ground now? Scot Wichser: Right now we ve got about 3,000. So, if I take the minimum of 80%, that ll put us right at the 4000 ton total. President Montrastelle: How about beet juice? I know you ve put beet juice down this year. How much have you used of that? Scot Wichser: Um, well we used, um, we used more of that probably then the salt because President Montrastelle: Yeah. Scot Wichser: we went out and treated bridges and roads and stuff because they would call for something. So, we would go out and treat the roads. Plus, we do treat salt with it also.

18 Page 18 of 38 Councilmember Raben: We would have spread 25% of our inventory and Scot Wichser: Don t take me on that number because I really don t have a hard number yet on that. Um, this time of the year I sit down and look at the past winter and kind of do my figures. And, I just haven t got everything put together yet. Councilmember Raben: Well, I know, I would just exercise caution. Money is tight. I d rather spend it, one thing for sure, we ve got pot holes. And, we need to consider every dime we ve got to fix the roads and pot holes. And, it s kind of funny that we re talking about salt. The most destructive thing to the roads. Um Scot Wichser: Well, one of the things we do do Councilmember Raben: So, we can spend more to tear up more, but Scot Wichser: One thing we have done, we treat, we re treating our salt with the beet juice. And what that allows us to do is, it burns hotter. We don t have to use as much salt. So, doing that should cut, helps cut the usage of salt when we have an event. Because salt with quit, slowly start working at around low 20 s to 20 decrees. And, once you get down in the teens and lower, it almost stops working. So, when we treat the salt, it will work 24 hours a day no matter what the temperature. Um President Montrastelle: Councilman Kiefer? Councilmember Kiefer: Yeah, hi Scot. Um, question, um, does the salt or the beet juice, does it, do you lose any value like if you had a ton of salt, does, at the end of one year, do you have some loss from that? Like, just from naturally Scot Wichser: Normally not much at all. As long as keep it covered. Councilmember Kiefer: Okay. Scot Wichser: If, if we keep it covered, keep the rain off of it. If it gets rained on all year, you re going to get some, you know, you take salt and you wet it, it s going to Councilmember Kiefer: Yeah. That s what I was getting at if you had much loss from it. Scot Wichser: But, we ve got it, everything we ve got at the, at the shop right now is under cover. Councilmember Kiefer: Okay. And, then the beet juice, does it lose any potency? Scot Wichser: No. And, we ve got storage tanks for that. Councilmember Kiefer: Great, great. That s all I was wanting to know. Thanks. President Montrastelle: Scot? Scot Wichser: We re looking at ways to try to save money on this type of thing. We re always looking at new technology too. To try and help us out. President Montrastelle: Very good, Scot.
