1 PLAINFIELD TOWN COUNCIL November 28, :00 p.m. Mr. Brandgard: The Plainfield Town Council meeting for Monday November 28, 2016 is now in session. PLEDGE OF ALLEGIANCE Mr. Brandgard: I would like to ask everyone to rise for the Pledge of Allegiance. ROLL CALL TO DETERMINE QUORUM Mr. Brandgard: Please let the record show that all members are present and we have a quorum for conducting business. Before we get started I would like to welcome class from the Urban Structure and Policy class at IU is that a graduate program? Undergraduate. I would like to welcome you here and hopefully you will find it interesting here and you will come back. We enjoy having people out in the audience. Thank you for coming. CONSENT AGENDA Mr. Brandgard: We will go to the consent agenda, we have a few items on the consent agenda. 1. Approval of the Minutes of the Town Council meeting of November 14, Approval of reports from the Town Engineer, Fire Chief, Director of Parks & Recreation, Director of Planning, Town Court, Human Resources and the Town Manager, and the Director of IT all dated November 22, Approval to authorize the Town Council President to execute settlement agreements or other documents necessary to pursue acquisition of sewer easements related to the construction of the West Fork Interceptor Sewer project, per the Town Engineer s report. 4. Approval to enter into a sewer cost recapture agreement with Ron Endres, subject to finalization of costs and legal review of a final agreement, per the Town Engineer s report. 5. Approval of Change order #3 to the Town s contract with Rieth-Riley for the reconstruction of the intersection at Main St. and Ronald Reagan Parkway, adjusting unit price quantities of multiple contract items resulting in a reduction to the contract amount of $7,107.91, per the Town Engineer s report. 6. Approval to partially release retainage in the amount of $35, to Rieth-Riley for work associated with the reconstruction of the intersection at Main St. and Ronald Reagan Parkway, per the Town Engineer s report. 7. Approval of the Parks & Recreation Department Refund Policy, per the Director of Parks & Recreation s report. Mr. Brandgard: Are there any additions or corrections to the consent agenda? Mr. Bridget: Mr. President, regarding the minutes of the last meeting I would like to request a change on page 3. Mr. Culver of Crossroads Engineering was requesting that we vacate an easement and the only question I had was is Tim was satisfied that the easement was empty, he did say that he was satisfied and I would like to see that reflected. 2 BID AWARD Mr. Brandgard: Do we have a bid award this evening from the Water System Automatic Meter Reading (materials only) Mr. Beicher: We do have a recommendation, we received a bid at the last meeting, the low bidder was E.J. Prescott Company in the amount of $1,945, and the recommend of the award is to that company. Mr. Brandgard: Thank you. Mr. McPha±1: So move. Mr. Kirchoff: Second. Mr. Brandgard: The motion is second to approve the committee report to award the Water System Automatic Meter Reading (materials only) contract to E.J. PUBLIC HEARING Mr. Brandgard: We have a public hearing scheduled this evening for Resolution No Do we have proof of publication? Mr. Daniel: Yes we do. Mr. Brandgard: We have a public hearing for Resolution No A Resolution Preliminarily Designating Economic Revitalization Area and Qualifying Certain Personal Property for Tax Abatement- MD Logistics, Inc., MD Express, Inc., and MD Packaging Services, Inc... Again this is a public hearing is there anybody in the audience that wishes to address the Council on this matter? Again this is the opportunity for the public to give comment to Resolution No Nobody coming forward we will close the public hearing and deal with this at the proper time. BUSINESS FROM THE FLOOR Mr. Brandgard: We will go to business from the floor. I think James Dolan from Vincennes University is here. Mr. Tucker: Good evening Council my name is Dave Tucker I am Vice President for Workforce Development and Community Services at Vincennes University. behalf of the administration at VU, particularly my boss President Chuck Johnson. We thank you very much for the partnership that we had with the Town for the last 5 years, it is hard to believe that it was a little over 5 years ago that we were here in front of this group to talk to you about our plans for logistics and training and education center that we finalized and built and have been in at least in our view, very successful at over the last 5 years. We wanted to come back and talk to you about where we have been, where we are now, and where we plan to go in the future. I am here to introduce James Dolan the Director of Logistics at the center. On Mr. Dolan: James Dolan with Vincennes University. We occupy space I like to refer it to the Banning Engineering building, then eventually we will refer to it as the Logistics Training and Education Center. It was April 11, 2011 the last time President Helton, Dave, and myself were here talking about bringing a program here to central Indiana, more specifically bringing it to Plainfield. So I would like to talk a little bit next minutes about the past, present, and the future of what we see logistics looking like. So those of you that don t what VU L Tech is, it is a Logistics Training Education Center so we are committed to hands on training and we are committed to hands on training, we are committed to the logistics and supply chain so obviously when we started there was about 33 million square feet of light manufacturing distribution space, we are approaching 40 million just in the Town limits here. so we focus on hands on training, we have classroom instruction but we work on a blended working environment for those of you that haven t been out here, I invite you out come to our 30,000 square foot warehouse, it is a training and education center. Here is some of the programs that we teach up there. Everything from your basic fork lift certification through a Class A CDL, team lead essentials training all the way through our associate s degree, our academic certificate as well as our newest program our warehouse distribution essentials. I would like to talk with you a little bit about where we started back in 2011, we came to the Town Council, and you graciously approved $100, a year over 5 years and allowed us to put a flag here in Plaint ield. We opened up in January of Plainfield Town Council

3 2012, we opened up our 30,000 square foot facility, and we are able then use that money to open our facility to then leverage against other financial institutions. We received a 3 million dollar grant from the Department of Labor that was a capacity building grant that allowed us to bring equipment, bring in facility and to do some renovations to the facility, it really allowed us to make a world class facility out there. Then in 2014 we added some equipment, some RF Scanning technology, lightening picks, some voice pick, all of the technologies that the warehousing distribution industry uses, our students now had access to and were able to use in their training classes. So when they went out to an employer they were competent with that equipment. Continue to expanding we added trucks and trailers, we had TKO wrap 9 trailers for us, you may have seen them drive around. Those are our students, so please give them room. They try to follow the rules but they are learning out there. We got a fleet driving around all of central Indiana and it proudly says on there, Plainfield, Indiana. Then more recently just earlier this year Toyota material handling, Toyota Industrial Equipment, material handling out of Columbus, Indiana we have had a partnership with them for a couple of years since we planted here, they actually now do 6 of their classes at our facility. What that means is that they are bringing folks from around North America and really international to come in and do sales training, book camp training, advance parts training, mechanic training and we also teach a class for them basic skills on warehouse distribution. So we have folks coming in from really around North America coming here to Plainfield staying in Plainfield. I actually 14 of them that started this morning I teach that class so I got 6 of them from Canada and then all around U.S.. So they are here in Plainfield living, breathing and sleeping here for the next 4 1/2 days. So since we opened in 2011 when I started working there with a little over 2,300 students come through the building. I love to say that is outstanding and that is great but Jeff is here in the audience and he can probably tell us there is over 2,400 open jobs in warehouse and distribution just right now, so we haven t even met that need. It is partially because we focus on quality. We want to make sure the students coming out of our doors are capable to hit the jobs but we need a way to expand. Real quick about the funding here that initial $500,000 that we started with, we were able to go the university, we were able to go to the Federal Government, the Department of Labor, Indiana Department of Corrections, Department of Transportation, Department of Workforce Development, so we are able to leverage that $500,000 and almost have 1000* return bringing in about 5 million dollars worth of equipment and staff into the building, so we are very proud of that. So we appreciate you starting us off there. Here is the problem, we ve got a lot of people coming through our doors and there is not enough of a workforce out there, which means companies, are putting in automation, they are putting in advance storage and retrieval systems, and they are putting in conveyer belts. They are getting rid of entry level jobs to put in high skill high wage jobs. Bullet point 2 is very fitting today on cyber Monday, how many of you have ordered something online this weekend and expected it to be delivered this week. It is our warehouses in the local area that have fulfilled that need, so increase in customer expectations, it is not just a dirty forklift in a dusty environment anymore, it is technology so that is our problem. Here is a solution that I think Vincennes University can bring to the table. There is not yet an industrial maintenance for the supply chain program in the State of Indiana, Vincennes University does industrial maintenance for manufacturing, we do that in four different locations around the state but we do not do that for the supply chain. So we would like to bring that here to Plainfield. These are high demand, high wage, and high skilled jobs, high in demand jobs. I have spoken with Walmart.com folks and they have an immediate need and there are other central Indiana and Plainfield companies that have an immediate need in the warehouses so we would like to help fill that need. Just for those of you that maybe are not quite sure what a supply chain technician is, someone who operates, installs, maintains all of that equipment that is in these automated facilities. So this is where we would like to focus. This is where we are proposing we start and I know we have had some discussions with a couple of Council members on what it would take to bring a program like this to Plainfield, our initial estimates were about 2 million dollars to bring a program like this with staff, with equipment, significant investment in equipment, but in discussions there is not really that much of an appetite for that much money and I appreciate that but I believe what it is going to take is for the University to bring this program to be able to leverage funds with Federal Government with other state entities. What we are looking for is an investment of a million dollars that will allow us to bring equipment that would allow us to bring staff, allow us to do some facility modifications, or increase the space to be able to bring more students here to help meet the needs of the employers. 4 snapshot from Bureau Labor and Statistics what the wages are for those skills, you can see entry level and you can see entry level you are approaching $20.00 an hour with a little bit of experience you are at an hour. I appreciate your time and if there are any questions. Mr. Brandgard: Are there any questions for Jeff? Mr. Angle: So you ended with you are looking for an investment of a million dollars. Mr. Dolan: Correct. Mr. Klinger: Let me augment that because this has been an ongoing process over the course of the summer and then I think it was as early as back in the spring when they first came and chatted with us and we started talking kind of about the next steps for VUTEC and they came to us with multiple, Robin and I sat down with them and gave them some ideas and thoughts of what we were hearing from industry and they came back with multiple options in terms of some proposals and I think at some point all of the Council members saw that and I think a couple of Council members had an opportunity to go out and actually see the facility first hand. As we continued that conversation I think mostly consulting with Robin and with Kent we kind of zeroed in on this particular program that this is what we are hearing from our business owners in the area that this where the demand is and where they are having he most difficulty finding skilled labor. So we wanted to introduce this type of program and talking with Robin and Kent we kind of narrowed in on what we thought how the Town might be able to contribute to that and what we came up with was a $500, initial investment plus an additional $100,000 over 5 years, so $100,000 a year over a 5 years so it would be a total commitment of 1 million dollars over a 5 year period with the bulk of it up front to help them trying to get the program established. So that is what we presented to James and David back there and then essentially asked James to come back and make this presentation so that the Council can consider the proposal and talk about how the Town wants to, or whether the Town wants to commit to supporting this or not basically. So that is essentially how we laid it out and I think we have even built it into the budget and into our cash flows already so we have the funding available if the Town was so inclined. Mr. Angle: So James I know you had a certain window there but I have another question. So the initial investment 5 years ago, you have definitely shown the ability to increase that, 1000% right? So what kind of plan do you have for the next investment? Will there be a like kind of matching funding and grants you are going after? Mr. Dolan: Our first step is to talk with the University about what the University would like to do as far as reinvesting or up investing, obviously they are supporting us currently with the general fund. But seeing the increase in students, seeing the increase in tuition that is coming through, we are going to start there and see. I know David has had some discussion with the VP S and the President that will be the first step. The other discussion then talking with some large employers. Toyota already has an appetite to increase the number of training classes that they want to do here in Plainfield, I mentioned they are doing 6 different classes and they would like to increase that with additional industrial maintenance training, technician training and one other course I can t think of the name of it. They already want to come to the table with a larger footprint. Actually our property owner denied them the ability to put up the Toyota logo on the front of our building because we are already at a maximum number of logos on the Ronald Reagan store front, at least on their property, but we would like to look at a way to increase our ability to serve more students. So we are going to start with the University and we are going to talk with other employers and then there is always Angela Daugherty is our program manager here, she helped manage that 3 million dollar grant. She is constantly looking for other state and federal grants to go after equipment and staff and capacity building. Mr. Kirchoff: So you are going to have to have more space? Mr. Dolan: We are currently at capacity with our 2 classrooms we built out, so we jumble classes and have them in the warehouses so we definitely need to add additional classrooms, some additional office space, and additional restroom facilities to be able to support... Mr. Kirchoff: Have you started that analysis? Plainfield Town Council

5 Mr. Dolan: We started discussion with architectural services on what that would take. We are trying to weigh the balance between what it would take to renovate our existing space as well as to take a look at a new space either with our current property owner or with a new property owner. We are not really sure what that looks like yet, but defiantly going to have that discussion. Mr. McPhail: I certainly think it s appropriate for us to continue to build the educational base in Plainfield. Vincennes has done a great job, we ve got some peripheral schools in Avon doing some other things, but they are focused on logistics and that is what we have here and we need to continue to leverage that and to provide for our employer base out there. We spent time earlier in the evening talking about transportation and this is just another piece of the pie and I think they are doing an excellent job up to this point and time and I would like to continue to support them. Mr. Kirchoff: I think it would be a good conversation to have at a work session. What is your timeframe? Mr. Dolan: Our employers are asking us for yes, yesterday. I know Robin asked us 5 years ago. I think the biggest barrier to entry is the equipment, it is a significant investment in the equipment itself in order to be able to train because these models here basic AC/DC motor control sensors, there are trainers that it takes to put a student on that work bench and there is a lead time for that, so if we are going to be able to launch classes in the summer of next year, we need to be having that discussion now. If we are going to be looking at the fall of next year then we got a couple of months. Mr. Bridget: And the availability of qualified trainers? Mr. Dolan: With industrial maintenance we actually don t have a problem finding trainers. Our other 4 locations have a good instructor base. What that looks like here in Plainfield I don t know yet because all the employers are hiring them. Mr. Brandgard: With that said can we put this on the docket for a work session before the next meeting? Mr. Klinger: We can do that. Mr. Dolan: Thank you for your time. Mr. James: Good evening, any questions concerning the ordinance that is before you tonight for the first reading regarding the text amendment to the zoning ordinance to create roof signs for warehouses? Mr. Brandgard: Thank you. Jason, anything from Public Works? Mr. J. Castetter: In Tim s report you might have saw where he mentioned the digestive lid going back on. This week it has actually going on tomorrow and it is going to be lifted at 8:00. We got some wind coming in tonight so it may delay things tomorrow depending how long the wind and when it lays down, but 8:00 tomorrow morning. Also this is the last week for leaves. So if you haven raked your leaves and you are on Monday s route, you are too late. Mr. Brandgard: With the trees hanging onto their leaves longer this year we are probably going to have a leaf problem longer than this week. Mr. J. Castetter: I think as long as we keep having decent weather and no snow we are going to continue, I am going to make sure there is one vac truck and start getting stuff prepared for winter. It will come and we got to get these trucks ready. We will finish out this week, run it all week and make sure that there is a vac available for next week and maybe the week to follow. 6 Mr. Chafin: Just 2 things in my report that I wanted to bring to your attention and get your approval. On one is the annual gift of good health, which is included in my report. It is the annual 25% off coupon that we allow to our residents for a 3 month membership to the Rec Center. Mr. Perona is ready to put that in the Water Line if you are so inclined. the second is do you remember a few years ago Royals Royce approached us about a membership to the Rec Center and we have some challenges. I put a proposal in the report and essentially all that they are going to do is provide a membership for their employees. The price of the membership is dependent upon residency. They are going to provide that to their employees. They are going to give their employees to the option of upgrading that to a couples or a family membership at their expense if they so choose too. The would get the information from Rolls Royce and we would put an account balance due on the account and then invoice Rolls Royce only difference is that we for that which is differently than what we typically do and I just wanted to make sure that you were aware of that and everybody was okay with that. I was glad that this changed to the point where it provides it and I think we have the capacity to handle it, they couldn t give us when they asked an estimate of how many individuals or families that might take advantage of the opportunity who are in the area here but we will keep track of that and we do with the Township and IU Health West so we would be able to report those specific numbers to you. I just wanted to bring that up and make sure that you were okay with us doing a little bit of a change in policy in which we create an account and With that I don t have anything else unless you have any questions. will create a different membership kind of like what we invoice. Mr. Bennett: I will get with Rhonda about the invoicing, I have some questions about that. Mr. Chaf in: Okay, thank you. Mr. Brandgard: Scott anything from Transportation? That was a good announcement last Tuesday afternoon. I was surprised, my daughter-in-law wasn t aware of it until I told her while we were in Gatlinburg. Thank you. Nate, anything? Tony do you have anything? Mr. Perona: I do sir, thank you. First of all one of the resolutions that is on the agenda for your consideration is the confirmatory for the personal property tax abatement for MD Logistics. We have Chad Miller from Katz, Sapper, & Miller who is representing MD Logistics so if you have any questions he would be pleased to answer those for you. Also in my report I mentioned some land from the Hendricks County Commissioners tax sale that may be of interest to the Town. I just wondered if the Council had any questions and if they didn t if I could have consent to go forward and try to obtain those parcels. Mr. Kirchof ft I was comfortable with all of them except I stopped when I look at the property south of the new North Salem State Bank. Mr. Angle: I agree, I am hesitant with that one as well. Mr. Kirchoff: Why would we want that? Mr. Perona: Well, Jason can tell you that we ve received a lot of phone calls on that. Mr. Kirchof ft I totally understand that, but why would we want it? Mr. Perona: First of there is in our comprehensive plan there is a corridor that goes around the Burlington Factory property that is a perimeter road that is of interest to us. This is adjacent to that and would affect our ability to control access into that perimeter road and so that is one reason why we would want that. Again the other part of it is it allows us to clean up something that was left over from the Metropolis problem and... Mr. Kirchof ft If the former manager done a better job. Mr. Perona: I wasn t looking at Lance. But anyway it would allow us to clean it up and we think there is reason to believe that either the current owner of those two strip malls back in there would want to take control of that or North Salem State Bank because it covers their entrance and their exits and if they don t take care of it they won t be able to get in and out of there. Mr. Kirchof ft Then let them take care of it. Then Plainfield Town Council

7 Mr. Angle: Is there any kind of ordinance that gives us authority to force one of the adjoining property owners to take care of it? Mr. McPhail: No, and I think over the years Tim has exhausted every other avenue to correct that problem. Mr. Bridget: I can tell you that strip is heavily used as a connector. Just on the use and availability of it, it should be of interest. Mr. Angle: But it sounds like Tim s worked on trying to get the parcel owners interested in there and they are not. Mr. Brandgard: I think another way to look at this is if we had control of it we could close it. Which you can t do now. Mr. Daniel: Tim can speak to this but I think the problem in the past when Tim was talking to these people is their view is if they do anything there they may end up creating some liability for themselves, so it is a hands-off thing. Where at least as an idea if the Town owned that and had control of it then like Robin said we could do, I mean we may not be able to by ordinance force somebody to take that but at least it puts the Town in a position, before we weren t in a position to say well you can buy it, but there is nobody to buy it from because there is a real question about who really owns it, right now the County owns it through the foreclosure. At least if the Town owned it we would have control of it and have some leverage there to possibly... Mr. Angle: But the businesses have the same right to purchase it as the Town does. Mr. Daniel: No. Mr. Perona: They would have to pay taxes on the property. Mr. Daniel: The problem is and my memory is and I could be all wrong about this Tony. Some of that what they do is they assess that as commercial property. So you will have a little piece of ground there and they may have a $150, worth of taxes owned on it and nobody is going to pay that. The Town can take that at this point in the process and they can waive those taxes so we don t have to pay that, so it makes it where we are able to do that without paying those taxes, where a private property owner can t. So it really puts them in a position. Mr. Kirchoff: So then can we sell it? Mr. Daniel: Sure, absolutely. Mr. Kirchoff: Because if you look at it, it is just a strip in there and we don t own anything else around there. Mr. Klinger: Ultimately that is the intent is that we would then be able to transfer ownership to one of the adjoining property owners. Mr. Angle: So this conversation has been had then? Mr. Bennett: Until we get in control of it, it makes it difficult for anything to move forward. We can take ownership for virtually nothing through commissioners. Mr. Angle: Maintenance and liability. Mr. Klinger: There are costs associated with it. Mr. Angle: Because immediately when people find out we own it, why haven t you repaired it, why isn t it closed, I broke a thigh or whatever that that is going to happen immediately. Mr. Kirchoff: Well what I am hearing you say though is we are going to buy can sell it that is the only way I can support it. it so we Mr. Brandgard: It is much like what we did with that other piece behind McDonald s up there. Mr. Kirchoff: We still haven t done anything with that one. Mr. Perona: Well we are in the process of working on that. Plainfield Town Council

8 Mr. Angle: So why couldn t we have those conversations with now with those property owners and have a plan in place right away. That way it puts us in a position of less liability. Mr. Brandgard: I think you got a timeline of when you can obtain this from the County. Mr. Angle: I m not getting into the weeds too much but I am saying if we buy it today it could be a year before these other parties are interested and we we d have a years worth of maintenance and things to do with this property. Mr. Perona: If this works like the other one we will have year before we even take possession of it. Mr. Daniel: It takes a while to get the paperwork to go. Mr. McPhail: It is a long process. Mr. Daniel: IN the meantime then you can talk to property owners and say we are going to own this and do you want us to close this street or do you want to buy it? Mr. Angle: So I think maybe that was the missing piece, so we are saying that intent is to sell it but didn t hear our plan is it is going to take 12 months and in that 12 month period Tim and Tony are going to speak with landowners and we are going to talk to them about the commitment and what it means so forth and so on. Mr. Daniel: Right. Mr. Klinger: There are no guarantees. There is risk associated with it but that is the intent and we would talk to those adjoining property owners and try to work out a deal with them while we are going through this process of acquiring the property. Mr. Angle: That makes sense. Mr. Perona: Consent? Mr. Brandgard: Consent. Tim anything additional from Engineering. Steve anything from the Communication Center? Brad anything from the Chamber? Mr. DuBois: Sure real quick I just give you a quick update. Last Monday we got the Christmas lights up and hopefully you have had an opportunity to drive up and down and see the new colored lights. I would like to thank Jason and his crew for getting Quaker Boulevard lit. There was some issues with those poles, they weren t reset when they were installed and we plugged all of those lights in Tuesday and Monday night nothing lit up, I was heartbroken. His crew got out there right away the next day and got it all working. We still have a few lights that are out but I think all of the parties that take care of that has been notified so hopefully they will all be lit eventually. That is all that I have. Mr. Bridget: The Quaker man looks great. Mr. DuBois: You like the Quaker man? TOWN MANAGER S REPORT Mr. Brandgard: Anything additional from the Town Manager? Mr. Klinger: I do have a few items. You should have received my written report in the box there. I think the one think I neglected to include in there is that I had a meeting with Zach O Connor who is the Community Liaison for Congressman Rokita. He happened to be in the neighborhood and stopped in and we ended up having about an hour and a half long chat talking about all the great things happening in Plainfield and a couple of projects in particular that we might seek the Congressman s support. So it was nice to be able to sit and meet Zach and start the ball rolling on a couple of items where I think Congressman Rokita could actually be beneficial to helping us move some projects forward. All of you were here for the work session and you may recall that an issue came up as part of the Economic Improvement District that we are trying to establish for the south connector, Cinda indicated a need for a letter or some sort of notice to help maybe move things along with some of the property owners out there, so I would request Plainfield Town Council

9 that the Council grant Robin authority to sign such a letter that will be drafted in cooperation with the Town Attorney, Mel Daniel. Mr. McPhail: Consent. Mr. Klinger: Then finally Joe has mentioned the ordinance that is on the agenda, Ordinance No and I believe it is my duty as Secretary of the Plan Commission to let you know that on November 7, 2016 the Town of Plainfield Plan Commission gave a favorable recommendation to the proposal to amend the Town of Plainfield Zoning Ordinance amending article 7.4 regarding flat roof signs in the 1-2 district. The Plainfield Plan Commission of Plainfield Zoning Ordinance with a favorable recommendation. A copy of the proposal was included in the certified the proposal to amend the Town materials for the meeting. The Plainfield Plan Commission voted 6-0 to make that favorable recommendation to the Plainfield Town Council. Mr. Brandgard: Do we have a motion to approve the Plan Commission s recommendation? Mr. McPhail: So move. Mr. Angle: Second. Mr. Brandgard: Motion is second to approve the Plan Commission s recommendation as described, if there is no further discussion all those in favor signify by aye, opposed, motion carried. Mr. Klinger: That is all unless you have questions. OLD BUSINESS Mr. Brandgard: Kent any old business? Mr. McPhail: Mr. President I have one item that is old for me and it is probably new for you. But I was approached by a citizen, I m going to say 3 meetings back or maybe 4 meetings back concerning an issue with receding and situation when Roadway went through when Hadley Road was improved and the round a bout put in at Center and Hadley and that has been several years ago. He approached me and I did have Jason follow up and take a look at that. The individual called me last week and I told him it was a situation that staff didn t feel like they could address and he is welcome to come and address the Council. He was not here earlier in the meeting but he is here now and I think if Mr. Duke would like to address the Council I would ask that you allow him to do so. Mr. Duke: I actually was here and was considering just waiting, I got to be honest with you, I saw the PowerPoint presentation and I thought that wouldn t take me anytime at all to put something together for you to give you the whole story. But since you brought it up I will go ahead bore you. As you stated the round a bout went in and the widening of the road which I probably benefited from it more than anybody else. I live just west of Angela Court on Hadley Road on the south side. So every time I tried to pull in my driveway I almost got killed by someone coming over the hill. I actually drove through my neighbor s yard on a very frequent basis to the right just trying to keep from getting hit. So it I has been extremely beneficial. However I also have a storm drain on the side of that hill in my yard. Because of that when a truck came in to put gravel in, I used to work for the State Highway when I was in college, so I was a little bit familiar with it, and by no means a civil engineer. However when they dumped the gravel I immediately went out and spoke with the person who I believed to be in charge and I said I think that is too much gravel. He said no it is just right and we got to cover it. So I said okay and I kept an eye on them and then they started spreading it out and I went back out to them and said now I know it is too much gravel, there is just not enough room to put any dirt on top of this. You can t grow grass with a few inches of dirt, you just can t do it. He promised me that my information was inadequate and the new technology there wouldn t be any problem so they put dirt down on top of it and then the sprayed the new grass down, I m sure you have seen that and it took everywhere else and then mine was all gone, every bit of it just washed right down because the angle of my yard is just pretty steep so another guy came out and he said he got it don t worry about it and he came out with a netting that they held it down with and said this will make it all better. It is not blue grass but it is similar and you won t be able to tell the difference and you will like the texture of it better anyway. Instead if you go out to my yard right now you would see of that first 15 or 20, probably 30-40% of it is just brown now, it is all Creeping Charlie that came from that and I have Plainfield Town Council

10 made phone calls for the last 4 years to everyone and I am sure they are sick and tired of hearing from me. Everybody goes out and looks and says yes it is a weed problem. Well the weeds didn t get there, I didn t dream them up nobody planted them except the contractor, but because there is literally I think I have a video I can show you that makes better sense. As you guys are probably familiar you can see that is something that you can push down into the yard, as Mr. McPhail and I were discussing you guys are in the business of politics and you are quite familiar with yard signs for candidates. I couldn t get one in my yard, I haven t been able to get one in my yard since Hadley was done. I can t get what an 1/8 of an inch piece of metal in my grass it is all gravel. Again as you can see every time I try to push that into the ground it just turns, nothing goes down in that ground. My brother in law ran for School Board and I literally had to put it down at the edge of the yard and every time that I do I basically end up putting it in my neighbor s yard on both ends because I can t put it in my yard. So what the solution is to this, I don t know. In a perfect world and obviously it is winter now so it is something that would have to wait until next year, but what I need is somebody to come out an Engineer or somebody who looks at it and can see that I don t want the storm drain to have any problems because there is not enough gravel around it, but if it has to be built up, so be it. I don t think I am being unreasonable I want this to be beneficial for both of us. I just want my yard fixed, whatever the easiest, quickest, cheapest way to get that done so I got some Kentucky blue grass in my yard and the creeping Charlie doesn t take over the whole thing that is all I am asking. I don t want this to turn into something and actually to be honest Mr. McPhail I was going just hold off and just get somebody aside and see if I could avoid taking to talk to Council. This isn t about getting anybody in trouble, it is not about trying to get any money, I just want this fixed. Mr. Brandgard: I appreciate your problem and I don t think any of us can come up with a quick solution but I would turn to Tim and Jason to take a look at that and see what you think happened out there and what we can do to fix it. It appears to have happened when we widened the road and we need to go back and see how we can correct it. Mr. Duke: I appreciate you hearing me out on this. I should have practiced this by apologizing, I apologize for being in uniform, and I am going in immediately I am no way obviously the City of Indianapolis. Mr. Angle: I know it was already brought up once but it is worth repeating that Scott Singleton did a great job with his crew in getting Moon Road open before the Thanksgiving holiday. Not only myself but a lot of my relatives and friends were very very thankful, so thanks again, appreciate it. Mr. Kirchoff: Based on that Scott are there, I know you mentioned Butler, Fairman and others, are there some parties that we should formally say thanks too? Mr. Singleton: You mean more formally than this format? Mr. Kirchoff: Yes I think something in writing. Mr. Singleton: This contractor is Bowen and Reith Riley, the DOC helped out tremendously and all of the property owners were very accommodating, so we can defiantly put something together and kind of identify why the project was successful and who was involved in that. Mr. Kirchoff: That would be great. Mr. Angle: That would be much appreciated. Mr. Kirchoff: Good work. This is an old item and I will report it under that, but I was trying to remember when this came up, but it must have been earlier this year when we only had 2 Council members that could be in town for a meeting if you remember that. By statute we were allowed to open the meeting and were allowed simply to table, remember that? Mr. McPhail: Oh yes. Mr. Kirchoff: Well the discussion came out of that that with technology today should we consider comparing the ordinance that would allow for electronic teleconferencing for those kinds of situations. I think Mel we had some conversation, it probably takes a special ordinance to do that. Mr. Daniel: Well and I haven t looked at that since that time and some time passed. Because there is some problems with state law and that as far as Plainfield Town Council

11 what you can and cannot do. My memory as of then, which I haven t looked at recently is as a matter of state law you cannot conduct business that way under the Indiana Statutes right now, which really needs to be fixed with the technology that we have now and that sort of thing it makes no since, we can hook up people all over the world. The issue was whether they can really be heard by the audience; well that is all not a problem anymore. We will take a look at that and one way or the other that should be fixed. Mr. Kirchoff: If the law needs to be changed then we need to work to try and get that done. That is all. NEW BUSINESS Mr. Brandgard: New business.
