1 TOWN OF PLAINFIELD TOWN COUNCIL September 8, 2008 The Plainfield Town Council met on Monday, September 8, In attendance were Mr. Kirchoff, Ms. Whicker, Mr. Brandgard, Mr. Gaddie and Mr. McPhail. PLEDGE OF ALLEGIANCE CONSENT AGENDA 1. Approval of the minutes of the regularly scheduled Town Council meeting of Monday, August 25, Third reading and adoption of Ordinance No : Heartland Senior Living R-1 Residential District. 3. Approval of the August 2008 monthly reports for the Department of Public Works, Department of Planning and Zoning and the Plainfield Police Department. 4. Approval to make a partial release of retainage on the Ronald Reagan Parkway and CR200S project to Rieth-Riley Construction Company in the amount of $295, leaving a retainage balance of $293, ($588, $295, = $293,007.63) plus any accumulated interest per the Transportation Director s Report dated September 5, Approval of the Parks and Recreation Director s, Town Engineer s and Transportation Director s Reports dated September 5, 2008 and the Human Resources Director s Report dated September 8, Mr. Kirchoff made a motion to approve the Consent Agenda as read. Second by Ms. Whicker. Roll call vote called. Ms. Whicker yes Mr. Gaddie yes Mr. Kirchoff yes Mr. McPhail yes Mr. Brandgard yes 5-ayes, 0-opposed, 0-absent. Motion carried. BID AWARD: Traffic Signals Stafford Road at Airtech Parkway Mr. Brandgard said we also have a bid award to make this evening for the traffic signals at Stafford Road and Airtech Parkway. Do we have a recommendation? Mr. McGillem said yes we do. The committee met and reviewed the bids and the committee is recommending to the Council that we award the bid to Midwestern Electric, Inc., the low bidder for alternate one, 60 day completion time in the amount of $126, Mr. Kirchoff made a motion to approve the recommendation of the committee and award the bid to Midwestern Electric, Inc. in the amount of $126, Second by Mr. McPhail. Motion carried. BUSINESS FROM THE FLOOR None. TOWN MANAGER S REPORT Mr. Carlucci said as I indicated in my report to the Council I was planning and am asking permission from the Town to annex the former Shouse landfill, which as you know the Town of Plainfield owns and is in the process of remediation. It also will give us an opportunity to do additional annexations in the future from that annexation. I think there are approximately 13.5 acres out there but I would still need your permission to go forward. We are the owner of the property. Mr. Brandgard asked, is there consent to move forward? given. Consent Mr. Carlucci said at the last meeting there was discussion about Resolution No , the Multi Modal Transportation resolution of support. I have talked with Phil Wroth who is second in command of the Regional Transportation Council. We had a nice discussion about that! 1

2 and I also went back and reviewed some of the directions study. One of the concerns Mr. Kirchoff has has to do with potentially taking up valuable abandoned railroad right-of-way and losing that for mass transit purposes. So, I asked Phil specifically that question and I will go into what he said here. He said basically the only area that would be any concern would be on the Pensey railroad line, which runs through Cumberland and out towards Greenfield. There are trail projects already on the way down there on the Pensey and there are also projects being discussed and moving forward in Greenwood. He made an interesting point; he said the right-of-way in a lot of these areas are wide enough to support both rapid transit and the trail that one wouldn t preclude the other one. Although he did mention that the area even in Cumberland where the Pensey goes through is just going through cross street after cross street after cross street. Those are issues that I think they are facing now with the proposed north/east connector. In my review of the plans for the regional transportation a lot of that comes outside Marion County. Mostly it is bus rapid transit on existing corridors. Most of the mass transit is mostly inside Marion County except for the northeast extension up to Noblesville and Fishers. Actually it showed it coming out to the airport in Plainfield and it extended to Greenwood. Those are dense areas so there are a lot more dense populations in those areas. So, in his estimation, and it is always open for debate, is that it will have little impact on the regional transportation plans in terms of mass transit. Mr. Kirchoff said I can add some comments to that. I had a CERTA meeting a week or two ago and on the agenda was verbatim except where it says Town of Plainfield it was CERTA. So, we discussed it and I can tell you that generally all of the communities on CERTA are supportive of this. However, they were appreciative of the fact that we raised the issue and I apologize because they were supposed to draft some wording that would carve out not only current plans but any potential plans and say that we would support this as long as it didn t add any potential negative affect on anything that might come down the road. So, I apologize because I meant to call them today and I was busy this afternoon and didn t get that done. Christine from Hamilton County and people from Shelby County all were conceptually where we were about not wanting to pass something that would then be considered to be contradictory. So, again I apologize; they were going to give us a paragraph that I thought would fit into here to give us a sense of yes we support this. I can t think of the lady from Indianapolis Mr. Carlucci asked, Joan? Mr. Kirchoff said not Joan Sanders but another staff member who is in transportation. She spoke very highly in favor of this because this could generate up to fifty million dollars for trails and infrastructure. So, we need to find a way to support it but by the same token I need a way to feel more comfortable that we have put the appropriate wording in there to protect ourselves from any conflict to protect ourselves as we go down the road. And I apologize I didn t get that done today. Mr. Brandgard said I would just add to that we are generating words that we are generally in favor of this but we don t want to impede the other either so we probably ought to wait until we get those words and bring this back up for review. Mr. Kirchoff said I will make sure that I get that to you within the next week or at least I will contact CERTA and see if they have it done. Mr. Carlucci said or just give me the name and the phone number because I know that you are going to be busy and I can take care of that. Something that came up in the last few days is I got a call from Mr. Deckard who lives at 220 Pickett Street. He has a class reunion and he lives right on Pickett and U.S. 40 I think as you turn on Pickett. He would like to close that street and I told him I would at least bring it to the Council because I think he is planning on doing this on the 27 th or the 28 th whatever is a Saturday. Mr. Brandgard said it s the 27 th.! 2

3 Mr. Carlucci said so what I suggested to him is that we get Council s approval subject to review by the Plainfield Police Department and the Plainfield Fire Department. I did have some concerns about him wanting to completely close that street. I said maybe the police cars could find another way around but the firemen have to go to the fire and if they have to turn onto Pickett and it s closed, that creates operational problems. So, he is working real hard; he has already 30 commitments for a reception at his house and he s talking about more. He is working hard to get parking at Van Buren and do different things but I said I would get back to him in the next couple of days. I didn t have time to get both chiefs together and talk about that today and we won t go forward unless it can be worked out safely. That is what I told Mr. Deckard too. I said it doesn t work for anybody if we have a problem. Ms. Whicker asked, how many driveways does it affect? Mr. Carlucci said I don t know. I know where the house is but I can t count the driveways that go up that street but if you can t even get up that street and you are blocked off Mr. Brandgard said there has to be another way. Ms. Whicker asked, does he have the well wishes of his neighbors whose driveways would affect? Mr. Carlucci said he says that he does. I will take him at his word. I think he is a pretty earnest young man. He said he talked to his neighbors and they didn t have a problem and the worst case scenario is there will be people there for a couple of hours or they won t. But again I did talk to him about maybe just parking on one side and leaving the other side opened. He could put some barricades in but again it is a major street over there for people to get around on. Ms. Whicker asked, did he give hours; like between the hours of seven and eleven? Mr. Carlucci said if he gave me the hours, I have completely forgotten what they are. I m assuming probably during the day. Mr. Brandgard said I was going to say that we have done this in the past and I think it is all contingent upon the requester to make sure that he is not impeding his neighbors and make sure that there is no traffic issues. Mr. Carlucci said like Crystal Bay and Hardin s Creekside Estates will call in to do a rummage sale down the entire street and we will say that is fine; you can put some barricades out. You still have to let thru traffic through but you also have to leave a lane opened so that the fire department and police can get down there. We ve never had a problem in the past although this is a much tighter area in the older part of Town. So, I would be glad to work towards that and communicate back with the Council s president. Mr. Brandgard asked, is there consent under conditions just discussed? Consent given. REPORTS Mr. McPhail said at our last Council meeting I indicated that we had received bids to put a new roof on the apple house and the potato house at the athletic facility. We were concerned about the cost and the other issues. We received two bids; one from JDH, which was $95, and we received a bid from Marley Construction, which was $82, We went back and took a look at the buildings. Both of the buildings had lean-tos or drive-thru sheds that have been added onto the buildings. We were able to determine that they were not part of the original buildings. They were in pretty bad condition and they are going to take quite a bit of work. So, Jason had his crew remove those and we brought the low bidder in and sat down with them and took that cost out. We now have a bid of $69, to do that work and I think given the time of year that we need to move forward and get new roofs put on those buildings and stabilize them if we have the funds someplace to do that. Our agreement says that we will restore them. Clay has worked with me on this and Jason and Wes got tied up so we didn t get him in our meeting today but we did review it. I think it is imperative that we get those roofs on there before they deteriorate! 3

4 any further. I would recommend that we accept the quote from Marley Construction and move forward if we can find the funds to do it. Mr. Bennett said I was looking at that as they were meeting and we have the funds. This will be something that will not only save us time in the future but also money when we finally fulfill the completed commitment to refurbishing both of those buildings. We have the money. Ms. Whicker asked, Kent was this going back and not doing the exact replica of the single but doing something different? Mr. McPhail said no it is putting the replica of the shingle on there. We met with Rebecca Smith with the historic preservation and she came and walked through the building. She is really excited that we are able to do some things. It would put the roof nearly back to the original, which is replacing those metal shingles with a duplicate metal shingle. It is a little different size but exactly the same pattern and everything. It will be rebuilding the chimneys from below the roofline up. They have to come down and be rebuilt and there is quite a bit of damage on the small building. It looks like we are going to have to replace the whole roof deck on it. It has deteriorated that bad. The larger building about three feet of sheeting around the edges and then some spots up through it need to be replaced. That would bring it back as close to the original as we think it is feasible. We talked today to put a shingle on there we could maybe reduce that cost by maybe $10, if we put an asphalt shingle on there and I think for $10, we need to maintain the historic character of the building. There is almost $32, worth of labor just to remove it and repair it and put it back in. Ms. Whicker said and the State had not specified it had to remain in historic condition. Mr. McPhail said the memorandum of understanding says that we will restore them and maintain the historic character of them. Mr. Gaddie said when we put this out to bid, was this public? Mr. McPhail said we invited four people to bid and we actually got a bid from two of the four. Mr. Gaddie said I didn t know if we put it in the paper or anything. Mr. McPhail said it is pretty hard to provide a scope of work. We tried to provide a scope of work and it was too difficult. To go out with a public bid we really had to have a scope of work that was pretty detailed and probably hire an architect to do that. I don t think we are capable of that. Mr. Gaddie said he was talking about those lean-tos and I talked to a guy who put in about 40 hours there and he said he had been retired about 15 years and said those lean-tos were there when he started. Mr. McPhail said they certainly have been there quite awhile but if you go study the building, the ground elevation has been raised probably six or eight feet around those buildings. The lower windows have been closed off. Under those lean-tos windows and doors have been closed off so you know it wasn t part of the original building. They were in bad shape and really we couldn t see any future use of having those on there at the cost to maintain them. I would move that we approve the contract with Marley Construction not to exceed $70, to repair the roofs and do it with the historic shingles and maintain the historic character of the buildings with myself as being the signatory on the documents. Second by Mr. Kirchoff. Motion carried. Mr. Kirchoff said I wanted to thank Wes for the spreadsheet that you have in front of you. I don t know if you have had a chance to look on your flash drive but it was a little bit of an addition there but as I look at this we had an investment committee meeting today and we were talking about monies. If I analyze this right, it says that we are going to be up around $850, this year on our food and beverage tax. I think that is a very positive sign. I know that these cash flows varies and we can t quite figure out why they jump around the way that they do. But I guess my first question is having heard the concerns from the restaurateurs in Town with our no smoking policy I think it is pretty obvious that it has not had a negative impact and,! 4

5 in fact, it looks like it has had a positive impact on cash flow and as you look at that three or four years ago we were at $500, and this year we are going to be over $800, Again, we have to be careful in drawing too many conclusions but as I looked at that on the disk and then again today with the revised numbers I think it is really a positive story for us and wanted to share that observation. Mr. Brandgard said in looking at this and seeing the big jump and the fact that it is maintaining I had the same initial thought relative to the no smoking ordinance. It doesn t appear like it has impacted the restaurants very much. The other thing is I m wondering when the increase in the food and beverage tax was put in for the stadium, did we get any part of that? Mr. Carlucci said that half percent goes to the County. Mr. Brandgard said that is a significant jump. Mr. Carlucci said once they got to a certain dollar amount they got to keep everything above that. It was different for each county. Mr. Bennett said I wanted to point out that you have the corrected spreadsheet. I have not been to a restaurant in Plainfield that says that they have been negatively affected and I ask in almost everywhere I go. I m not aware of any restaurant that has been negatively affected. I ve asked Cracker Barrel, Applebee s, Chili s; none of them have said that they have been negatively affected. Mr. Brandgard said even some of them that were quite concerned about it appear to be just as busy as they were. Mr. Bennett said we talked about the outdoor eating areas being a positive. There have been some price increases that have helped those revenues as well. The restaurants that I go to they have said that the attendance are staying study even in the economic climate that we are in. So, there are various reasons why we are seeing an increase but we are certainly not seeing a negative impact because of the no smoking ordinance. Mr. Daniel said you may recall at our last Council meeting I reported the following morning Mr. Carlucci and I would be over at Judge Boles Circuit Court on the West Central Conservancy District settlement. Tuesday morning on August 26 th the court had a very short hearing and approved the order redefining the West Central Conservancy District boundaries, which concludes that case. You may recall the lawsuit itself was dismissed sometime ago; we were just waiting court approval on the boundary change and that is now finished and that is finished in its entirety. Mr. Gaddie said out in Glen Haven I think the president, I didn t get his name, but things out there like commercial blowers and even individuals that blow their grass out in the street he said that doesn t bother him but when it rains, it washes it down to the ponds and it is causing a problem there. Mr. Brandgard said I m glad you brought that up but I guess when anybody cuts their grass out there, they are all blowing it out from the yards into the streets. Mr. Kirchoff asked, don t they have a neighborhood association? Mr. Gaddie said it would be the same affect anyplace that has ponds. Mr. Brandgard said I think when we get farther into the storm sewer situation we have, I think at some point and time we are probably going to have to disallow doing that too. I notice that we have the sweepers and stuff going around all of the time sweeping stuff up. I think Jason can probably answer that a little bit better. Mr. Jason Castetter said the storm water is going to enforce those things. (Inaudible). Mr. Brandgard said I feel fairly confident they have a homeowners association and they are the ones that are going to have to deal with that. They are not our mowers that our employees are out there cutting that grass.! 5

6 Mr. Kirchoff said I know they do that because they have come to us back when the developer wasn t performing his duties and there was a homeowners association and a neighborhood association or whatever that is where I would send them. Mr. Brandgard said I know even when I cut my grass, if I have an overabundance that goes out in the street, I sweep it up in front of the street anyway. Mr. Chafin said a couple of meetings ago you had approved Kyleigh s Krew to have their carnival. Just as a reminder that is this Saturday in case you are driving by Swinford Park and see some blow-up houses out there and music going on. They have a couple of softball games scheduled with children of various disabilities as a fundraiser as well. So, I just wanted to remind you that it is going on. Also, the competition pool is empty, the leisure pool is being drained and we had about 200 dogs this weekend take a dip in the pool. Mr. Brandgard said it sounds like it is a little more popular this year. Mr. Chafin said it was very popular so that is about $1, in the Beneficent Fund. Mr. Kirchoff said did you say Swinford for Saturday? Mr. Chafin said yes. Mr. Brandgard said that event seems to be growing every year. That is a good thing; it is a good cause. Mr. Chafin said we had a lot more big dogs; 35 pounds and over, than we did little dogs; it was very entertaining. Ms. Whicker said they don t require proof of rabies vaccination. Mr. Chafin said they do. You have to bring proof of vaccination. We do require that. Chief Anderson said I have a request. I wanted to try to get the next available work session. The meeting would be at Station 3. There are a lot of things going on at the fire department we would like to sit down and go over with you. I m looking at the second week in November. (It was scheduled for November 13 th at 6:00 p.m. at the headquarters). Mr. Brandgard said they ought to have some good drawings for the station for us to review. The last session we had with the architects it was a pretty much all day session reviewing room by room what was in the rooms and configuration. So, I think they have come up with some good renderings of what it may look like. I think by that work session we will have some good information to present. Mr. Belcher said the sidewalk program is going really well. John and Jason s crews have made a lot more progress this year, which is a great thing. We are essentially almost done with South Center on the west side. I think they have one piece of walk to put in but that led us to our next question of where do we go next? That is the question I wanted to bring to you tonight. We are trying to link up major pieces of our structure trails to trails or parks to parks and things like that. I had a question from a resident this week that lives on the east side of Center Street. It was a great question and he was very complementary of the project and everything that was going on but he just said are you going to come to my side next? So, that is the question that I bring to you. We had really planned on going over to Avon Avenue next to start on the east side of Avon where the State stopped doing walks and complete a section going north to get to essentially the bottom of the hill and then next year we are going to come down the hill from the Vandalia Trail, which then would create a nice smooth link from U.S. 40 up to the Vandalia. But I wanted to make sure that we were on the right path here and that is what you would like for us to do because we could just go to the other side of Center Street. We still would probably want to, no question, it is just the timing. Certainly there may be some questions that come to you if we are no longer there next week, let s say, we re working on another section of roadway. I thought it was worth bringing to you because we really don t have a hard fast policy but this is a program that we have been sort of moving towards and everything has been good. I think it! 6

7 has all been well received but I don t want it turn because somebody doesn t understand what we are doing or you don t understand or don t agree with it. Mr. Brandgard said I think we made such an improvement on the North Center Street that to just do that section we did on South Center and not complete it I think we need to get that completed. Mr. Belcher said do you mean go to the east side? Mr. Brandgard said yes; the east side and then Buchanan Street north on the west side. Mr. Belcher said I see continue on the north of Buchanan Street. Mr. Brandgard said no on Center Street and Buchanan Street north. We went south of Buchanan Street. Mr. Belcher said right and we are on the west side. Mr. Brandgard said yes but we need to finish the west side north of there. Mr. Belcher said okay I m with you now. Mr. Brandgard said as well as the east side. Mr. McPhail said in consulting with Tim and John pretty regularly on this project I want to do every sidewalk in the old part of Town. But I do think we probably don t have time this year to complete Center Street if we do both sides. I do think it is important that we get a link to that trail on Avon Avenue. So, my whole response has been are we going to have money to continue the project next year so we can keep going? To me I don t see a stopping or a starting point. Mr. Gaddie said (inaudible). Mr. Belcher said have you looked at that section on the west side going north? I haven t looked at that section on the west side of Center Street from Buchanan north of U.S. 40. Is it in as bad of shape as going south was? Mr. Anderson said (inaudible). Mr. Belcher said so we could do just spot repairs on that north section and complete what you are talking about and still have some money left potentially to go to Avon Avenue. then? Mr. Kirchoff said would that be feasible to get done this fall Mr. Belcher said yes with the rate that they are going I would think they could complete those spot repairs if we want to do that on the north and probably still go over to Avon Avenue. Mr. McPhail said they can get one side done this year I think but I don t think they can get both sides done. Mr. Kirchoff said that is what I was saying just fix the spots and move to Avon. Mr. Belcher said just fix the spots on the west side and then go to Avon and try to get that piece done; that is probably more feasible. Mr. Brandgard said I read an article today talking about the new rolled concrete. Mr. Belcher said roller compacted concrete. down. Mr. Brandgard said yes; put it down like asphalt and pack it (Inaudible). Mr. Belcher said with the asphalt prices there are other alternatives coming to the table, which is good.! 7

8 Mr. Brandgard said they were saying that you could put it down all year, which I thought was interesting. Mr. Belcher said if that is the general consensus, what I would like to do, because this discussion probably takes a little more time, maybe in the March transportation work session between now and then maybe we could come up with some kind of an idea for the rest of the old part of Town. How many walks do we have and what that might cost and what kind of prioritization program could we come up with and give that to you for consideration and maybe we could then answer questions like that from residents in when are we going to get to that side of the street? If we have a plan and a program, we could figure out how we can fund it and then we can answer those questions. Mr. Brandgard said that would be a good idea. Mr. McPhail said I think if we have one side of Center Street south, we certainly have accomplished our first goal, which was to try to get sidewalks when the bridge goes out where we get trail traffic through Town on a safe sidewalk. I think the top priority at least we will have that met by the end of the year. All of the streets have problems I think and you got that one and I have a couple of phone calls from other residents. Mr. Belcher said some other towns have gone to programs. When you look at the whole Town, you have to start thinking about cost sharing to make it feasible and some kind of reasonable timeframe. I m not sure the Town could pay for every sidewalk; I just don t think it is possible but some towns offer a sharing program to make that happen. Mr. Brandgard said we did have a program at one time where we had kind of a cost sharing between the homeowner and the Town to replace sidewalks. Mr. Belcher said it is pretty well received most of the time certainly for folks who like to keep their property up. There may even be more we need to do in terms of a requirement that they to some degree keep a sidewalk from becoming some kind of hazard. Ms. Whicker said I did want to make mention that I saw a resident south of Buchanan on Center Street north of the park and everyday religiously twice a day they were out there watering that new grass. You can see when you go out because that new grass has come up so beautiful compared to the other lawns that are still dirt and there has been no germination whatsoever. But through that heat those residents, and I don t know who they are, they have done a great job to really to bring to fruition what we are trying to do. Mr. Belcher said it is amazing and stark how different it was on that one particular home and amazing how it popped up there. Mr. Brandgard said that last section you broke out today and put the forms up it is kind of interesting to see how that was going to go because that section seemed to be dropped a lot from the rest of it. I noticed even when I drove by today, I could see the forms and you can see underneath the forms in one area. OLD BUSINESS Ms. Whicker said I failed to mention that the Clarks Creek Natatorium has officially started the first programming of the swim club on Friday night for the kids and there are already 50 kids involved as mentioned in the report. I m looking forward to meeting with the committee this week and going over what needs to get done to get more programming in place. Mr. Brandgard said at our work session we had some comments about trying to get the scheduling worked out. I had run into Jud Wolfe after that and mentioned it to him and he gave me the reason why but he said we will get it taken care of. Ms. Whicker said Nate has done a good job in communicating our needs for getting up and running. Mr. Kirchoff said at the last meeting I had requested Wes to convene the investment committee and we met this morning. Basically, we would hope at the next meeting to have a report of what we have done and where we are going forward. So, we are having some real good! 8

9 communication between the Clerk Treasurer s Office and engineering. So, we are moving forward. Mr. Brandgard asked, do you have any idea what impact the Lincoln Bank merger is going to have on us? Mr. Bennett said I haven t talked to anyone from Lincoln Bank; I don t perceive anything. This is a pretty routine transaction. I know it s not necessarily routine although Lincoln Bank has been through one of these transactions before but I don t anticipate any negative impact from the Town s standpoint. Mr. Gaddie said I noticed the corporate office is getting transferred out. Mr. Bennett said that s not a positive for us but from a service standpoint I don t see those people leaving. I m just sorry to see us losing the headquarters. I m sure everybody else is. I don t see a negative impact from a service standpoint. Mr. Gaddie said stock prices went up. (Inaudible). One of their officers sold 13,000 shares at $12.00-$14.00 (inaudible). Mr. Bennett said if you read the IBJ article, which you probably did, they have been caught up, at no fault of their own, in the decline of the mortgage part of the industry and the banking industry in general. That whole industry has taken it on the chin simply because of one segment of that market. It was a business decision that I wasn t necessarily surprised by but I was disappointed to hear about it. NEW BUSINESS None. RESOLUTIONS Mr. Brandgard said we will leave Resolution No tabled tonight. A resolution for the support for Multi Modal Transportation in Central Indiana. Mr. Brandgard said next we have Resolution No : Authorizing Purchase Agreements at SR267 at the Metropolis Parkway. Mr. Kirchoff said the only thing that I had on that is the wording in the agreement or proposed agreement indicated it was the interchange at I-70 and SR267. In fact, this is a better description. Mr. Brandgard said yes; it is a better description. Mr. Kirchoff said with that being said I would move to approve Resolution No : Authorizing Purchase Agreements at SR267 at the Metropolis Parkway. Second by Mr. McPhail. Roll call vote called. Ms. Whicker yes Mr. Gaddie yes Mr. Kirchoff yes Mr. McPhail yes Mr. Brandgard yes 5-ayes, 0-opposed, 0-absent. Mr. Carlucci said can I ask the Council if they would officially table the resolution to the next Mr. Brandgard said leave it on the table for the next meeting?
