1 INVENTORY OF THE PERSONAL ESTATE OF Alexander Wallace DECEASED. AT Dingwall, the Fourth day of September Nineteen Hundred and eleven years the following Inventory of the Personal Estate of the late Alexander Wallace was presented for registration in this register, along with Extract Trust Disposition Settlement, conform to law by Mr. John Sandison, Solicitor, Tain, who died at Manse Place, Tain, on the First day of May I. Follows Trust Disposition and Settlement of said deceased Alexander Wallace: --- I, Alexander Wallace, late Merchant and residing at Manse Place, Tain, with the view of settling my affairs, and providing for the disposal of my means and estate after my decease Do hereby Give, Grant,

2 Dispose convey and make over to and in favour of William John Macdonald, Town Chamberlain, Tain; Roderick Finlayson, Farmer, Ardjachic, Tain, and Cambusavie Sutherlandshire; Charles Mackenzie, Bank Agent, Tain, and Alexander Wallace, late Farmer, Tullich, Fearn, now residing in Hartfield Street, Tain, and to the acceptors or acceptor Survivors or Survivor of them, and to such other person or persons as shall be assumed in manner aftermentioned (the major part accepting and surviving at the time being always a quorum) as Trustees and Trustee for the ends uses and purposes aftermentioned (the said Trustees and their foresaids being throughout these presents denominated "my Trustees") and to the assignees of my Trustees or their foresaid heritably and irredeemably All and Sundry lands and heritages goods gear debts and sums of money and in general the whole estate and effects heritable and moveable, real and personal of what kind or nature soever or wheresoever situated now belonging or which shall belong to me at the time of my death, with the whole voucher and instructions, writs titles and securities of and concerning my said Estate and Effects, and all that has followed or may be competent to follow thereon: But declaring always that these presents are granted by me in trust only and for the ends uses and purposes aftermentioned vizt: (First) For payment of all my just and lawful debts deathbed and funeral expenses, and the expense of executing this Trust. (Second) That my Trustees shall hand over to my niece Isabella Wallace presently residing with me the whole household furniture bed and table linen and plenishing in my house at the date of my death. P. Storm the sum of Thirty pounds sterling: To the children of my grandniece Mrs. Barbara Munro or Farquharson wife of John Farquharson, Inverness equally among them the sum of Twenty pounds sterling: To my nephew Alexander Munro No 498 Argyle Street, Glasgow, the sum of Twenty pounds sterling: To Annie Douglas my domestic Servant the sum of Ten pounds sterling: To the fund for behoof of Aged and Infirm Ministers of the United Free Church of Scotland the sum of Ten pounds sterling: (Fourth) I direct that the free residue of my means and Estate shall be divided equally between the said Alexander Wallace Munro, Draper, Tain, and William Wallace Mackay, Salesman, Tain: And I direct that from each of the foregoing legacies and residue shall be deducted the expense of discharging the same: And it is hereby declared that in the event of any of my said legatees predeceasing me leaving lawful issue, such issue shall be entitled equally among them to the legacy to which their parent would have been entitled if in life: And further I direct my Trustees to lodge any of the foresaid legacies or shares of residue which may be payable to minors on Deposit Receipt with any Chartered Bank in Scotland in names of the parents or guardians or administrators of said minors for behoof of the legatee and it is hereby specially declared that a discharge or Receipt by the parents or guardians or administrators of the said minors shall be a valid, effectual and sufficient discharge to my Trustees for the legacy or share of residue bequeathed to the minor: And I hereby declare that the whole provisions of the Settlement so far as they devolve upon females shall be exclusive of the jus marite and right of administration of any husbands they may have married or may hereafter marry, and that the same shall not be affectable by their debts or Deeds or the diligence of their Creditors: And for the purpose of carrying into execution this Trust my Trustees shall possess all the powers privileges and immunities already conferred or which may be conferred by Statute on gratuitous Trustees according to the most liberal interpretation, and that they will be entitled to assume and add to their number such a friend or friends as they may have confidence in, and to compound and take part for the whole of any disputed debts or claims: And I declare that all persons who shall pay to my Trustees any sum of money shall be noways concerned with the application of the same but shall be sufficiently exonered [sic] by any deed or writing containing an acknowledgement or receipt by my Trustees: And I direct my Trustees to appoint Mr. John Sandison, Solicitor, Tain, to be Law Agent in the Trust and to pay him the usual professional fees: And I hereby declare that my Trustees shall in no wise be liable for any omissions in management nor for the omissions of their agent, nor for the responsibility of the

4 debtors purchasers or others with whom my Trustees may transact and shall nowise be liable singuli in solidum or for one another but each for himself and for his own personal intromissions and no further: And I nominate and appoint my Trustees to be my sole Executors: And I hereby revoke all former Settlements made and executed by me: And I reserve power to alter innovate or revoke this Settlement at pleasure but in so far as not altered or revoked it shall be valid and effectual though not delivered in my lifetime: And I reserve my liferent use and enjoyment of the whole Trust Estate before conveyed: And I consent to the registration hereof for preservation: In Witness Whereof these presents written on this and the three preceding pages are along with the marginal addition on page first subscribed by me at Tain the twenty-first day of April ;nineteen hundred and nine before these witnessed Ronald Ross Munro Macdonald apprentice to the said John Sandison and Duncan Fraser Mackenzie, Shopman with Wallace & Fraser, Ironmongers, Tain, declaring that the words "also my gold "watch" on the thirtyfirst line of the first page and the words "if she is in my service at the time of my death" in the seventeenth and eighteenth lines of the third page were deleted before subscription (signed) Alex: Wallace. We, the within designed William John Macdonald, Roderick Finlayson and Charles Mackenzie & Alexander Wallace hereby accept of the office of Trustees and executors conferred on us by the foregoing Trust Disposition and Settlement (signed) W. Docquet signed as relative to oath to Inventory at Tain 30 Aug 1911) Collated by Alex Ross J.C.S AT Tain, the Thirtieth day of August IN PRESENCE OF Hugh Munro Fraser, Esquire, Justice of the Peace for Ross and Cromarty, Appeared William John Macdonald, Town Chamberlain, Tain, who, being solemnly sworn and examined, Depones: That the said Alexander Wallace, late Merchant and residing at Manse Place, Tain, died at Manse Place, Tain upon the first day of May Nineteen Hundred and eleven, domiciled in the County of Ross and Cromarty in Scotland. That the Deponent is Executor Nominate of the deceased along with Roderick Finlayson, Farmer, Cambusavie, Sutherlandshire: Charles Mackenzie Bank Agent, Tain, and Alexander Wallace, late Farmer, Tullich, Fearn, and now residing in Hartfield Street, Tain, conform to Trust Disposition and Settlement by the deceased dated 21st April 1909, which is signed as relative hereto. That the Deponent has entered, or is about to enter, upon the possession and management of the deceased's Estate as Executor foresaid, along with the said Roderick Finlayson Charles Mackenzie and Alexander Wallace. That the Deponent does not know of any testamentary settlement or writing relative to the disposal of the Deceased's Personal or Moveable Estate or Effects, or any part thereof, other than that before mentioned. That the foregoing Inventory, signed by the Deponent and the said Justice of the Peace is a full and complete Inventory of the Personal or Moveable Estate and Effects of the said Deceased, wheresoever situated, and belonging or due to him beneficially at the time of his death, in so far as the same has come to the Deponent's knowledge. That the amount of Estate Duty (and interest thereon) payable upon this Inventory, as particularly shown in the Statement for Estate Duty and Summary annexed hereto, is paid to the Commissioners of Inland Revenue, conform to the Receipt upon Page No. 1 hereof.
