Miller Financial Fast Track Report Deficits in early Fund years and surpluses in later Fund years continue to hold. Little or no development is expected on claims prior to Cyber Security The Fund will subsidize a cyber security audit to be conducted for each member to determine any potential data security conditions within their IT systems. This is critical given the increasing incidence of data losses and system breaches among public entities. A1196 Status Our sources advise that this bill has a slim chance of passage in the Senate, but we will monitor closely. Claims Update (Robert Persico/Wendy Wiebalk) Update on recent Supreme Court case DD vs. UMDNJ Tort Claims

7 Wendy addressed the recent Supreme Court case of DD v. UMDNJ which reviewed the standard for filing a late Notice of Claim and will make it far more difficult for plaintiffs to file them in the future. Nurse Case Manager Program Bob advised, the nurse case manager program will begin May 1, The program will seek better medical outcomes for injured employees, reduce unnecessary treatment, secure care in a cost effective setting and bring the employee back to preinjury status as soon as possible. Safety Director (Anthony Ven Graitis/Walt Reibrich/Wendy Wiebalk) Report on Safety Committee Meeting Anthony discussed Safety First, How is my Driving has been approached and a pilot program will be rolled out in the upcoming weeks. The GSMJIF may provide some financial support for members agreeing to implement the program. The 2012 Stewardship Reports: will be completed this month and distributed to members and results discussed at SCMs. The Wellness Incentive Program will be rolled out by 6/1. An will be mailed in the next few weeks outlining the program. Employment Practices Wendy commented on the volume of EPL cases, the costs associated with same, and noted that although all members have policies and procedures in place, it can only help to address these issues regularly. Anthony commented on the when the EPL committee met and discussed a monthly topic to be to be agreed upon by committee members, a bulletin drafted and distributed to all GSMJIF members on a monthly basis. Anthony indicated that Wendy will discuss at the Fund Safety Meeting and Commissioner meeting monthly. Also, additional member committee members are being sought and volunteers are appreciated. Cyber Security Audit Anthony discussed how the GSMJIF will coordinate Cyber Security audits using John Lucich of Network Security Group and to have NSG visit each member by year end starting with municipalities nearest to Union. NSG will start with Rahway, Linden and Maplewood. Risk control will help coordinate visits with IT personnel at each member location. Treasurer s Report Mr. DeBlasio reviewed the monthly treasurer s report and cash management account and advised that the Fund has met all outstanding obligations and its financial position is secure. There were no questions. Presentation John Geaney of Capehart Scatchard Workers Compensation Benefits and Taxation Mr. Geaney reviewed the treatment of workers compensation benefits and local salary continuation programs.

18 RESOLUTION NO GARDEN STATE MUNICIPAL JOINT INSURANCE FUND (Hereinafter referred to as the FUND ) APPROVING CLAIMS PAYMENTS BE IT RESOLVED by the Board of Fund Commissioners of the Garden State Municipal Joint Insurance Fund, that confirmation and authorization approval is made in issuance of the attached claims payments totaling 2,226, against the fund. 19 RESOLUTION NO RESOLUTION APPOINTING APPROVED COUNSEL FOR THE GARDEN STATE MUNICIPAL JOINT INSURANCE FUND WHEREAS, the Garden State Municipal Joint Insurance Fund is responsible for providing a defense to certain claims brought against its members in accordance with the Fund s coverage documents; and WHEREAS, in order to appoint defense counsel, a law firm must be on the approved counsel list of the Garden State Municipal Joint Insurance Fund to defend any members of the Fund; and WHEREAS, the law firms shown in this resolution (3) have been proposed as Counsel for the Garden State Municipal Joint Insurance Fund for the year 2013; NOW, THEREFORE BE IT RESOLVED, by the Board of Fund Commissioners of the Garden State Municipal Joint Insurance Fund that the law firms named in this resolution be and the same are hereby appointed as an approved counsel for the Garden State Municipal Joint Insurance Fund for the year 2013: Brenda Coppola Cuba, Esq.
