4 MINUTES OF MEETING TURTLE RUN COMMUNITY DEVELOPMENT DISTRICT A regular meeting of the Board of Supervisors of the Turtle Run Community Development District was held on Monday, June 26, 2017 at 6:00 p.m. at the offices of Governmental Management Services, 5385 N. 5 June 26, 2017 FOURTH ORDER OF BUSINESS Good News Mr. Kapish: I just want to start the meeting now. I want to run down what we have here. We have a full agenda tonight. I think that I couldn t get to everybody to what we are supposed to have to what I expect and what I hope you guys expect just to go through the presentation with Lux Solar Inc. which is the items in the roadway for the crosswalks and the LED lights they have. We also have the discussion with Broward County about the drainage. We all know that a couple weeks ago we had flooding going on. There was flooding all over Broward County. We had a lot of backup in Turtle Run. It wasn t our fault at all. Also we are going to have a discussion about the wall construction documents with Tamara Peacock and the discussion for the projects for the bonds and also for the culvert clearing of the diver s reports and anything else that anybody seems to be needing that we should be doing. I also want to discuss the pavers at the main entrance. That was really what the damage that the rain did and what we need to do. So anyway we will go onto comments and good news. Skip do you have anything? Mr. Carney: All said thank you. Mr. Kapish: Zaida? Ms. Karnegis: No. Mr. Kapish: John do you have anything for us? Mr. Pfeiffer: No just grateful to be here. Mr. Kapish: Lance do you have anything? Mr. Morgan: No thank you. Mr. Kapish: The good news is that it stopped raining I think. Now it is too hot. Dennis do you have anything for us? Mr. Baldis: Happy to be here. FIFTH ORDER OF BUSINESS Public Comments Mr. Kapish: Number 5 is our public comments section. Anybody that has come here from the public or anybody that isn t a vendor or a regular attendee this will permit people to comment. 2

6 June 26, 2017 Mr. Grover: I would like to speak on behalf of the business owners in connection with the discussion on the bonds. Is now an acceptable time to speak? Mr. Baldis: Can you please say your name? Mr. Grover: I am Anuj Grover, G & C Holland, Coral Springs. We are the owners of the shopping center on the corner known as Turtle Run Shoppes on the corner of Sample Road and Terrapin Lane. We know that there is a bunch of items that you all are discussing potential improvements in the CDD with regards to capital items that could be made in connection with the funds being received and whether the bond process should be put forward. Obviously we don t want to get in the weeds with regards to what should be or should not be done. Obviously that is for you all to decide but we want to strongly encourage that what we have heard is that if those bonds can be done in a way that the tax revenue is not going to be increased then we are as we have been investing in our properties and we have been talking to our tenants if we have a vested interest in making sure the lighting is improved, the traffic flow is improved and that the surrounding area does in fact get investments made. It is beneficial to us and it is beneficial to our tenants. It is beneficial to the surrounding business owners in the community. So we wanted to make sure that our voices were heard as a very large tax payer in the CDD. Quite frankly I believe we pay more taxes than any house in that area. Mr. Kapish: That is correct. We are not finished with the bond issue. We have a couple steps to go through to issue that. My expectation is I hope to have those things polled and decided on by the end of July. I think that is pretty attainable. Mr. Pawelczyk: The current methodology report and the assessments that were undertaken that were levied which will actually be imposed once the bonds are issued provide that your assessment on the property now is not going to go up. Correct? Mr. Baldis: Correct. Mr. Pawelczyk: So if you are paying $100 per square foot now it is going to be $100 per square foot or less will be your overall assessment. What they are doing is and we have explained this is that we are using the money that is already there that they already collected. 3

7 June 26, 2017 Mr. Grover: Understood. Mr. Pawelczyk: Trying to make it work quicker. It is all on the website too. Mr. Kapish: If you want to go back to your tenants and reassure them that we will definitely be trying to be as fair on the bond issue. The bond issue should help everybody in Turtle Run. Mr. Grover: The conversation that we have had with some of our tenants have been in light of the qualification that we have been saying that the taxes itself would not be going up and obviously if you are doing a bond revenue you are pulling the revenue forward and then paying for it over time with the increase in the taxes because you are using the money that you actually pulled forward from the bond. They were encouraged by that concept. Mr. Pawelczyk: In other words if the CDD is going to increase that amount by a penny, you as the property owner is going to get written notice that we are going to have a public hearing and that we are going to increase that level of assessment beyond what it is but it has already been advertised and published. Mr. Grover: Excellent. Thank you for letting me speak. Mr. Kapish: Was there any more questions from the tenants? Mr. Grover: No. We have seen the website and we are adequately apprised on the issues so we are able to speak with some knowledge of what we were discussing. Mr. Baldis: We appreciate you coming. Mr. Grover: Thank you for your time. Mr. Baldis: Everyone else is on the agenda. Mr. Kapish: We are going to go to the presentation from Lux Solar, Inc. SIXTH ORDER OF BUSINESS Presentation from Lux Solar, Inc. Mr. Kapish: Lux Solar Inc. is the vendor that makes LED lights for crosswalks. Mr. Baldis: Solar. Mr. Kapish: Solar power and Dennis met with them earlier and Dennis asked me if I would meet with them. I met with them and I was impressed so we invited them back to 4

8 June 26, 2017 this meeting to discuss their product. That is their product on the table. I will let them speak. Mr. Baldis: If you recall I brought this to the Board s attention because of the roundabout and the amount of signs in the roundabout. We could reduce that amount by using this product by 17 and then there is other applications throughout that they will go through and show you where it will be applied. Mr. Masdalawi: My name is Mas Masdalawi. I am the president of Lux Solar, with me is Gilbert Soles, Vice President. As you know most of us we have some difficulties trying to see the roads. Our object is to be able to provide guidance for the drivers. If it is foggy outside it is more challenging even with street lights you probably can t see your path most of the time. Of course pedestrians and bicycles are always very vulnerable. What we have right now are solutions that we give is that we put markings in the roadways. We put signs. We put lineators, we put chevrons, we put RPM s but unfortunately those are not enough to be able to solve our problems. What they have in common is that they all need a light. The light you can only see as far as your headlights. Two to three hundred feet, that is not enough time for a driver to be able to make a decision. This is what we are right now. We are a solar road lights like what you saw over here imbedded in the pavement. This is one of the projects we have done on Miramar Parkway for Broward County. You can see those lights from 1,000 feet away. No wires you just come in and all self-enclosed. This is how it looks in the pavement. This is a development that we did down in Homestead. Highlighting the edge of the pavement in yellow. This is a roundabout we did in Palmetto Palm. When we did this first roundabout, Palmetto Bay is a very rich area as you go down to South Miami, the community was so excited they did six roundabouts after that. Everybody was very welcoming about it. Hopefully this video works. Speed bumps as you know at nighttime, you really can t see them no matter how much you paint or what you do. These are steady yellow as you can see here is one, here is another one. This is also another development down in Homestead. Stop bars, we came up with an idea over here. On fire hydrants to be able to have blue lights to highlight them so you can see them from far away. This one over here is actually flashing red in the 5

9 June 26, 2017 pavement that is cheaper than a stop sign that can save someone s life. We installed about 75 locations down in the city of Surfside. They are going to be doing another 250 locations. You can highlight the bike lanes. You can use them for trails and sidewalk areas. When you can t see a median as you can see over here it is dark, you could hit it. You will be able to see it from a distance. This is a new concept for us which is very effective and everybody is very excited about it is a wireless in-road lights. So right now what we have is currently you have to go and open cut the road and put in the lights. This one over here we just in a few hours, we can install and you can have a wireless system to activate the lights for cars to see the crosswalks. This is how we do it. We mark it and we have special machines, we put the epoxy and then within ten minutes you can drive on it. Our units are waterproof and also they are approved by DOT. We give a five year warranty and it is all made is the USA those products. Three hours of sunlight or 8 hours of rainy days you get 16 hours of light. Now we discussed with Dennis and I would like to show you this is the concept that we have for the roundabout. There is a sight pollution in this roundabout. We went ahead and we laid out the plan and we submitted this plan as conceptual just to see how and we discussed it with Scott Brunner who is the Director of Traffic Operations at Broward County and he is in favor of what we talked about for the signs. They love our RPM s and see it as a solution to be able to replace what we are dealing with the signs in some areas to compliment those. So what we have done here is that when approaching the roundabout we would have just like you saw in that picture, you would have white lights placed at 20 feet and then there would be a 10 foot on center. So it would give you that narrowing down to the roundabout and then we have three flashing yellows that would be there at the end so that somebody would be able to see that roundabout when they approach it. The video would have given you an idea what it looks like I apologize. Then the same thing at all the approaches. In addition because you have a very unique condition here you have that concrete apron in the middle and then on the back we can highlight it with white lights so you will be able to see it. So the roundabout would be very visible and it is also at the same time we are going to place white lights where the crosswalks are happening. This way if someone comes in they will be able to know that 6

10 June 26, 2017 this is an area where there is a crosswalk at those locations. In the meantime we are going to go ahead and remove some of the signs that really can be redundant and really optional, some of them, so this way it will look more attractive to approach the roundabout. It will create a traffic calming effect when people will be able to see it. All those lights you can drive on them and it will be effected by any vehicle traffic. This is an idea. We have another roundabout and I have a letter over there from the city of Pine Crest. He loved the lights so much that the roundabout was very effective for them but at the same time we had a location where we placed the lights at the intersection in the city of Pine Crest where people were losing control and going into the guard rail. Once we put those lights that guardrail has never been hit. The year before it was hit 46 times. The best message we give to our driver is drive in the headlights and that is what we are trying to do here. We are taking practically the airport runaways that practically the whole transportation industry relies on and we are taking it to our highways right now to be able to accomplish that. The developments like yours will be very beneficial because this is an area where it could be targeted and there are so many areas that is why we wanted to share that with you that would be to be able to be as creative as possible to be able to deal with your safety issues. We are a safety solution company that is our objective. I would like to answer any of your questions. Mr. Kapish: How many signs at the roundabout would be eliminated? Mr. Masdalawi: Well right now we have there are 2 signs over here. We are only going to have one sign which is on your right hand side. The left hand side can t be removed. The county so far and this is part of the issue of discussion right now, the county would like to have only the two departure signs. The arrivals we can remove those signs. We are able to take those out. So we are talking about I think when you come in you will be able to see just that one sign which is a yield sign. All the signs next to it we will taken out. Those will be removed but you would have the pedestrian crossing signs only. You are only going to have three signs per approach ultimately. We requested from the county that this would be removed. They requested from the county to remove these but to leave the one for the school crossing only because this is important and it s school crossings. So 7

11 June 26, 2017 that is something that with this solution for discussion. I mean I have an from Scott over their supporting the lights and saying that initially these are the signs that they would be able to keep or remove. Mr. Baldis: The City of Coral Springs is in favor of this product too right? Mr. Masdalawi: Yes sir. Gilbert can talk to you about that. Mr. Baldis: Paul Carpenter is the one at the city correct? Mr. Masdalawi: Yes. You spoke to him right? Mr. Soles: Yes we spoke to the city and they very much liked the product. As a matter of fact they are looking at two crosswalks that they are considering to do with us right now. Mr. Baldis: Ok because they would have to give approval for this too. Mr. Kapish: What crosswalks are they doing? Mr. Soles: There is one on University and I do not recall the other one. Mr. Baldis: Isn t it the Walk? Aren t they doing one at the Walk? Mr. Soles: I don t remember the two of them. They just talked about it. I recall them talking about University and I believe it was by a shopping center. Mr. Baldis: I want to make sure and one thing that I questioned when I saw this was you have all these lights and the residents nearby so if you can explain to them what the residents are going to see with all those reflectors when it is nighttime. Mr. Masdalawi: One of the pictures that we showed you before. Mr. Morgan: You mean it is like a low non-intrusive light? Mr. Baldis: Correct you see the light if you are approaching it. The light doesn t go above the curb so no one can see it. Mr. Masdalawi: As you can see this picture was taken with the headlights off. So you can see the path over here and you can see someone if they are crossing the street. You are going to be able to see shadow but these lights are only directed for you as a driver. It does not create an ambient light where it disturbs any residents even when they are flashing they don t disturb. We placed them like in Homestead on the stop bars and they are really flashing closer to the homes and not a single complaint from anyone because it 8

12 June 26, 2017 is not really a light that is made to be traveling up high. It is made to travel only top 3 ½ feet which is really to be to you as a driver to see your path. That is what it is made for. It is really in terms of residents we haven t had a single complaint. Actually everybody likes it because it is really more friendly and I failed to mention which is kind of important relating to this and Dennis talked about here is the fact that these are approved by the US Fish & Wildlife for turtles so that tells you that they are made just for the driver to be able to guide you to see what it is and it is not too bright because it can blind the driver to see where you are going. So it is definitely a great way to be able to see your path and to create safety light. This is one and here is the other one. This is what you are going to see. Mr. Morgan: How far are those lights placed apart? Mr. Masdalawi: What we do and what we are proposing for your roundabout we placed them at 20 feet apart and then we go ten feet. That is sufficient. Mr. Morgan: These here are ten feet apart? Mr. Masdalawi: These are 20 and this one over here is 10. We want to allow sufficient distance to be able to see that. We do that on purpose because we are trying to get the driver to pay attention. Mr. Morgan: That would be which device? Mr. Masdalawi: This. Mr. Morgan: What would be the application of this device? Do you drill holes in the ground? Mr. Masdalawi: Yes. Mr. Pfeiffer: He has a cutter and he epoxy s it in. Mr. Masdalawi: Correct. In essence what you are looking at is that light is less than a ¼ of an inch above the pavement. All the components and everything is under the pavement. Mr. Baldis: It is lower than the regular reflectors. Mr. Masdalawi: We core and we take the core out and then we put the epoxy, put the unit together. There are leveling pieces until it dries. It dries within just ten minutes. We take the leveling pieces out and you are ready to drive on it. 9

13 June 26, 2017 Mr. Morgan: If they need to repaired? Mr. Masdalawi: We core the exact same area. We take it out and we put a new light in there. We don t do any other coring. It is the same spot. Mr. Morgan: How long does the device last? Mr. Masdalawi: Technically right now we expect a ten year life span out of the light. What we have inside there we don t have batteries, we have capacitors. That is a big difference. Batteries can t take much with the heat and everything they would not survive but the hybrid capacitor, it will be able to harness energy and also provide enough sufficient for our lights to activate. Mr. Pfeiffer: Does the light activate it, in other words during the daytime it is off to conserve and it senses that it is dark? Mr. Masdalawi: It is only on at nighttime. Mr. Pfeiffer: So it has light sensors. Mr. Masdalawi: Yes sir. In the solar panels themselves they are made to be able to get to a specific darkness it will turn them on. So if it is really dark during the day like because of heavy rain or fog or something they will activate with whatever the weather condition is which is important also for us. Mr. Pfeiffer: It doesn t happen often down here but if you have three or four days of clouds would they not function because they didn t get their three hours of solar energy? Mr. Masdalawi: If you look at this picture here and this is another one where we place them under tree canopies. Actually some of the areas where we place them the irrigation water hose covers them and then it dries and it doesn t affect them. They are waterproof. We put these in pools. Six feet of water charge and discharge. Mr. Pfeiffer: If it is in the shade all day it will still function? Mr. Masdalawi: Yes, it will function. Mr. Pfeiffer: So it just needs light, not direct light. Mr. Masdalawi: Yes because we are not really asking for a major power source. We are only talking about 2.4volts. We have done many tests and we tested in areas like 10

14 June 26, 2017 Minnesota which is really snow and their days are really short and they are operating all night long. So over here we never have any problems. Mr. Pfeiffer: So under tree canopy they still function? Mr. Masdalawi: I have them under tree canopies for two years now. They are running no problem all night long. Mr. Soles: I will jump in here if you guys don t mind. We just did an installation last week in the Florida Keys. I had all those lights in my home and with all the rain that we have had I had them under the porch in the back of the house underneath, not outside but under. With all the rain and cloudy days every night they were on the entire night. Took one of them, took it inside the house and left it inside the house over 30 hours of the flashing without any sunlight inside the home. The steady was about 26, we really didn t time that one good enough. But over 24 hours or 26 hours we are able to get out of a charge. They only require 2.4 volts and they shut off at 1.7. They never reach 1.7 because it is so low it doesn t shut off itself. Mr. Morgan: What is the different application between this one and that one? Mr. Masdalawi: Well that one is made to be placed on bare walls on the side or on top of a curb. They are not made to be driven on. They can withhold 10,000 lbs. but the problem is they are only attached with epoxy. Mr. Morgan: You mentioned something about our amount of curve in the roundabout. What application are you talking about for that? Would that go on the curb itself or on the ground around the curve? Mr. Masdalawi: We can put it in concrete or asphalt. Mr. Kapish: Or pavers? Mr. Masdalawi: Or pavers. Exactly because we have pavers in those areas. The reason we wanted to put these in the curve is because we had conditions, boats and people with attached things or landscapers they would go on top of the roundabout then they will destroy your investment. We don t want to do that. We have experienced that these over here if they are not out of the traffic and they get hit we are wasting money by doing this. Mr. Ozyman: Those are more pedestrian lineators. 11

15 June 26, 2017 Mr. Masdalawi: We are talking with the Turnpike use it s better or on 95 things like that or they can be used for MOT like on top of the curb specific but for an investment that we are looking at as a permanent, we need to make sure that we get it set up right. Mr. Ozyman: How easy is it for the District to replace let s say one comes loose? Mr. Masdalawi: What we do is that we pour 6 inch diameter. We only go 2 ½ inches. Even though it is 2 ½ inches we only need ½ inch. So when we take it, Gilbert if you could be so kind for example here is where we took it out. You take it out and then in the same area we come back with the epoxy and we put it back in there. It is as easy to put it back in as it is to take it out. Same thing. We go exactly over the same mark. Mr. Soles: The epoxy that we are using is sealing the asphalt, what you don t want is the water getting underneath the asphalt. If there is a pocket it could create a problem. The epoxy that we are using is MR 29 epoxy that actually seals the entire thing. It has been approved in Ohio where it snows and all that. So that is one of the things that we are really cautious about. Mr. Carney: How do you do the installation in the roadway with pavers? Mr. Masdalawi: We are going to pour the same way that we are pouring in concrete and everything. Now if it becomes a situation where it is going to be a problem because the pavers are sitting in sand, we will probably take the pavers out and we are probably going to have to go and create a concrete area to be able to put the lights in if it is sitting in sand because that would be a problem. Mr. Carney: If the pavers are sitting in sand correct? Mr. Masdalawi: Yes but I think the one I looked at they were sitting in concrete. Mr. Kapish: At the roundabout? Mr. Masdalawi: Yes. Mr. Kapish: They are on the compacted, the same compact that you asphalt on. Mr. Carney: It is only a concrete border. Mr. Masdalawi: We can place the lights anywhere we want so right now with the pavers we have to place them in the crosswalks. Mr. Kapish: You mentioned about putting it in the concrete bands. 12

16 June 26, 2017 Mr. Masdalawi: Yes that is what I was going to say. Mr. Kapish: You mentioned that the roundabout you would put it in the flat part of the curb. Mr. Masdalawi: Correct. Like over here we can avoid and we can go in front and over here there is a concrete band we can put it in the concrete band here. These we can put in the concrete areas in the curb so those would be sufficient. Mr. Kapish: So if you f curb you would be putting it like, say this was the up part of the curb, you would be putting it here but not all the way up. Mr. Masdalawi: Right because is slopes just a little bit. So it would be ideal on the high side. Mr. Ozyman: Even if there is no band it is just my guess that if somebody wants to steal or vandalism it would be very easy to take out a paver. Mr. Masdalawi: We would have to have a stable ground. To me it looks like those pavers are in pretty good condition. That is why I thought it was stamped concrete. Mr. Ozyman: It has a one inch sand bed underneath. I don t know if it is one inch now but that is how they were put in. Mr. Masdalawi: If it is in sand we would probably avoid it and we would put it in the concrete band which is we have the option to be able to do that in this case. Mr. Carney: One more question. I notice you have a five year warranty. What does that cover? Mr. Masdalawi: Everything. Mr. Carney: Parts and labor? Mr. Masdalawi: Right now we are doing work furnishing and install so we would be responsible. Ms. Karnegis: How long have you been in business? Mr. Masdalawi: This is a whole new technology that is taking place. We have been working on this for four years now. We got our approval from DOT three years ago. This is the first approval in the country so this is cutting edge technology that is taking place here. We are proud they are made here in West Palm, Florida so we are creating our 13

17 June 26, 2017 products here that is really new in the market. Solar markers typically like these have been in the world for about 12 years maybe but has never been robustly made to be able to withstand traffic. So you can imagine any electronics getting hit by cars is going to be a problem. So we are actually the first to take a product and put it below the ground. It makes logical sense obviously because all the components are buried and protected but you can drive on it. So this new technology is new that is taking place. However the concept and the components inside has been similar. I have seen it where it has nine years of actual products based in Korea. Korea the same concept of having LED lights, not the same like this but obviously similar that they used. Mr. Ozyman: I was reading an article in the papers and I forgot which state but they started using similar panel crosswalks. Slowly maybe in a few years all the asphalt will be panels. Mr. Masdalawi: Solar technology is the way of the future right now for us. I know in the last ten the computer was huge and now look, we have everything here at our fingertips so once we get the footprints to be able to be small enough we will be able to accomplish a lot of things. This is a new technology that is approved by the DOT. We are the first company ever to be approved by any state agency. Gilbert, he used to work with the DOT for 30 years as state engineer and he knows that many people have applied to be approved and they have never been approved. First time so it is definitely a great aspect here. Of course for you, you are protected because if there is any problems with the lights we would come and replace them no questions. We have done that for a couple of municipalities that lights didn t work. No questions, we came in, took them out, and put in new ones. The beauty of what we have here is there is no wires, we come in and in a couple of hours we are done. Mr. Ozyman: What would be your response time to replace or repair? Mr. Masdalawi: It depends on what is going on because everything we make we make to order. So it depends on how busy we are but within a couple of weeks depends on what we have here. Our goal is to be able to provide really an effective solution for many communities. Just the thought of anyone you know that just has a hard wire system 14

18 June 26, 2017 with conduits and electric and everything is just takes everything out of any possibilities and the cost becomes pretty challenging. Mr. Pfeiffer: So the warranty covers the light fixture and the installation. Mr. Masdalawi: Yes sir. Mr. Pfeiffer: Ok. Mr. Kapish: How many of these would be put in? Mr. Masdalawi: At this particular point I think we have submitted 249. Mr. Baldis: I have a question. You are saying that you are doing the installation, what if you get so busy that you hire a sub-contractor, how is that going to effect the warranty or is it the same? Mr. Masdalawi: That question came about the cost on installation because right now we are paying for the cost of installation so if a contractor is going to be doing that project we would have to work with them to make them understand that if there is a situation what we would do is we are going to go ahead and come with our forces. Mr. Baldis: It would be the same. Mr. Masdalawi: I can t ask the contractor to come back. They have done their job so it is going to be the same. Mr. Baldis: I got you. Mr. Masdalawi: We are not trying to be in the installation business but because it makes it cost effective and everything that is why we do it. Mr. Baldis: What do you need from the Board now? You have given your presentation. I don t know if there is any more questions but what is our next step for them just to discuss this? If they agree to this and they decide this is something they would like to move forward with what are they going to be required to do? Mr. Masdalawi: We developed the plans and we are doing it free of charge to be able to get this going so what we would like to do is we would like to move forward with this plan and try to then start the process of reaching out to the county officially. Reaching out to the city officially to be able to start taking the signs off and also to be able to go ahead with the process because we have to work hand and hand. We are taking down the signs 15

19 June 26, 2017 and we are replacing them with lights and that is what the county is looking at. We are taking something but we are putting something better. Mr. Baldis: What do you need from the Board to do? Mr. Masdalawi: What I would like for you guys if you would be kind enough to approve this project. Mr. Baldis: Can you them or send, or do you have something they can take with them and then at the next meeting they can discuss if this is something that this is going to move forward with? Mr. Masdalawi: Yes sir I can. Mr. Baldis: If you can send it to me then I can forward it to all of them so they will have two weeks to look at it, think about it and decide if they want to go forward and to what extent. Mr. Soles: We would forward you a proposal with a plan sheet. That would give them an opportunity to review the plan sheet. What is going to go on and what the cost proposal is of that. Then we can go from there after that. Mr. Baldis: One thing that we spoke about out in the field is that I would want something from Broward County saying that we can take these signs out. I don t want to put these in and have the signs and it look like a circus. Lights and signs everywhere. So we would need something from them to assure us that we are not going to need all these signs. Mr. Masdalawi: Our proposal that we are going to send to you is going to be twofold. One fold is going to be able to go ahead and take care of the signs first and then come back with a conclusion about what signs are going to have to remain. Whatever we can work out with the county and the city we will report to you. Then of course the plans are already defined. They also have to approve that plan, the city and the county. They approved others so it is not going to be any problem approving what we have here. So that will be the two-folds that we would be getting that before we start you will know exactly that these are the signs that will remain and these are the signs that will be replaced. Mr. Baldis: Alright. 16

20 June 26, 2017 Mr. Masdalawi: The proposal will encompass all of that. So we are getting the effort of getting all the engineering elements included as part of the process. Mr. Kapish: How long is the process assuming that we go ahead with the project, would you first apply for a permit from the city? Mr. Masdalawi: For the sign removal? Mr. Kapish: Yes. Would you apply for a permit from the city and the county? Mr. Masdalawi: Yes. Right now the county, the way Scott was sharing with me, the city comes back to the county and asks them because they don t have the expertise, are you ok with this arrangement. So we are going to get the blessings of the county saying yes, we are ok with this arrangement but the approval is going to be pretty much from the city. Mr. Kapish: So what is the installation time to put these in? Mr. Masdalawi: For us I would say three or four days. We will do it during the working hours. Off peak hours. Mr. Kapish: Assume that we are doing this and today is the 26 th what would be the ETA on this as far as getting this installed? Would it be 60 days? 6 months? Mr. Masdalawi: It would take 30 days for us to get you the lights in the ground. The time for us to get the approval from the county for the signs from the city, that is probably longer than that. Mr. Kapish: That is why I was asking. Mr. Masdalawi: That I don t know because we are going to push to get them to process it quickly and to go forward with that. Because of our relationships with the agencies it shouldn t take too long, maybe 30 days. Let s say worst case scenario within three months everything will be done. That is once you say let s go. We can t reach out to the county or anybody without your blessings. Mr. Ozyman: Do you do your own survey to stakeout where you are going to put the lights and all that? Mr. Masdalawi: Yes. We do all of that. Mr. Kapish: What is the cost of this project? 17

21 June 26, 2017 Mr. Soles: We don t have a proposal yet. We just did the plan sheet with the total lights. We haven t done a proposal for you yet. Mr. Masdalawi: I have one question because we can go ahead and come up with a plan to be able to say what sign is going to be removed but do you have the forces to be able to remove those signs or do we need to get someone? Mr. Baldis: We can get them out. Mr. Masdalawi: Ok. So in our proposal we are just defining what is being removed but you guys will remove them then. Mr. Baldis: Part of what we are also going to have to deal with is we have a license agreement with the city. This is probably going to be changed to them and that is going to have to go to the city commissioner so when you are talking to them my understanding is we need someone from the city to request this and that we can t. Mr. Kapish: Doesn t the license agreement we got for the roundabout itself to do all the modifications to the roadway? Mr. Pawelczyk: I just brought it to Dennis saying that is likely you are going to have to amend the license agreement. Mr. Baldis: It is something we are going to have to look into. Mr. Pawelczyk: I don t know for sure but I am 90% sure that we are going to have to do it because you are changing the approved project. It shouldn t be an issue. I would think the city would want to do it. Mr. Baldis: It is just something you are going to have to be aware of. Mr. Pawelczyk: When you are approved by the city, Dennis can give you a copy of that agreement. Those are city streets and the CDD is allowed to improve them with a roundabout which is now owned by the city. We gave it to the city. The medians we do the landscaping with the medians. Basically the city is responsible for the pavement and the curbing in essence but we the CDD kind of maintains everything. Mr. Masdalawi: The city and county, the main issue is that we are doing something that conforms within the CDD. That is what they are looking for and that s what we are. 18

22 June 26, 2017 Mr. Baldis: So are you good with that? They send it to me and I get it to you folks and we can look at it for two weeks and come back. Mr. Pfeiffer: Sounds good. Mr. Kapish: Anybody have any questions? Ms. Karnegis: How much does one of the lights like the one you have in your hand, how much does that cost to install? Mr. Masdalawi: I think about $250 to install. Our object is to make it as economical as possible because we are looking at value. A resident: What is the material of the casing? Mr. Masdalawi: Cast-iron and polycarbonite lens. Polycarbonite is very strong. It will have scratches on it and it doesn t effect and all of our polycarbonate units have the UV inhibitor in them so they won t change color when the sun hits it over time. Mr. Pfeiffer: Do you have any competition? Mr. Masdalawi: Right now we are the sole source. This is the first of its kind that is taking place. Mr. Baldis: Thank you. I appreciate it. Mr. Masdalawi: I am a traffic engineer. It is my passion to save people s lives and we have done several projects where we have actually reduced many crashes. It is rewarding to look at it. I am making a difference and that is more important. It was definitely a challenge to put this proposal together. It is not easy. We have been reached out by the University of Florida in the City of Gainesville because they are working with tons of vehicles. There is so many things and the Turnpike also wants us to advise them, they are doing express lanes. Mr. Pfeiffer: I know in Florida one of the biggest problems with senior citizens is they have night blindness so this is a great market. Those people can t see at night. Mr. Masdalawi: I appreciate all your time. Thank you. Mr. Kapish: Ok we are going to move onto discussion of Broward County regarding drainage. 19

23 June 26, 2017 SEVENTH ORDER OF BUISNESS Discussion with Broward County Regarding Drainage Mr. Kapish: If everybody remembers which I am sure you do, I guess it has been about two weeks ago that we had the heavy rain that went on for days. We had street flooding. We had so much flooding in the lakes under the powerlines that the lakes under the powerlines became one huge lake and saw no boundaries. Some of lakes in Coral Bay was even worse where it went into people s homes. Dennis worked very hard and very diligent in trying to get that to be resolved as soon as possible. Mr. Baldis: This is what happened and why the streets in Turtle Run flooded. Coral Bay was required to put fish gates in because they wanted to install carp in their lake to help control the weeds instead of using chemicals. Those grates got clogged with weeds, debris and all this stuff that goes into the canal. The gates were put on there to stay on there. They were put on by the industrial divers that we use to inspect our pumps. It was a huge effort to get them off so until they were able to get them off the water backed up and caused the flooding. Once they were removed the water drained the way it was supposed to drain. I asked Mr. Crouse to come tonight to explain because I understand why it happened and what was done to resolve it but after the fact the Turtle Run lakes were drained to seven feet which I have never seen in my 30 years and that is 2 ½ feet below the designed level. So I asked him to come to explain to us how they handle that situation and why it was so low and just how they managed the water. I have some other questions. I have talked to South Florida Water Management and I have a call into the lady here in Broward because Turtle Run and Coral Bay are being identified as Water Control Districts and Drainage Districts on those websites. The emergency number for one is Mr. Pawelczyk which is our attorney. The other gentleman works for us but he doesn t work for Turtle Run. We are a Community Development District and it is very misleading to the public when they call up and say, what are you doing with the canal levels and I say I don t control that, Broward does. They go no they don t, it is on the website. So they think I am being untruthful and I don t want to resent that so those are the questions we are kind of curious about. 20

24 June 26, 2017 Mr. Crouse: A lot of things in life are balances. This is one of those things. You can have too much water in the system when it rains a lot and you have too little in the dry season so our goal is to try and keep the water level about 2/10 higher or 2/10 lower than the control level. We try and keep it in that range of 4/10. This is how we go about doing it. It is kind of applied common sense but that is what engineering is anyway. We call it the Goldilocks principle because it is like the porridge, it is too hot or too cold so we want it just right so we use our friend Goldilocks to emphasize that. What we do is we have control charts of hard data on Colonial Drive to south of you all and to the south of Coral Bay and the main canal that runs north south goes to that control structure. So the county operates that control structure and the reason why we do that is that the Broward County Administrative code authorizes this when there is multiple municipalities involved and because there is Margate and because there is Coral Springs involved that is why we have authority to have that structure and to operate. So we operate that structure and we are fortunate in this part of the county because we are a little bit higher topographically then other parts of the county so we drain out by gravity we don t rely on electricity. It could be knocked out during a storm like people down in Mirimar and Pembroke Pines and all that have to pump out their water. We have gravity, a more reliable system. We can open gates and discharge water. So we are in an advantage to that. Looking at the fourth slide it shows in bleak image of the whole north part of our county and it shows what we do with our recharge system and our drainage system. So this goes the whole way down basically to Fort Lauderdale airport and goes on each side to about 195 and on the west side over to say Route 7 in that area. In this area the topography varies tremendously and our water level in our canals vary from about 11 down to about 2. So we are almost tidal by the time we get down to the southeastern corner of the area that we are talking about. So operationally what we do all the time and what we are looking at for is first of all where do we want that level in the canals and that can vary a little bit seasonally but we figure out where that is, where we want it and where it is now. What is happening with the ground water? Has it rained recently? Is there still ground water in the soil that hasn t come into the canal system yet or has it been really dry like it had been a few weeks before. 21

25 June 26, 2017 We were actually recharging the system and pumping water into the Hillsborough canal just a couple weeks before this whole incident happened. You may remember we were in that drought period. We also look at the weather forecasts. We look at NOAA. We look at the National Weather Service. We look at South Florida Water Management District that have a couple of meteorologists on staff. They do a forecast every day and they update it. The drought monitor on page 6 shows that in May of 2015 we were in this extreme drought and we had a big rainfall then not too long after that and we came out of it. The next page is another application that South Florida Water Management has, it is called Raindar. So it is a radar estimation of how much it has been raining and they can do this practically instantaneously. It is an estimate so it is not like they have a rain gauge where they come out and measure it but rainfall of course can vary from point to point to point so this is in some ways a better system of estimating rainfall over a larger area. In this particular case and the September 2015 example that is not in color but if it were it would show a red area by Markham Park that had about four or five inches in a relatively short period of time. The next page is what has been happening over the last 26 years. We drew all the rainfall on here and we did a trend line and it shows there is a steady decline in the average annual rainfall when you put a trend line in there. That doesn t mean that it is always going to go in that direction. It may come back up we don t know. The next page after that shows seasonally what happens. Up until this year June was very consistent and pretty flat but this year we had that big rainfall in the beginning part of that so that kind of changed things. It could change any month of the year could be high or low. So we look at all these weather forecasting elements, we looked at where we are right now and we participate in conference calls with the South Florida Water Management District. We just finished conference calls with the National Weather Service and what is happening with the weather conditions. This morning I was just at the local mitigation strategy meeting at the Emergency Operations Center and the NOAA representative that does a lot of the forecasting was there talking about some of this stuff. So we have to stay tuned to this and we do. Another website that South Florida Water Management District has is the actual radar and satellite infantry that they put out in real time. The next page shows 22

26 June 26, 2017 which is really a movie but there is a big chunk of red and orange headed right towards Fort Myers. So that time was September 29, 2015, Fort Myers is about ready to get blasted with a decent amount of rainfall. The next page is some of the applications from NOAA. They have come through and this is when tropical storm season is which we are in right now. This shows you, this was tropical storm Joaquin. This was actually captured from the screen of what happened back in 2015 with Joaquin. At one time it was showing to be it is just a tropical storm, that is what the little s s mean along the path there. Then a couple days later went, oh well our new forecast is not a tropical storm anymore, it is a hurricane. It is not just a hurricane, it is a major hurricane. So it turned into what was projected to be a major hurricane. Conditions vary and we are always paying attention to what is going on. The next couple of pages are part of that weather information that we get from South Florida Water Management District. It is all available on a public website. It shows in this particular case that we were scheduled to have a lot of rain. It shows there that we were scheduled to get several inches of rain in that particular time. Two inches of rain on Thursday, October 1 st. Well what happened was the system turned in another direction, kind of like what Hurricane Matthew did. Thank goodness last year and when the forecast came out a couple days later it was much drier. So it is kind of damned if you do and damned if you don t. If we start dumping water real early or we get rid of too much water and then we are too low but if we don t get enough water out in time then we are too high. So we really have to pay attention. It takes some time to drain that system down in some cases. We work 24/7 and 365 days. We have operations people that are available around the clock and we do operations around the clock. There is other information that shows you what is happening for a longer range projection. NOAA predicts what is happening in the next three months if you are going to be above average precipitation or below average, above average temperature or below average. These are just things we keep our eye on as we go down the line. Our gates down at the Colonial Drive are variable at those locations so we can open gates up and let water through or we can set the gates a little bit lower and let water go over the top of them depending on what we are trying to do. So we do some of both depending on those conditions. Over the years we sort of developed 23

27 June 26, 2017 part of an expert system that these rules of thumb that Turtle Run doesn t have as much water in it as Coral Bay as far as the lake area so if it rains in Turtle Run a lot of it is going to hit the pavement. It is going to hit grass and it is going to soak into the ground or it is going to end up in the water bodies. For example if it is 15% is the lake area or the water body area, that other 85% of the water is going to end up getting there especially when the ground water is saturated like it was. So this was one of the factors we took into account in the beginning of the month when we said hey, what is happening here. We are in the wet season now so we could intentionally go a little bit lower to be safer to not flood people especially since there was a problem with the fish grate. If we have a lower table water on your water crossings there even if the areas remain clogged there is more of head to drive the water through. So that was able to provide a little more relief from what you had. We have had to err on the side of drawing it down a little bit more than normal and figuring that because of the time of year it was and because it has rained a lot recently which it is projected to rain some more they will fill back up fairly soon. I believe it did a few days later, it was pretty close to back to where it was. The last few pages talk about what happened on June 7. The first one is from the National Weather Service. It shows about 10 inches or so that occurred in that 48 hour period leading up to 8:00 in the morning on June 7. The slide before that was the South Florida Water Management District rain guard estimate that showed it was a maximum of about 10.8 but that was a little bit to the north so we figured about 10 inches and that was in a 24 hour period so those numbers were fairly close. The last photo for the last slide shows that the South Florida Water Management District kind of did a similar thing on the Hillsborough Canal to the north. They drew that down to the point where we had launched a boat into the Hillsborough Canal because our canals tie into that and we had to check out a couple of things by boat but we couldn t get the boat back to the boat dock because there were shelves that were created because they had lowered the water so much. We had to wait for the Hillsborough Canal to come back up before we could get our boat back into the trailer and carry it away. So what it all comes down to is Yogi Berra rest in peace. A good manager. Make a game plan and stick to it unless it is not working and then you have to change it. 24
