3 109 Functions and powers Ngā Mana Whenua o Tāmaki Makaurau Collective Redress Act 2014 (1) The Maunga Authority has the powers and functions conferred on it by or under this Act or any other enactment. (2) In exercising its powers and carrying out its functions in relation to the maunga, the Maunga Authority must have regard to (a) the spiritual, ancestral, cultural, customary, and historical significance of the maunga to Ngā Mana Whenua o Tāmaki Makaurau; and (b) section 41(2). (3) In exercising its powers and carrying out its functions in relation to the administered lands, the Maunga Authority must have regard to the spiritual, ancestral, cultural, customary, and historical significance of the administered lands to Ngā Mana Whenua o Tāmaki Makaurau. [Emphasis added] 41 Maunga must remain as reserves vested in trustee (1) This section applies to each maunga once the maunga is (a) vested in the trustee under subpart 1, 2, or 3 of this Part; and (b) declared a reserve under any of sections 18 to 29, 33, and 39. (2) The maunga is held by the trustee for the common benefit of Ngā Mana Whenua o Tāmaki Makaurau and the other people of Auckland. Pakuranga Tennis Club Incorporated Lease Moved: H Rawiri, Seconded: K Parkinson, That the Tūpuna Maunga o Tāmaki Makaurau Authority CARRIED a. resolves to publicly notify pursuant to s119 of the Reserves Act 1977 an intention to grant a lease to the Pakuranga Tennis Club Incorporated for a term beginning at the expiry of their present lease and ending on 30 June 2019 with a right of renewal of a further one year until 30 June This resolution is made to meet the directives within the Tūpuna Maunga o Tāmaki Makaurau Integrated Management Plan and aligns with the values and pathways set out in the Plan. The intention is to place the health and well-being of the Tūpuna Maunga at the heart of this decision. b. recognises there may be submissions, in response to the public notice, and a hearing pursuant to s120 of the Reserves Act 1977; c. delegates to the Chair and Deputy Chair the power to execute a lease, including a Maunga Outcomes Plan, with the Pakuranga Tennis Club Incorporated on the standard terms and conditions. The Chair and Deputy Chair are delegated to confirm a lease rental (being a market rental as determined by a registered valuer with due consideration for any contribution to the health and wellbeing of the Tūpuna Maunga) ; and d. delegates to the Chair and Deputy Chair the power to agree to terms governing the withdrawal of the Pakuranga Tennis Club should the Club decide not to accept the lease. 7 Agenda July Auckland Kindergarten Association Lease Moved: Deputy Chair A Filipaina, Seconded: K Wilson, That the Tūpuna Maunga o Tāmaki Makaurau Authority a. resolves to grant a lease to the Auckland Kindergarten Association Incorporated (AKA) for a term beginning at the expiry of their present lease and ending on 30 June 2019 with a right of renewal by AKA of a further one year until 30 June This resolution is made to meet the directives within the Tūpuna Maunga o Tāmaki Makaurau Integrated Management Plan and aligns with the values and pathways set out in the Plan. The intention is to place the health and well-being of the Tūpuna Maunga at the heart of this decision. b. delegates to the Chair and Deputy Chair the power to execute a lease with the Auckland Kindergarten Association at a market rental (to be determined by a registered valuer), including a Maunga Outcomes Plan, and otherwise on the standard terms and conditions. The Chair and Deputy Chair are delegated to confirm a lease rental (being a market rental as determined by a registered valuer with due consideration for any contribution to the health and well-being of the Tūpuna Maunga). c delegates to the Chair and Deputy Chair the power to negotiate transition terms if the Auckland Kindergarten Association Incorporated decides not to accept the lease. 8 Northern Sports Car Club Incorporated Lease Renewal Moved: K Parkinson, Seconded: H Rawiri, That the Tūpuna Maunga o Tāmaki Makaurau Authority CARRIED a. resolves to accept the exercise of the right of renewal of the existing lease to 31 October 2021 by the Northern Sports Car Club Incorporated, b. directs Management to conduct a rent review to a current market rate pursuant to the existing lease, c. authorises the Chair and Deputy Chair to make any decisions on the rent review with any consideration for contribution to the health and wellbeing of the Tupuna Maunga, d directs Management to request the Northern Sports Car Club to agree to Maunga Outcomes Plan. 13 Agenda July 2017 Attachment A Attachment A Health and Safety Register reported to Maunga Summary of incident Number of any near misses Outcome of investigations into any incidents and near misses Health and Safety management matters arising Actions Taken 28 Maungawhau Cyclist had a near miss with the exit chain while biking down the Clive Road exit. 2 There are 2 reflective sleeves that cover most of this chain when it is up. The sleeves are regularly checked to ensure they are in working condition. Management are looking at options to slow cyclists down when they are riding downhill 28 Maungakiekie Reported that an assault took place up near the tihi on the 14 th of June at midday. It was reported by the police that it was an attempted aggravated robbery and two couples were involved. Police are currently working on the case. Cornwall Park Trust informed of incident, however there has been no contact with Cornwall Park Trust from the Police. On-going prompt communication between police and the Tūpuna Maunga team for future incidents. Police informed of connecting with Cornwall Park Trust around accessing entrance way camera footage. Police are investigating and victim has been spoken to by Tupuna Maunga team. Ongoing correspondence with Police, Cornwall Park Trust and the victim until the case is resolved. 26 Maungarei Bare footed visitor identified rusty spike of an old waratah (redundant and partially removed farming infrastructure) poking approximately 6cm out of the ground at the point near a track as a puncture wound hazard for walkers. 1 reported Staff on site assessed as dangerous Potential risk removed Remaining section of rusty waratah removed with as little soil disturbance as possible and recycled 26 Te Pane-o- Mataaho Recent storm damage to group of old macrocarpas near summit track 0 reported N/A (no data on any near misses, but large branch fell very near one section of track) Risk of tree failure and branches falling onto track Arborist report info gathered. (5.45 am) They rode into the chain causing damage to himself and his bicycle. 1 Staff assessed the chain and worked with our contractor to find a better solution. Reflective tape on the chain gets worn out periodically from being dragged across the road during gate lock/unlocks. Re-applied high visibility tape across this chain. Maintenance contractors will monitor the chain and re-apply as required. Hi visibility chain sleeves will also be put on. 26 Maungakiekie While walking near the archery club a visitors foot fell into a small sunken hole that was covered by kikuyu 1 Contractors located the hole and filled it in. Hole has been filled. 26 Puketāpapa Quarry face exposed following removal of weedy vegetation that was blocking views from the carpark below the tihi. 1 A section of mesh fence was put up and flax were planted previously to create a barrier for people. Increased current fall risk as more weed trees were removed, the natural barrier was also being removed Additional temporary fencing installed 25 Otahuhu Large pine tree fell across ring road leaving a hanging branch on a nearby tree 1 Aborist and contractors responded within 2 hours to tape off the area and made the area safe by removing the branch and cleared the debris blocking the road. Potential risk to visitors accessing the maunga Dangerous limb removed 25 Maungawhau Received feedback that some visitors have been seen slipping on sections of badly eroded track. 2 Exposed roots and pipes are spray painted to make visitors aware of the hazard. Emergency services responded and the area was cordoned off until blessed. 1 Management contacted the Taonga Trust who assisted with the blessing of the site. No H&S matters identified Maunga blessed, no further action required. 24 Ōhuiarangi Management identified a potential risk to visitors with a cut hole in the safety fence about the quarry 1 Management logged urgent job and contractors undertook repairs. Potential risk to visitors accessing the tihi Fence repaired 24 Maungakiekie Management identified a risk to visitors around the top of the old quarry. 1 Management to consider installing warning signs indicating steep cliff Potential risk to visitors accessing the tihi Management to consider installing signs on fence to identify risk. 24 Te Pane-o- Mataaho Dangerous tree reported by staff near track after recent storm event. Track was used by pedestrians to access the tihi. 1 Had arborist inspect the tree for safety, recommended maintenance work to be carried out to ensure safety of public. Area has been cordoned off to restrict access.. Arborist scheduled to undertake maintenance work. 24 Maungakiekie Dangerous tree, threatened safety of pedestrians and vehicles 1 Immediately closed the access road and footpaths, arborist team removed the limbs within 2 hours of the issue identified. Potential risk to visitors accessing the maunga Dangerous limb removed 24 Takarunga Management received a fire report relating to the Bunker on Takarunga. The report identified a number of issues with the building that needed to be addressed to ensure 2 Management have relocated the lessee to another facility until the full extent of the issue is understood and addressed. Potential risk to visitors using the Bunk for events. Relocated lessee to anther premises, identifying risks and issues with NZ Fire Service and AC Building Compliance team. 16 Agenda July 2017 Attachment A reported to Maunga Summary of incident Number of any near misses Outcome of investigations into any incidents and near misses Health and Safety management matters arising Actions Taken safety of users of the facility. 24 Maungawhau A young male injured his foot when a spike from an old warratah post went through his shoe. 1 Management have located the section of track where this occurred and have laid matting down to prevent further injuries. Physical work to upgrade this track begins in late March. Potential risk to visitors accessing the maunga. Spike buried in ground again and covered over by matting. This section of track will be re-routed in the track upgrade. 22 Takarunga Concerns raised by management regarding the fire place in the Bunker. The fire is used to heat and keep the building dry during the winter months. Concerns were raised when the guard on the chimney heated up when the fire was in use, potentially resulting in members of the public burning themselves. 1 Management spoke to the Bunker operators and asked that not more fires be lit until we have completed a safety & fire inspection. Potential risk to visitors touching the chimney guard and risk to guests of the Bunker Safety and fire inspection has been actioned to review all aspects of the Bunker operations in regards to fire and associated risks. 20 Otahuhu Complaint received regarding an injury received (twisted ankle) due to the lack of sport field lighting on the training field on Otahuhu. 1 The field is a soil field which means it is unsuitable to be used outside daylight hours. There are currently no lights installed. The arrangement with the sports club is that they book hours during which the field will be used in this case the field was being used outside the bookable hours. One injury (twisted ankle) has been reported with the potential for further accidents if the field is continued to be used after hours. Management will meet with the Otahuhu League Club to discuss the use of the field in the evenings and health and safety obligations. The incident occurred within gate opening times. 1 Management have reviewed the Police information and will wait for the Police investigation to be completed. Management assessment is that this was a rare and isolated incident. There is little further we can do to prevent such behaviour however we will review this with NZ Police. Management are working with the NZ Police 20 Mt Roskill Male taxi driver assaulted in the lower car park of Mt Roskill. Incident occurred within park opening times. 1 Taxi driver admitted to hospital, NZ Police are investigating the incident. Management assessment is that this was a rare and isolated incident. There is little further we can do to prevent such incidents however we will review this with NZ Police. Management are working with the NZ Police 19 Maungakiekie Pedestrian and vehicle related incident on the access road to the tihi 3 The road alignment and lack of footpaths to the tihi has resulted in the potential risk to pedestrians walking to the tihi. The road is increasingly popular for walkers and runners and will increase due to the planting of the trees. Potential health & safety risk to pedestrians. Have reviewed speed signs and will install a shared sign to indicate to drivers the need to comply with speed limits and other users.. 19 Maungakiekie Visitor tripped on path and fell injuring himself 1 Staff assessed the area and path and although the path is in good condition there is a capacity issue with the number of visitors using this path during high use times. Potential further issues relating to the volume of traffic and design of the asset. 19 Maungakiekie Pest control contractor felling into hole while undertaking a night shoot. 1 Incident was investigated and concluded that when the incident occurred the contractors Risk to public and contractors. Hazard has since been filled in to remove the hazard. 18 Maungawhau Cyclist fell off bike at speed hump on downhill section of road. 1 Speed signage already installed; install an additional speed sign on section of road to inform cyclists of appropriate speed Non compliance with speed signs resulting in injury 18 Ōtāhuhu Wasp nest discovered 1 Contractors were notified and have destroyed the nest Potential health and safety risk to visitors and volunteers 17 Maungakiekie Local user expressed concern that people were injuring themselves using the skate park bowl because of its dated features and surfacing. No specific incident reported. 0 Management will engage a skate park specialist to look at the site and make recommendations for improvements. Safety assessment of recreational infrastructure 17 Maungawhau Wasp nest discovered 0 Contractors notified and will destroy the nest Risk to visitors and volunteers 17 Maungakiekie Child fell off flying fox and broke his arm 1 Management have carried out a safety assessment to ensure it complies with playground standards. Note there has not been any recorded incident relating to this request. 0 There are no specifications regarding the installation of fences around playgrounds. Advice received is if the playground is within 5 meters of a road, fencing should be considered. The Maungawhau playground is positioned on average 10 metres from the road. The assessment considered the location and provided the following recommendation: The play space is located well back from the road (average 10m) and there is planting, a footpath and a low post and rail fence between the playground and the road; all providing a sense of enclosure for the play space. Safety assessment of play equipment 17 Maungawhau Contractors threatened by homeless man 2 Police were notified and removed the individual from the site Safety of visitors, volunteers, contractors and staff 16 No health and safety incidents reported for this period 15 Matukutūruru Risk to visitors falling off quarry cliff 0 Staffs have investigated and will be placing hazard signs at entrance to the Maunga to ad- Serious health and safety risks if signs are ignored Tūpuna Maunga o Tāmaki Makaurau Authority Agenda - 28 Page 19
