5 PRESBYTERY OF SHENANDOAH MINUTES OF THE 154 th STATED MEETING The 154 th Stated Meeting of the Presbytery of Shenandoah was held at Lexington Presbyterian Church, in Lexington, Virginia, at 9:30 a.m. on Tuesday, May 8, The Moderator, Ruling Elder Dr. Paul Dana, called the meeting to order with prayer. WORSHIP Worship was planned and arranged by the Maury River Mission Community, members of which led the service of worship and Celebration of the Lord s Supper. The sermon was preached by the Rev. The Rev. David McKee, Synod of Mid-Atlantic Executive, was seated as a corresponding member (Presbytery of Western North Carolina), as well as the Rev. Helen Locklear, Board of Pensions Regional Representative (Presbytery of Coastal Carolina), and Ruling Elder Orlanda Carr, Presbyterian Foundation (Presbytery of Charlotte). The Rev. William Klein welcomed the commissioners to Lexington and gave a brief history of the church. APPOINTMENTS The Moderator appointed the following: Assistant Clerks - Rev. John Haney, Ruling Elder Karin Cron of Bethesda Church and Ruling Elder David Wade of Timber Ridge Church. Parliamentarian Rev. Fred A. Holbrook MINUTES OF FEBRUARY 11 and APRIL 17, 2012 The Body approved the minutes of the stated session held February 11, 2012, as distributed. The Body approved the minutes of the special session held April 17, 2012, as distributed. The docket was adopted as amended. (See page 60) DOCKET COMMUNICATIONS AND REPORT OF STATED CLERK The Rev. Daniel S. Williams, Acting Stated Clerk, presented the following report, which was approved: I. FOR INFORMATION: POLITY CORNER: ELECTRONIC MEETINGS Robert s Rules of Order, Newly Revised, 11 th Edition (RONR) is available in a new edition, published in September According to G , this edition is the parliamentary authority for all meetings of councils within our denomination. This new edition of RONR has guidance on electronic meetings, which was not covered in earlier editions. To hold electronic meetings, RONR stipulates that they must be authorized in the bylaws of the organization. (In our churches, this authorization usually would be expressed in the council s operations manual.) Here is what RONR says on the subject: Among some organizations, there is an increasing preference to transact business at electronic meetings that it, meetings at which, rather than all participating members being physically present in one room or area as in traditional (or face-to-face ) meetings, some or all of them communicate with the others through electronic means such as the Internet or by telephone. A group that holds such alternative meetings does not lose its character as a deliberative assembly (see pp. 1-2) so long as the meetings provide, at a minimum, conditions of opportunity for simultaneous aural communication among all participating members equivalent to those of meetings held in one room or area If electronic meetings are authorized, it is advisable to adopt additional rules pertaining to their conduct. (RONR, p. 97, lines 15-32) The need for simultaneous aural communication is consistent with the Historic Principles of Church Government first stated by our denomination in 1797: Decisions shall be reached in councils by vote, following opportunity for discussion and discernment, and a majority shall govern (F ). 53

11 The authorization for electronic meetings would most properly appear in the manual definition of meetings. For instance, the Manual of Shenandoah Presbytery defines meetings in its procedural rules: Kind of Meetings: Besides stated meetings there are adjourned meetings and special meetings. To allow for electronic meetings, something like the following should be added to this passage: Presbytery and its committees, task forces, and entities may hold electronic meetings so long as the opportunity for simultaneous aural communication is maintained. As to additional rules governing electronic meetings, RONR suggests the following: Notice for the meeting should give adequate instructions as to how to access the meeting electronically, especially the Internet address or telephone number to use. The type of equipment or computer software required for participation in meetings, who is responsible for providing it, and contingencies for technical difficulties or malfunctions. Methods for determining the presence of a quorum, and the conditions under which a member may raise a point of order doubting the presence of a quorum. Methods for seeking recognition and obtaining the floor, means for submitting motions, and taking and verifying votes. RONR, p. 98f., lines 30ff. Once again, the key to all of this is that electronic meetings must provide for simultaneous aural communication equivalent to that which exists when all participants are physically in the same room. Examples include conference calls, Go-to-Meeting.com, Skype calls, Face Time calls on iphones, and video conferencing. Certain electronic means do not meet the standards established by RONR, such as handling business by , regular mail, fax, chat rooms, or by text message. According to RONR, such technologies do not constitute a deliberative assembly, and is not recommended. Any such effort may achieve a consultative character, but it is foreign to the deliberative process as understood under parliamentary law. (RONR, p. 98, lines 17-19). What if a session finds itself needing to make a decision quickly and the only options seem to be polling the members by telephone or ? While this is not recommended, neither should our procedural rules be interpreted to be a straitjacket restricting the council from acting in an expeditious manner. Should a vote be taken by in one of these non-recommended ways, the action should be revisited and affirmed at the next stated meeting. Doug Sensabaugh (Communications Coordinator) and the Communications Committee can advise interested parties on the availability and use of the various types of communication technologies that afford simultaneous aural communication. II. RECOMMENDATION: Separation Guidelines. While applying the amendments to the Separation Guidelines approved at the April 17 special meeting, a couple of issues surfaced in section VI. When the amended first sentence of section VII was moved to become the first sentence of Section VI, it created a redundancy with the original first sentence that became the second sentence. The lined-out text, below, was editorially removed to correct this problem, as this action did nothing to change the meaning of the policy at this point. VI In the event that the vote for dismissal is two-thirds or more of active members present and voting, the session and the Administrative Commission shall proceed with a plan of separation. Negotiation Topics. If the outcome of the preceding process indicates dismissal should be pursued, The administrative commission and the session shall discuss the following points. After the meeting, it was suggested that part of the text that was removed at original lines be reinserted at this location. It was determined that this should be done by amendment, and not as an editorial insertion. Proposed Amendment: In Section VI, first sentence, after the word proceed, to strike out with a and insert to develop a reasonable and orderly. The new sentence would then read, In the event that the vote for dismissal is two-thirds or more of active members present and voting, the session and the Administrative Commission shall proceed with a to develop a reasonable and orderly plan of separation. 54

12 With advance notice, the action to amend something previously adopted requires only a simple majority, and not two-thirds of those present and voting. From the Stated Clerk: OMNIBUS MOTION A. Receive the Committee on Representation, report as printed on page 61 BOARD OF PENSIONS UPDATE The Rev. Helen Locklear spoke about several actions of the Board of Pensions in modifying the Benefits Plan, particularly the changes made due to the health care reform law. An explanation was also given for why there was no experience apportionment given for 2011: the plan assets must be 128% of what is necessary to fulfill plan obligations, and that level has not been met for the past several years. See pages for written report. PRESBYTERIAN FOUNDATION Ruling Elder, Orlanda Carr, Jr., Ministry Relations Officer, spoke about the ministry of the Presbyterian Foundation. Mr. Carr highlighted the planned giving opportunities of the Foundation, particularly the gift annuities program. COMMITTEE ON MINISTRY The Rev. Richard Reifsnyder, chair, presented the following report, which was approved: I. FOR INFORMATION: A. It was suggested that an be sent to all clerks of sessions of pastorless churches informing them where to find the most up-to-date contract forms on the web site. B. The Virginia General Assembly has approved a bill to add the word commissioned to those allowed to officiate marriages in the Commonwealth of Virginia. The law will be effective July 1, This will affect the commissioned ruling elders serving churches in Virginia. The law reads: Order authorizing ministers to perform ceremony. When a minister of any religious denomination shall produce before the circuit court of any county or city in this Commonwealth, or before the judge of such court or before the clerk of such court at any time, proof of his ordination and of his being in regular communion with the religious society of which he is a reputed member, or proof that he is a commissioned lay pastor [commissioned to pastoral ministry] or holds a local minister's license and is serving as a regularly appointed pastor in his denomination, such court, or the judge thereof, or the clerk of such court at any time, may make an order authorizing such minister to celebrate the rites of matrimony in this Commonwealth. Any order made under this section may be rescinded at any time by the court or by the judge thereof. 55

13 II. ACTIONS TAKEN: A. Approved renewing the commissioned ruling elder contract between the Union Session and Judy Hensley, for a period of one year beginning March 7, B. Approved renewing the supply contract between the Bunker Hill Session and the Rev. William Everhart through March 31, C. Approved the interim contract between the Bethel Session and the Rev. Philip Sommer from April 15, 2012-April 14, D. Approved the church information form from the Parish of the Valleys. E. Approved renewing the temporary supply contract between Mt. Carmel Session and the Rev. Jack Heintzleman through December 31, F. Approved renewing the interim contract between Olivet Session and the Rev. Harry Johns from April 11, 2012 April 10, G. Approved the supply contract between Nineveh Session and the Rev. Randy Webb through December 31, H. Approved the request from the Williamsville Session granting permission to Candidate Helen Punker Robertson to celebrate the Sacrament of the Lord s Supper at Williamsville Church and Westminster Chapel. III. RECOMMENDATIONS: A. Concerning the Rev. Sarah L. Hill: 1. That Presbytery approve the following terms of call between Lexington Church and Sarah L. Hill effective May 1, 2012, to be the installed associate pastor. (Sarah is already a member of Shenandoah Presbytery) Annual Cash Salary $45, (Of the above, $20,000 is designated as housing and utility allowance) SECA 3, Board of Pensions 14, Continuing Education, books & materials, and auto reimbursement at IRS rate 4, Three month Sabbatical after six years of service Sabbatical escrow including pulpit supply Moving expenses to the field Four weeks annual paid vacation, including four Sundays Two weeks annual paid study leave, including two Sundays Disability clause included 2. Patricia Hunt, effective May 8, D. That Presbytery accept the 2012 changes in terms of call for ministers as printed on pages HONORING THE REVEREND HOWARD A. NEWMAN The Rev. Howard A. Newman was recognized upon his retirement on June 4, Ruling Elders Doug Sensabaugh and Peggy Wonderley voiced their appreciation of Howard and his years of service to the Presbytery. COMMUNICATIONS COMMITTEE The Rev. Tom Holden, chair, and Ruling Elder Doug Sensabaugh, presented a PowerPoint presentation on the Key Church Communicator program of the Presbytery. PROFESSIONAL DEVELOPMENT The Rev. Rachel Crumley presented the report of the Professional Development Committee, and highlighted several seminars to be presented throughout the year in cooperation with the Board of Pensions. The Committee presented the following written report: FOR INFORMATION: COMMITTEE ON PREPARATION FOR MINISTRY Candidate Walter Canter (Cooks Creek) was examined and certified ready to receive a call at the March 20 th meeting. Walter will graduate from Louisville Seminary in May. Enrolled Gwen Carr, from Tinkling Spring Church, as an inquirer SYNOD of the MID-ATLANTIC The Rev. David McKee, Synod Executive, gave greetings to the Presbytery. Mention was made of the recommendation pending before the 220 th General Assembly that would eliminate synods. Mr. McKee called for the church to make a comprehensive evaluation of its self-identity and governance. MOFFETT FOR MISSION The Rev. Don Allen led the report of the Moffett for Mission Committee. John Dull, Associate for Youth and Director of Music of First Presbyterian Church, Staunton, spoke about how the Moffett Fund underwrote their youth mission trip on June to volunteer with Kids Club, a day camp program on the eastern shore of Maryland. NOMINATIONS COMMITTEE Ruling Elder Richard Johnson, chair, presented the following report, which was approved as follows: That Presbytery approve the following to serve as additional members of the General Presbyter Search Committee: Ruling Elder Emerson Deitz from the Tinkling Spring Church, Ruling Elder Pat Williams from the Moorefield Church, and Teaching Elder Jonathan Bunker serving the Berryville Church There were no nominations from the floor. 57

John McDonald led the body in prayer remembering the many persons and causes that members of Shenandoah Presbytery had called to our attention in written concerns during the morning. ACTING GENERAL PRESBYTER The Rev. Randy Webb proposed three initiatives for the Presbytery to consider: Train and equip a presbytery resource team, skilled in listening and facilitating the conversations that may take place over the issue of potential separation of congregations from the PC(USA). Invite our Ethiopian partners to share their experience and train us in evangelism. Design and implement a multi-faceted, presbytery-wide emphasis on biblical Christian stewardship based on the acronym MOSAIC: Making Our Stewardship Alive In Christ. PRESBYTREY COUNCIL The Rev. Patrick Pettit, vice-chair, presented the report for the Council, which was approved as follows: I. FOR INFORMATION: A. The Council Welcomed new Treasurer Pam Williams, who reported that the Presbytery Corporation has received a $25,000 bequest from the estate of Dawn Bulle. C. There is a need for a Presbytery Representative to the Theological Education Fund. For more information, please contact Acting Stated Clerk Dan Williams at pastor@sec-stn.org. II. ACTIONS TAKEN: A. Agreed to the titling and insuring of a shower trailer in the name of Shenandoah Presbytery for use by the Presbytery and Presbyterian Disaster Assistance. Mountain Valley Mission Community will undertake the purchase, construction, management, and maintenance of this resource. B. Accepted, with regret, the resignation of John Bethard from the General Presbyter Search Committee, with gratitude for his service. C. Approved a contract with Heather Carter, Office Coordinator, for the weekly cleaning of the Presbytery office, at the budgeted amount of $140 per week. D. Approved changes to the Strong Ministers Fund Application. E. Reviewed recommended changes to the Strong Ministers Fund policy; since this policy is a part of the Presbytery Manual, proposed changes will need to be acted upon by the Presbytery. III. RECOMMENDATION: That Presbytery approve increasing the membership of the Search Committee by three members. 58

16 CHANGE OF MODERATOR The Rev. Olivia Haney, Vice-Moderator, convened the remainder of the meeting. CHURCH DEVELOPMENT The Rev. Kerry Foster reported for the Committee. An update on the Percept system was given, which is used to provide data for mission studies and to identify new persons moving into a community. David Witt announced the upcoming five conferences What Are You Waiting For, at Tradewinds Resort, St. Petersburg Beach, FL, July 30 August 2. Church Development will pay for the registration cost ($285) for the first five people who apply, through July 10. WORLD WIDE MINISTRIES The Rev. Carl Howard reported for the Committee, encouraging churches to participate in the mission fair at the Big Event on September 15. A prize will be given for the best display, in appearance and content. Mission grants have been given from the Ramsey Fund, to Winchester First and HAMC for mission trips. The committee will meet June 15 to disperse the remaining available Ramsey mission funds. ACTING STATED CLERK The Rev. Daniel S. Williams, acting Stated Clerk, reported several items to the Presbytery, including one opinion piece: The relationship of the current and old Forms of Government (FOG): the old FOG can only be used to guide procedural matters that are no longer covered in the current FOG. For any matter that involves constitutional standards or implications, the current FOG must be used. The Acting Clerk reported that the publication of SHENANDOAH PRESBYTERY: A Heritage of Service has been delayed until the end of May due to the opportunity for the History Committee to add more information to the book, primarily appendices, for the price that was quoted. The Clerk also noted that Kim Stroupe had recently completed her 26 th year of service to Shenandoah Presbytery.
