1 Regular Monthly Meeting for Town of Kimball Thursday, January 4,2001 Mayor Davis called the regular monthly board meeting to order at 6:00 p.m. Mayor Davis asked for roll call. Those present were Mayor Davis, Vice-Mayor Jackson, Alderman Case, Alderman Taylor, Aldernlan Witcher and Attorney Featherston. Alderman Case made a motion to approve the minutes as written. Vice-Mayor Jackson seconds the Alderman Carl Taylor stepped down from his position due to his term ending. Judge William Gouger, Jr. swore in Mayor Jere N. Davis, Alderman Jerry Don Case and Alderman Rance Castle. Roger Coffelt, Financial Advisor with Tennessee Department of Environment and Conservation Division of Community Assistance and Bill Young, Utility Finance Consultant with The University of Tennessee Municipal Technical Advisory Service were at the meeting to explain the situation concerning the Town's Sewer System Finance situation. Their recommendation for the town's sewer fund is to raise the rates over a three-year period, which consist of the following Effective July 1,2001: $60 per month up to 3,000 gallons (minimum bill). $4 per 1,000 gallons over 3,001 gallons. Effective July 1, 2002 $65 per month up to 3,000 gallons (minimum bill). $4.50 per gallons over 3,001 gallons. Effective July I, 2003 $70 per month up to 3,000 gallons (minimum bill). $5.00 per 1,000 gallons over 3,001 gallons. On March 1,200 1, this plan will be explain to the Board of Wastewater Finance in Nashville. The enterprise fund must stand on its own without any transfers from any other funds. The State will come to the town and adjust the rates accordingly if the town does not take action to fix the problem. Mayor Davis made a motion to approve Ordinance #I38 on first reading concerning the sewer rates. Alderman Case seconds the Discussio~i was made concerning the hiring of a Building Inspector for the town. Alderman Case made a motion to table the issue at this time. Alderman Witcher seconds the Vice-Mayor Jackson made a motion to copy all the minutes and send them to Data Archives Inc. to have the minutes scanned and converted to a CD and to create an additional CD for a master copy. Alderman Witcher seconds the The Recorder explained about the State of Tennessee Local Government Insurance Plan. The State Insurance will save the town money, as well as, the employees money. Also the copay are cheaper for those who choose to go with the HMO or POS Plan. Mayor Davis made a motion to enroll in

2 the State of Tennessee Local Government Insurance Plan effective March 1,2001. Vice-Mayor Jackson seconds the Vice-Mayor Jackson made a motion for Alderman Castle to be the liaison for the Street Department. Alderman Case seconds the Vice-Mayor Jackson made a motion to place Alderman Castle on the Planning Con~mission. Alderman Case seconds the Vice-Mayor Jackson gave a fire hall update as follows: The fire hall is at about 5% of the completion. The recorder had called everyone on December 1 1,2000 concerning this change order. Vice- Mayor Jackson made a motion to ratify the change order on the dirt work for approximately $1 6,000. Alderman Witcher seconds the Alderman Case gave the Police Report as Follows: l~itiaation Tax I $8.751 act Costs $0.001 l~essions Court 1 $ l~icense fee I $ I Vice-Mayor Jackson gave the fire report as follows: there were four calls, one mutual aid and three rescue calls. The department responded to 61 calls for the year 2000 and had no one injured in the department. The calls are as follows 6 structure fires, 7 vehicle fires, 22 rescues, 20 mutual aid calls, 3 brush fires and 2 calls to help with traffic and 1 fuel spill. There was an average of 6 personnel on each call. The annual firemen's dinner will be on Saturday, January 6,2000 at the fire hall at 6:00 p.m. New Business: NONE Alderman Case made a motion to adjourn. 3 Regular Monthly Meeting for Town of Kimball Thursday, February 8,2001 Alderman Witcher opened the meeting with prayer. Vice-Mayor Jackson called the Public Hearing to order at 6:00 p.m. concerning Ordinance #I38 on Sewer Rates. Vice Mayor Jackson asked Recorder Moss to read the new rates and the effective dates, which are as follows: Effective July 1, 2001 : $60 per month up to 3,000 gallons (minimum bill). $4 per 1,000 gallons over 3,001 gallons. Effective July 1,2002 $65 per month up to 3,000 gallons (minimum bill). $4.50 per 1,000 gallons over 3,00 1 gallons. Vice-Mayor Jackson explains the reason for the changes and asked for any discussion. Alderman Witcher made a motion to close the public hearing. Alderman Case seconds the motion. All voted aye. Vice- Mayor Jackson called the regular monthly board meeting to order after the public hearing. Vice-Mayor Jackson asked for roll call. Those present were Vice-Mayor Jackson, Alderman Case, Alderman Castle, Alderman Witcher and Attorney Featherston. Mayor Davis was absent due to having the flu. Alderman Case made a motion to approve the minutes as written. Alderman Witcher seconds the Alderman Case made a motion to approve Ordinance #I38 on second and final reading concerning the sewer rates. Alderman Witcher seconds the The Historical Society had asked to be on the agenda; however, no one showed up to represent the group. Discussion was made concerning the hiring of a Building Inspector for the town. Alderman Castle suggested talking with the building inspector of South Pittsburg. The board decided to have a meeting with Mr. Jarvis Wooten, South Pittsburg's Building Inspector, on Monday at 5:OO. Alderman Witcher made a motion to authorize Attorney Featherston to draw up a proposal to Marion County for use of the County's Building inspector for $400 a month. Alderman Castle seconds the Alderman Case made a motion to grant the beer permit to Sandra Ellis for Oscar's B-B-Q for offpremises sales. Vice-Mayor Jackson seconds the Discussion of the town obtaining a credit card. Attorney Featherston will present the town with a proposal at the next meeting.

4 There were lots of discussion concerning delinquent business licenses and those businesses operating without a license. Alderman Witcher made a motion for the recorder to go see those who have a delinquent business license and those without a business license. Alderman Castle seconds the Recorder Moss gave an update on the water tank. The Fish and Wildlife Service has records that the federally endangered Indiana bat (Myotis sodalis) is know to occur in the vicinity of the project; therefore, the project has until March 3 1 to remove any trees greater than six inches in diameter at breast height. Vice-Mayor Jackson gave a fire hall update as follows: The work order change from last month for approximately $16,000 for extra dirt work only cost $1 2,354. New Business: Alderman Case discussed getting the BZA board set up correctly by the board of Mayor and Aldermen in terms. Vice-Mayor Jackson made a motion for the board to set up the Board of Zoning and Appeals Committee at the next board meeting. Alderman Case seconds the Alderman Witcher made a motion to approve Resolution Number concerning the obtaining of Certificate of Deposits and cash in of Certificate of Deposits who is authorized and how many signatures are required. Alderman Case seconds the Alderman Witcher stated the citizens on Apache Trail requested a stop sign at Apache Trail and Virgil Thomas Drive. Alderman Witcher made a motion under advisement from Attorney Featherston to advertise for a public meeting to add a stop sign at Apache Trail and Virgil Thomas Drive. Alderman Case seconds the Mr. William McCullie made a statement concerning the Planning Commission.

5 Alderman Witcher thanked Mr. McCullie and Mrs. Holland for serving on the Planning Commission. Mr. Carl Taylor requested the Recorder read a statement the Planning Commission passed in a previous meeting concerning rezoning commercial property, which is as follows: The Kimball Municipal Planning Commission, during its regularly scheduled monthly meeting on January 28, 1999, resolved to make a policy change in regard to future rezoning recommendations. Hereinafter, it shall be the policy of the Kimball Planning Commission to discourage the rezoning of residential property to commercial if such property does not lie within 4,000 feet of the Interstate 24lHighway 72 intersection. The reason for the policy change is twofold: to encourage consistency in regard to rezoning recommendations and provide for residential stability. Mr. Roger Frizzell stated the case against him has been dismissed and he would like to have his job back. Attorney Featherston address Mr. Frizzell's concerns. No action was taken at this time. 6 Regular Monthly Meeting for Town of Kimball Thursday, April 5,2001 March 8,2001 meeting cancelled due to lack of quorum. Mayor Davis called the regular monthly board meeting to order. Mayor Davis asked for roll call. Those present were Mayor Davis, Vice-Mayor Jackson, Alderman Case, Alderman Castle, and Attorney Featherston. Alderman Witcher was absent at the beginning of the meeting. Alderman Castle made a motion to approve the minutes as written. Alderman Case seconds the Tina Dyer, Secretary of the South Cumberland Cultural Society, was at the meeting to inform the board of the non profit organization that is in need of funding for historical, musical, theatrical and literary events. The organization would like to be remembered during budgeting times for the workshop. Discussion was made concerning the hiring of a Building Inspector for the town. Alderman Jackson made a motion to hire Ronnine Blevins as the town building inspector for $400 a month for a 6-month trial basis. Alderman Case seconds the Discussion of the town obtaining a credit card. Attorney Featherston suggested taking bids from the local banks. Vice-Mayor Jackson made a motion to take bids fiom the local banks for a credit card to make room reservations for town business with as long as all supporting paper work is documented. Aldern~an Case seconds the Vice-Mayor Jackson made a motion to approve the Amendments for the Money Purchase Plan. Mayor Davis seconds the Vice-Mayor Jackson made a motion to ratify the signing of the Sequatchie Valley Mutual Aid Agreement. Alderman Case seconds the Alderman Case made a motion to ratify the signing of the Mutual Aid Agreement for Law Enforcement. Alderman Castle seconds the Vice-Mayor Jackson made a motion to ratify the town turning the 1999 unpaid property taxes over to the Attorney to tile with the Clerk and Master Office effective 4/1/2001. Mayor Davis seconds the Vice-Mayor Jackson explained about the problem with the split face block. Vice-Mayor Jackson made a motion to ratify the work change order for the split face block and reverse safety edges in the amount $8,271. Alderman Case seconds the Alderman Case made a motion that the town will not do anymore burning in the pit on Hwy 2. Vice- Mayor Jackson seconds the Vice-Mayor Jackson made a motion to accept sealed bids for a John Deere inch cut Lawn Mower for the Maintenance Department to be opened at the next meeting. Alderman Case seconds the

7 Mayor Davis made a motion for Attorney Feathersion to develop a Resolution for a Savings account at First Volunteer with Mayor Davis, Vice-Mayor Jackson and Alderman Case on the signature card with a requirement of two signature to withdraw any money from the account. Alderman Case seconds the Mayor Davis made a motion that Roger Frizzell's employment with the Town of Kimball and benefits are terminated immediately. Alderman Castle seconds the Alderman Case gave the Police Report as Follows: Alderman Witcher entered the meeting at this time. Christmas Light Committee Meeting decided on 5 different lights the decision was made to have samples sent to the town or have a representative bring the light to the town hall. New Business: Alderman Case made a motion concerning the use of the Garbage Truck for the Cornbread Festival and Sparkle Day the town will supply the truck and driver and the sponsor of the event requesting the use of the truck will pay for the landfill tipping fee. Alderman Witcher seconds the Vice-Mayor Jackson made a motion to donate $1000 to Jasper Park. Alderman Witcher seconds the Attorney Featherston stated he went to Nashville concerning the Sewer System Hearing. The town is now in compliance since we made money last year; however, the Wastewater Finance Board will continue to monitor the fund. Those present were Mayor Davis, Vice-Mayor Jackson, Alderman Case, Alderman Castle, and Attorney Featherston. Alderman Witcher was absent. Alderman Case made a motion to approve the minutes as written. Vice-Mayor Jackson seconds the Members of the Historical Preservation Commission were present at the meeting to request a donation to their organization. Mayor Davis made a motion to approve $ for the South Pittsburg Princess Theatre Historical Preservation Society for fiscal year budget Aldernian Case seconds the Vice-Mayor Jackson made a motion to approve on first reading ordinance number 139 concerning Budget Amendments for Fiscal Year Mayor Davis seconds the motion. All voted aye. Alderman Case made a motion to approve on first reading ordinance number 140 concerning corrections to the Kimball Municipal Code Book. Vice-Mayor Jackson seconds the motion. All voted aye. Mayor Davis asked Recorder Moss to open the bids for the 345 John Deere Lawn Mower which are as follows: Cole's Equipment $ Heddcn Tractor Co. $ Baker Equipment Co. $ Homestead Lawn & Tractor $ General Equipment Co. $ Vice-Mayor Jackson made a motion to accept the lowest bid from Homestead Lawn - & Tractor for $5587. Alderman Castle seconds the Vice-Mayor Jilclison made a motion to ratify the work order change for additional fencing upstairs in the amount of $200. Mayor Davis seconds the Mayor Davis made a motion to ratify the contract for the Building Inspector for the Town of Kirnball. Alderman Castle seconds the

Also Assistance Chief Butch Brown had breathing problems after the fire in Jasper on May 2. Christmas Light Committee: The Maintenance crew put two lights up. There were several comments fiom the public that stated they liked the two lights. The committee will meet again and have a recommendation at the next meeting. New Business: Alderman Case made a motion to add to the approved type of driveway tile high density polyethylene double walled corrugated pipe the following sizes: AASHTO M " Type S 15" Type S 18" Type S 24" Type S. 10 Public Hearing June 7,2001 Mayor Davis opened the Public Hearing at 6:00 p.m. The hearing concerns Ordinance 139 on Budget Amendments for Fiscal Year and Ordinance 140 on amending Ordinance 130 correction to the Kimball Municipal Code Book. Mayor Davis calls for discussion. There was no discussion fiom the public or board; therefore, Mayor Davis asks for a motion to adjourn. Alderman Case made a motion to adjourn. Alderman Witcher seconds the motion. All voted aye.

11 Regular Monthly Meeting for Town of Kimball Thursday, June 7,2001 Mayor Davis called the regular monthly board meeting to order after the public hearing. Mayor Davis asked for roll call. Those present were Mayor Davis, Vice-Mayor Jackson, Alderman Case, Alderman Castle, Alderman Witcher and Attorney Featherston. Alderman Case made a motion to approve the minutes as written. Vice-Mayor Jackson seconds the Teresa and Phil Easterly 4 View Street contacted the town about turning a security light that they are currently paying for around to make a street light. Mayor Davis made a motion that the town turns this light around to face the street then the town would take on the billing. Alderman Witcher seconds the Vice-Mayor Jackson made a motion to approve on second and final reading ordinance number 139 concerning Budget Amendments for Fiscal Year Alderman Witcher seconds the motion. All voted aye. Alderman Case made a motion to approve on second and final reading ordinance number 140 concerning corrections to the Kimball Municipal CodeBook. Alderman Witcher seconds the motion. A11 voted aye. Vice-Mayor Jackson made a motion to approve on first reading ordinance number 14 1 concerning Budget for Fiscal Year Alderman Witcher seconds the Alderman Case made a motion to give all employees a 5% increase effective July 1,2001. Alderman Castle seconds the Vice-Mayor Jackson made a motion to approve on first reading ordinance number 142 concerning amendments to ordinance 135 to increase salaries of police chief, recorder, clerk and maintenance supervisor. Mayor Davis seconds the Alderman Case made a motion to accept the contract with Johnson, Murphey and Wright, P. C. for the July 1,2000 until June 30,2001 audit for $8,485. Alderman Witcher seconds the Vice-Mayor Jackson made a motion for the Recorder to send a letter to all businesses that have a business license concerning a workshop about signs. Alderman Witcher seconds the Alderman Case made a motion to add an additional week for 20 years of service that will be a total of 4 weeks for 20 years of service. Alderman Castle seconds the Alderman Witcher made a motion for annual leave to be effective on each employees hire date anniversary for the new weeks such as 1 week, 2 weeks, 3 weeks and 4 weeks to be used before the calendar end. Alderman Case seconds the Alderman Witcher made a motion to make the annual leave new weeks to start on anniversary date effective July 1, Alderman Case seconds the Bereavement Leave Policy the days taken off for bereavement must be taken in consecutive days. Recorder Moss should type a memo approved by board and issue to all employees.

12 Alderman Case made a motion that each board member chooses a person to go on the Board of Zoning and Appeals '1 year, 2 years, 3 years, 4 years, and 5 years put the names in a hat then draw out the names first name drawn will be 1 year term, second name drawn will be 2 year term, third name drawn will be 3 year term, fourth name drawn will be 4 year term, and fifth name drawn will be 5 year term and at end of the terms the Board will replace the person. Alderman Witcher seconds the Alderman Witcher made a motion to advertise for sealed bids the Christmas Decorations based on the committees recommendation to be turned in by the next meeting. Vice-Mayor Jackson seconds the Vice-Mayor Jackson made a motion to advertise for sealed bids for park equipment for 6' slide, swings, benches, and diggers to be turned in by the next meeting. Alderman Case seconds the motion. All voted aye. The air conditioner is leaking Freon and causing problems according to E.H. Marsh the coil needs to be replaced and it would cost approximately $2,430 for new coil and furnace. After some discussion the board decided to take bids because the unit is about 11 year's old. Alderman Witcher made a motion to advertise for sealed bids for a split unit 5-ton heating and air unit to be turned in by the next meeting. Alderman Case seconds the Alderman Witcher made a motion to accept Resolution accepting a Contract with the State on the Sidewalk from Holiday Inn to Junction. Alderman Castle seconds the Vice-Mayor Jackson made a motion to accept Resolution authorizing the Savings Account with First Volunteer Bank. Alderman Castle seconds the Vice-Mayor Jackson made a motion to accept bids to sell the chipper. Alderman Witcher seconds the Alderman Witcher made a motion to accept bids to sell the packerlroller. Vice-Mayor Jackson seconds the Vice-Mayor Jackson made a motion to allow 4 days for keeping a dog in the dog pound. Alderman Witcher seconds the Alderman Witcher made a motion to ratify the purchase of 6 tires for the dump truck in the amount of $1, Vice-Mayor Jackson seconds the Vice-Mayor Jackson made a motion to renew the Hardware and Software Contract with Local Government in the amount of $8, Alderman Castle seconds the Vice-Mayor Jackson made a motion to approve the work change orders for Credit $3 12 for wall heating and air, $578 painting the concrete mason walls in bathrooms and meeting room, $1 692 Painting floors with epoxy paint, non-skid slide paint, Curbing on the parking lot $171 9, Lights moved and adding some lights $566. Alderman Witcher seconds the Vice-Mayor Jackson made a motion to accept sealed bids for a fence on the east and north side of the firehall property about 6' high chain link fence to be opened at next meeting. Mayor Davis gave the Water Tank Update there needs to be a better drawing of the water tank site on Mr. Beene's property and the easement across Dr. Hudson's property. Vice-Mayor Jackson made a motion for Recorder Moss or Mayor Davis to contact Travis Shields with Southern Surveying to allow them until Tuesday at 9:00 a.m. to turn in the survey on the water tank site and easement if it is not done then the town will hire Clemmon's Surveying to do the job. Alderman Case seconds the motion. All voted aye expect Alderman Witcher abstained. Alderman Witcher did not vote due to possible conflict. Mayor Davis stated he would contact Travis Shields tomorrow. New Business: Vice-Mayor Jackson asked the Board about spending $3, which has been donated to the fire department plus $6,000 that is in next year's budget for furnishing for the new fire hall. Mayor Davis made a motion to allow Vice-Mayor Jackson to spend $9, for furnishing the new firehall. Alderman Castle seconds the Mayor Davis made a motion to allow the town to get voice mail. The hearing concerns Ordinance 14 1 on the Budget for Fiscal Year and Ordinance 142 on amending Ordinance 135 to Increase the Salary of the Town Recorder, Police Chief, Town Clerk and the Supervisor of the Street, Garbage and Maintenance Department. 15 Special Called Meeting June 29,2001 Vice-Mayor Jackson called the special called meeting to order after the public hearing. The purpose of the special called meeting is to approve on 2" and final reading Ordinance 14 1 on the Budget for Fiscal Year and Ordinance 142 on amending Ordinance 135 to Increase the Salary of the Town Recorder, Police Chief, Town Clerk and the Supervisor of the Street, Garbage and Maintenance Department. Vice-Mayor Jackson asks for a roll call those present were Alderman Witcher, Alderinan Case and Vice-Mayor Jackson. Those absent from the meeting were Mayor Davis, Alderman Castle and Attorney Featherston. Alderman Witcher made a motion to approve on 2nd and final reading Ordinance 14 1 concerning the Budget for Fiscal Year Alderman Case seconds the Alderman Case made a motion to approve on 2"d and final reading Ordinance 142 concerning Amendment to Ordinance 135 to Increase the Salary of the Town Recorder, Police Chief, Town Clerk and the Supervisor of the Street, Garbage and Maintenance Department. 16 Regular Monthly Meeting for Town of Kimball Thursday, July 5,2001 Mayor Davis called the regular monthly board meeting to order at 6:00 p.m. Mayor Davis asked for roll call. Those present were Mayor Davis, Alderman Case, Alderman Castle, Alderman Witcher and Attorney Featherston. Vice-Mayor Jackson was absent. Alderman Case made a motion to approve the minutes as written. Alderman Witcher seconds the Alderman Witcher made a motion to authorize Attorney Featherston to draw up a Resolution for a Credit Card with First Volunteer Bank for the Recorder to use to make reservations. Alderman Case seconds the Development of Board of Zoning and Appeals Board Alderman Witcher appoints Scott Hawkins Alderman Castle appoints Roger Ford Alderman Case appoints Martha Holland Mayor Davis appoints Mike Cagle Vice-Mayor Jackson by written request appoints Jack Keef Alderman Case made a motion to approve the above appoints to the Board of Zoning and Appeals Committee. Alderman Witcher seconds the Terms for each member will be set up at the first meeting along with the appointment among the members for the Chairman and Secretary. Buddy Fuller of Fuller Fencing came by town hall to get an advancement of $400 to rent some equipment to change the slope of the land. Since the advancement, Buddy Fuller has not been seen since. It was agreed that the flags stay down at this time. Alderman Case requested that the town donate an old Motorolla GM 300 Radio to the Richard City Fire Department to help them get started. New Business: Alderman Case would like to know about the new roads in Kimball City Limits that have never been dedicated to the Town. Attorney Featherston discussed the issues with the water tank. The Marion County Planning Comniission will have a problem approving the division of the lot due to lot size. easement and the front part will not pass the health department approval for a septic system. The best solution appears to be to purchase the whole lot; however, there are a couple of things that come up with the purchase. The first thing is the covenants on the subdivision; therefore, the town needs to get a waiver from the owners that own lots now. The next issue will be the price for the lot and is it agreeable to the board members. Mayor Davis said Dr. Hudson will sale the lot for $1 3,000 to the l'oun of Kimball. Alderman Witcher wanted everyone to know that he is representing Dr. Hudson. Alderman Witcher also stated he has not tried to influence anyone to buy the property and that he will not be voting 011 this issue. Mayor Davis made a motion to buy lot 9 from Dr. Hudson contingent upon obtaining waivers of the restricted covenants recorded in volume 120 deed book 139 page 122 in ROMCT and contingent upon the approval of the water tank project design. -4lderman Castle seconds the motion. All voted aye except Alderman Witcher which abstained from voting. Mayor Davis made a motion that Kai Jin Huang be approved for a beer permit for the China Alderman Case seconds the Mayor Davis has been talking with Pete Hiett, State Engineer, concerning the tower lighting near the interstate. The cost to the town would be $75,000 to $100,000 to put up 6 of the steel tower lighting, 100 to 120 feet tall and 6 to 8 lights per pole. The town would have to match what the state spends on the lighting. Also the state will need to do a study on the area which will take approximately 9 to 10 months.
