2 FOREWORD سم الله الرحمن الرحيم Alhamdulillah, all praise be to Allah, The Most Gracious and The Most Merciful, peace and blessings be upon the Prophet Muhammad, and with Allah s blessings, mercy and abundance, this third International Seminar on Halalan Thayyiban Products and Services (SAPPHAT III) 2018 was successfully organized. For the third time, this seminar, through the combination of ideas and energy, was jointly organized by the Faculty of Shariah and Law, the Halalan Thayyiban Research Centre, Sultan Sharif Ali Islamic University and the Halal Industry Development Division, Ministry of Energy (Energy and Manpower) and Industry, Brunei Darussalam. The theme for the third SAPPHAT Strengthening Halalan Thayyiban Industry in Safeguarding National Insights is very relevant with the present situation. In order to achieve a peaceful and blessed country, as a Muslim society, it is our responsibility to create and practice Halalan Thayyiban in all aspects of our lives as it is one of the Shari ah teachings. The objectives of choosing this theme are to identify the needs and continuity of the Thayyiban industry in the course of human life on earth; to emphasize the privileges and advantages of the Thayyiban industry in calling upon the people through the perfection, beauty and determination of shariah and the law; and to hold discussions as well as exhibitions in the development of the halal industry towards the realization of the National Vision Alhamdulillah, UNISSA establishes Halalan Thayibban Research 1

3 Centre which has started its operation last year as an outcome of the first SAPPHAT and become the first Halalan Thayyiban Research Centre in Brunei Darussalam. Through this seminar, sharing ideas and exchanging experiences are hoped to realise UNISSA s aim to start a new journey of research in Halalan field which can be a huge contribution to Brunei Darussalam and fully support the concept of Negara Zikir. 16 KEYNOTE SPEAKER 2 DR MUHAMMAD ASHFAQ Dr Muhammad Ashfaq, a German national based in Düsseldorf, is the CEO of Amanah Halal Research Centre which has offices in Germany and Pakistan. He is widely recognized as an outstanding and experienced expert, with more than 12 years of international experience, who has contributed to the development of the halal industry through his cutting-edge research and global initiatives for human capital development and organizational capacity building. Dr Ashfaq has conducted a number of lectures and facilitated training programs for many institutions and companies on the topic of halal economy. He also conducted a TV lecture series for Paghiam TV Network. Dr Ashfaq is a certified coach and consultant from HDW Network (NRW) Germany and a certified Trainer the Trainer from the Australian Centre for Education and Training (ACET) Melbourne. He has also gained certification in Innovation Management and Entrepreneurship from International Summer University Carinthia, Austria. Dr Ashfaq has spoken on the topic of halal economy at conferences in more than 30 countries worldwide, and has served as a peer-review referee for a number of international conferences. In pursuit of his passion, Dr Ashfaq is currently a visiting faculty member at the Wittenborg Business School in the Netherlands and Coburg University in Germany. 15

17 Dr Ashfaq earned his doctor of philosophy from the University of Tübingen Germany. He holds an MBA from Coburg University, Germany and a Post Graduate Diploma in Halal Industry. Dr Ashfaq was awarded the Young Scholars Research Award by the Bilkent University, Turkey in 2015 for his innovative research contributions. He was also awarded the prestigious LGFW (Baden Württenberg Government Germany) scholarship for his Ph.D. at the University of Tübingen, Germany. He speaks three international languages including German, English and Urdu. 16

18 ROLE OF HALAL EDUCATION IN THE PROMOTION OF HALAL CULTURE IN DIFFERENT COUNTRIES Dr Muhammad Ashfaq Chief Executive Officer Amanah Halal Research Centre W: E: Mobile: (whats app) ABSTRACT The word 'halal' is an Arabic word that means permissible or lawful. Muslims are supposed to consume permissible, pure and wholesome food. Allah has strongly prohibited Muslims to consume nonpermissible food (haram). Halal food is not only a religious issue, but it is a way of quality food. Muslim consumers are projected to spend more than US$ 2.6 trillion by the end of 2020 on Halal and non-halal food and lifestyle products and services, which creates significant business opportunities for individuals and companies. Fast-growing Muslim population creates tremendous business opportunities for Muslims and non-muslims alike (currently about 2 billion Muslims represent 25% of the World's population). The Halal food industry has demonstrated a veritable point of convergence between the Islamic world and the West. There is significant scope of expansion in the global Halal industry because non-muslims are also attracted to healthy Halal food and non-food products and services. One of the fundamental ways to promote Halal Industry not only within Muslim countries but also in non-muslim is to create awareness among all stakeholders. It is estimated that over 80% of Halal products are being manufactured and supplied by non-muslims. Therefore, Halal education and awareness is the prerequisite for the development of this promising industry particularly for Muslim entrepreneurs. The main aim of this presentation is to shed light by knowledge sharing on various elements of the global Halal industry including consumer awareness, use of technology, supply chain integrity and role of regulators etc. Halal awareness could be done among Muslims by 17

19 emphasizing on religious beliefs, self-identity and media exposure. This will help to promote Halal norms and culture which will be an important step in the development of the Halal. 18

20 KEYNOTE SPEAKER 3 DR RUSHDI SIDDIQUI Dr Rushdi Siddiqui is a proven international executive with 20 plus years of experience, work and travel, in 25 emerging market countries with Fortune 500 companies, startups, and consulting advising/ mentoring roles. He has focused on the Muslim market since 1999, as it presents the next China size opportunity on investing, consumerism/lifestyle, and content. He led a team at Dow Jones Indexes to create world s first Islamic equity index, Dow Jones Islamic Market Index (1999), world s first Sukuk Index with Citigroup (2006). He led team at Thomson Reuters to create global platform for financial content for Muslim world and world s first halal food index, Sami Halal Food Index (2011). He was co-founder/ceo first global ecomm platform for halal food, Zilzar (2014) and Zilzar Life curated Muslim lifestyle content website. He was co-founder of world s first global ecomm platform for sustainability products (Global Eco-Mall, 2016), and raised profile of eco-resorts and responsible consumerism. The global market value of Halal food is said to be 1.6 Trillion US Dollars and growing. Halal has however transcended the boundaries of food and beverages and has expanded into pharmaceuticals, nutraceuticals, cosmetics, processing aids, packaging, logistics, health and wellness, tourism, fashion and the list goes on. Halal is thus no longer a dietary preference but has become an allencompassing and holistic lifestyle choice. This presentation seeks to unpack some of the areas beyond food in an attempt to dispel the misconception that the end all & be all of Halal is food and beverage. 21

Since its inception in Malaysia, Business Excellence (BE) has assisted organizations to manage and review seven dimensions, which are leadership, planning, information, customer, people, process and results, all of which relate to sustainability. In addition, many organizations benchmark themselves against similar organizations to compare these seven dimensions. Instead of a physical benchmark (such as number of employees and machines), they may use reports as a tool to compare themselves to others in the same industry. The organizations are also able to identify ways they can improve their own operations without recreating new methods. They are able to accelerate the process of change because they can refer to models from other organizations in guiding their changes. Indeed, the halal industry in Malaysia and Brunei Darussalam is still worth to be examined at this point. It is important to identify the best practices and industrial capabilities of halal products to penetrate the global halal market. This paper highlights the importance of using BE to help organizations to identify more opportunities and manage changes, which include training and educating existing employees. The challenges are to increase the businesses capacity with significant collaboration between agencies, industries, and universities in both countries. Received Bachelor of Law (Hons.) - LL.B and Master of Comparative Laws (MCL) from Ahmad Ibrahim Kulliyyah of Laws, International Islamic University Malaysia. Later, in 2012 obtained her PhD degree from University of Manchester, United Kingdom. Her area of specialization is consumer law and issues in Malaysia. Extended the area of consumer law issues to halal regulation and policies. Has been teaching at the University of Malaya since 2003 both at postgraduate and undergraduate levels. 30 UNDERSTANDING THE TOYYIBAN COMPONENT OF HALAL COSMETIC SYSTEM IN MALAYSIA Zalina Zakaria 1, Siti Zubaidah Ismail 2 & Aspiyati Jusoh 3 ABSTRACT Cosmetic products have now been regarded as foods for the skin. Today, the innovation of such products coupled with the massive demand for them offers a great opportunity for those who aim for profit from the mass production of such products. This is in line with the principle of freedom of choice that ensures that consumers have a wide range of products to choose from. The most crucial consideration, however, is that the products available to be consumed are safe and are not a danger to the health of consumers. In the recent years, the demand for halal cosmetic and personal care products by Muslim consumers has increased enormously in many countries including in Malaysia. With such demands, the number of halal application from cosmetic companies to Malaysia s halal competent authority (the Department of Islamic Development JAKIM) has also increased; that is from 290 applications in 2015 to 425 applications in Until March 2017, there are 232 companies that have Malaysia s halal certifications under cosmetic and personal care scheme. All cosmetic companies must rely on several important references to get halal certification for cosmetic. The Manual Procedure of Malaysia s Halal Certification (the third revision of 2014) and also the Malaysia s Halal Cosmetic Standard which is called MS : Islamic Consumer Goods - Part 1: Cosmetic and Personal Care - General Guidelines" are the most important reference documents that contain very strict requirements on halal certification for cosmetic products. It is imperative that halal cosmetic products must use only halal ingredients, however, another most crucial concern is, the products are safe and are not a danger to the health of consumers as well as of quality products. 31 elements are crucial for the toyyiban element, which are also the most important part of halal. For that, before all halal specific procedures have been fully observed, the products must undergo productnotification system by the National Pharmaceutical Regulatory Agency (NPRA), an agency established under the purview of the Ministry of Health of Malaysia to ensure that the products are safe for consumption. This paper takes a proper glimpse at the product notification system for cosmetic in Malaysia to cover the toyyiban component of halal, the insights of halal cosmetic control, as well as the enforcement activities by the relevant regulatory authorities so that a strict adherence to halal and safety system could be safeguarded. The obligations imposed on the cosmetic producers show that that under halal and toyyiban cosmetic regime, the responsibility of the producer or manufacturer of products is the utmost importance. This is a cardinal principle since they manufacture the products in the first place. All of the above are known as pre-market control, in other words products are controlled prior to them being placed on the market. The responsibility on the producer does not stop after the product is released onto the market, but continues beyond. They also have a duty to monitor the products when they are on the market. This is called post-marketing obligations. It appears that a good halal cosmetic regime requires a stringent halal and safety framework where it is the direct responsibility of the manufacturer, and where authorities are in charge both of pre-market control and post market control. In addition, standardized labeling, information regulation and also risk assessment are also important, especially in cosmetic products where the chemicals are used in the product formulations. Growing demand for halal products would also influence the demand of other halal service areas particularly halal logistics and warehousing since all goods need to use these services. This literary paper attempts to have an overview on the subject of halal and tayyib meat supply chain constituents in order to sustain halal integrity in accordance with Islamic law. Halal meat is one of the important issues in Islam. Therefore, halal acceptable animals and birds must be slaughtered according to Islamic rituals to render them halal. Moreover, it is essential that these meat products are conserved separately through the supply chain to avoid the risk of contamination. Consequently, the halal supply chain approach is vital to assure the halal integrity from the source of origin to the point of consumption. The constituents of halal and tayyib meat supply chain include farm management, animal transport, slaughterhouse management, manufacturers, dealers, and finally the customers. Proper program training and development plans on halal awareness and animal welfare for the personnel have to be done to enhance their skills and levels of knowledge that meets halal standard and thus to be as good as or better than others in logistics industry and reflect perfect halal character and awareness. Sharia tourism is not interpreted as a tour to the grave (pilgrimage) or to the mosque, but the tour that comes from nature, culture, or artificial framed with Islamic values. Sharia tourism is not only related to religious values, but more to the lifestyle. Simeulue District, Aceh Province is an area that plans to develop tourism as the main economic sector of the region in the future. The condition of the region that implements the Islamic Shariah in the development of Simeulue tourism is experiencing its own obstacles, coupled with the development of conventional tourism in Simeulue since the beginning has not been developed optimally. Therefore, this paper aims to describe how the condition of Simeulue tourism development, how it relates to the shariah of Islam applied in Simeulue, and the perception of business actors and tourists in developing tours in Simeulue. After a decade of service, PSSD was still trying to achieve its goal of becoming one of the leading business organizations in Malaysia. In their attempt to fulfil business excellence, PSSD had implemented some improvements and development to their products by benchmarking itself with a popular bread brand, Gardenia. Data were collected through an interview with managers of PSSD to gain information on the company s background and business activities to help determine the company s progress towards halal business excellence. 43 PRESENTER ASSOC. PROF. DR. SITI ZUBAIDAH ISMAIL Dr Siti Zubaidah Ismail is Associate Professor at Shariah and Law Department, Academy of Islamic Studies, University of Malaya. Graduated with Bachelor of Shariah (Honours) from University of Malaya, Master of Comparative Laws (IIUM), Master of Laws (Birmingham) and PhD (Malaya). She is the writer of four books: Law on Shariah Criminal Procedure (DBP, 2016), Law on Shariah Criminal Offences in Malaysia (University of Malaya Press, 2017), Compensation for Physical Injuries due to Negligence according to Islamic Law (ILBS, 2017) and Women Who Kill Their Spouses (VDM Germany, 2011) and contributed more than 50 articles in local and international journals. Dr Siti is an expert in shariah criminal law and is active in conducting research in that field. Her other research interest is in halal management system and she is an associate member of University of Malaya Halal Research Centre (UMHRC). Australia has been exporting its various meat product to many countries around the world, including Muslim countries. It all began in the 1970s when Muslim countries representatives came to Australia looking for sources of halal meat. Since then, the abbatoirs aiming to become the halal meat provider, started to have well-trained human resources i.e: halal slaughter-men, supporting infrastructure and technology. What started as small Muslim-based slaughterhouses catering for local market, has grown into multi-billion exporting business to cater for Muslim demand and halal meat market around the world and this, has sparked the participation of non-muslim players into the halal meat industry. As a result of this situation, it has created a need for halal certification and eventually saw the dawn of certification bodies establishment (CBs). Initially, it was the non-formal religious authority, imam, ulama certifying the small scale slaughterhouses and the halal logo was simply put in front of the establishments. At present, certification bodies seem to be competing with each other in gaining customers trust and aiming to tap into the bigger oversea market. Obtaining JAKIM recognition too, the Malaysian halal authority, would have a big impact on their organization. This paper examines how certification bodies conduct their activities in issuing halal certification, by focusing on meat industry in Australia. It also explores issues and challenges facing the certification bodies in a country where there is no direct governmental regulation overseeing their affairs. Observation was also conducted at three slaughterhouses and in-depth interviews were conducted with the company staff, halal checkers and slaughter-men to understand the mechanism used by CBs in certifying the abattoirs. JAKIM s Halal attaché in Australia, and JAKIM auditors were also interviewed to obtain insight on the overview situation regarding CBs that have been recognized by JAKIM in Australia. The thematic analysis was done after all the data are gathered. 44

HTFQM combines the application of international standards with halal standards. This concept is universally applied. Its value is measured based on the marketability of the food product in terms of its superior quality in hygiene, safety and purity based on the Shar iah. Such focus makes the external factors of the product to be more emphasized. However the internal factor such as the integrity of the actors, is a critical issue that can inhibit the effectiveness of HTFQM. Since the HTFQM applies the Halalan Tayyiban concept as introduced in Islam, the impact and purpose of its implementation have exposed a gap from the perspective of an Islamic-based Development (IbD). This paper is to present the missing dimension in HTFQM. The results are then analyzed to explain the features and mechanisms that need to exist to build the ideal dimension according to IbD. In collecting data for this paper, two phases are involved: empirical and theoretical. For the first phase, the study was conducted by obtaining primary data through face-to-face interview with selected informants. The second phase involves data from documentary studies from HTFQM related secondary sources. The main finding shows that the implementation of current HTFQM does not apply all the elements contained in the halalan tayyiban concept. The evaluation of halalan tayyiban food quality is limited to the physical and technical elements. The analysis proved that an ideal concept of HTFQM can be formed but the actors in 46

48 the halal industry must rise to have the qualities of an Islamic-based Development Actor (IbD Actor) so that all aspects of the physical, spiritual, material and supernatural elements can be included. 47

49 PRESENTER ASPIYATI BINTI JUSOH ASPIYATI BINTI JUSOH is a PhD Student, at the Department of Law, Academy of Islamic Studies, University of Malaya, Kuala Lumpur, Malaysia, under the supervision of Dr Zalina Zakaria, Senior Lecturer and Associate Professor Dr Siti Zubaidah Ismail. She Obtained her first law degree (L.L.B honors) from International Islamic University Malaysia, 2002 and following by her master degree (L.L.M ) from Universiti Kebangsaan Malaysia, Bangi, Kuala Lumpur in She has been registered as an Advocates and Solicitors of Malaya in March 2004 and served as legal practitioner for about 4 years in Tetuan Syed Barakbah and Co, Kota Bharu, Kelantan. In 2007 she joined UiTM, a higher learning institution in Kelantan, Malaysia as a law lecturer and in September 2014 she took her unpaid study leave for PhD. She also actively involved in halal consultancy. Her area of study for PhD is Halal food regulation focusing on halal meat products from exporting countries i.e. New Zealand. 48

The industry is estimated to be worth between NZ$200 and NZ$300 million (USD143 million and USD214 million). The client list includes Malaysia, Saudi Arabia, Egypt, the United States and the United Kingdom, with countries such as France emerging as another potential market. Recognising the market s economic potential, the local meat industry moved to institute halal methods in several of the country s slaughterhouses. Almost 80 percent of sheep and 50 percent of cows slaughtered in the country are done so according to Muslim requirements. In fact, it has become cost effective to slaughter an animal in the halal manner, even if the meat is destined to be exported to a non-muslim market. The challenge however is to ensure that slaughtering process will remain halal when the production occurs in non-muslim countries. Hence, this paper is going to focus on the issues arises for slaughtering adopted by New Zealand as one of the biggest exporter of meat products that cater large Muslim population is fully complying with the halal guidelines provided by each and every country. As for example, do they really comply with the requirements stated under MS 1500: 2009 which contains guidelines for Halal Food 49

51 and Poultry Production, Preparation, Handling and Storage for Malaysia and also Malaysia Protocol for Halal Food and Poultry Production which intended to support the Malaysia s requirement for Halal meat, poultry and their products. Among other things to be highlighted in this study is regarding the stunning process used by the abattoirs in New Zealand prior to slaughtering process and also the usage of Thorasic Sticking method in halal slaughtering. These procedures are mainly used in New Zealand to hasten the time of death for the animal and shorten prolonged consciousness level of the animal after slaughtering and also to increase the meat quality level after removal of most of the blood from the body. This research adopted qualitative approaches and involve three possible methods in gathering data which includes interviews, field observation and document analysis. She has been involved in teaching PB1501 Malay Islamic Monarchy Philosophy (MIB) and PB1301 The Development of Education in Brunei Darussalam (Perkembangan Pendidikan Negara Brunei Darussalam) modules at Universiti Brunei Darussalam. She has also been appointed by Malay Islamic Monarchy Supreme Council as MIB facilitator in workshops and seminars held by Brunei government sectors. Rezeki halal dan haram mempunyai kesan yang besar sepanjang kehidupan mereka hinggalah mereka menemui ajal masing-masing. Rezeki yang diperolehi merupakan tulang belakang kehidupan di dunia dan berkait rapat dengan kebahagiaan di dunia dan akhirat. Sehubungan itu, objektif kertas kerja ini ialah ingin menjelaskan bagaimana memperolehi harta halal yang disarankan oleh syara. Kertas kerja ini juga mendedahkan sejauhmana kehalalan rezeki mempengaruhi tingkah laku seseorang. Selain itu kertas ini menonjolkan faktor yang menjana ke arah pemilikan harta halal. Kajian ini berbentuk kualitatif, menggunapakai teknik analisis dokumen, perbandingan dan pemerhatian. Kajian akan mengupas sumber-sumber pengeluaran hukum, menelaah pendapat ulama dan menganalisis kaedah fiqh serta maqasid syariah yang berkaitan. Kajian ini merumuskan bahawa hak individu untuk memiliki harta terbatas dalam ruang yang dibenarkan oleh syara dan keinginan memperolehi harta halal sejajar dengan anjuran syara adalah berkait rapat dengan faktor dalaman diri. Dan Tahun 1980, salah seorang yang telah terpilih seramai 50 orang untuk melanjutkan pelajaran di Sekolah Menengah Arab Laki-Laki Hassanal Bolkiah sehingga Tahun Dan melanjutkan pelajaran ke Institut Pengajian Islam Brunei Darussalam selama 3 Tahun ( ). Dan sebelum melanjutkan lagi pelajaran pada tahun 1997 (University of East London BSc in Economics, University of London [SOAS] M.A in Islamic Studies), telah berkhidmat sebagai Pengurus Bank di The Islamic Bank of Brunei Berhad (IBB) dari Disember 1993 sehingga Mac Seterusnya pada 13 Mac 2006 sehingga Mac 2013 berkhidmat sebagai Pengurus Jabatan Pematuhan dan Undang-Undang di Tabung Amanah Pekerja (TAP) sebelum diperuntukkan selama 3 tahun lebih sebagai Pengurus di Jabatan Pelaburan di Tabung Amanah.
